Tigard, OR 97223 OREGON RE: Durham Road Closure Randy, The City agrees to allow the closure of Durham Road from September 18th through September 29th from 9:00 AM to 4:00 PM with the following conditions: 1. The '72-nd Avenue Road Closed, sign, previously installed and removed, be updated with the correct dates of closure. We also require that a sign `108th Avenue to 113th Avenue', '9 AM to 4 PM` be installed at the same location. These signs shall be .installed 1 - 2 weeks prior to the road closure. See the attached Traffic Control Plan. 2. Durham Road shall remain open to traffic from 4 PM to 9 AM and at any time from 9 ^.M to 4 PM in which one lane of traffic can be maintained with flaggers. Durham Road can be closed only when the presence of traffic is detrimental to the progress of the work. 3. During the periods of the road being open to traffic with a gravel surfacing, we shall require that `CONSTRUCTION AHEAD' and 'PAVEMENT ENDS' signs, in black and orange, be installed 200 feet prior to the construction zone on Durham Road. See the attached Traffic Control Plan. 4. The following signs and the submitted traffic control plan signing shall be in place prior to commencing work on Durham Road. A 'Pacific Highway' sign shall be installed at the SW corner of 98th bvenue and Summerfield Drive. A 'AT 108TH AVENUE, sign shall be inst-illed below the 'ROAD CLOSED TO THROUGH TRAFFIC' at Durham Road and 98th Avenue. See the attached Traffic Control Plan. 5. The gravel roadway section shall be maintained to a smooth surface and dust shall be controlled at all times. The approved set of plane does not require extension of the 36 inch or 48 inch CMP or the reconstruction of the bike path. A 12" CMP is required at station 3+60. The road closure is required in order to allow the developer of Sycamore Terrace Apartments to make improvements to the sight distance of Durham Road. The improvements shall consist of elevating the two dips in the existing pavement 3-4 feet. During the period of the constructioii in which the roadway will be open to traffic, 4 PM to 9 AM, the motorists will be required to drive on two sections of gravel roadway. Also, a sensitive lands permit request- to place a gazebo and a small portion of a building in a ravine. -[he property is ironed R-25 (Multiple Family Residential, 25 units/acre) and is located at 10960 SW Durham Road (WCTM 2S1 15AA, Lots 800 and 900) . DECISION: Notice is hereby given that the Planning Director' s designee for the City of Tigard has APPROVED the above request: subject to certain conditions. The findings and conclusions on which the decision was based are noted below, A. FINDING OF FA-T 1 . Br. ground The subject parcels were recently annexed to the City in November 1988. No previous applications have been reviewed by City staff. 2. Vicinity Information Properties immediately to the east and west are also zoned R-25. Properties to the northwest are zoned and developers as R--25 (PD) (Multiple Family Residential, 25 units/acre, Planned Development) . Properties to the north, known as separate phases of the Summo rfield development are zoned and development R 7 (PD) (Single Family Residential, 7 units/acre, Planned Development). Finally, one property immediately to the south i, zoned R-4.5 (Single Family Residential, 4.5 units/acre) . This parcel recently received Planning Commission approval to develop a 24 lot. subdivision. Remaining propert-les to the southwest of the subject parcels are in Washington County. 3 . Site Information and Proposal Description The parcels presently contain 7 structures, including a single family residence and assorted farm buildings. A family orchard of fruit; trees fronts Durham Road; several of these trees are of sufficient size (6" or greater) to be regulated by the tree removal provisions of the Community Development Code. A large holly tree exists along the driveway, four lar-g- fir trees are near the house and some very tall fir trees exist at the southeastern corner of the property. Numerous sycamore trees sit a�ong the north side of the ravine. The remainder of the property is covered by tall grass and weeds . At: the southern end of the subject parcels is a large ravine designated by the City Comprehensive Plan as a significant wetland and which is a tributary of the Tualatin River. Section 18.84 .045 of the NOTICE OF DECISION - SDR 88-26/V 88--42/SL 88-06 - LAMPKIN/WEST-BELL - PAGE 1 1 Code contains unique regulations for, this ravine. Upon application for a Sensitive Lands Permit, the Director may allow portions of the ravine below the 140 foot: elevation to develop provided that the slope of the land is less than 25 percent, that no unstable soil conditions exist, and that tree removal requirements can be met. The site has approximately 230 fee': of frontage on S.W. Durham Road. Durhan load is one of the most traveled major- collector streets in the City, carrying a substantial amount of traffic between Boones Ferry Road and Pacific Highway. It is currently a two—lane paved roadway with 20 feet of right--of.