MEMORANDUM CITY OF TIGARD DATE: November 8, 1990 TO: File #SDR 90-0005 FROM: Vi Goodwin, Permits Coordinator RE: Certificate of Occupancy, Nonremonstrance Agreement, Performance Bond, Landscaping The Building Division has issued a certificate of occupancy on this project at the request of Mr_ . Rogers and John Schmidt, both of whom were anxious to get a tenant into the building on this date. However, two conditions remain to be satisfied: a nonremonstrance agremment and the installation of landscaping. The nonremonstrance agreement required as a condition of approval for this project is in the process of being reviewed by the City Attorney so that it reflects the circumstances that exist at the 72nd Avenue access. Specifically, the SDR 90-0005 applicants cannot close the access .because there is an easement through the access that is intended to provide access to the site to the south. Also, there is a tax lot in the access that is owned by the State Highway Division. Under these circumstances, the applicants cannot be required to close the access since this would put them in jeopardy of being sued by the owners of the property to the south. The City wants a nonremonstrance agreement that states that in the event the access can be closed, the aplicants will not remonstrate against the closure. This agreement should reflect the circumstances that exist so that the applicants are not forced to close an access over which they do not have absolute control . Until the nonremonstrance agreement is signed by the applicants, the City will not allow the release of L. a perfomance bond. The applicant must also install the required landscaping. Key Bank has submitted a letter indicating they are holding $3000 for Mr. Rogers, to be used to complete the landscaping. Mr. Rogers has agreed to have the landscaping installed no later than January 1, 1990 . So long as the $3000 remains available, the rest of the performance bond may be released upon the signing of the nonremonstrance agreement. This will probably take a few weeks because the agreement must be approved by our attorney and Mr. . Rogers ' attorney. This decision is being reissued because it came to the City's attention after the original notice of decision was issued that the SW 72nd Avenue access which appeared to be located on tax lot 700 is actually included in a separate tax ,at (WCTM 2S1 1AC tax lot 701) not under the ownership of the applicants. Because tax lot 701 is not under the control of the applicants, they are unable to satisfy condition a condition limiting the use of this driveway. Therefore, this amended decialon is being issued to reflect this situation (Condition #2) . DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request SUBJECT TO CERTAIN CONDITIONS. The findings and conclusions on which the decision is based are noted below. A. FINDING OF FACT �I 1. Background The subject parcels were annexed to the City in February, 1979 (Boundary Commission File Y 1360) . In 1983 the parcels were designated c-P when the current Comprehensive Plan was adopted by the City Council (ORD. # 83-24) . 2. Vicinity information , The subject parcels are located in the Tigard Triangle on the souheast corner of SW 72nd Avenue and SW Gonzaga Street. Properties to the north, east, and south are zoned C-P. Properties to the west are zoned C-G (General Commercial) and tr -.he northwest R-3.5 (Residential, 3.5 units/acre) . City Universi .y i3 located north of the site and Phil Lewis Elementary School to the went.. Lets east of the site are occupied by single family residences and to the south by office buildings. 3. Site Information and Proposal The site fronts on SW 72nd Avenue, a major collector, and SW Gonzaga Street, a local street. Tax lot B00 is vacant, grass covered, with evergreen trees along the southern boundary and an evergreen hedge alonq the eastern boundary that provides screening ; NOTICE OF DECISION - SDR 90-0005/14IS 90-0003 - LF.E/PAULY/ROGERS - PAGE 1 for nearby residences. A two-story house occupies tax lot 700. The house has been being used for commercial purposes, most recently a housekeeping service, and is to be removed prior to construction of the proposed office building. Vegetation includes several evergreen and deciduous trees and rhododendron bushes. Several trees have been removed in preparation for the construction of the proposed office building. A permit was issued by the City for this purpose. The applicants propose to adjust the lot line between tax lot 700 and 800 to increase the size of tax lot 700 from approximately 17,474 to 20,358 square feet and decrease the size of tax lot 800 from 19,173 square feet to approximately 16,289 square feet. A 5,653 square foot, two-story office building is proposed to be f constructed on tax lot 700. The building footprint is 2,924 square .'set in size. Twenty seven parking stalls (including 2 handicapped ani 4 compact parking spaces) are shown on the site plan. ACCes6 to the site is currently provided from 72nd Avenue by an 