portion of 72nd Avenue in the City of Tigard between Villa Ridge
& Baylor, starting on September 28 , through October 18 , 1989.
The street will be closed to everyone except emergency traffic

Avenue as an alternate route. This work is permitted by the

work pertinent to the above project.
1. Perform the surveying or verify the existing surveying information as
necessary for the design.
2. If necessary, provide for the expertise of other engineers at _n av soils
or structural engineers and, r.leo, oversee materials and syw+tens teet.ing.
.1. Prepare construction drawings in accordance with the City standards aad
obtain the City, and if applicable, DEQ, County, or Stat- approval of such
drawings.
4. Supply constr_:tion staking.
5. Providc adequate inspection to assure compliance with City Specifications,
and keep accurate field notes in order to prepare "as-built" drawings.
6. Upon completion of construction provide one set of as-built drawings on
mylar to the City.
7. Upon completion of construction, provide written certification that all
improvements are complete in accord with the approved plans and
specifications.
8. Obtain City approval prior to any substantial deviation f-om the approved
p1ans.
9. Resolve engineering and construction related problems as may arise.
We agree to notify the City immediately if the above agreement is terminated or
it the engineer for any reason is unable to perturm the above duties.

the valine of the property. Aside from making accessibility
more difficult, there are some unique problems which, I
forsee, will arise unless preventive action is taken before-
hand. I will not attempt -to list these concerns in this
letter because it would be much easier to communicate with
you or, someone in authority right at the scene of my drive-
way so that I can point out these problems . If these prob-
lems are properly resolved a.nd addrei§sed in the final plans,
I will gladly sign any paper which bars me from any future
legal recourse in -t,his matter.
What I am asking will cost very little if included in the
original plans . But, on the other hand, correction of these
problems after the project is finished can be very costly.

1. Perform the surveying or verify the existing s,irveying information as
necessary for the design.
2. If necessary, provide for the exvertise of other engineers such as soils
or structural engineers and, also, oversee materials and systems testing.
3. Prepare construction drawings in accordance with the City standards and
obtain the City, and if applicable, DEQ, County, or State approval of such
drawings.
4. Supply construction staking.
5. Provide adequate inspection to assure compliance with City Specifications,
and keep accurate field notes in order to prepare "as-built" drawings.
6. Upon completion of construction provide one set of an-built drawings on
mylar to the City.
7. Upon completion of construction, provide written certification that all
improvemerts are complete in accord with the approved plans and
specifications.
B. Obtain Citi• approval prior to any substantial deviation from the approved
plans.
9. Resolve engineering and construction related problems as may arise.
We agree to notify the City immediately if the above agreement is terminated or
if the engineer for any reason is unable to perform the above duties.

Dear John:
Pursuant to our telephone conversation today, it is Iny understanding that
language added by you to the Off-Site Documents (Item G attached) is in
reference to the Permittee (Westwood) obtaining "sign-offs" from the
adjacent property owners, signifying that Work performed has met with
their approval . In no case, shall property owners be able to direct the
Permittee to perform Work beyond that which is indicated on the Off-Site
Documents at our clients expense.
As we discussed, the Design Team is concerned that neighbors may not allow
access to their property to perform necessary minor Work in their
driveways. This Work, I understand, is beyond the Right-of-Way Easement
that has been secured by the City.
It is particularly important that the City secure a written instrument
that grants access to the neighbors' property to perform this Work, prior
to our proceeding with the Street Improvement.
Sinc.P it may take some time before the City has this Document(s) ill hand,
we request that completion of the Off-Site Improvement not be a condition
of Occupancy for the Addition Project.

