Please be adviseu that the existing fire hydrants are inade- quate to provide sufficient coverage for the planned development. The city fire code requires that fire hydrants be located within 250 feet of any part of a building in an industrial zone. There- fore, a fire hydrant shall be installed along SW 74th Avenue, mid- way between the two existing fire hydrants, preferably in a planter area. (See attached drawing) . Estimated cost: $3 , 000. Additiona'.ly, the existing fire hydrant located on the south- east corner of Puget' s property must be moved behind the proposed sidewalk .and raised so that the bottom fringe is level with the sidewalk. The applicant participated in an LID for tha :improvement of 7,Ith 1 r. Avenue in 1982. At that time, no development by the landowners was planned and the City limited the construction costs imposed on the landowners to $95 , 000 . That limitation required a revision to the street standard to an "interim" standard to keep the costs within the budget. In 1984, the City approved a small expansion to this facility and made no change in the "interim" standard for the street. However, the applicant is now before the City to nearly double the size of its operation. The City consistently requires applicants to bring roads and utilities to standard in conjunction with new development. There is no dispute that the road as presently built is not to standard for an industrial area. The hearings officer believes that, unlike the burden imposed by a local improvement district which is implemented regardless of the economic climate of the time, an exp^Y,siun such as the one proposed indicates that the applicant's business is doing well and it is now time for the applicant to assume its responsibility to meet the development standards as published and enforced by the City. The "interim" is over and this road should be brought up to standard as part of this development. NOW THEREFORE IT IS HEREBY ORDERED THAT SDR t'8-12 and SL 88- 02 ce and hereby are approved, subject to the following conditions: 1 . PRIOR TO THE ISSUANCE OF BUILDING PERMITS, THE FOLLOWING CONDITIONS SHALL BE SATISFIED. The northern driveway shall ne relocated or deleted to comply with the 30 foot spacing requirement between driveway aprons. d. A permit or evidence demonstrating compliance shall be obtained by the appli-cant from the U. S . Army Corps of Engineers (Authority: Section 404 , Clean Water Act, 33 U.S.C. ] 344) for discharge of dredge or fill material into waters of the United States. A copy of the permit shall. be provided to the City Engineering Office by the applicant . e. I was spokeperson for 100% of the affected Property owners concerning the 1982 74th LAID and am fully abreast of the agreements made. Agreements made with the property owners by the City council and City officers must be honored today. FACTS: The property owners had cost estimates which showed the the project could be built for $95,000. and this figure was blessed by the City Engineer, Mr. Frank Currie in several preliminary meetings that were held with, city officers including the City Manager. The only City standards to be 3eleated that the property owners approved and representations made the the City Council for the 14 June 1982 appr,)val were as follows: a. 24 feet of prepared and paved surface to city specifications; initial proposal called for thirty feet of preparation and paving. b. deleat curbs and s=dewalks. If the employees of the City unilaterally changed the specifications after the 14 June 82 date- the City most assume sole responsibility. It warj agreed between the parties prior to the Council meeting and during the hearing on 14 June 82 the word interim was being used only because of the deviation from then existing city codes enumerated earlier under a. and b. Thisproject was never represented as a temporary improvement. The second agreement made inconjunction with the first agreement between the City of Tigard and the property owners and most be honored today is as follows: After the balance of 74th Street is paved to a full thirty feet and curbs and sidewalks installed i.n this section the City has a right to go back and widen the 1982 LID portion of the street six more feet and install curbs etc. and biE. the property owners accordingly. The property owners agreed to w6ive their- right to remonstrate. Again if the City failed to secure all the applicable documents for the above we the property owners can not be held responsible. Summation: The City in their fidicuary role most be compelled to hong agreements and representations made '.n 1982 and enumerated above. Therefore Puget Cororat.ion is under no City obligation to do anything to 74th Street because in July 1988 approximately 2,050 feet of 74th is still a gravel patch. Furthermore property owners are not responsible for any deviations made to city standards unilaterally by City employees . We should remember that the property owners paid the $95,000 to grade and save the street. We relied on the City to protect our interest. T have noted that. the 14 June 82 transcript notes are very incomplete. Some realignment of 74th Street. 3. Some adjustment of the cut and fill to adjust the grade of the street -- gravel shoulders. 