The above-entitled matter came before the Hearings Officer
at the regularly scheduled meeting of October 13, 1988, at the
Tigard Civic Center-Town Hall , Tigard, Oregon; and
The applicant requests a sensitive lands permit, to fill a
drainageway and floodplain area with approximately 200 cubic
yards of fill and to remove an equivalent amount of material in
another location in the floodplain of Fanno Creek; and
The hearings Officer conducted a public hearing on October
13 , 1988 , at which time testimony, evidence and the Planning
Department' s Staff Report were received; and
The Hearings Officer adopts the findings of fact and
conclusions contained in the Staff Report, a copy of which is
attached hereto, and marked "Exhibit A" and incorporated by
reference herein;
NOW, THEREFORE, IT IS HEREBY ORDERED that SL 88-04 is
approved subject to the following condition:

1 . The area below the 100 year floodplain elevation shall
be dedicated as greenway - open space to the City. A monumented
boundary survey showing all new title lines, prepared by a
registered professional or land surveyor, shall be submitted to
the City for review and approval prior to recording. The
applicant may delay the dedication of the greenway until after a
permit, as required by condition #2 herein, is obtained, however-
the
oweverthe performance assurance or letter of commitment as required in
condition #7 shall remain in effect until such dedication is
made.
2 . A permit shall be obtained ty the applicant from the
U.S. Army Corp of Engineers (Authority: Section 404 , Clean Water
Act, 33 U.S .C. 1344) for discharge of dredge or fill material
into waters of the United States . A copy of the permit shall be
provided to the City Engineering Division by the applicant. The
applicant may begin work on landfill above the floodplain without
said permit, but any fill or removal of material below the
floodplain shall be preceded by the permit required in this-
condition of approval .
3 . Sanitary sewer and storm drainage details shall be
provided as part of the public improvement plans. Calculations
and a topographic map of the storm drainage basin shall be
provided as a supplement to the public improvement plans.

Calculations shall be based on full development of the
serviceable area.
4. A grading plan with surveyed cross-sections of the fill
and excavation areas and earthwork quantity computations shall be
provided as part of the storm drainage public improvement plans.
5. The proposed storm drain shall be centered in a 15 "
public utility easement and constructed to public standards. The
easement shall be executed on forms provided by the Engineering
Division.
6. Five (5) sets of plans and profile public improvement
construction plans and one ( 1) itemized construction cost
estimate, by a Registered Professional Engineer, detailing all
proposed public improvemen•cs shall be submitted to the
Engineering Division for approval. . Two (2) sets of plans and
profile plans shall he submitted for preliminary review prior. to
submittal of final plans.
7. Construction of proposed public improvements shall noir
commence until, after the Engineering Division has approved public
improvement plans. The section .gill require a 1008 performance
assurance or letter of commitment, a developer-engineer
agreement, and the payment of a permit fee. Also, the execution
of a compliance agreement shall occur prior to, or concurrently
with the is: e of approved public improvement plans.

8. The applicant may delay the implementation of
conditions 1 , 2, and that portion of condition 7 that applies to
Engineering Division approval of the public improvement plans, to
facilitate the U.S. Army Corps of Engineers permit. However , the
applicant will retain in place the 100% performance assurance or
letter of commitment until said conditions are met.
9. THIS APPROVAL IS VALID IF EXERCISED WITHIN ONE YEAR OF
THE FINAL APPROVAL DATE.

2. Background Information
No previous applications have been reviewed by the City regarding this
property.
3. Vicinity _Information
Fanno Creek lies within the western portion of the property. Parcels
zoned R-7 (Residential, 7 units/acre) and R-12 (Residential, 12 units/
acre) are situated on the west side of the creek. A combination of
properties zoned I---P and I-L (Light Industrial) are in the immediate
vicinity to the north, east, and south. Access to the property is
provided by 74th Avenue which borders the eastern lot line.
4 . Site Information and Pro )gsal Description
The property is undeveloped and covered by a combination of trees,
brush, and grass. The 100 year floodplain, which has an elevation of
131 feet, ocr-upies the western half of the parcel. A small drainageway
runs under 74th Avenue and across the subject property to Fanno Creek.
The applicant proposes to eventually vst,,blish an office, maintenance
shops, covered equipment storage, and yard for the pipeline business.
Prior to begirnnirir3 this rroject, the atn,? icant is requesting approval
to place approximately 9,000 cubic yards of fill on the uplands portion

