Mr. Jules Kessler

You have requested a determination whether the various businesses associated
with Let's Go Travel could be located at the former Mellow Trucking Company
site at 11655 SW Pacific Highway in Tigard. The businesses include a travel
agency, a collection agency, a printing business, a computer software
business, and a charter bus service which includes servicing buses other than
those operated by the chareer service.
of primary concern is whether the charter service including repair of other' s
buses may be established at this site as a continuation of the previous use of
the site for fleet storage, a conditional use in the C-G (General Commercial)
zone, and also for heavy equipment repairs, a use which is not normally
permitted in the C-G zone. You have submitted letters from Ray Baldwin of
Mellow Trucking and Donald Hall , owner of the property, that indicate that
heavy equipment repairs and fleet storage have occurred on the site for in
excess of 40 years, longer than the City and Washington County have regulated
use of the site. These uses are therefore considered nonconforming uses of an
existing structure and site under the provisions of Community Development Code
Section 18.132.040 (d) and are allowed to continue as legal uses subject to
certain conditions. The uses are allowed to continue at that location as long
as the structure is not enlarged or modified. The extent of the use or the
site also cannot be enlarged or extended. It the use is discontinued or
abandoned for a period in excess of six months, the right to continue the
nonconforming use is terminated. Another similar use may be established
within the six month period after discontinuation of the nonconforming use and
maintain the legal nonconforming status.
We believe that your proposal to establish the charter bus storage and service
business constitutes the same use types as previously occupied the site and if
established within six months of Mellow Trucking's discontinuation of business
would maintFin the nonconforming use status. Please note, however, that these
uses and the building would not be allowed to expand beyond the area used by
Mellow Trucking. This clearly would include the rear portion of the parcel
which is zoned R-25 (Residential, 25 unite/acre) and which has not been shown
t;; have been used for the previous nonconforming uses on the rest of the 91te.
The other uses proposed are all permitted usee in the C-G zone. A travel
agency !s classified as a convenience sales and personal service use; a
printing business is classified as a business Support service; a collection

agency and computer software service are professional and administrative
services. These uses, would constitute a change in use for the property.
Establishment of new uses on the site cannot be allowed without Site
Development Review approval of site improvements necessary to comply with
Community Development Code requirements. These requirements would concern
provisions for parking, landscaping, access, and signage, among other things.
The City's Site Development Review process would require a minimum of four
weeks to process an application for review of improvements necessary to
establish the travel agency, printing, collection agency and computer software
businesses. The process would not delay your ability to establish the charter
bus operations and repair businesses. This could include office operation:;
necessary to conduct those buhtnesses.
Please contact me if you would like to arrange for a pre-application
discussion of the Site Development Review requirements or if further
cl.arificatton of the n3neonforming status of the use of this Froperty.
Sincerely,

CITY OF TIGARD PLANNING DEPT,
Mr. Liden

Sir,
As per our conversation at the meeting concerning the property located at the
address of 11655 SW Pacific Highway and the continuation of the usage as a
repair shop, storage parking, and maintenance facility; we have asked the
previous business which has been in operation on the property for some time to
give us a statement, of their utilization of the property. Mr. Baldwin, of the
Mellow Truck Express, Inc. , was kind enough to do this for us.
As you can see from his letter, the usages as we outlined in our original
proposal seems to have been a part of the general commercial business in the
most recent past.
We also took the liberty of asking the owner-, Mr. Donald W. Hall for a
statement of earlier history on the property. Mr. Hall's statement would
indicate that the property has been used in this same type of repair work for
what would be approximately 45 years.
With these acknowledgments of prior purpose as a basis fo.• asking for a
continuation of similar types of business utilization. we feel. that proof
zoning from past history under a "grandf -ther clause" would seam appropriate.
Please review this matter as we discussed, given the evidence of continuation
and let us know of your decision in this matter.
Yours,
Jules Ke sler

RE: Property at 11655 SW Pacific Highway
Gentlemen:
TO WHOM IT MAY CONCERN, as to the past usage of the inaicEted property located
in Tigard in previous years:
We know and attest to the fact that the property has been used as a commercial
trucking operation under our management where major and minor repairs of all
sorts were made to engines and types of commercial equipment.
It has been used as a retail. repair shop for all types of equipment for
independent operators on a retail basis over several years.
Fuel has been sold Vo independent operators on a cash and credit-account basis
from the tank: and pumps on the property.
The facilities of the property hive been rented for all types of equipment to
be parked in storage -- trucks, trailers, cars, vans, equipment, and freight
have been parked upon the property. At the present moment, there are only two
storage rentals left because of our leaving the property: 1) A tree planting
and removal firm has its truck, trailers and operations equipment on the
property; 2) a raring car with its transport trailer and spare pArts ar,d other
miscellaneous equipment is stored on the property.
Other items stored en the property have been portable office units, (one of
them is still tnere as an abandoned unit); damaged equipment awaiting repair;
loads of steel while awaiting transport to its last work destination and other
items such as pick-up trucks with campers and trailers for perlous of time for
safekeeping for the owners.
If there is any question concerning our Letter, please contact us for any
clarification.