18 I foot wide driveway located on the northeast corner of tax lot 700 (identified as tax lot 701) and from an adjacent site to the south by a private drive. A 2.4 foot wide access is proposed from Gonzr.ya Street. It is to be located approximately 100 feet from the intersection of 72nd Avenue and Gonzaga Street. Sidewalks and walkways provide pedestrian access from the parking lot and from Goazaga Street. The applicants propose to landscape approximately 30% of the site. 4. Agency and NPO Comments The F;igineering Division has the following comments: The applicant has submitted a site plan, plot plan, topographic survey and landscaping plan for a proposed office building on the southeast corner of Gonzaga Street and 72nd Avenue. Findings: a. The site fronts onto 72nd Avenue and Gonzaga Street. 72nd Avenue is a major collector and is partially improved with a tapered pavement from 30 to 15 1/2 feet from centerline with a curb. These improvements were constructed in conjunction with the State signal at Hampton Street and 72nd Avenue. Major collector streets standards require 22 feet of pavement from the centerline with a curb and 6 foot sidew lk. Tire existing right-of-way of 30 feet from center is adequate. Gonzaga Street is a local street and is a narrow paved street. Local streeta require 17 feet of pavement from centerline with a curb and 5 foot sidewalk. Half street improvements, typically required for commercial development, should be installed along Gonzaga Street.. NOTICE OF DECISION - SDR 90-0005/HIS 90-0003 - LEE/PAULY/ROGERS - PAGE 2 The Oregon State Highway Division is working on a plan for najor revisions to the interchanges of Highway 217 with I-5 and 72nd Avenue. Two alternatives are currently being considered. Final selection of the design alternative is still several months away. Detailed design will not begin until the alternative selection process is completed. It appears that the interchange reconstruction will require some modification of 72nd Avenue in the vicinity of the subject site. The final d?sign of these modifications will not be available for some time. Therefore, a future improvement guarantee should be accepted in lieu of half- street improvements on 72nd Avenue, as provided in Code section 18.164.030.A.1.c(vi) . b. One access is proposed to 72nd Avenue and one is proposed to Gonzaga Street. Access to major collector streets is discouraged, especially if an alternate access is provided. Since an access is proposed onto Gonzaga Street, the access to 72nd Avenue should not be allowed. C. The site slopes toward 72nd Avenue. On site storm drainage should be collected an site and discharged into the public storm drainage system in 72nd Avenue. d. A public sanitary sewer line exists in 72nd Avenue which can provide service to the site. However, a public sewer line should be in©talled to the east in Gonzaga Street to provide future service to parcels to the east of the site. The Building Division notes that a demolition permit will be required for removal of the existing buildings. NPO M4 reviewed the proposal and expressed concern about the 72nd Avenue access, the increase in vehicular traffic along 72nd Avenue with no provision made for pedestrian amenities, and the long term impacts of allowing commercial development so near the Phil Lewis Elementary School. The Fire District comments that fire hydrants will be required in accordance with the Uniform Fire Code and that installation must be coordinated with the Tigard Water District. The Metzger Water District , General Telephone, Metro Area Communications, and Portland General Electric have reviewed the proposal and have no objections to it. No other comment.s have been received. B. ANALYSIS AND CONCLUSION Section 18. 120.180 refers to the specific chapters of the Community Development Code which must be satisfied in order to gain approval from NOTICE OF DECISION - SDR 90-0005/MIS 90-0003 - LEE/PAULY/ROGERS - PAGE 3 the Planninq Director or his designee for a site develop.rient review. The chzpters referred to contain standards for development in the C-P zoning district, landscaping and screening, off-street parking and loading, visual clearance areas, access, egress, and circulation, and signage. With respect to these standards the proposed development exceeds the requirements for minimum lot size and lot width. No front, corner, side, or rear yard setbacks are required. Visual Clearance Area standards are satisfied. Approximately 308 of the site is to be landscaped (158 is required) and the proposed structure does not exceed the maximum allowable building hE ht. There are several aspects of the proposal that will require mudification or clarification, discussions of these follow. Landscaping and Screening The applicants have submitted a landscaping plan that is not in agreement with the site plan with respect to the layout of the b4illding and parking lot. It is deficient in the number of street trees along 72nd Avenue and Gonzaga Street, there are no trees shown