of the property. Of this amount, approximately 192 cubic yards of fill
will be placed within the 100 year floodplain. A culvert- will be used
to accommodate the water flowing in the drainageway.
5. Age- icy and NPO Comments
The US Army Corp of Engineers have authorized the proposed work subject
to conditions (see attachment).
The Building Division has no objection to the request.
The Engineering Division has the following comments:
The applicant- has submitted a topographic survey and grading plan
showing the fill;.ng of a draw from Fanno Creek. A volume of
material equal to the fill is to be excavated from the bank of
the creek. A 24" storm drain is proposed to replace the draw as
a drainageway. The floodway extends to the edge of the
floodplain throughout this reach of Fanno Creek.
The excavation and fill. are within the 100 year floodplain. The
draw is a natural drainage with slopes in excess of 25 percent.
Consequently, a Sensitive Lands permit is required.
The Sensitive Lands Ordinance requires that land form alterations
will preserve or enhance the flood plain storage function and
maintenance of the zero-foot use floodway shall not result in any
narrowing of the floodway boundary. This requirement is met
since there is an excavation along the creek bank equal to the
fill of the draw.
The Ordinance also requires that alterations not result in a
decrease of the water flow capacity or any increase in the water
surface elevation of the 100-year flood. Since the excavation is
in a more hydraulically efficient portion of the floodway than is
the proposed fill, the water flow capacity will be increased by
this project. Consequently, there will be no rise of the water
surface elevation of the 100-year flood.
In addition, the 0rdinance requires that the landform alterations
not leave steep slopes that will result in erosion, stream
sedimentation, ground instability, or other adverse on-site and
off-site effects or hazards. Filling of the draw will eliminate
the existing steep slopes. The exist.iny drainage within the draw
will be routed through a proposed storm drain that will eliminate
sedimontation and erosion caused by off-site run-off.
The Unified C<ewerage Agency indicates that the strength of the existing
B-inch sewer line should be evaluated to determine if the line will
resist the additional lead created by the fill .
NPO Ifs states that the data submitted for review was insufficient with
regard to upstream and downstream imparts.
No other commonts were re-_eived.

B. FINDINGS AND CONCLUSIONS
The Planning Staff has determined that Comprehensive Plan policies 2.1.1,
3 .2. 1, 3 .2.2, 3 .2.3, 3.5.3, and 3 .5.4, and Community Development Code
Sections 18.68 ar►d 18.84 are the relevant review cri' aria in this case.
The Planning staff finds that the application is consistent with the
relevant Plan policies based upon the following discussion:
1. Policy 2. 1. 1 is satisfied because the NPO and surrounding property
owners have been notified of this hearing and given an opportunity to
comment.
2. Policies 3.2. 1, 3.2.2, and 3.2.3 are satisfied because the proposed
alterations within the 100—year floodplain will not result in any rise
in flood elevation. Also, the streamflow capacity of the zero--foot
rise floodway will be maintained and it does not appear that any
upstream of downstream changes in the floodplain will be made. As a
condition of approval, dedication of sufficient open land will be made
to enhance the greenway which abuts the property on the west.

3. Policy 3 .5.3 is satisfied because additional greenway wil be provided
as a condition of approval and this in turn will repre—,ci-st another
addition to the Fanno Creek greenway system as called for in the
Comprehensive Plan.
4 . Policy 3.5.4 calls for the provision of an inter—connected pedestrian/
bicycle path throughout. the City. The location of this path is riot
known at this time, but it probably will be located on the west side
of Fanno Creek. As a result, a pathway should not be constructed in
conjunction with this proposal.
The Planning Staff finds that the proposal meets the relevant criteria
found in the Community Development Code. based on the following findings:
1 . Chapter 18.68 is satisfied because the proposal meets all of the
requirements of the I—P zone.
2. Chapter 18.84 is satisfied because the application meets all of the
relevant sensitive lands criteria in section 18.84 .040(a) and (b)- if
the conditions of approval are rt►et as indicated b+alow.
C. RECOMMENDATION
Rased upon the discussion above, the Planning staff recommends approval of
SL 88-04 subject to the following conditions :
THE FOLLOWING CONDITIONS SHALL BE SATISFIED PR10R TO ISSUANCE OF A SLTE
WORK PERMIT BY THE BUILDING DIVISION (STAFF CONTACT: CONDITION 1, JOHN
FEIGION, CONDITIONS 2-7, GREG BERRY, PHONE 639--4171) .
