Southwest 72nd Avenue is classified as L major
collector and carries the following standards; 60 feet
of right-of-why and 44 feet of pavement. Currently the
portion of SW 72nd Avenue which is adjacent to the site
is fully improved except for sidewalks . The right-of-
way in front of the site varies from 21 to 25 feet from
centerline. There is an access driveway from 72nd into
the site. Chapter 18 . 108.060 of the Community
Development Code, limits direct individual access to
arterial and collector streets . Since the site has
access to local streets (Fir and 74th Avenue) the
access point from Std 72nd Avenue should be abandoned.
The applicant has shown on the preliminary plan that
the access to the site will be from SW Fir Street and
that the access to SW 72nd Avenue will be closed.
Therefore, the applicant should be required to do the
following:
A. Dedicated additional right-of-way to 30 feet from
centerline along SW 72nd Avenue frontage;
B. Install a sidewalk along the frontage of SW 72nd
Avenue; and
C. Kandon the access point along SW 72nd Avenue.
Southwest Fir Street is classified as a local street
with the following standards; 50 feet of right-of-way
and 34 feet of pavement. Currently the portion of SW
Fir Street which is adjacent to the site is fully
improved on the north side, including sidewalks . On
the south side of Fir Street the pavement width varies .
There is an extruded curb and 20 feet of right-of-way.
2'herefore, the applicant should be required to do the
following:
A. Dedicate additional right-of-way to 25 feet from
centerline along the SW Fir Street Frontage, and
H. Provide half-street improvements along the
frontage of SW Fir Street.
Southwest 74th Avenue is also classified as a local
street. Currently SW 74th has no improvements along
the frontage of this site. The Development Code allows
the Director to accept a "non-remonstrance" for
improvements it the site meets certain criteria as
specified in Section 18 . 164 . 030 . This site meets the
following criteria under Section 13 , 164 .030:
Additional planning work is required to define
the appropriate design standards for the street,

and the application is for a project which would
contribute only a minor portion of the
anticipated future traffic on the street.
Therefoie, the applicant should be required to do the
following:
A. Sign a non-remonstrance agreement for the future
improvements along SW.74th Avenue, and
B. Dedicate additional right-of-way to 25 feet from
centerline along the SW 74th Avenue frontage.
2 . SANITARY SEWER: There are two existing public sanitary
sewer lines that abut this property; an 8 inch line in
SW Fir Street and an 8 inch line in SW 72nd Avenu,: .
Based on the "as-builts", both lines appear to be of
adequate size and depth to serve the site: the
applicant or applicant's engineer should field verify
this information prion to the start of any work.
The existing single family residence is currently
connected to a septic system. The applicant is
requesting that the converted office be allowed to
remain connected until such time as further
development, system failure or ten years, whichever
occurs first. It is the City's policy that for
commercial/office development, the site is required to
connect to the public system prior to occupancy (if a
public system is available) . This policy is consistent-
with Unified Sewerage Agency regulations that require
sewer connection for structures within 300 feet of a
public line. Therefore, the applicant should be
required to connect to the available public sanitary
sewer system.

3 . STORM SEWER: Thera are existing public storm sewer
lines available in SW Fir and SW 72nd Avenue. Again,
both lines appear to be of adequate size and depth to
serve the site. The applicant or applicant's engineEr
should field verify this information prior to the start
of any work. The applicant shou!.d be required to
connect any onsite storm system to the public system.
The City of Tigard Build'-.ng Division has reviewed
this proposal and has offered the following
comments :
A building permit: will be required for changes to the
existing residence. The bu" ding shall be required to
conform to the standards set forth for a commercial
building. These standards shall include (but not be

limited to) : ramps, stairs, exits, bathroom
facilities, fire extinguishers, glazing subject to
impacr and demonstration that the building is
structurally able to support the design loads for such
office use.
If the existing well is not to be used, it should be
properly capped-off as required by the Washington
County Watermaster.
The handicapped parking stall shall have a total width
of 16 feet (9 foot stall with 6 foot access aisle) .
With the implementation of the American Disabilities
Act (ADA) , it is suggested that the applicant give
consideration to providing accessibility into the
building, and the use of the toilet facilities . It may
be required as part of the ADA.
^ ialatin Valley Fire and Rescue District has reviewed this
proposal and has offered the following comments:
Fire hydrants are require within 250 feet of all
portions of the structure measured around the outside
and along access roadways . Location approval will be
coordinated with Tualatin Valley Water District.
General Telephone has reviewed this proposal and has offered
the following comments :
The developer should contact GTE Engineering Office for
requirements . Allow 45 days lead time from completion
of ATE Engineering review to trench open date.
Coiumbia Cable has reviewed this proposal and has offered
the following comments :
Please contact Columbia Cable for pre-wire
specifications .
The City of Tigard Operations Department, and Portland
General Electric have reviewed this proposal and have issued
no comments or objections .
No other comments have been received.
C. ANA„YSIS AND CONCLUSION
Section _18 . 64 of the Community Development Code (CDC)
contains the dimensional requirements for the C-P zone. The
subject property .is 42 , 160 square feet which greatly exceeds
the 6, 000 square foot minimum required. Additionally, the

