78th Avenue and SW Pacific Highw"L Tigard (Wash. Co. Tax Map �Sl 36CD, Tax
Lots 1CO3 200, 300, 1100, 12UU and 1300j.
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED subject to certain conditions. The findings and
conclusions on which the Director based his decision are as noted below.
A. FINDING OF FACT
1. Background
A Sign Code Exception SCE 1-84 was approved by the Planning
Commission on April 17, 1984 to allow two freestanding signs
subject: to the following conditions:
1. One freestanding sign for the retail center and one
freestanding sign for the Testa"rant aLe permitted.
2. The signs shall be reviewed and approved by the Planning
Director prior to the issuance of building permits.
2. Vicinity Information
Properties to the east and south are zoned C-G and tl,e land to the
west is zoned C-P (Commercial Professional) . Residential uses
zoned R-7 (Residential, 7 units/acre) or within Washington County
are on the north side of Pfaff.le Street.
3. Site Information and Proposal Description
This undeveloped property is located at the intersection of
Pacific Highway, 78th Avenue, and Pfaf€le Street. A 36, 710 square
foot retail shopping center and a separate 3,800 square foot
restaurant are proposed for the 3. 14 acre parcel. Two driveways
onto Pacific Highway and one onto 78th Avenue are envisioned along
with a delivery tntrance on Pfaffl.e Street.
The restaurant will feature a drive-through window in addition to
a dining room. N total of 158 parkf.ng spaces including those for
compact cars and handicapped persons has been provides. A bicycle
tack is proposed at the southwestern corner of the development. A
landscaping plan for the project: shows that slightly over 15% of
the site will. be landscaped.

4. Agency and NPO Comments
The Engineering Division has the fallowing comments:
a. An 8-foot wide sidewalk is required along Pacific "_bnwa;
dnti a 5-foot wide sidewalk is necessary along 78th Avenue
and Pfaffle Street.
b. Pfaffle Street is designated as a minor collector and City
standards call for a 60-foot right-of-way. An additional 5
feet of right-of-way should be dedicated along the Pfaffle
Street frontage.
C. A copy of the final survey for the property should be
submitted to the Division.
The Building Inspection Office notes that provisions for storm
drainage should be reviewed.
The Tualatin Rural Fire Protection District has the following
comments :
a. The small traffic island shown at the southwest exit should
be painted only or removed.
b. Fire hydrants are required within 250 feet of all portions
of the project.
c . A sprinkler system or fire resistant wall separation shall
be required.
The State Highway Division has no objection.
N?O #4 has not responded.
B. ANALYSIS AND CONCLUSION
The proposed site plan is generally in conformance with the applicable
provisions of the Community Development Code. Listen below are the
revisions that should be made to the firal site plan.
I . Chapter 18.106 of the Code requires that standard parking spaces
be 18 by 9 feet in size and up to 2i% of the spaces mny be
designated for compacts requiring dimensions of 15 by 8.5 feet.
The spaces along the front of the building are 16 feet in depth
and must be lengthened to 18 feet and/or designated for compact
cars.
2. A minimum of 9 bicycle rick spaces are required for the entire
devel-)F•ment. Three spaces should be provided near the main
entrance to the restaurant. A bike rack for the retail building
is shown near the southwestern corner of the project. The 6
required spaces should be more centrally located or evenly spaced
along the front of the retail building.

3. Evidence regarding access over the property to the southwest
should be provided.
4. The recommendations of the Engineering Division and the Tualatin
Rural Fire Protection District should be followed.
-the landscaping plan is consistent with City requireMrLIts for street
trees and general landscaping. It should be noted that the standard for
street tree size has recently been reduced from a caliper width of 3
inches to 2 inchee. Also, there are several Lombardy poplar trees
located within the vision clearance area for the 78th Avenue driveway.
Section 18.102.030 allows for trees in this area as long as branches
lower than 8 feet in height are pruned.
C. DECISION
Site Development Review application (SDR 7-84) is approved subject to
the following conditions :
1. Standard half-street improvements including sidewalks, curbs,
street lights, and driveway aprotis shall be proviued along the
6bth Avenue frontage.
2. Seven (7) sets of plan-profile public improvement construction
plans and one (1) itemized construction cost estimate, stamped by
a registered civil engineer, detailing all proposed public
improvements shall be submitted to the City's Engineering Division
for review..
3. Construction of proposed public improvements shall not commence
until after the Engineering Division has issued approved public
improvement plans (the Division will require posting of a 100%
performance bond) , the payment of a permit fee and a sign
installation/streetlight deposit. Also, the execution of a street
opriiing permit or construction compliance agreement shall occur
prior to, or concurrently with the issuance of approved public
improvement plans.
4. Drainage plans shall be submitted to the Engineering Division for
review and approval .
51- Prior to issuance of building permits, a revised site plan shall
be submitted for Planning Director approval with the following
changes :
a. The traffic island located within the southwestern driveway
shall. be removed or painted only.
b. A minimum of 3 secured bicycle rack spaces shall be provided
near the front building entrance of the restaurant and a
minimum of 6 additional spaces shall be located along the
front of the retail building. The bicycle rack design shall
also be submitted for approval.

c. Parking space dimensions shall conform with Chapter 18. 106
of the Community Development Code.
b. Additional right-of-way shall be dedicated to the City Along the
Paff.e Street to increase the right-of-way width from centerline
to 30 feel. Also, the triangular areas shown on the site plan at
the corner of 78th and Pfaffle and 78th and Pacific Highway should
be dedicated as shown.
7. An access easement for the southwestern driveway shall be reviewed
and approved by the Planning Director prior to the issuance of
'wilding permits.
8. T:.i.s approval is valid for the period of one year from the final
decision date noted below.

WHEREAS, the City further required the payment of fees ,And the execution of a
Compliance Agreement which st.i.pul.ated tl.at:
"Upon receipt: of certification by the D«partment of Public Works
that. ail requirements hove beoi- meat, and a Once Year Maintenance Bord,
the City Council agrees to accept. the public improvements, subiect
to the requirements for correction of Deficiencies and mainte'-ance
for a period of one year. . . . " ; and
WHfRLAS, said Certification has now been provided to the Council; and
WHEREAS, the required performance bond remained in full force and effect
throughout the normally required maintenance period of one year; and
WHEREAS, no public improvement deficiencies remain to be corrected.
NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council. that:
The City Council accepts the public improvements con,truct.ed within the
right--of-way of SW Pfaffle. Street & 78th Avenue adjacent. to Crossroads
Commercial Devel/opment.