Dear Randy:
As we recently discussed, the adjustments to SW 72nd Avenue being
required of the Tigard Cinemas as part of their expansion will
impact the City of Tualatin's 36" water transmission line located
in SW 72nd Avenue.
Our analysis has indicated th6t the grade in SW 72nd can be
lowered to a point that regni� zs a minimum of 3 ' of cover over
the 36" water line without adversely impacting this water line.
For your information, we have included plan and profile sheets in
this location.
From our analysis o.c this project, at this time, and discussions
with the City of Tigerd and the developer's representativcs, we
have determined that the only necessary adjustments to the water
line would be the lowering of the manhole cover on the air
release valve in this area.
If the scope of this project changes beyond what we have talked
about to date, please contact Dallas Lee for additional

information regarding the City's water line or potential. impacts
on this line.

Due to input from motorists and adjacent property owners who use 72nd Avenue
she City of Tigard is requiring that the Tigard Cinewas reconstruct a. portion
of 72nd Avenue in conjunction with their development. The reconstruction has
been required in order to increase the sight di.stanciF, of 72nd Avenue and
provide safer access. This will be accomplished by lowering the `ump in 72nd
Avenue just north of the Cinema's accessp approximately 2 1/2 feet. Lowering
the roadway will require the driveways which access 72n6 n,venue along the
reconstructed portion to be regarded. The Cinema's contractor will be required
to regrade the driveways at: no cost to the property owners. ,/ L

Dear Keith:
We are preparing to re--submit. the Construction Documents for the Tigard
Cinemas Addition Project to you for plans review, and subsequent issuance
of the Euildinj Permit. The owner has acknowledged and approved the
proposed four to five week review period as described in your letter of
13 March 1989. Revised Documents should be in your office in
approximately two weeks.
I hive, as you suggested, contacted Gary A1fson to discuss sight-line
issues at 72nd Avenue. He has indicated that his recommendation to Staff
will be for the developer to improve sight lines for exiting automobiles,
allowing them more time and distance to judge the often speeding
approaching traffic of 72nd Avenue.
We challenge this recommendation. It should not be incumbent upon the
developer to improve 72nd avenue to provide extended sight-line distances
for automobile traffic traveling in violation of the posted speed limit,
but rather upon law enforcement to enforce the speed limit. The actual
site distance required for safe ingress and egress will decrease with
enforcement of the speed limit.
We would appreciate your re-evaluation of this issue with the appropriate
City Departments. It is our understanding that speeding along the subject
frontage has been a problem for some time, long before the theater
building was constructe:i. In fact, neighbors reaffirmed this point during
the NPO meeting we attended.

Bases: upon the response of reviewing agencies and the neighborhood, I do not
anticipate any significant problems or time delays associated with this

driveway will be solved. The resolution of this problem in advance will reduce
the chance of any unnecessary delay in the issuance of the building permit.
Also, for your information, the entire neighborhood on Duvall Street
immediately south of the theater, has applied for. a Comprehensive Plan
Amendment and Zone Change (File No. CPA 88-03/ZC 88-03) from single family
residential to commercial (C-G zone) . This application will be reviewed by the
Planning Commission on April. 4, 1989 and the City Council on April 24, 1989
(official notice will soon be sent to General American Theate:a) . Since many
landscaping and setback requirements along the south boundary of the Tigard
Cinemas project are based upon the abutting zoning, this proposal, if approved,
will relax the standards that are now in affect.

The theater gate on 72nd Avenue is painted white and tends
to blend in with the light-colored theater building. Not only .
that, but because the build.Lng is attractive and imposing, a
driver' s eyes are drawn to the building and away from the
rather low gate .
So far, two accidents ( that I am aware of) have occurred in
Which cars have crashed into the gate; and there have been
at 'least two near misses in which drivers have barely stopped
in time. The two accidents hre involved extensive damages to
the cars but luhkily there have been no injuries.
I fear that other accidents will be occurring in the future
unless something is done to call drivers' attention to the
gate. Drivers are conditioned to see the color red as a danger
signe.l ; therefore , I strongly urge that conspicuous round red
reflectors be securely fastened to these g�ites before a really
serious accident occurs .
Thank you .for giving this matter your prompt attention.
Also, southbound cars on 72nd fully disappear behind the hill
before reappearing suddenly to northbound drivers making left
turns into the theater lot. So .far no accidents ha-,/p occurreu
between such vehicles, but I have been a witness t-) at least
three near misses which involved brake-squealing and horn-honking.
Once again, I urge that something be done before we have a.
serious accident. Personally , I believe that southbound drivers
should be alerted beforehand about possible left-turning vehicles .
A T-intersection sign at the bottom of the hill may be appropriate.