State of Oregon House Bill 2084 , which became effective
September 1, 1990, requires one disabled person parking
spaces if 6 to 25 parking spaces are provided. The proposed
plan provides for the one disabled person parking space
•which is required. Therefore, this code requirement has
been satisfied.
Code Section 18 . 106 . 020 (pj requires one bicycle parking
spa( a for each 15 vehicle parking spaces in any development.
Since there are only 5 parking spaces to be provided on this
site, one bicycle parking space is required. The site plan
does indicate that a bicycle parking rack is to be provided
on this site. Therefore, this code requirement has beer►
met.
The applicant proposes to cover the parking lot with gravel
for a "temporary period of time until the property is fully
developed in five to ten years . " Code Section 18 . 106 .050(11
states:
Except for . . . temporary uses as authorized by
subsection 3 below, all areas used for the parking or
storage or maneuvering of any vehicle, boat or trailer
shall be imprived with asphalt or concrete surfaces
according to the same standards required for the
construction and acceptance of City streets .
The above referenced Subsection 3 refers to temporary uses
as defined Section 18 . 140 (Temporary Uses) . An approved
Temporary Use Permit must be applied for and obtained in
order to utilize this code exception. Additionally,
temporary uses are valid for only 12 months . The proposed
use on thin site is not a Temporary Use and does not qualify
to utiliz,: this exception. Therefore, the parking area on
the subject site shall be paved according to City standards .
The site meets the minimum access standards through the
provision of one 24 foot wide access driveway from SW Fir
Street. Code Section 18 . 108 . 080(A) requires that a
commercial development with a parking area providing between
0 and 99 parking spaces be provided with an access drive
with a minimum access width of 30 feet. The accessway must
be paved to a minimum width of 24 feet. The applicant is
proposing a paved 24 foot wide paved accessway and therefore
satisfies this access requirement.
Code Section 18 . 108 . 050(A) requires that within all
commercial developments, walkways shall extend from the
ground floor entrances to the streets which provide the
required access and egress . The proposed site plan
indicates that pedestrian access to the main entrance of the
proposed office will be provided by a sidewalk leading to

the SW ','2nd Avenue frontage. Although vehicular traffic,
will access the site from SW Fir Street, the main pedestrian
access point will be from SW 72nd venu . The parking area
is connected to the office building by a porch and 1
handicapped access ramp. Therefore, this code requirement
has been satisfied.
Section 18 . 102 (Visual Clearance Areas) requires that a
clear vision area shall be maintained on the corners of all
property adjacent to intersecting right-of-ways or the
intersection of a public street and a private driveway. A
clear vision area shall contain no vehicle, hedge, planting,
fence, wall structure, or temporary or permanent obstruction
exceeding 3 feet in height, except that obstructions which
may be located in this area shall be visually clear between
3 and 8 feet in height. Visual clearance areas shall be
that triangular area formed by measuring a 30 foot distance
along each of the right-of-way or property lines and then
connecting these two 30 foot distance points with a straight
line. The proposed development conforms with all visual
clearance requi.remenLs of Lli6 code section. In addition,
the applicant has taken vision clearance into account in the
submitted landscaping plan.
Chapter 18 . 150 requires a permit and contains standards for
removal of trees having a trunk 6 inches or more in diameter
four feet above the ground on undeveloped land. A permit
for tree removal must comply with the following criteria:
a. The trees are diseased, present a danger to
property, or interfere with utility service or
traffic safety;
b. The trees have to be removed to construct
proposed improvements or to otherwise utilize the
applicant 's property in a reasonable manner;
C. The trees are not needed to prevent erosion,
.instability, or drainage problems;
d. The trees are not needed to protect: nearby trees
as windbreaks or as a desirable balance b%ween
shade and open space;
e. The aesthetic character in the area will. not be
visually adversely affected by the tree removal;
and
f . New vegetetiot► planted by the applicant, if any,
will replace the aesthetic value of trees to be
cut .