-way from the centerline to the sito.'s frontage. The applicant proposes to construct a 94 unit apartment complex consisting of 9 buildings with a varying number of dwelling units. A swimming pool and a gazebo will also be constructed. The gazebo is proposed to go behind or south of Building "I", below the 140 foot elevation. Building "I" also is proposed to be constructed slightly within the 140 foot elevation. Should the applicant wish to place Building "I" and the gazebo in the ravine, a sensitive lands permit will be required (discussed later in this report) . Access will be provided from SW Durham Road with only one access point. The. applicant states that 94 carports and a total of 141 parking spaces are proposed. 4. Agency and NPO Comments Portland General Electric, the Tigard Water District, General Telephone Northwest Natural Gas and the City Building Division have all reviewed the proposal and have no objections to it. School District 23J has the following comments: As a result of continued growth in student enrollments at all levels and 0:e const:ructior of a new facility on the Durham Elementary School site, the Tigard School District will be reviewing elementary and junior- high attendance zones later this school year with the idea of mak.irig appropriate/necessary changes. The area of this proposed development may likely be impacted by that process and decision, so the developer cannot make any commitments to renters about where their children will attend elementary or junior high school until the decision is made by the district which will go fnto effect in September 1909. The Consolidated Fire and Rescue District comments that: as~uming building "I" has a gross area of 2,200 square feet on throe levels between fire walls, then a required fire flow should be developed for 2,200 gpm at 20 psi . This amount of water shall be deliverable at all hydrants. Due to the reducr-d scale of submitted plans, the turning radii is indeterminate. The City Engineering Division has reviewed the proposal and m ,kos the following commonts: a. Durham Road is a major collector street and typically requires 3 travel lanes within a 90 foot wide right.-of--way or 45 feet either side of the centerline. NOTICE OF DECISION — SDR 88-26/V 88-42/SL 88-06 — LAMPKIN/WEST—BELL — PAGE 2 j b. The vertical profile of Durham Road along the site's fr. )tage does not meet current s'.andards for sight- distance. 'The ultimate future profile will require cutting down the hills and filling in the valleys of the existing roadway along the frontage of and on both bides of the site. In order to design the access to the apartment complex at the proper elevation to match the ultimate profile of Durham Road, a profile is required extending beyond the site showing the Future grade of Durham Road. Half—street improvements would riot be practical at this time due to the substandard vertical profile. Adequate sight distance should be provided prior to Billowing the subject apartment complex access to D4rham Road. This can be provided either by the applicant or by the Durham Road project. c. The Major, Streets improvement Bond, approved in November 1988, includes Durl­Am Road as one of the roadway? to be improved. Construction -s expected to occur in 1 90. The design is expected to be completed in 8 to 12. months. If the applicant oxpects to begin construction in 1989, the ultimate profile should be coordinated with the City's efforts in the design of Durham Road. The portland cement coiicrete apron, curb returns, and sidewalk within the right—of--way should be constructed by the Durham Road project. d. The Community Development Code requires that 2 accusses be provided with curbs and a sidewalk for apartment complpxes with 50 to 100 units. The proposed apartment complex has :14 units and has proposed one access. Due to the access restrictions caused by the site' s limited frontage width and the City's desire to limit access to a major collector, the Engineering staff has no objection to one ac-:ess provided that the single access is modified to increase its capacity. The modifications should include a wider entrance, a decreased grade change at the apron, and increased radius curb returns at the corners of the access. This one access will provide adequate capacity to the apartments while limiting the. number of direct accesses to Durham Road. e. "rhe Community Development Code requires that major accesses and driveways be improved to the same standards required for the construction and acceptance of City streets. We recammend that the parking areas be constructed with a minimum of 2-1/2 inches of asphaltic concrete over 6 inches