SIGHT DISTANL
The following specifies the minimum requirements for sight distance for
roads intersecting each other , and driveways intersecting roads.
The minimum intersectional sight distances shall be ba;ed--or-design speed
of the road. The intersectional sight distance shall :
be based on an eye height of 3.5 feet and an object height of 4.25 feet
above the road, and
shall be measured from the center of the crossroad ten (10) feet from
the extAnded curb line or edge of pavement of the crossroad.
Minimum intersectional sight distance shall be equal to ten (10) times the
design speed of the road as shown below.

to the existing 1,795 seat complex. Location: 11626 F.W.

_DECISION: Notice is hereby given that the Planning Director's designee for
the City of. Tigard has APPROVED the above application subject to conditions.
The findings and conclusions on which the decision is based are noted below:
A. FINDING OF FACT
1. Background Jnformation:
In 1.987, the City granted a Site Development Review approval (.SDR 87-12)
to develop the existing five (5) auditorium theatre complex which
contains 1,795 seats. In addition to the tleater, a new driveway access
was established onto 72nd Avenue and the existing access unto Pacific
Highway was improved. Parking spaces for 650 vehicleo were provided in
conjunction with this the,ter.
2. Vic,_:.:ty Information:
Properties to the north and west are also zoned C-G (Commercial
General) , and the land to nurtheast on the opposite side of 72nd
Avenue is zoned C•-P (Commercial-Professional) . A single-faiAly
residential neighborhood that was recently rezoned from R-3.5
(Residential 3.5 units/acre) to C-G (Commercial General) , borders the
subject property on the south. Additional single family development
which is zoned R-3.5 lies to the southeast on the east sia of 72nd
Avenue.
3. Site Information and Proposal Description:
The applicant proposes to expand the existing theater with
corresponding additions to the east and west sides of the building
which will add six auditoriums to the five theater complex. The
addition will contain 944 seats, for a total of 2,739 seats within
the entire complex.
Parking and landscaped areas will be amended somewhat to accommodate
the new addition. The most notable change to the site plan will
involve the redistribution of parking spaces and landscaped areas on
the north, east and west sides of the theater. Landscaping along the
Perimeter of the project will remain unchanged. Parking spaces are
proposed to total 701, and the existing driveways to 72nd Avenue and
Pacific Hi.ghway are not intended to be modified.

An update to the initial traffic report by Keach Associates, Inc. was
submitted indicating that the traffic impact onto Pacific Highway
and 72nd Avenue will not increase provided that the scheduling is
stagrpTed between the larger existing theaters and the smaller.