The proposed usages for the property located at 11655 SW Panific Hig'iway, being
a ,piece of ground nearly six acres of what has been in its past history a heavy
construjtion company and the more recent use as a trucking company operation
which included th-e offices and repair, fueling and main`enancee of heavy diesel_
equipment as well as the property being used for the rental of storage space
for the public for sutih equipment, (thee indication that we have is that this
fa^ility was also operated for the sale of pats and repair equipment or other
people outside of the trucking company which was operating oa the property).
Tho configuration of the prupe,^ty is sunk that the building is on the front
portion, pa-king area behind the building and approximately 20% of the ground
not being used. A walk-ove,- of the ground in the back portion explains why the
property was not developed foe^ a parking area sinie there seem:-3 to be heavy

ground. Poresible to use drain fields for lowering th,? water leiel?'l? Does nit
look as if it would be feasible to utilize for heavy buildings or heavy
equipment, within a reasonable cost factor. Perhaps such things as l.iglit
storage fa:eility mtght be pla,ead here within a percentage return on cost of
improvement.)
Hist_ory
Let's Go Tavel is a retail travel agency, but the bulk of its operatiolis is
th,e formula`.ioia and vending of its own escorted tours. This is approximately
90% of its volune of bastnoss. Mo,3t of its sales are mads be telephone with a
v,.ry small number of walk-in customers. In bustnes3 fifteen years.
Apollo Charter Bus Seovicee,_ Ince. is the transportation arm of Let's Go Tavel.
It. has at the prNsent. time eight pieces of equipment. It has, as of to date,
not hal more than nine buses. Future expansion, as envi a toned in `.h-r neext rive
years, would not more than double the fleet size. It is a registered shop
far,il.i.ty for Eagle Buses, (the Tr-Ai1.w-ays type) , bj Eagle International. Parts
ar l so-rvice facei.).ities are now made availa51e for the piibli,c roc those in need
of same while in the Portlaeil area.
Tho present shop area located in the) Lake Oswego In,iusl.%riql Park sarvic+s bases
arid other diesel equipment for fu(.+1, oil, pa-ts and rapair• for their ),n
equipmeat, and for the public.
Sinoe the optinun oparPtiun of th company is to have the equipment •r)rking,
they total number of buses at th-a home installation does not usanlly r`ae)h the
nolibe,, of buses in the fleet singe they are often on tour.
To maintain an even workload for the emplo;rees of the company, outsides work is
S,Iheduled for the publLc sector. Sinoe the installation in Tigard would oe
in.aide, th1 impaot on thea community 4ould not be a factor, in fart the
operation as run bj Apollo w,)ul.d be leas di3rupttve than the past usage of
M,lloa Trak Express sinof? they would heve fewer pieces of equipment on moves
or their own, and outside work would fit t•) more standard work houra that a
truoking comp3rnies operations.
Cusl,om Prin_`. Shkp is th-i in-house printing operation of Let's Go Travel, but
does do wh,lesale prin`ing for the publt.c. Thta is not a "quick-print" s''nop
op3^ation, but rather a volume prt.nting operation for business by appointment.
Yep Aeaov_e,ry, Inc.. and Key Bi.l link Service is a collection agency with
ownership in part by th-e principles of Let's GO Trzvel and Apollo Bus. It,-+
operation is not a normal publtc contact company, but more of a service
operation.
Im%Ajnation Plus, Ino. i!a a computer software and hardwa-e company that is a
spinoff of the dovelopmc.clt of unique computer operatiocis by Let's Go Travei.
It is not a retail. outlet; but, rather, a service company working by
appointment more than as a publI.c contact. compa:jy.
Out thoughts for- the property are theses
1 . Office space for our various operatioeis. Modifications of the buil.dtng
intee^malty as needed since the building is quite dated and in need of
r.modoling.
2. Snap operations fc.r the bus company needs little di°ferert than has been
hr,re in the past with the one ex,2option that w, would be looking to plate a
wr.shing area inside of the building to cle-,a, s+arlrice and fufll the
equipmerit rather thrin having it being done outaid, as has been the past
practice. Thiq would entail the ins:alla`,ion of a sewer connection inside
of the bui l.ding in the floor, (i' practic:;l).
3• They parking area as is now being used would be sufficient to the needs of
they 00m011y for the parking of their own equipment, they pa-king of cars of
cl;stome,z and for a s Lgriir'icant number of lease-rental spades for sunk
things as campers, RVs, boats Rnd other types of vehicl?:3, none of which
w-,uld t1lp3nt the community since theay tend not to be move frequently.
■
Tfio utilization of a property chis lai,ge has to have a return on investment
commise:^ate with the cost. The utili.za`.ioa of the office spa,ie by the
comFnereial e0mp:3niea will no alone giva suf,'icie:it return on investment. The
operaticn of tha shop fa^ilities would 3ugm,nt that intone, but w,,uld not carry
the entire load based upon the size of the bas comp-fly 'it thi3 time. Tho
a.tditioa of ser^vitt; to the public and storage spa-^e rental, (w,iich is now and
h-d be-n a pat-t of the operation on tho property) , w-)uld ada operation funis t'-)
b.-Ing this complex of companies into a viable framew--).,k of p-ofit so that
operations would 5e suoces.3fu1.
Tno property itself is a flag lo` that does not lend itselr wall to other uses
al-. this time, tho batik portion being usele3:3 betia, ise of the water problem
urtless a light comnercial utilization can be implemented such as a storage
fa;7ilit-y Nome time in the fu`.ure, or the water table problem 3:31v3 by other
mF-ans; but its entrance to the publl.c is sufcicient for th- needs of the
companies which would 3a using the buil.dtng. The ex;)oau^e on Patlific Hig"iw3y
i„ such that the idontificatio3 sigill for the companie:3 would not interfer, with
ar y other buainoss, (plati.ament would 3e approximately where the present sign is
pla^ed by the previous oompa y).
Wa :3-le no other item:; which wa c,-in make dotermin3tions upon at. th.a present, time
w_th so brief a review and survey of the future usages of the building and
land.
W, are open for sug,;es'io..zs as to how to proceed to best make use of th.>
pouperty, fitting within the needs of our c.nmpany and finances.

Jales Kessler,