in the parking lot islands, and the ground cover selected for use in the parking lot planters will not sufficiently screen the parking area. A revia,ad landscaping plan must be submitted showing street trees, parking lot screening, and trees to be planted in the parking lot islands in conformance with Code section 18.100 (Landscaping and Screening), in addition to the information shown on the previously submitted site plan. off-street Parking The standards for off-street parking are satisfied as to number of required parking spaces (27 provided, 16 required) and handicapped spaces (2 provided, 1 required) , however no provision has been made for bicycle parking. One secured bicycle rack space must be provided for each 15 required parking spaces. Access, Eqress, and circulation Section 18..108.060 (Inadequate or Hazardous Access) states that access to collector streets shall be considered only if there is no alternative way to access the site. In this case, there is an existing access shown on the site plan to 72nd that the applicants intend to use. However, becaune there is a preferred alternative access on Gonzaga, access on 72nd Avenue will not be permitted. The applicants must submit a revised site plan that reflects the closing of this access. An additional access to the subject site from the adjoining parcel to the south also exists and in depicted on the site plan. The origin of this driveway is unknown. It was riot approved as part of the site development review for the adjacent sites (SDR 45-77) on which it is located. Staff has no objection to the continued common use of this driveway if the access to 72nd Avenue is eliminated. City Univeraity is located north of the site and Phil Lewis Elementary School to the west. Lots east of the site are occupied by single family residences and to the south by office buildings. 3. Site Information and Proposal The site fronts on SW 72nd Avenue, a major collector, and SW Gonzaga Street, a local street. Tax lot 800 is vacant, grass covered, with evergreen trees along the southern boundary and an evergreen hedge along the eastern boundary that provides screening for nearby residence. A two-story house occupies tax lot 700. The house has been being used for commercial purposes, most recently a housekeeping service, and is to be removed prior to construction of the proposed office building. Vegetation includes severe evergreen and deciduous trees and rhododendron bushes. Several trees have been removed in preparation for the construction of the proposed office building. A permit was issued by the City for this purpose. NOTICE OF DECISION - SDR 90-0005/MIS 90-0003 - LEE/PAULY/ROGERS - PAGF 1 The applicants propose to adjust the lot line between tax lot 700 and 800 to increase the size of tax lot 700 from approximately 17,474 to 20,358 square feet and decrease the size of tax lot 800 from 19,173 square feet to approximately 16,289 square feet. A 5,653 square foot, two-story office building is proposed to be constructed on tax lot 700. The building footprint is 2,924 square feet in size. Twenty seven parking stalls (including 2 handicapped and 4 compact parking spaces) are shown on the site plan. Access to the site is currently provided from 72nd Avenue by an 18 foot wide driveway located on the northeast corner of tax lot 700 and from an adjacent site to the south by a private drive. A 24 foot wide access is proposed from Gonzaga Street. It is to be located approximately 100 feet from the intersection of 72nd Avenue and Gonzaga Street. Sidewalks and walkways provide pedestrian access from the parking lot and from Gonzaga Street. The applicants propose to .landscape approximately 308 of the site. 4. Agency and NPO Comments The Engineering Division has the following comments: The applihffflt has submitted a site plan, plot plan, topographic survey . ., and landscaping plan for a proposed office building on the southeast --Vis._-- corner of Gonzaga Street and 72nd Avenue. _,.m' Findings: a. The site fronts onto 72nd Avenue and Gonzaga Street. 72nd Avenue ..au.. is a major collector and is partially improved with a tapered _ pavement from 30 to 15 1/2 feet from centerline with a curb. These Improvements were constructed in conjunction with the State signal at Hampton Street and 72nd Ave,iue. Major collector streets standards require 22 feet of pavement from the centerline with a curb and 6 foot sidewalk. Tho existing right-of-way of 30 feet from center is adequate. Gonzaga Street is a local street and is a narrow paved street. Local streets require 17 feet of pavement from centerline with a curb and 5 foot sidewalk. Half street improvements, typically required for commercial development, should be installed along Gonzaga Street. The Oregon State Highway Division is working on a plan for major revisions to the interchanges of Highway 217 with I-5 and 72nd Avenue. Two alternatives are currently being considered. Final selection of the design alternative is still several months away. Detailed design will