4. Agency and NPU Comments
The Engineering Division has the following comments:
a. The additional theaters, reportedly, will not increase the
traffic impact onto adjacent streets since each theater's
beginning and ending timeb will be phased with the existing
theaters. Traffic will increase overall, but the amount of
traffic at the peak will remain the same. Staff and the State
are concerned as to exactly how the schedules of the 11 theaters
are going to be staggered to have sequential beginning and
ending times.
The traffic report indicates that the theater schedulz should be
able to be modified to limit the impact to less than the impact
of the two .largest theaters ending and beginning within a 15
minute period. The two largest theaters have a combined seating
of 1, ' 20. The traffic analysis for the access design as it
C cly exists was based on a "worst case" condition in which
performances in the two largest thea,reu end and begin
sirnultaneously, with all seats filled in both theaters.
The applicant has not submitted a schedule to demonstrate that
the enlarged facility will not exceed the "worst cage"
conditions of the original traffic analysis.
b. Since the prior decision, the City has received complaints from
customers of the theater, local residents, anA travelers of 72nd
Avenue of inadequate eight distance north of the theater's
access to 72nd Avenue. Staff han reviewed the conditions at the
Bite and concur with the citizens that additional eight distance
is desirable. Vehicles entering the access, traveling north on
72nd Avenue and vehicles exiting the Bite, turning right onto
72nd Avenue do not have adequate sight distance. This is due
to the crest of the 72nd Avenue hill, just north of the access,
restricting the ability to see vehicles traveling south on 72nd
Avenue.
The previous decision required the applicant to provide a 400
foot eight distance fot the 72nd Avenue access. This
requirement was met as measured from the centerline of the
access, as required. However, for vehicles in the right turn
lane of the access drive and for southbound vehicles turning
left into the driveway, additional eight distance should be
provided.
It is Btaff'a recommendation that this crest be reconstructed to
provide increased eight distance. The speed for major. collector

streets is 35 mph. . The corresponding vertical curve design
cr..*-er': requires the curve length to be 40 to 50 times the
charge in grade before and after the curve. The street
reconstruction should replace the existing pavement width as it
currently exists. The waiver for future 72nd Avenue
improvements; required for the initial development, should
remain in force.
Requests were also made by the public to provide a center turn
lane on 72nd Avenue. It is staff's opinion that the traffic
volumes on 72nd Avenue with the added theater traffic do not
warrant such a turn lane as a condition of development.
C. The new theatre structure will not substantially increase the
stormwater runoff from the site since the existing paved area is
being replaced with the roof area. Therefore the downstream
impact is negligible and no modifications to the existing system
are required.
The State Highway Division indicates that the impacts of the added
1,204 seats to the theater complex should be studied for traffic
impacts to the street and highway •y item. The signal modification
made at 99W and the theater driveway were made to handle the present
complex.
The Building Inspection Division, Washington County Fire District
No.l, P.G.E. , Metzger Water District, and General Telephone all have
ro objections to the proposal.
No other comments have been received.
B. ANALYSIS AND CONCLUSIONS:
The proposed development iH consistent with Community Development
Code requirements for building height and setback, access, lot
coverage, and the intended use. Additional discussion is warranted
relating to parking, landscaping and buffering, accese and signt
distance at 72nd Avenue, traffic generation, and trash pick-up.
Landscapinq. The conceptual landscaping plan presented in the
application appears to meet all code requirements for landscaped area
as well as types of vegetation for buffering, screening and parking
areas. However, a more detailed plan should be submitted prier to
the issuance of building permits which clearly identifies the
location, types, and sizes of the landscaping materials and ground
cover to be installed.
During a recent site visit, the health and adequacy of the existing
landscaping was evaluated. The following items must be ;ompleted in
order to meet Code requirements:
1 . The ground cover and netting used for erosion control in
the southeastern corner of the site along 72nd Avenue needs
to be re-established.