of baserock and the access drives be constructed with a minimum of 3 inches of asphaltic concrete over 8 inches of baserock, provided that the subgrade is of good quality and can be adequately compacted, f. The subject site drains to the south into a large drainage ..wale on- site. The submitted drawing shows the proposed storm drainage system discharging into this swaln and appear's to satisfactorily cover the requirements of storm water control . NOTICE OF DECISION — SDR 88-26/V 88-42/SL 88-06 — L.AMPKIN/WEST—BELL — PAGE 3 g. A sanitary sewer line exists within the Swale at the south end of the site and is proposed to provide service to the apartment complex. At a recent; Parks Board meeting, members commented that they would like to see pedestrian access to the 1.13th area ravine whenever and wherever possible, It is intended that a pedestrian path be provided in the future within the ravine between the Tualatin River and Durham Road. NPU #6 has reviewed the proposal and comments: 'The NPO is on record as having established a position that all future development south of Durham Road was existing access on 113th, 108t.h, Serena Court or 92nd. Isolated developments whi-h directly access Durham Road are therefore discouraged. We desire a unified development of the area between 1O8t17 and 113th Avenues, thus dictating one access for that entire area from Durham Road. Th,. neighborhood planning organization passed a motion, 6-0, in favor of denying this application until it conforms with the Transportation Policy that was previously set by NPO 6 and to defer a decision regarding access to Durham Road until the City adopts the transportation elements of the Pubkic Facility Plan. ANALYGII,S AND CONCLUSION Section 18. 120. 180 of Lhe Code contains the criteria whereby the Director can approve, approve with modifications or deny a site development review request. Relevant criteria include density computation, landscaping screening, visual clearance areas, off-street parking and loading, access and egress and signage. The proposed application meets the development code standards for handicapped parking vision clearance and sensitive± Lands. Further discussion is warrar .ed on the fol:•-)wirrj areas: 1 . Park irig Sufficient parking spaces have been provided for residents arid their- guests as required in Sections 18. 106.030(a)(4)(B) and 18, 106.020(g). The Code requires 1 .5 spaces for, each unit, and of these, one must be covered. The proposed site plan discusses carports but does not indicate where they are to go; total parking spaces number- 1A1 . The applicant needs to provide 94 covered parking spaces; therefore, 94 of the 141 uncovered spaces should be designated as covered spaces on a revised site plan. 'The Code also requires at least one secured bicycle rack space for- each 15 parking spaces in the development. The site plan, therefore, should be revised to show at least- 10 bicycle parking spaces. NOTICE OF DECISION - SDR 88-26/V 88--42/SL 88-06 - LAMPKIN/WEST-BELL. -- PAGE 4 2. Signage No plans for signage have been submitted with this proposal . -therefore, all signage must be submitted separately in the future and be approved for sign permits by the Planning Division, Section 18. 114. 130(b) allows one permanent- freestanding sign at each entry point to the housing complex, not to exceed 32 square feet in area per sign face. 3. Landscaping The landscaping plan for this site shows that a little over half (57.09%) of the property will be landscaped. Approximately one fif+h of the parcel at the southern end will be left in its natural state. . Staff has concerns about construction vehicles and debris in this area and recommends a prohibition to remedy potential damage to the wetlands and vegetation. The applicant has not indicated which of the existing trees, if any, will be preserved. Some of the existing large trees are shown on the landscaping plan. However, the applicant should submit a revised landscaping plan indicating this and an arborist's report to verify specifically which ones will be conserved, especially those in the ravine area. Although the Code does not have any specific screening or buffering requirements in this rase, Section 18. 120. 180(a)(4) requires that issues such as privacy and screening be evaluated, The issue of screening is most important along the southern property line, bec<iuse of the abutting single—family residential zone designation. The landscaping plan shows no real buffering or screening to the south. This plan should be further refined to ensure that adequate screening and privacy is maintained for nearby residents. 