4. Some drainage by culverts and catch basins. S. The curb and sidewalk on both sides of the street were eliminated. The above interim ,,pproval was based upon the agreement by the property holders of a non-remonstrance in the event that the remaining 3,000 feet of 14th Street was ever paved to the full 30' of curbs and sidewalks that the City would ,go back and widen our portion and install curbs and sidewalks on one side with the property holders ;raying the bill . Background Information A site development review (SDR 17-73) was granted in 1973 which allowed the expansion of an existing building. A loading area was provided with a driveway onto 74th Avenue. A parking area and landscaping was also installed on the north and east side of the building. '!n 1984, further expansion to the facility was approved by the City (SDR 8--84) . In conjunction with this development half-street improvements on Bonita Road and 74th Avenue were installed, A new parking lot was also built. . 3 . Vicinity Information The I t (Light Industrial) zone applies to the north iand east The ]:-P (Industrial Park) zone includes the property to the youth. The only Other industrial use in the immpdd Ate vicinity lies to the east. Apartment buildings zoned R-12 (Residential, 12 units/acre) are located on the western side of Fanno Creek. 4. Site Information and Proposal Description Since the 1984 approval, the applicant has obtain�.H additional property and is planning to expand the plant to the s01.t:h. Two houses presently are located south of the existing industrial building (arid the northern STAIT REPORT - SDR 88--12/SL 88--02 PAGE 1 residence will be removed as part of this project. The new 20,000 square foot- addition will be attached to the south side of the existing building. A one-way driveway will be extended from the northern parking area between the existing building and the floodplain. Fifty-five new parkLng spaces will abut the new addition on all sides. Along with the access provided by the one-tray drive, three new driveways are proposed on 74th Avenue to provide access to the parking lot and loading area. A Sensitive Lands approval is also necessary because a portion of the driveway and parking area will be located within the 10u-year floodplain which has a flood elevation of 135 feet. The applicant only proposes to change the existing grade slightly in order to accommodate the parkin; lot and driveway. 5. Agency and NPO Comments The Building Inspection Division indicates that if the existing house that is to be re`ained is on a septic system, it will need to be hooked up to sanitary sewer. Tualatin Rural Fire Protection District indicates that automatic sprinkler protection will be required for the addition. the Tigard Water, District notes that there is an existing 12--inch main along southwest 74th Avenue Some of which is due to a rebate to those property owners who paid for this earlier. It appears that lateral mains with fire hydrants (and possibly fire sprinkler system) will have to be installed toward the building to comply with City Fire Code. Otherwise, it is believed the development can be served adequately. The City Park Board has no comments related to the proposal . The U.S. Army Corp of Engineers has reviewed the proposed plans and Brian K. Blankenship has issued a letter indicating that'a permit. is not required. The Engineering Division has the following comments: 1. The submitted plan sheet's, dated March 1908, and narrative accompanying the application indicate a proposed 20,000 square Feet building addition and parking lot, with access and half street improvement's on 74th Avenue, 2. The subject site fronts onto Bonita Road end 74th Avenue. Improvements wcer•e made to Bonita Road and 74th Avenue by the Puget Corporation in the past to the limits of the property at that time. The 74th L_ID project- made interim tmprovement„ consisting of 3 inches of asphaltic concrete on 9 inches of aggregate baserock, to a width of 24 feet, along the remaining site frontage. 74th Avenue is classified as a local streit within an industrial area. Local strL c pavement thickness standards ,iave been provided by the 74th LID. 74th Avenje serves an industrial area and industrial pavement standards roquire additional pavement thickness for the increased load placo.,d on the pavement from the trucks, fo meet industrial pavement standards the existing pavement should be overlain with 2 inches of asphaltic concrete from the center line to the edge of the existing pavement. The new, widened pavement sectirin should consist of 4 inches of asphaltic concrat:e over 3 inches of (3/4" — 0) aggregate baserock over 12 inches of (2" -- 0) aggregate baserock. 4. The plan submitted shows three driveway accesses onto 79th Avenue. The Community Development Code requires that drivewayl be spared a minimum of 30 feet apart, edge to edge. The northern driveway conflicts with this requirement- as it is shown to be approximately 15 feet from an existing driveway. 5. The public storm drainage is shown to be collected at the southern, lowest- end of the half street improvements and dischArged to the west into Fanno Creek. The public line is shown to be within a 10 fo,:.it wide easement where the standard is a 15 foot wide easement dedicatcl to the public. The private storm drainage system is shown to be. collected on- site by catch basins and discharged into Fanno Creek. The Uniform Plumbing Code requires that all private storm drainage catch basins utilize a sump to collect debris. G. No sanitary sewer connections are proposed as this addition is attached to the existing structure. 7. The proposed parking lot is stated to be encroaching into the 100 year flood plain. This is allowed provided the necessary permits are obtained from the Corps of Engineers prior to construction. No other comments have been received. B. FINDINGS AND CONCLUSIONS The Planning staff has d,-termined that Comprehensive Plan policies 2. 1 . 1, 3 .2. 1, 3.2.2, 3 .2. 