2. The Douglas fir trees that were planted along the rear of
the existing building co provide screening have died and
need to be replaced.
3. The majority of the southern landscaped area as well as the
areas bordering the parking lot contain blackberries and
other weeds. This constitutes "noxious vegetation" as
defined in the Tigard Municipal. Code and muEt be removed
and replaced with an acceptable ground cover such as turf,
bark mulch, or ivy.
Parking. The Community Development Code requires that one parking
space be provided for every four (4) seats 1,ithin the cinema complex.
Base upon the number of seats, 685 parking spaces are required. The
applicant's site plan shows a total of 701 parking spaces and
therefore, the Code requirements are satisfied. Also, the
appropriate number of additional handicapped parking spaces have been
provided.
The Code requires that one bicycle parking space be provided for
every 15 required vehicular spaces. Thirty•-two bicycle spaces were
provided in conjunction with the original development of the
theater. Because of this expansion, another 14 bicycle parking
spaces must be provided.
Access and Sight Distance on 72nd Avenue. As noted by the
Engineering Division, the sight distance is not adequate at the 72nd
Avenue entrance. In order to be consistent with City standards and
to provide for safe ingress and egress from the driveway, additional
sight distance (consistent with a 35 mph design speed) should be
provided.
Traffic Impact. The arplicant indicates that by proper bcheduling of
the different shows at the theater complex, the traffic generation
will not pose an additional problem. A business owner nearby on
Pacific Highway has indicated to the City staff that traffic
congestion problems presently exist at peak hour times, such as
Saturday evenings. As indicated above by the Engineering Division
and State Highway Division, this scheduling plan will be reviewed to
ensure that the public street system and nearby properties are not
adversely affected.
Trash _Pick-up. Several complaints have been received regarding the
hours of trash removal from the site. In order to maintain a more
compatible relationship with the residents to the south, trash pick-
up eho,ild be limited normal daytime hours.
C. DECISION
The Planning Director's designee APPROVES SDR 88-27 subject to the
following conditions:

PRIOR TO THE ISIUANCE OF BUILDING PERMITS, THE FOLLOWING CONDITIONS
SHALL BE SATISFIED:
1. A profile of 72n. Avenue shall be required, extending 300 feet
either a+.de of the subject site showing the existing grade a.1
proposed future grade. The applicant shall reconstruct the
crest vertical curve to the future grade and same width as
currently exists. Pavement thickness shall be to major
collector standards. A vertical curve length equivalent to 40
times the change in grade on either side of the vertical curve

2. Seven (7) sets of pian and profile public improvement
construction plans and one (1) itemized construction cost
estimate, stamped by a registered professional civil engineer.,
detailing all proposed public improvements shall be submitted to
the Engineering division for approval. Two (2) sets of plan and
profile plans shall be submitted for preliminary review prior to

3. Construction of proposed public improvements shall not commence
until after the Engineering Division has approved public
improvement plans. The section will require a 100% performance
assurance or letter of commitment, a developer-engineer
agreement, the payment of a permit fee and a sign

opening permit or construction compliance agreement shall occur
prior to, or concurrently with the issuance of approved public

spaces as required by the Community Development Code. The

a revised traffic study may be required by the State Highway

the driveway entrance is to be replaced and lengthened as approved in rase
SL 87--07.
The applicant proposes to construct a five theater building with a total
capacity of 1,938 persons. The building will be located near the southern
property line with parking provided to the north, east, and west. The

existing access and traffic signal at Pacific Highway will continue to
serve as the main rnt.rance to the site with a second access proposed on
72nd Avenue. -the 72nd Avenue driveway will be open only during theater
business hours .
4. A enc _and NPO Comments
The Metzger WiLer [District, Building Inspection Division, and General
Telephone have no objections to the proposal.
The State Highway Division notes that an access `raffic report has been
submitted for review and that an access permit will be required.
The Engineering Division has the following comments:
a. The proposed development will have its primary vehicular access via an
existing private roadway connecting directly to Pacific Highway and a
secondary vehicular access via a driveway connection to SW 72nd Avenue,
b. A tra Uic analysis dated 4-29-87 and prepared by Robert Keech, P.E. ,
of Keech Associates, Tnc. , supports the proposed access pattern. The
traffic analysis reviewed alternatives for theater access, including
alternative future alignments of SW 72nd Avenue. Based on the Keech
analysis, it appears that the direct roadway connection to Pacific
Highway, using the existing driveway, provides the least impact on the
public street system.
C. The peak traffic periods at a theater are generally of short duration
and generally occur outside the times of peak traffic on adjoining
streets.
d. Pacific Highway is a State highway under the jurisdiction of the
Oregon Department of Transportation (ODOT) . It appears that ODOT will
require the applicant to provide intersection and signal improvements
for the private roadway approach adequate to provide for the traffic
volumes projected by the Keech trc.ffic analysis.
e. SW 72nd Avenue is under 0e jurisdiction of the City and is classified
as a major collector which provides for 2-4 moving lanes of traffic.
Existing improvements and right--of-way are substandard. The Tigard
Triangle Traffic Circulation Study, prepared for the City by
Associated Transportation Engineering and Planning, Inc. , and
completed in October of .986, recommends that SW 72nd Avenue be
improved to provide 2 moving lanes plus turn lanes where needed. The
Study suggests that SW 72nd Avenue will need to be further widened to
4 travel lanes plus to-n lanes in the future as the Tigard 7-iaogle
approaches full development ,
In order to meet full design standards, it will be necessary to
substantially revise the existing vertical alignment of 72nd Avenue
between Pacific Highway and Baylor Street; hence, it is not practical
to provide half -3lroet improvements along the applicant's SW 72nd

