A fire and life afety plan review was conducted on the above-
captioned project for compliance with the 1985 editions of the Uniform
Building Code (UBC), Uniform Mechanical. Code (UMC), and the Uniform
Fire Code (UFC) as amended by Washington County Fire District's
Ordinance 86-1.
The plans are approved for foundation siting only for the above-
captioned property. Access problems created by the construction of
this small restaurant in front of the Chalet Pancake House is still a
concern to this Fire District. Future plans of extending Dartmouth
Street and providing an access to the property off of that street will
alleviate this concern. If within a year Dartmouth Street plans have
not be substantially placed and a target set for its extr;nsion with
the additional. access to this property, and if car back-up for the new
Spanky's Drive-In restaurant is extensive, limitations will need to be
looked at or alternate methods will need to be looked at to provide
better access to the Chalet Pancake House.
Cooking equipment plans, hood and duct plans, fire extinguishing
pins, and construction plans still remain to be submitted to this
office for review and approval.

The Waahington County Department of Public Health has received and
revs-awed the plans for the proposed Spanky'a Super Burger Express
located at the above noted address.
It is our understanding that community water and community sewer will
be utilized at this structure.
The plans are approves subject to the following changes, additions or
reccmmend?`ions:
1) The plans do not indicate arty customer tables or chairs. Be
aware that If these are provided or anything that: would
encourage on the premise consumption then public restrooms
must be provided in accordance to Oregon Ada4inist:rative Rules.
Chapter 333, Division 155 and the Oregon Uniform Building Code
Table 5-E.
2) The plans do not show a utility 91nK. The rules require at
least one utility sink or curbed cleaning facility with a
floor drain. This must be utilized for the cleaning of mops
or similar wet floor cleaning tools and for the disposal of
mop wate- or similar liquid waste. The use of utensil-washing
or equipment washing, or food preparation sinks for this
purpose is prohibited.
3) Number 23 is indicated as a three compartment sink unit. Each
compartment must be large enough to totally submerse your
largest multi-use utensil . The plans show a drainbuard only
or, one side of the three compartment sink. Dralnbo;ards or
easily moveable dishtables of adequate size to provide for
proper handling of soiled utensils prior to washing and for
cleaned utensils following sanitizing must be located so as
not to interfere with the proper use of the dishwashing
facilities.
4) Any sink used for food washing must drain indirect to a floor
sink or a floor drain. Be aware that handwashing sinks can
not be utilized for any purpose other than handwashing.

5) The beverage dispensing/ice bin units shown at the front
counter must have their liruid wastes drain indirect to the
floor sink provided in this area. The plans show liquid
wastes from the ice maker will drain to a floor sink and the
liquid wastes from the walk-in refrigerator will drain to a
floor drain. Any refrigeration unit not equipped with an
evaporator pan must have its liquid wastes drain indirect to a
fi,,or drain or floor sink.
6) The handwashing sinks in the food preparation are and restroom
must be equipped with dispensed soap and dispensed sanitary
towels. Thr water to these sinks must be tempered.
Handwashing sinks can not be used for any purpose other than
handwasning.
7) Each refrigeration unit not equipped with an accurate built-in
thermometer, must have a spirit stemmed thermometer located cn
the top shelf or door. Metal stem-type numerically scaled
Indicating thermometers accurate to +2 degrees F shall be
provided to assure attainment and maintenance of proper
Internal cooking, holding or refrigeration temperature of
potentially hazardous foods. Each hot holding facility
storing potentially hazardous food shall be provided with a
numerically scaled indicating thermometer, accurate to +3
degrees F, located to measure the air temperature in the
coolest part of the facility and located to be easily
readable. Recording tt !rmometers, accurate to ±3 degrees F.
may he used in lieu of indicating thermometers. Where it is
not pract'cal to irittall thermometers on equipment such as
bain-maries, steam tables, steam kettles, heat lamps, cal-rod
units, or insulated food transport carriers, a product
thermometer must he available and used to check internal food
temperatures.
8) To minimize manual contact of fonds, please provide and
utilize handled scoops and other appropriate utensils.
9) All food or food items on display within customer reach which
are not prepackaged, must be protected from customer
contamination by a sneeze shield or other approved means. See
enclosed.
10) All lamps over or within fnod storage, food preparation, and
food display facilities and facilities where utensils and
equipment are cleaned and stored shall be shielded, coated or
otherwise shatter resistant.
11 ) All storage if food, food containers, and single service
utensils must be on sheives at least six inches above the
floor except where storage is on wheeled plaL:orms or four
Inch high sealed bases. Metal pressurized containers need riot

