regular meeting of August 3, 1976, considered your request for
approval of a lumber storage building in a C-3 zone and your
submission was approved subject to the following conditions:
1 . A landscape plan be submitted to Design Review Board
which includes eight obscuring plantings along the
north and west property lines and an attempt be made
to provide some landscaping in the front of the build-
ing adjacent Pfaffle and Pacific where a 10 foot land-
scaped setback is required.
2. That five feet of right-of-way be dedicated on 6.W.
Pfaffle for future street widening .
3. An agreement to participate .in s local improvement to
Improve S.W. Pfaffle to city collector street standards
be filed with the City Recorder. At the time of
improvement this property will be credited for the

LOCATION: 11675 SSV Pacific Highway
APPLICANT: Marine Lumber Company
BASIC FACTS:
1 . The site is designated General Industrial on the Tigard
Community Plan and zoned C-3, General Commercial .
2. The proposed use is listed as a conditional use in the C-3
zone.
3. Section 18 .68.020 authorizes the Planning Commission to re-
instate or resume a discontinued non-conforming use "if the
non-conforming use for structure is destroyed or damaged by
a cause of the extent requiring the discontinuance of the
use while affecting repairs. The future structure or use
on the property shall conform to the provision of this title
unless reinstatement of the original structure as specifically
approved by the Planning Commission. "
4. The proposed building is to be located one foot from the
adjoining residential zone (A-7.) There 10 feet of side yard
setback is required . The original building which burned
on June 1 , 1976 was located in the same location that the
applicant is proposing to place a lumber storage shed.
FINDINGS:
1 , The applicant is proposing to reconstruct approximately a
4000 square foot lumber storage shed to replace the one
destroyed by an alleged arsonist on June 1 , 1076. If
allowed, the structure is to be located on the existing
foundation of the building destroyed by fire.
2. The existing use is a lumber yard and retail sales on a . 85
acre parcel .
3. The surrounding land use is vacant land with single residential
uses north across Pfaffle St . and Pacific Hwy. to the south.
4 . The applicant has stated that the lumber storage shad would
constitute approximately 9% of the total valuation at the
site and that the inability to reinstitute the storage shed
would create a hardship and be detremental to the remaining

91% investment on the site.
5 . Section 18 .28.040 of the Tigard Municipal Code requires a
side yard setback of 10 ' when abutting a residential zone.
The lot to the west is zoned A-2, Nhilti-Family Residential .
The applicant has stated his intent- to adjust the property
line so as to provide the fire seperation required by the
Uniform Building Code for this type of. structure.
6. The applicant has stated that the impact on public services
and the adjacent sites and immediate neighborhood will be
no more than the original building.

Project: Lumber Storage Shed, Marine Lumber Company
Gentlemen,
1. It is proposed to reconstruct a lumber storage shed, the original
of which was destroyed by arson on June 1, 1976.
The original building was one foot from the west, line of Lot 100
which is zoned C-3. Lot 200 is zoned A-2.5 which requires a ten
foot _)etback.
As lots 100, 2009 300 and 1300 are under common ownership and no
change in occupancy or use is contemplated, it is requested that
the non-conforming use permit of the original building be reinstated
which would allow the building to be reconstructed one foot from
-the property line. This would make much better use of the lumber
yard.
It is our intention to locate the west end of the new building
fifteen feet from Pfaffle Road which is in conformance with the
required setback for yard and for future �.treet widening.
2. Tipard's adopted comprehensive plan call s for general commercial
use in this area. This, of course, requires a non-conforming use
reinstatement.
3. The community need and/or public benefit derived consists of
having a limber yard in this location which is very convenient
for the neiFhborhood.
4. There will be no changes in operation of the new building.
S. Rebuilding the limber stor pe shed building would constitute about
9% of the total value of the land and buildings so it would be
very uneconomical to relocate this business.

6. The new structure would have no more impact on the adjacent
sites,occupants or activities or 4mrwdiate neigbborhood than
the orivinal building.
7. The impact on public services would be identical with the
original building.