should br� required. The applicant should also demonstrate, by
completing a preliminary centerline design profile ani necessary cr•css
sections, that eventual improvement of SW 72nd Avenue to de-;i,;n
standards will not significantly impact the proposed site improvemenr.s.
f. Area residents expressed concern over bicycle and pedestrian safety.
The staff evaluated the input and found the concerns are warranted and
should be addressed. The transportation element of the Comprehensive
Plan currently recommends provision for pedestrian and bicyclr..
circulation along SW 72nd Rvenue. These improvements are usually
required with new development when standard street improvements are
installed, which is not the case with this project. However, the need
for these improvements appears to be present with the theater
development. Therefore, staff suggests an int(-rim solution requiring
the applicant to install a 5 foot shoulder, 4 feet of which is to be
2" of Class C asphalt, along the applicant's entire SW 72nd Avenue
frontage. The structural section of the shoulder shall include 6" of
3/4 "-0" rock . These improvements shall be included in the applicants
publ'c improvement drawings and permit for work already proposed on SW
72nd Avenue.
g. Intersection site distance on SW 77nd Avenue . It appears that the
applicant can significantly exceed the sight distance requirements for
30 mph, given the location of the proposed SW 72nd Avenue access.
Fherefore, in an effort to address the residents conte-ns, it is
recommended that t'.e it►tersection sight distance requirement be
changed to a minimum of 400 feet, which exceeds the requirements of
35 mph.
h. The City has budgeted funds for desiyn of an improved intersection of
72nd Avenue at Pacific Highway. When completed, the intersection
improvements will further enhance access to the theater complex. In
the interim, the proposed private roadway access is expected to
function adequately as thQ primary theater access to Pacific Highway.
Based on "ie Keech analysis, theater traffic can be adequately
accommodated without the 72nd/Pacific Highway intersection
improvements.
i . The applicant has proposed a gate on the 72nd Av ,nue driveway to
prohibit vehicular access from 72nd Avenue when the theater is not in
LISP. The gate should provide a way to avoid potential probT-?ms of
motorists using the parking lot as a through route between Pacific
Highway and 72nd Avenue.
i
j . The Transportation Ma.- of the Tigard Comprehensive Plan, adopted in
1983, recommends a street connection between the proposed Dartmouth
Street extension and SW 68th parkway, following 4-he gen ral alignment
of Red Rock Creek. Subsequent data from the 1986 Tigard Triangle
Traffic Circulation Study supports the future need for local street
connections between Dartmouth Street extension and SW .,8th Avenue.
Based on data from the 1986 study, it appears that the alignment of
the local street connections is not critical .