be elevated. All floor mounted equipment, unless readily
moveable, shall be: sealed to floor, or installed on a
concrete cr other smooth raised platform at .east four inches
high, or elevated on legs to provide at least a six inch
clearance between the floor and equipment if no part of the
floor under the mixer is more than six inches from cleaning
access.
12) Food and containers of food shall not he stored under exposed
or unprotected sewer lines or water lines, except where
automatic fire protection sprinkler heads may be required by
law.
13) Utility lines and pipes can not be installed so they are
exposed and installed horizontally on the floor.
14) The plans show tile flooring in all areas of the store except
where there is retail display of bottles of wine and foods not
In a form or quantity to be consumed right away. A rubber
based caving of a minimum of four inches in height must be
used. There can not be any gap greater than 1/32 of an inch.
Ue retall display area will be carpeted. The carpet must be
one that is easily cleaned. The plaits do not indicate the
surface materials of the ceiling, walls, counters, shelving,
etc. Be aware that all surfaces must be smooth, sealed,
non-absorbent, and easily cleanable. Gaps in floors, walls,
and ceilings around plumbing and electrical work must be
filled in to prevent rodent nd insect entrance. A rubber
based coving of a minimum of four inches in height must be
used. There can not be any gap greater than 1/32 of an inch.
15) The restroom door must be self-closing.
18) There must be hot and cold t.empired water to the handwashing
sinks. If self--closing, slow closing, or metered faucets will
be used, they must be designed to provide a flow of water for
at least 15 seconds without the need to reactivate the faucet.
17) All plumbing suet meet the requirements of the City of Tigard
and the Oregon Uniform Plumbing Code.
18) All employees must have current Washington County Food
Handler's Cards.
19) This facility and its operation must meet all the Oregon Rules
for Eating and Drinking Establishments.
20) A pre-opening inspection must be conducted by our Department
prior to license approval and operation. Please contact Mark
Hanson at 848-3752 at least one week prior to operation to
schedule this inspection.

DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has approved the above described application subject to certain
conditions. The findings and conclusions on whicr, the Diroctor based his
decision are as noted below.
A. FINDING OF FACT
1 . Background
No previous land use applications have been revi .,wed by the City
regarding this property.
2 . Vicinity Information
The property is located on the south side of Pacific Highway, near, the
18th Avenue intersection. The proposed Dartmouth Street extension
will border, the southwestern property boundary . All surrounding
properties are zoned C--G (Commercial Generai) .
3 . Site Information and Proposal Description
The property is developed with a restaurant and parking lot that are
presently vacant. The applicant in. -)ds to place a small
(approximately 350 square feet) building in front of the restaurant
for the provision of drive--through service. The expansion is not of
sufficient size t;o require the submittal of a Site Development Review
application. Although a formal application review is riot necessary,
all Community Development Code standards apply .
The applicant, is proposing to have two drive--through windows with a
minimum stacking distance for five vehicles for each window. A
variance to the Code requirement for a 10 vehicle storage distance per
window is requested.
4 . Agency Rnd NPO Comments
The Engineering Division notes that motorists do not generally stop as
closely together as shown. 0^, cnlrul ;ting stacking lengths, a
distance of 25 feet per car 5o,,ju.ld be used.
The Bvildinq Inspection Division has no objection to the proposal .
Tunlatin Rural Fire Protrct:ion District says that the proposed site

