Background Information No previous applications have been reviewed tbylud included respect original to the bubject property. The property incorpot.-ition of Tigard in 1961. 3. Veiijity Information Properties to the north, south, and west are also zoned C-G (Commercial General). Properties to the northwest are zoned C-P (Commercial Professional) . Properties to the east hPve been developed as single family residences but have recently been rezoned to C-G. FINAL ORDER NO. 88- It _ PG - PAGE l 4. Site Information and Proposal Desciiptcori The site has been developeri gi.nce 1955 with a single story veterinary clinic. The front yard is e,itirely paved. The side yard c:onta ns a dog run. The small vacant ;property and the Hwy. 217 right-of-w lie to the west. Immediately in front of the building ip parking and an access road which runs parallel to Highway 99W. A r,rassy median strip of considerable width further separates the property from Highway 99W. 'rhe subject sign consists of white lettering on a maroon fence, which is some 18 feet high. The fence is attached to the main buiVing at one end and is located at the western portion of the property. The total sign area is approximately 180 square feet, The sign is almost totally obscured from view by a huge evergreen tree at its western edge. The subject sign has been considered nonconforming as of March 20, 1988, and the property owner was notified of this earlier this ,year. A voluntary compliance agreement was signed indicating the willingness on 'the part of the applicant to take some action to rectify the nonconforming sign once the City notified him of the adoption of new sign code regulations. Ordinance r13-20 incorporated numerous new regulations into the sign code. It was adopted on July 25, 1988, and became effective on August 26, 1988. The City officially notified busine9s and property owners of the new sign code adoption in September. The property and business owners have been cited for the following nonconformities: 1. Oversize (area) freestanding area, a violation cf Section 18.114.130(c)(1)(B) and (C) . 2. Too high freestanding, sign/fence, a violation of Section 18.114.130(c)(1)(D) . 5. Agency and NPO Comments The Cit,r Building_ Division has reviewed the proposal and has no Objections to it. No other comments were re :eived. B. FINDINGS AND CONCLUSIONS This application shall consider both a Sign Code Exception and Variance for sign area and a Variance for fence height. 1. Sign Type The first: question or i,,que to be resolved by the Commission is whether the sign can be considered a freestanding sign or a wall sign. When staff made a r'iel.d inventory of nonconforming signs last year, this FINAL ORDER NO. 88- 14 PC - PAGE 2 sign was categorized as a frees~anding sign. Upon a more careful analysis, however, staff has classified the sign as a wall sign. The i��:ludes: . . ."and not attached to any definition of a freestanding sign building_,". because the background for the sign, namely, a fence, is attached to the main building, staff concludes that this sign must be considered a wall sign. The same logic was used by staff in issuing sign permits to Stereo Superstores in order to allow the two large wall signs on the east and west building faces of that store. 2. Sign Size ft.). Because the The fence area measures 15 x 18 feet (270 sq. lettering of the sign is distributed through the upper two-thirds of the sign only, staff concludes that the sign in question measures 15' x 12' or 180 square feet in area. "he front wall face of the building measures approximately 51 feet by 14 feet for a total of 714 square feet. The combined total wall area for both the front wall and fence i' equal to 894 square feet. Fifteen percent of the entire wall area is 134.1 square feet. Staff concludes that the sign should be considered a wall sign; however. , as such, it cannot meet the 15 percent maximum sign area requirement. Applicable Sign Code Exception Criteria The applicable Sign Code Exception criteria is found in Section 18.114.145 (a)(3) which allows an increase in sign area of 25 percent. An increase of 25 percent would, at most , allow a sign of 68 square feet. The existing sign, which is 12.5 square feet larger, represents a 34 percent increase over the standard 15 perceit allotment for wall signs.. Since both the sign and the building were erected long before thip provision was in effect , the Comhlission may conclude that it is not unreasonable to grant the 34 percent additional increase in sign area now. However, a variance to 25 percent limit must also be granted. 4. Variances Fot Fence Height and Sign Size Criteria for reviewing the variances are contained ii code Section 18.134.050. They are as follows: The Director shall approve, approve with conditions or deny an application for a variance based on finding that the foilowing criteria n.re satisfied: (1) The proposed varianre will not be materially eetrimental to the purposes of the Code, be in conflict with tb, policies of the Comprehensive Plan, to any other arplicable policies and standards; and to other properties in the same zoning district or vicinity. (2) There are special circumstances that exist which are peculiar to the lot size or shape, topogr,�phy or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; F 1 NAT, ORDER Nn. HH- 14--- PC - 'PAGE 3 ( 3) The use proposed will be the same as permitted under this Code and City standards will he maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; (4) Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were locate3 as specified in the Code; and (5) The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The proposed variance to fence height will not be materially detrimental to the Code, the Comprehensive Plan, to other policies and standards or to the adjacent property. The extreme lieight of the fence no longer serves its originally intended purpose as a screen. Existing natural and physical systems will not be adversely affected. The applicant has pointed out that the fence was erected to shield the animal runs and blackberry bushes from view. In the meantime, the evergreen trees and blackberry Lushes have grown to shield the sign as well. A field visit revealed that :he top of Lhe dog runs is not .such higher than ground level. Although the fence is nor:�onforming, the Commisrion sees no immediate benefit in reducing its height. Indeed, the only reason the fence is being questioned is because it serves as a backdrop to the sign lettering. The sign does not really serve adequately as a sign because it is so far set back from the public right-of-way and because it is obscured by trees and bushes. Relocation of the sign as a freestanding sign also is n(;t possible. It would not be permissible to erect the sign either on the state right-of-way median strip or directly in front of the building because of interference with parking. Under the provisions of the recently adopted sign ;ode, the parcel would be entitled to a freeway-oriented sign; however, neither the Commission not the applicant find thiq desirable. S'aff does not want to recommend remcval of the tree nor would removal of the blackberry bushes do mu,.h for th public good. Therefore, the only alternatives that the Commission sees are either: 1) reduction of the fence height to a maximum of 8 feet as allowed by the Code, and relocation of the signage to the front wall of the building, or 2) reduce the sign size in its present location to meet Code standards or Section 18. 114. 145(x)(3) and retain Lhe present fence height, or 3) allow the applicant to retain the sign and fence as is, provided the applicant obta.ns a sign permit and the use of the property remains the same. DECISION The Planning Commission approves both SCE 88-05 and J 88-31 subject_ to the following conditions: The applicant shall obtain a sign permit for the subject sign. 2. Should a change in use occur on the subject parcel, the fence and sign must be removed within 90 days of vacating the premises. 3. As long as the fence sign is in use, no additional freestanding signage, including, a freeway-oriented sign, shall be permitted.
