Dear Mr. and Schubert:
This letter is written to clarify your concerns i-egardiog code requirements as it permins
to fencing and an accessory structure on your prop°arty and adaitionally, the City of
Tigard's stance on a property line dispute with the ow�Ar of land adjacent to yours.
First, your property described as 1 S ,*36AA-00802 (map and tax lot number) was I
originally developed in Washington County. When the proryerty was annexed into the
City of Tigard, it was designated as a R-4.5 zone. In the annexation process, the City
of Tigard aces not require 'he property owner to adapt to the requirements of the newly
designated zone, but in the case where a difference in zone requirements occur, the City
of Tigard recognizes thorn as non-confo-ming. Adoption of the existing zoning.
requirements would only be necessary i,i case of replacernr:nt. Therefore, the accessory
structure now existing on your property is not required to confo,m to R-4.5 setback
dimensions. Fences in the City of Tigard are allowed to be built ON the property line.
As far as the property line dispute with the owner of 1 S136AA-OG900, this is a civil
matter, which should be resolved with the assistance of Washington Gounty recorded
documents and independent surveys. The City of Tigard does not concern itself with
these issues, but relies upon properly recorded documents, the oldest of -ourse having
precedence in establishing the correct property lines. It appears that concerns you
mentioned rega►ding an encroachment issue was addressed in a document recorded on
February 24, 1957.