The I)reliminary site plan does not indicate that any
treLs will need to be removed. Rather, the applicant
has stated that the existing perimeter trees which abut
the adjacent streets are intended to be counted toward
the minimum street tree requirement. If it seems to
become necessary to remove a tree, no tree removal
shall be allowed to occur prior to Planning Division
staff review and approval of a tree removal permit.
Section 18 . 100_035 (Street Trees) list the criteria for
the maximum spacing of street trees along public
rights-of-way. The landscaping plan proposes to
utilize those perimeter trees which currently exist as
part of the minimum street tree requirement. The
applicant also proposes to plant additional street
trees at this site. The street trees as shown on the
landscaping plan surpass the requirements of this code
section. Therefore, this section has been satisfied.
Section 18 . 119 . 130(D) (Signs) list the allowable signs
and sign area for the C-P zone. The applicant proposes
to locate one freestanding sign along SW 72nd Avenue
approximately 50 feet from the corner of SW 72nd Avenue
and SW Fir Street. The proposed sign will. be less than
eight feet in height and will not exceed 32 square feet
per face. The proposed signage seems to fit within the
allowable sign height, placement and area for this
site. All signs shall be approved through the Sign
Permit process as administered by the Planning
Division.
DECISION: Notice is hereby given that the Planning Director's
designee for the City of Tigard has APPROVED Site Development
Review SDR 91-0015 subject to the conditions listed in Section I .
THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE

II . FINDINGS ABOUT SITE AND SURROUNDINGS
A. Background:
The Community Development. Directors' designee approved Site
Development Review SDR 91-0015 for this site on November 21,
1991 . The decision approved the conversion of a 1, 360 square
foot single family residence into professional offices with
related site improvements . The applicant appealed conditions
number two (2) and four (4) of this approval . This appeal was
heard before and approved by the Planning Commission on
,January 6, 1992 . There ;a. e been no other City land use
decisions for this site.
B. Site location and vicinity information:
The subject parcel is located on the southwest quadrant of the
intersection of SW 72nd Avenue and SW Fir Street. Southwest
74th Avenue abuts this site on its ' western edge. This site
is bordered on the east and south by properties which are
zoned C-P (Commercial Professional) . The property to the
north is zoned R-25 (Residential, 25 units per acre) and is
developed with the Hampton Ridge Apartments . The property to
the west is zoned R-4 .5 (Residential, 4 . 5 units per acre) .
C. Site information and proposal_descri tion:
As stated by she applicant, the subject p_:operty is currently
improved by a single family residence which is approximately
1360 square feet in size) , a 352 square foot detached garage,
an 80 square foot tool shed and a 143 square foot well house.
The residence is currently served by a septic tank-drain
field, and a domestic water well . There are a variety of
deciduous and evergreen trees located around the perimeter of
the site. Access to the propert:y is currently from SW 72nd
Avenue near the corner of SW Fir Loop and SW 72nd Avenue.
The applicant requests Planning Commission approval to allow
an amendment of Conditions of Approval number two (2) and four
(4 ) . Condition two states that prior to building permit
issuance, the applicant shall connect the existing structure
to the public sanitary sewer line. Condition four states

prior to building permit issuance, the applicant shall
complete standard half-street improvements, including concrete
sidewalk, driveway apron, curb, asphaltic concrete pavement,
sanitary sewer, storm drainage, streetlights, and underground
utilities shall be installed along SW Fir Izt*•-eet. Improvements
shall be designed and constructed to Local street standards
and F'lall conform to the alignment of existing adjacent
improv,.,nents or to an alignment approved by the Engineering
Department.
The applicant requests that the landowner not be required to
connect the existing structure to the public sanitary sewer
until either the property is further developed or the cr.rrent
septic system fails . Also, an appeal of con(41tion 4
requesting a non-.remonstrance agreement for '-.alf-street
improvements on SW 74th Avenue with the half-street
improvements to be completed when either SW 74th Avenue is
improved or the remainder of the site is developed.
III . COMMENTS
A. Comments and Hearing Testimony:
The staff report was presented by Senior Planner Dick
Be-aersdorff. Mr. John Shonkwiler presented oral testimony in
favor of the appeal . Two neighboring property owners
testified in favor of the appeal . No other public testimony
was received. A taped recording of the oral testimony was
made at the hearing. Minutes of the public hearing are being
prepared at this time.
IV. APPLICABLE APPROVAL STANDARDS
A. Sanitary Sewer
Section 18 . 164 . 090 (Sanitary Sewers ) states that sewers are
required and shall be installed to serve each new development
and to connect developments to ex!.sting mains . Additionally,
Comprehensive Plan Policy 7 .4 . 4 Sewer Service) states that
the City shall require that all new development- be connected
to an approved sanitary sewerage system. Implementation.
Strategy 8 states :
The purpose of Policy 7 . 4 .4 and related policies is to
permit pre-existing development utilizing septic tanks or
other landfill sewage disposal methods to continue to use