4. Density Computations and Residential Density Transition 'The net development area of this parcel is determined according to the provisiors of Chapter 18.92 and 6ection 18.40.040 Residential Density Transition. The net development area for this parcel is calculated by subtracting land in the ravine ( .685 acres), and all land proposed for privaLe streets ( .862 acres) . This results in net acreage of 3.3 acres. (4.85 -- 1 .55 acres) . To calculate the net units per acre, the number of square feet in the net development area (143,748 square feet) is divided by the minimum number of square feet required for each lot or residential unit. in the R--25 zone (1,480 square feet minimum) . The result is a subtotal of 97 housing units. Residential density transfer provis�­ns of the Code allow transferal of 25 percent of the units which would have been allowed in the ravine. This would add 20 additional units for a total of 117 units. Since the applicant is only proposing to construct 94 units, this proposal will meet thr City's density requirements . NOTICE OF DECISIO" SDR 88-26/V 88-42/SL 88-06 — LAMPKINNEST—BE=LL — PAGE 5 The subject property abuts an established neighborhood area to the north as denoted on the established area/developing area map. Section 18.40.040(x) states that regardless of the allowed housing densities in Section 18.54, any property/land area within 100 feet of an established area shall not be developed at a residentiA-1 housing density greater than 125 percent of the allowed densi,:y in the adjacent established area(s) . However, the subject parcels and the established areas are separated by a major collector street and therefore this provision does not apply in this case. 5. Building Setbacks All setback requirements have been met except a 30 foot: rear setback along the southern property line because of the abutment of a lower density zone to the south. Building "I" is only 20 feet from the property line. This will require findings in favor of a variance to be discussed later in this report. 6. A,;cess and Egress A 2.4 foot two-way access road is required throughout the development. Hooever, the access dr to between building "6" and the the pool arid the laundry is only 22 Feet wide. This needs to be revised on the site plan. In regard to the comments received from AIPO N6, the staff agrees that the recommendation to limit all future access to 108th or 113th would be ideal . However, the staff does not agree that access should be denied because the property has a .legal right to access and an alternative plan for access has not: been developed, The parcels to the east and west have frontage on 108th or 113th and it appears that this will be the only major driveway between the two streets. The conditions below will provide for adequate site distance. 7. -free nem•,val The City is interested in preserving as many trees as possible. Chapter 18. 150 of the Community Develoomert Code aims to prohibit the unnecessary removal of trees and ets forth some guidelines for, achieving this goal. There is a large number of trees on the parcels, and the applicant does not indicate on the landscaping plan which, if any, of the trees are intended to be saved. It is unclear whether any of these trees on the subject property will be protected. Staff recommends a revised landscaping plan that will preserve as many of the existing trees as practical . Section 18. 100.035 of the Tigard Community Development Code requires the installation of street trees, in this case along Durham, at predetermined spacing depending on the :sire of the tree. They should be planted at least two feet away from the curb face and the driveway. 8. Setback Variance A variance has been requested to the required rear yard setback of 30 fret for building "I" whi•:h is proposed to be only 20 feet from the southern property line. NOTICE OF DECISION - SDR 88-26/V 88-42/SL 88-06 - t-AMPKIN/WEST-BELL -- PAGE 6 Section 18 . 134 .050 contiairis the cri .:eria whereby the Director can approve, approve with conditions , or deny a variance request. They are: a. The proposed variance will riot be materially detrimental to the purpose of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other• properties in the same zoning district or vicinity. b. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; c. The use proposed will be the same as permitted under• this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permiLting some economic use of the land; d. Existing physical and natural systems, such as but n.,t limited to traffic, drainage, dramatic land for•ins or park!, will riot be adversely affected any more that would occur if the development were located as specified in the rode; and e. The hardship is not self--imposed and the variance requested is the minimum variance which would alleviate the hardship. Staff does not pe, ceive this to be a problem because the ravine precludes development to the south from occurring too close and no encroachment will affect nearby buildings. The proposed subdivision development to the south will be 50 -- 120 more feet away from its northern property line aL the closest point: near Building "I" . No further development can be allowed on any of the 3 affected parcels. 