k . At its meeting of June 3, 1997, NPO #4 provided the following comment:
"NPO N4 members suggest that a study be made of the feasibility of
Extending the existing SW Atlanta Street westerly to SW 72nd
Avenue and continue across 72nd Avenue with an entrance to general
American Theater "Moyer" from suggested extension of SW Atlanta
Street: to conform with existing terrain to the East of SW 72nd
Avenue. The entrance to the theater group would be off of the
proposed SW Atlanta Street and thereby eliminating the necessity
of foot traffic crossing the extension of SW Atlanta Street. Also
the extension of SW Atlanta Street westerly to the proposed
extension of SW Dartmouth Street would complete a westerly loop
within the Triangle."
1 . It apnear3 that both the roadway alignment suggested by the
Comprehensive Plan and the alternative alignment suggested by NPO N4
are feasible routes and would satisfy the future local traffic needs
suggested by the 1986 Study. However, construction of the roadway
west of 72nd Avenue appears to serve no purpose 1,ntil it can be
actually connected to a completed Dartmouth Street extension. The
applicant has located site improvements so that thea local street
connection is riot precluded from crossing adjacent to and possibly
through a portion of their site in the future. Engineering recommends
that the applicants dedicate the northerly 25' of their property,
lying east of the SW Pacific Highway access, to the public for street
and utility purposes. This wil'. help facilitate the potential
connection in the future. This dedication will require that site
improvements be located at least 25' from the existing property line.
If it is determined in the future that this dedicated right-of-way is
not needed to facilitate the connection, it could be vacated which
would return it to the applicant's property. Once returned it
Potentially could be used for additional parking. No improvement to
this dedicated right-of-way is recommended at this time. However, the
applicant should sign a waiver of remonstrance for future improvement
of the above described street connection.
m. The site is traversed east to west by an exisving major drainage
system (Red Rock Crcek) that is closed west of tl+e primary access and
open east of the primary access. The applicant proposes to upgrade
the existing closed system and leave the open system as is.
Engineering would recommend that the applicant regrade the open system
to improve capacity and flow. The upgrading of the closed system will
require submission of detailed engilieering calculations, plans and a
public improvement permit. Both systems will require public drainage
easements.
n. Sanitary sewer service will be provided by an existing 10" mainline
which traverses the site from east to west.
NPO #4 has expressed concern relating to:
a. T'he possible need for a traffic signal at the 72nd Avenue driveway.

b. Streetlights along 72nd Avenue.
c. Street improvements on 72nd Avenue including widening sidewalk and
raising the grade for the lowest portion of the site.
d. Accommodating the westerly extension of Atlanta Street.
The NPO also suggested that a study be conducted regarding the feasibility
of extending Atlanta Street so that it forms an interrection at 72nd and
the proposed theater driveway.
Concerns were expressed by several adjoining neighbors pertaining to
noise, building placement, security, lighting, traffic on 72nd Avenue,
sight distance on 72nd Avenue, and the use of the theater driveway as a
short cut to Pacific Highway .
No other comments have been received.
B. ANALYSIS ANC) CONCLUSIONS
The proposed development is consistent with Community Development Code
requirements for building height and setback, access, lot coverage, and
the intended use. Additional discussion is warranted relating to parking,
signs, landscaping and buffering, future street alignments, and
construction traffic.
Parking
The Code requires 485 parking spaces for this project and 781 spaces are
proposed. This number will be i :.d uced slightly to accommodate the
additional street right-of-way fog• the future east-west street discussed
by Engineering. Additional Code standards for a minimum of 10 handicapped
parking spaces and 32 bicycle parking spaces also apply to this proposal.
The basic concept for parking is appropriate but additional information
she Id be submitted regarding parking space dimensions, location of the 10
reTuired handicapped spaces, and the design of the bicycle parking spaces.
Signs
The applicant has indicated a desire to retain the existinq freestanding
sign on Pacific Highway. Although the dimensions are not known, it is
clearly a non-conforming sign. It may be retained presently as long as it
is not modified or moved. The Code requires a non-conforming sign such as
this must be brought into conformance by March 20, 1988. The City will
expect this sign to be removed or modified to meet Code Standards by this
date.
Landscaping and Buffering
The proposed landscaping plan meets Code requirements for landscaped area,
street trees, and parking area standards . The only portion of the plan
that needs revision is the 70 foot landscaped strip shown along the
southern property boundary .