such methods, until a change of use occurs [emphasis
added] , a new main structure is erected, etc . . .
Additionally, Unified Sewerage Agency regulations require
sewer connection for structures within 300 feet of a public
sanitary sewer line.
Therefore, staff determined that a nonremonstrance agreement
was not warranted because: 1) a sewer connection is required
when developing commercial property; and 2) this request does
not meet criteria for granting nonremonstrance agreements;
there is no provision for a nonremonstrance agreement for
sanitary sewers .
B. lialf Street Improvements :
Section 18 . 164 .030W111 (a) states that streets within a
development and streets adjacent shall be improved in
accordance with this title. Section 18. 164 . 0306A) ( 1) (c)
contains the code standards for granting non-remonstrance
agreements for street improvements . The granting of such
agreements .is discretionary.
Section 18 . 164 .030(Erequires a minimum right-of-way of 50
feet with a minimum roadway width of 34 feet for local
streets . Section 18. 164 .039LNI requires the installation of
concrete curbs, unless exempted by the Commission. Sidewalks
are required by Section 18 . 164_070(A) to be constructed on
both sides of local streets and that they be constructed along
all portions of the property designated for pedestrian way-- in
conjunction with development of the property.

portion of SW Fir Street adjacent to the site is fully
improved on the north side, including sidewalks . On the south
side of Fir Street the pavement width varies . There is an
extruded curb and 20 feet of public right-of-way.
Comprehensive Plan Policy 8 . 1 (Traffic Ways ) Implementation
Strategy 5 requires developers of land to dedicate necessary
rights-of-way and install necessary street improvements to the
City's standards when such improvements have not been done
prior to the developer's proposals. These necessary
dedications may be required upon approval of any development
proposal .

The requiring of half-street improvements along SW Fir Street
for this current application is according to City standards
And is consistent with code requirements and the fact that
vehicular access to the site will be from SW Fir Street. City
staff has offered a nonremonstrance agreement for i.mprovemants
to SW 74th Avenue based upon Code Section
18, 164 . 030J_A1(_l) (c) (vi) which states:
Additional planning work is required to define the
appropriate design standards for the street, and the
application is for a project which would contribute only
a minor portion of the anticipated future traffic on the
street.
Staff recommended that a nonremonstrance agreement relating to
improvements on SW Fir Street was noL warranted because: 1)
half street improvementc3 are required wrer, developing property
with substandard or nonexisting improvements; and 2) this
request does not meet criteria for granting nonremonstrance
agreements .
VI . CONCLCiION AND RECOMMENDATION
The Planning Commission found that criteria (iii) of Section
1.8. 164.0,30(A) ( 1 j_ .s applicable. The code sections states:
Due to the nature of existing development on adjace,it
pr_opertles it is unlikely that street improvements would
be extended in the foreseeable future and the improvement
associated with the project under review does not, by
itself, provide a significant improvement to street
safety or capacity.
The applicant provided a letter from the Unified Sewerage Agency
(USA) indicating that connection to the sanitary sewer system would
not be required unless the existing septic tank failed. The
applicant also indicated that sewer elevations In SW Fir Street
make this sewer line unacceptable for services. The applicant
suggested that improving the street, and then later tearing up the
same street for the purpose of serving future de-velopment, would
not be appropriate.
The Planning Commission voted 7 to 0 in favor• of this appeal . The
Planning Commission ruled that conditions of approval number two
( Z ) and four (4 ) shall be amendau as follows:

Condition No. 2 - The landowner shall not be required to
connect to the existing structure to the public sanitary sewer
line unless: ( 1) the existing septic tank and drain-field
system fails, or (2) the landowner expands the size of the
existing structure or replaces it with a new structure.
Landowner shall be r9quired to obtain approval from Washington
County Department of Health for the change of use. In any
event, the landowner shall be required to be connected to the
public sanitary sewer '.ine no .later than the tenth ( 10) year
after the date of this Order.
Condition No. 4 - Upon improvement of S.W. 74th Avenue, or the
landowner's proposal for a new building or expansion of the
existing building, the landowner shall improve or shall
participate in a Local Improvement District to improve S.W.
Fir Street with standard half-street improvements, including
concrete sidewalk, driveway apron, curb, asphaltic concrete
pavement, sanitary sewer, storm drainage, street lights, and
underground utilities. Improvements shall be designated and
constructed to Local street standards and shall conform the
alignment of existing adjacent improvements or to an alignment
approved by the Engineering Department. An agreement shall be
executed by the landowner, on forms provided by the City,
which waives the property owner's right to oppose or
remonstrate against a future Local Improvement District formed
to improve S.W. sir and/or S.W. 74th Avenue. In any event,
the landowner shall. be required to construct the above
described improvements to S.W. Fir Street no later than the
tenth ( 10) year after the date of this Order.
All other conditions approved under the November 21, 1991 approval
issued for SDR 91-0015 remain the same.
THIS APPROVAL IS VALID IF EXERCISED WITHIN 18 MONTHS OF THE FINAL
DECISION DATE AS NOTED BELOW.
It is further ordered that the applicant be notified of the entry
of this order.
