D CISION: The City of Tigard Planning Director's Designee APPROVES the above
application subject to conditions. The findings and conclusions on which the
decision is based are noted below.
A. FINDING OF FACT
1. Background
It came to the City planning staff's attention that a furniture
warehouse liquidation sale was in progress at Oregon Business Park
in Januar-, 19,'1. While warehousing is a permitted use in the
light ineastrial .•.oning district, general retail sales is not. A
liquidation sale i. a considered to be retail. sales. The manager of
this even. was not .fied and informed that the liquidation uale was
not a Fsrmitted use and was asked to submit an application for a
temporary use pfrmit. The application was scbmitted to the
Planning Division on January 23, 1990.
2. Site and Vicinity Information
The use is taking place in a light industrial zoning district in
Phase I of Oregon Business Park located between Interstate 5 and SW
72nd Avenue, south of SW Upper Boones Ferry Road near the Southern
Pacific Railroad tracks. Properties to the north are zoned I-P
(Industrial Park) .
3. Proposal Description
The applicant requests paimission to hold a furniture clearance
sale to liquidate discentinued furniture invRntory Hours of
operation are 9 a.m. to 6 p.m. , Monday through Saturday and noon to
5 p.m. Sunday, January 19 through February 19, 1990. The applicant
expects an estimated 20 vehicles carrying 30 visitors to visit the
site each day the sale.
4. Agency Comments
The Building Division noted that the applicant may bo required to
install an additional exit for the warehouse if it is to be used as

a showroom. A building official will be contacting the applicant
concerning this matter in the near future.
B. ANALYSIS AND CONCLUSION
An application for a temporary use mint satisfy all of the criteria from
Section 18.140.050 (Temporary Use: Seasonal or Special Event) as listed
below:
1. The temporary use is limited in duration;
2. There exists adequate and safe ingress and egress;
3. There exists adequate parking for the customers of the temporary
use;
4. The use will pose no hazard to pedestrians in the area of the use;
5. The use will not create adverse off-site impacts.
The subject application satisfies all of the above criteria: The use is
limited in duration, adequate ingress and egress exists (note: the
building depar.ment will be investigating this adequacy of the ingress
and egress with respect to the continued use of the site as a warehouse-
showroom facility), adequate parking is available for the temporary use
customers, no threat is posed to pedestrians in the area, and the use
will not create adverse off-situ impacts.
C. DECISION
The Planning Director's designee for the City of Tigard APPROVES
Temporary Use TU 90-01 subject to the following conditions:
1. All directional signs, bann(+re, signs and flags shall be removed no
later than February 20, 1990.

A fire and life safety plan review was conducted on the above captioned
project for compliance with the 1985. editions of the Uniform Building Code
(UBC) , Uniform Mechanical Code (UMC) , and the Uniform Fire Code (UFC) , as
amended by Washington County Fire District No. 1's Ordinance 86-1.
Plans are approved conditional to the following items:
1 . Exit Door Hardware: All doors shown on the drawings must be openable
from the inside for immediate exit at all tames without the use of a
key, special knowledge, or effort. UBC Sec. 3304
2. Firestopping: In all wood framed walls and partitions, firestopping
consisting of 2-inch nominally-sized lumber or other approved
materials must be installed at all floor and ceiling levels,
Penetrations in this prescribed firestopping tn accommodate wiring,
plumbing, and other similar utility runs must be packed with
noncombustible materials in an approved marnier so as to prevent the
passage of flame. UBC Sec. 2516
3. Fire Extinguisher Required: A fire extinguisher having a minimum
rating of 2AIOB:C must be placed in an accessible location within
plain view. UFC Sec. 10.301(a)
4 . Flammable & Combustible Liquids Storge, Handling & Dispensing.
Storage, handling and dispensing of flammable and combustible liquids
shall be in compliance with Uniform Fire Code Article 79,
5. Approved Plans on Jc:: Site: One set of approved plana bearing the
stamps of the Tigard Building Department and this office must be
maintained on the project site throughout all phases of construction
and must be made available to building and fire inspectors for

Dear David:
This is a Fire and Life Safety Plan Review and is based on tho 1985
editions of the Fire and Life Safety Code (UBC) , Mechanical Fire and
Life Safety Code (UMC), Uniform Fire Code (UFC) , and other local
ordinances and regulations.
Plans are conditionally approved subject to the following:
1 . Automatic Sprinkler Plans: Plans referred to and examined by this
office contain no provisions for the alteration or installation of
automatic sprinkler system. Not less than three sets of plans for
the installation shall be submitted to this office for approval
prior to installation. (UBC 302(b))
2. Exit Door Hardware: All doors shown on the drawir,-; must be
openable from the inside for immediate exit at all t. m_s without
the use of a key, special knowledge, or effort . (UBC Sec. 3304)
3. Roof Covering: Roof covering of this additional structure shall
be of fire retardant type roofing, UBC Chapt, 32
4 . Approved Plans on Job Site: One set of approved plans bearing the
stamps of the Tigard Building Department and this office must be
maintained on the project site throughout all phases of
construction and must be made available to building_ and fire
inspectors for reference during required construction
inspections, (UBC Sec. 303)
5. Inspections Required: Inspection and approval of construction by
a representative of this office is required: (a) prior to the
cover of any new framing elements following the installation of
all utility runs which will be concealed within wall and partition
cavities; (b) upon completion of construction and prior to
occupancy of the tenant space. (UBC Sec. 305)