B. ANALYS LS AND CONCLUSION
In order to approve a variance, the following criteria must be met .
1 . The proposed variance will riot be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and standards;
and to other, properties in the same zoning district, or vicinity;
2. There are special circumstances that exist which are peculiar to the
lot size or shape, topography or other circumstances over which the
applicant has no control, and which are riot applicable to other
propert:ins in the same zoning district;
3 . 'rhe use proposed will bca the same as permitted under- this Code and
City standards will be maintained to the greatest extent that is
reasonably possible, while permitting some economic use of the land;
4. Existing physical and natural systems, such as but. riot limited to
traffic, drainage, dramatic land forms or, parks will riot be adversely
affected any more than would occur if' the development were located as
specified in the Code; and,
5. The hardship is not sol.f--imposed and the varianci requested is the
minimum variance which would alleviate the hardship.
The purpose of the stacking distance requirement is to provide adequate
space for drive-through windows so that vehicles do not back out onto
public streets and cause congestion problems. This drive--in restaurant
will offer a very limitod menu and the primary marketing strategy is to
provide fast, service and lower prices . The applicant: is proposing twn
service windows to reduce the waiting time per vehicle.
The site plan could be revised to have the lO uehicl.e sticking distance
with one service window. However, because- of the limited capacity of the
kitchen, dividing the 10 car requirement appears to be a suitable approach

1. President Tepedino called the meeting to order at 7:35 P.M. . The meeting
was held at Fowler Junior High School - Choral Room - .10865 SW Walnut,
Tigard, Oregon.
Z. ROLL CALL: Present: President Tepedino; Commissioners Vanderwood,
Butler, Edin, Fyre, Owens (arriving 7:45 P.M. ).
Absent : Commissioners Moen and Leverett (one vacant
position).

3. Minutes from December 6, 1983, were considered. Corrections were made by
the Commissioners. Commissioner Tepedino moved and Commissioner Butler
seconded to approve minutes as correctel. Motion carried by unanimous
vote of Commissioners present.
4. PLANNING COMMISSION DISCUSSION

5. PUBLIC HEARINGS
• President Tepedino opened the public_ hearing by reading the
procedures to be f ;llowed during the hearing.
5.1 SIGN CODE EXCEPTION SCE -83 Chalet Restaurant & Baker,, NPO N 4
A request for a Sign Code Exception to allow installation of a 100
sq. foot per face free-standing sign (to replace an existing 9' x 19'
sign). Located at 11680 SW Pacific Highway.
• Assistant Planner Skorney made staff's recommendation for denial
based on Community Development Code.
Commissioner Owens arrived.
• NPO - CCI Comments - No one appeared to speak.
• APPLICANT'S PRESENTATION - Leonard Remicke, Ramsey Signs,
represented the applicant. He stated the proposed sign is only 1.0%
over the allowable size and was needed to identify the site properly.
• Dennis Kaupal, PO Box 7108, Salem, Or. 97308, owner, explained that
the proposed sign is smaller than the existing sign and It would also
eaiminate the flashing lights.
• Commissionr Fyre questioned the noncontormance of the existing sign.
Discussion followed regarding sign code limitations and enforcement.
PUBLIC HEARING CLOSED
• Commisiocers Edin and Vanderwood supported req►,-2st as not being
unreasonable.
• Commissioner Owens did not support, would rather see sign brought
into conformance.
• Commissioner Fyre and Butler supported as this would eliminate the
existing nonconforming oign. They would like to see the sign code
followed, however, this request would only be a 10% increase.
• President Tepedino was concerned with all the work that went into
putting the sign code together, to turn around and make exception to
the code, might be establishing a precedence. He questioned If there
was some way to make a compromise.
• Discussion fo.'.lowed regarding minimum and maximum rejuirements,
justifications for approving exceptions and compromises the applicant
would make.
• Commissioner Edin moved and r;ommissioner Owens seconded to approve
SCE 5-83, changing the height from 24'2" to 22' and permitting the
100 sq. ft. for each side.
Motion carried by unanimous vote of Commissioners present .
5.2 COMPREHENSIVE PLAN AMENDMENT CPA 18-83 ZONE CHANGE ZC 14-83 RUSS
KRUEGER NPO 11 7
A request by Russ Krueger to amend the Comprehensive Plan Land Use
Map and the Zoning District Map to relocnte a neighborhood Commercial
designation from the west side of 135th Avenue, south of tax lot 100,
to the northwest corner of Lay lot 1000 along 135th Avenue.
• AEsisLant Planner Skorney made staff's recommendation for approval.
• Director of Planning and Development Monahan commented that the staff
was committed to initiate the Comprehensive Plan Amend,►ent for the
Commercial Neighborhood designation.
• NPO COMMENT - Richard Boberg, Chairperson fcr NPO lit 7, stated they
had never been notifed of the application. Discussion followed.
• APPLICANT'S PRESENTATION - Ryan O'Brian was present to answer any
question for the applicant.