3, 3.5.3, 3.5.4, 5. 1 . 1, 6.6. 1, 7. 1.2, 7.2. 1, 8. 1 .3, 11 .5. 1, and Community Development Code Sections 18.68, 18. 100, 18. 102, 18. 106, 18. 108, 18.84, 18. 120, and 15.04.080 are the relevant review criteria in this case. The Planning staff finds that the application is consistent with the relevant Plan policies with minor modifications based upon the following discussion: 1 . Also the streamflow capacity of the zero--foot rise floodway will be maintained and it does not appear that any upstream or downstream changes in the floodplain will be made. As a condition of approval, dedication of sufficient open land will be made to enhance the greenway which abuts the property on the west, 3. Policy 3 .5.3 is satisfied because additiunal greenway will be provided as a condition of approval and this in turn will represent other addition to the Fanno Creek greenway system 7 called for in the Conprehensive Plan. 4. Policy 3.5.4 calls for the• provision of an inner--connected pedestrian/bicycle path throuc,hout the City. The location of this path is not know at this time, but it probably will be located on the west side of Fanno Creek. As a result, a pathway should not constructed in conjunction with this proposal. 5. Po" zy 5. 1. 1 is satisfied because the proposed expansion will provide for• additional economic opportunities and jobs for local residents. 6. Policies 6.6. 1 and 11 .5. 1 can be satisfied if some additions to the landscaping plan as noted in the recommended conditions of approval are satisfied. A discussion regarding the rationale for the changes to the landscaping plan is presented below under Chapter 18. 100. 7. Policies 7. 1 .2, 7.2. 1, 8 , 1 .3 are satisfied because adequate public facilities and services are available for this site. 'The Planning staff finds that the proposal with minor modifications meet? the relevant criteria found in the Community Development Code based on the following findings: 1 . Chapter 18.68 is satisfied because the proposal nv ots all of the requirements of the I-P zone.. 2. Chapter• 18.84 is satisfied because the application meets all of the relevant sensitive lands criteria in section 18.84.040(a) if the conditions of approval are met as indicated below. 3 . The proposed landscaping and :;it-e plan is in basic conformaoc p with Chapter 18. 100, however, there are several items that need to be modified in order to cumpl. totally with this section of the Code. a. Additional screening needs to be provided along the west side of the existing building and proposed additions in order to help obscure the building w; well as the air conditioning unit from thn residential zone to the west. The proposed landscaping plan shows several deciduous tress to provide this buffer but additional ever•graen v�lgetatior wou?d greatly enhance this visual bur fer•. This -_ction of t':ie Code requires than parking spaces have trees in and around them at a ratio of one tree per seven spaces . The northeastern pak•tion of the new parking lot is without trees other titan the street trees along 74th Avenue. Some additional landscaping is required here. C . When staff visited the site, a large area near 74th Avenue was being used for storing pallets. Any kind of outdoor storage for the new develop- ment should include screening of either fencing or landscaping. 4. Chapter L8. 102 of the Code is satisfied because adequate vision clearance is provided at the proposed driveway entrances. 5. Chapters 18. 106 and 18. 108 ani Section 15.04.080 of the Code deal with parking and access requiremr.nts. These sections of the Code can be satisfied if the following modifications are made. a. The Code requires that there be a 30 foot distance between driveway entrances. 'rho northeastern driveway in the new parking area is only about 15 feet south of the existing driveway. This acces3 would either need to be removed or relocated in order to meet this Code requirement, Staff suggests that this driveway be removed because, in addition, the parking arrangement for the northeastern 18 spaces in somewhat awkward requiring two driveway aisles but only two aisles of parking. It is felt that with the deletion of the driveway, the two aisles could be combined into one and less pavement would be required to provide the 18 spaces. b. the Code requires that in a use such as this, there be one parking space for every employee of the largest shift. The applicant states that ?5 employees will be present at the largest shift and therefore the 88 proposed :paces will be adequate to moet Code rtomirement-s. However, the Code does require that one handicapped ?pace be provided for every 50 required parking spaces. As a result, the site plan should be amended to have two handicapped parking spaces be provi 'ed on site. 6. Chapter 18. 120 deals with the requirements for Site Development Review approval . If the above recommendations are implemented, the staff concludes that the provisions of this Chapter are satisfied its well. C. RECOMMENDATION Based upon the discussion above, the Planning staff recommends approval of SDR 88-12/SL 88-02 subject to the following conditions: 1 . A copy of the permit shall be provided to the City Engineering Office by the applicant. e. The applicant shall provide for, roof and parking lot rain drainage to the public stormwater drainage system. f. Five (5) sets of plan and profile public impr-vement construction plans and one (1) itemized construction cost estimate, stamped by a Registered Professional Civil Engineer, detailing all proposed Public improvements shall be submitted to the Engineering Section for approval .