not begin until the alternative selection process is completed. It appears that the interchange reconstruction will require some modification of 72nd Avenue in the vicinity of the subject site. The final design of. these NOTICE. Therefore, a future improvement guarantee should be accepted in lieu of half- street improvements on 72nd Avenue, as provided in Code section 18.164.030.A.1.c(vi) . b. One access is proposed to 72nd Avenue and one is proposed to Gcnzaga Street. Access to major collector streets is discouraged, especially if an alternate access is provided. Since an access is proposed onto Gonzaga Street, the access to 72nd Avenue should not be allowed. C. Th-a site elopes toward 72nd Avenue. on site storm drainage should be collected on site and discharged into the public storm drainage system .in 72nd Avenue. d. A public sanitary sewer line exists in 72nd Avenue which can provide service to the site. However, a public sewer line should be installed to the east in Gonzaga Street to provide future service to parcels to the east of the site. — The Building Division notes that a demolition permit will be required for .removal of the existing buildings. NPO #4 reviewed the proposal and expressed concern about the 72nd Avenue acceno, the increase in vehicular traffic along 72nd Avenue with no --�-� =- provision made for pedestrian amenities, and the long term imparts of ��►�--� allowing commercial development so near the Phil Lewis Blementary School. \ -+� The Fire District comments that fire hydrants will be required in accordance with the Uniform Fire Code and that installation must be coordinated with the Tigard Watar District. The Metzger Water District, General Telephone, Metro Area Communications, and Portland General Electric have reviewed the proposal and have no objections to it. No other comments have been received. B. ANALYSIS AND CONCLUSION Section 18.120.180 refers to the specific chapters of the Community Development Code which must be satisfied in order to gain approval. from the Planning Director or his designee for a Bite development review. The chapters referred to contain standards for development in the C-P zoning district, landscaping and screening, off-street parking and loading, visual clearance areae, access, egress, and circulation, and signage. With respect to these standards the proposed development exceeds the requirements for minimum lot size and lot width. No front, corner, side, or rear yard setbacks are required. Visual Clearance Area NOTICE OF DECISION - SDR 90--0005/MIS 90-0003 - LES/PAULY/ROGERS - PArE standards are satisfied. Approximately 30% of the site is to be landscaped (15% is required) and the proposed structure does not exceed the maximum allowable building height. There are several aspects of the proposal that will require modification or clarification, discussions of these follow. Landscaping and Screening The applicants have submitted a landscaping plan that is not in agreement with the site plan with respect to the layout of the building and parking lot. It is deficient in the number of street trees along 72nd Avenue and Gonzaga Street, there are no trees shown in the parking lot islands, and the ground cover selected for use in the parking lot planters will not sufficiently screen the parking area. A revised landscaping plan must be submitted showing street trees, parking lot screening, and trees to be planted in the parking lot islands in conformance with Code section 18.100 (Landscaping and Screening), in addition to the information shown on the previously submitted site plan. Off-street Parking The standards for off-street parking are satisfied as to number of required parking spaces (27 p,rtw4,ded, 16 required) and handicapped spaces (2 provided, 1 required)} bsstever no provision has been made for bicycle parking. One secured bicyele rack space must be provided for each 15 required parking spaces Access, Egress, andCirculation _ Section 18.108.060 (Inadequate or Hazardous Access) states that access to collector streets shall be considered only if there is no alternative way to access the bite. In this case, there is an exieti% access shown on the site plan to 72nd that the eppli.'�ants intend to use. However, because there is a preferred alternative access on Gonzaga, access on 72nd Avenue will not be permitted. The appl+.cants must submit a revised site plan that reflects the closing of this access. An additional access to the subject site from the adjoining parcel to the south alarm existe, and is depicted on the site plan. The origin of this &-iveway is unknown. It was not approved as part of the site developmt-.t r—iew for the adi�.:ent site (SDR 45-77) on which it is located. Staff has nu objection to the continued common use of this driveway if the access to 72nd Avenue is eliminated. Outdoor Lighting The site development plan does not show the location of outdoor lighting as required by Section 18.120.110. The applicants should include this information on the revised site plan.