9. Sensitive Lands Permit Section 18.84.045 of Tigard's Community Development Code specifically addresses development exceptions in the 108th/113th ravine/significant wetlands area below the 140 foot elevation. The Director may allow portions of the ravine to be developed provided that all of the following criteria are met: a. All of the land (within the ravine) beirig considered for development is at less than 25 percent slope; b. There are no unstable soil conditions on the land being considered for development; and c . The provisions of Chapter 18. 150 TREE REMOVAL shall be met. The applicant's site plan .i�idi,:ates that a portion of Building "I" and a gazebo are the only development intended for this area. Topographic maps for this area of the ravine show a slope approaching 20 to 22 percent. This satisfies the first criteria. NOTICE OF DECISION — SDR 88-26/V F8--42/3L 88-06 -- LAMPKIN/WEST--BELL — PAGE 7 1 The applicant shall. submit a soils engineering study which explains the nature of the underlying and nearby soils and their susceptibility to erosion. Tree removal requirements can be satisfied by the ar•bor•ist-' s report and revised landscapin(; plan discussed earlier in this report, The City requires that wherever landfill and/or development is allowed within and adjacent- to a 100--year floodplain of the Tualatin River and its tributaries, the City shall require the dedication of sufficient open land area for greenway adjoining and within the floodplain (Policy 3 .5. 3 of the Comprehensive Plan) . This dedication requirement poses a problem in that dedication of a strip of land in the 140 foot elevation for open space purposes would necessitate an easement from this area to the eastern property line. This would isolate the southeastern corner of the property, rendering it undevelopable. Also, the gazebo would not be permitted to be built on lanai dedicated to the City. Since the goal of the City in this area is to protect the integrity of the drainageway and allow pedestrian access and riot to prohibit all development in this area, a public use or access easement- for the land below 140 feet with an extension to the eastern property boundary would be a suitable alternative. This would allow for private improvemenLs such as the gazebo while retaiiliig public access through this portion of the property to the lower reaches of the ravine and the Tualatin River. C. DECISION The Director' s designee hereby APPROVES SDR 80-26 and V 08- 42 subject to the following conditions: PRIOR TO ISSUANCE OF BUILDING PERMITS, ALL. OF' THE FOLLOWING CONDITIONS SHAI L BE MET. 1 . A detailed tree protection and street tree installation plan shall be submitted for Planning Division approval which includes locations and types of trees to be retained, an arborist's recommendations for methods of protecting these trees during construction of the proposed apartments and also for maintenance of the long..-term hee3lth of the Lreos . The trees to be saved shall be )rotes:ted during construction by fencing or similar means approved by the Planning Division. No site grading, clearing, or tree removal shall occur prior to satisfaction of this condition. Also, the adequacy of the visual screening for abutting properties must- be approved. Mxham Road (westerly of S.W. 108th) (Name of Project) Dear City Engineer: We hereby certify that Westlake Consultants, Inc. (Name of Engineer) has been retained by West-Bell, Inc. (Name of Developer) to perform the following work pertinent to the above project. 1.. Perform the surveying or verify the existing sirveying information as or structural engineers and, also, oversee materials and systems testing. 2. If necessary, provide for the expertise of other engineers such an soils c structural engineers and, also, oversee materials and systems testing. 3. Prepare construction drawings in accordance with the City standards and obtain the City, and if applicable, DEQ, County. or State approval of such drawings. 4. Supply construction staking. 5. Provide adequate inspection to assure compliance with City Specification, and keep accurate fie19 notes in order to prepare "as-built drawings. 6. Upon completion of construction provide one set of as-built drawings on mylar to the City. 7. Upon completion of construction provide written certification that all improvements are complete in accord with the approved plane and specifications. P. Obtain City approval prior to any substantial deviation from the approved plane. 9. Resolve engineering and construction related p. oblems as may arise. We agree to notify the cii-i, immediately if the ab( ve agreement is terminated or if the Engineer for any reason is unable to perform the above duties.
