TRACY AND SIGRID HART
APPLICATION: A request by Renaissance Development Company (Tracy and Sigrid
Hart) for, approval of a sideyard setback variance to allow a roof overhang to
extend 2 feet, 3 inches into the required side yard, 3 inches beyond the
allowed setback. A 5 foot setback from the property line is required for the
building and a three fool: setback for the roof. The prof erty is zoned R-12,
PD (Medium Density Residential, 12 units/acre, Planned Delelopment overlay).
Location: 11593 SW 134th Place (WCTM 1S1 33DB, lot 2200) .
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard�h�:s APPROVED the above described application. , The findings and
conclusions on which the Director based hi-3 decision ar•e as noted below.
A. FINDING OF FACT
1 . Bac!cground
Thr subdivision plat for Brittany Square II subdivision which contains
the subject property was approved in 1984. No other applications
concerning this property have been reviewed by the Planning Division.
2. Vicinity Information
The parcel and the rest of the Brittany Square subdivision are zoned
R-12 (PD) . The larger park .ii to the north is under Washington
County's jurisdiction but is within the City' s vrban growth boundary.
This parcel is planned for medium—high density residential use and is
currently undeveloped.
3 . Site Information and Proposal Description
Tax lot 2200 is roughly pie shaped and contains 5151 square feet. The
property is 74 feet wide in the rear and 29 feet wide along the
street . The house that has been constructed on the site is located so
that the roof overhang on the southeast front corner is 2 feet, 9
inches from the property line. Roofs and similar architectural
features are permitted to project into the required setback as long as
the width of the yard is not reduced to less than 3 feet. The
applicant has requested a setback variance after the construction has
already occurred. The side yard width is adequate behind this point.
All rather setback requirements for the property are met. A sir foot
high wood fence is located along the property line in the adjacent
yard.

B. ANALYSIS AND CONCLUSION
Section 18. 134.050 of tho code requires the following approval criteria
for a var;�xnce:
1 . The proposed variance will. riot be materially detrimental to the
purposes of this Code, be in conflict with Lhe policies of the
comprehensive Plan, to any other applicable policies and standards;
and to other properties in the same district or vicinity;
2. There are special circumstances that exist vhich are peculiar to the
lot size or shape, topography or other circumst,l,nces over which the
applicant has no control, and which are not applicable to other
prop<^ties in the same zoning district;
3. The use proposed will be the same as permitted under this Code and
City Standards will be maintained to the greatest extent that is
reasonably possible, while permitting some economic use of the land;
4. Existing physical and natural systems, such as but not limited t,;
traffic, drainage, dramatic land forms, or, parks will not be adver,l- •
affected any more than would occur if the development were locatet,
specified in the Code; and
5. The hardship is riot. self-imposed and the variance requested is the
minimum variance which would alleviate the hardship.
The primary purpose of the setback standards for the R-12 zone is to allow for
adequate spacing, air, light, and privacy for residential structures. The
variance will have no effect: upon the existing properties in the area because
the adjacent parcel has already been enclosed by a fence providing adequate
privacy and already limiting light and air movement. No impacts upon other
adjacent residences are foreseen.
The residence is a permitted use in the zone and all other aspects of the
building will conform with the code. The variance will have no effect upon
existing physical and natural systems. Although the variance is self-imposed,
staff believes the variance in setback to be minimal (3 inches) with no ill
effects upon adjacent properties or natural systems.