The applicant proposes to retain approximately 10 of the lareler existing
trees in this area and supplement this vegetation wilh ivy yround cover-
and several Douglas fir trees directly behind Lhe theater building. rhe
existing chain link fence is proposed to remain.
Chapter 10. 100 requires that when commercial develormont oc4ur3 adjacont
to residentially zoned property, visual screening which includes an
evergreen hedge or solid fence, trees, and ground cover must: tae provided.
Preservation of the existing trees and the firs near the baiild;ng will
fulfill part of the screening requirement but additional tyres will be
necessary along the entire southern property line.
The electrical plan for the site indicates that a trench fur electrical
power will be dug within the south landscaped area between 72nd and the
building. This trench should be moved further north in order to avoid
damaging the roots of trees that are to be retained.
Along with the screening standards in Chapter 18. 100, Section 18. 120. 100
considers use conflicts related to noise and privacy. E1CCaU3e of the
close proximity of the building exits and parking lot to the southern
property line and the operation of the facility during the evening, it
appears that the existing chain link fence will not be adequate. A solid
barrier such as a wood fence or masonry wall should replace the existing
fence in order to help deflect noise created by movie patrons and
automobiles entering and leaving the site. In order to help reduce noise
and associated problems during construction, the fence should be erected
prior to or in conjunction with the construction of the foundation.
Future Street Alignment
As noted by Engineering, the alignment of the future street connection
between the Dartmouth extension and 68th Avenue has not been finalized.
The dedication of street right-of-way along the northern property boundary
will retain the option of completing this street in the future.
Construction Traffic on 72nd Avenue
The applicant has no objection to routing all construction traffic onto
Pacific Highway and not utilize the proposed 72nd Avenue driveway .
C. DECISION
The Planning Director approves SDR 87-12 subject to the following
conditions:
I . Prior to issuance of site grading permits:
a. The applicant shall demonstrate to the satisfacl.ion of the
Engineering Section, by completing a preliminary centerline design
profile and necessary cross section3, that Lhe eventual
improvement of SW 72nd Avenue to 35 MPH design standards will not
significantly impact the proposed site improvcmorits.

2 . Prior- to issuance of foundation and building permits:
a. Additional right-of-way shall be dedicated to the public along the
SW 72nd Avenue frontage to increase the right-of-way to 40 feet
from cente line. The description for said dedication shall be
tied to tt existing right-of-way centerline as established by
county sur-Ley N2'i,942. The dedicaticn document shall be on City
forms and approved by the Engineering Section. Contact Jon
Feigion in Engineering for forms and further information.
b. A non--remonstrance agreement for the future development of SW 72nd
Avenue and the future street connection between Dartmouth and SW
72nd Avenue shall be executed by the applicant, on City forms, and
shall be reviewed and approved by the City prior to recording.

C . The applicant shall provide for a minimum of 400 feet of sight
distance with the SW 72nd Avenue access using 3 .5 feet for eye
height and 4.25 feet for object height. The applicant shall also

public improvement construction plans and one (1) itemized
construction const estimate, stamped by a Registecod Professional
Civil Engineer, detailing all proposed public improvements shall
be submitted to tha Engineering Section for final approval.

j . Construction of proposed public improvements shall not commence
until after the Engineering Section has issued approved public
improifement plans . The Section will require posting of a 100%
Performance Assurance, the payment of a permit fee and a sign
installation/streetlight fee. Also, the exec tion of a street
opening permit or construction compliance agreement shall occur
prior to, or concurrently with the issuance of approved public
improvement plans.
k. The applicant shall submit a revised site and landscaping plan for
Planning Director approval which contain the following:
1) The street right-of-way dedicati-.n required along 72nd Av,anue
and the northern property line
2) Dimensions of parking spar,-s
3) Minimum of 10 handicap-d parking spaces
4) Minimum of 32 bic;cle parking spaces including bike rack design
