APPLICATION. A request for minor land partition Ppproval to divide a parcel of
approximately 33,000 square feet into 2 parcels of approximately 24,4:16 and
8,564 square feet. ZONE: R-4.5 (Residential, 4.5 unite/acre) . LOCATIOP': 7017
SW Maple Leaf Street (WCTM 1S1 36AA tax lot 6700) .
DECISION: Notice is hereby given that the Planning Director's designee for the
City of Tigard has APPROVED the above described application SUBJECT TO CERTAIN
CONDITIONS. The findings and conclusions on which the decision is based are
noted below.

A. FINDING OF FACT
1. Background
Th subject property was annexed to the City in September, 1987
aloiig with a large number of other properties in the northeast
Metzger area. In June, 1989, the Planning Commission approved a
request to subdivide a 3.41 acre parcel into 6 late between 7,917
and 44,058 square feat in size. In August, 1989 approval of
Subdivision S 89-06 allowed the c -eation of 7 lots instead of 6.
2.. Vicinity Information
Surrounding properties in all directions are also zoned R-4.5. The
majority of these have been developed as single-family residences
on varying amounts of acreage.
3. Site Information and Proposal Description
The site abuts SW 71st Avenue at the intersection of 71st and
Maple Leaf. There is an existing dwelling, a garage, and an
outbuilding it the approximate center of the lot. In the vicinity
of the propost;id partition there are 3 trees: a maple, an apple,
and an oak.
The applicant proposes to partition this 33,000 square foot parcel
into 2 parcela to accommodate the construction of a single-family
dwelling. The parcel to be used for the new dwelling in proposed
to be approximately 8,564 square feet in size and is located on the
southern portion of the parent parcel, the remaining 24,436 square
parcel will contain the exi.sti.nq residence.

4. Agency and NPO C3mments
The Engineering Division has the following comments:
The applicant proposes to divide a 0.76 acre residential parcel
along SW 71th Avenue into two parcels.
Findings:
a. The applicant hau submitted a site map showing the existing
house and a proposed house as well as a proposed sanitary
sewer service lateral.
b. The parcel was created by a previous subdivision application
(S89 -06/VB9-18) .
C. Each parcel abuts SW 7lot Avenue. The required public right-
of-way dedication was provided by the previous subdivision
application. The previous application also required a
nonremonstrance agreement for the formation of a futu• e local
improvement district formed to imprc.e SW 71st Avenue. The
nonremonstrance agreement has not been provided.
d. SW 71st Avenue is an unimproved local street. Subsection
18.164.030.A of the Code permits the Director to accept a
future improvement guarantee in lieu of street improvements on
property zoned residential. if the proposed land Partition does
not create any new streets. The existing street has a low
volume of traffic, and is adequate for emergency vehicle
access. No right.-of-way on the opposite side of SU 71st
Avenue has been dedicated. Additional paving would be
required to connect an improved street frontage to a paved
street. Moreover, the area surrounding the site is nearly
fully developed with streets without curbs and sidewalks;
consequently, a future improvement guarantee in lieu of street.

The proposed connection will require a separate permit.
f. Storm drainage is provided by an existing culvert crossing SW
73.st Avenue.
The Building Division notes that the utilities '.or the existing
house must be located and, if they cross new property lines,
easements must be provided. The applicants should be required to
submit a plan showing the location of the utilities.
The Metzger Water District notes that service must be extenders from
a 6 inch line in SW 71st Avenue.

Cableviaion, and U.S. West have reviewed the proposal and have no
objections to it.
No other comments have been received.
B. ANALYSIS AND CONCLUSION
The proposal satisfies the minor land partition approval criteria of
Section 18.162.040 of the Tigard Community Development Code. The
proposal conforms with the City's Comprehensive Plar; and complies with
statutory and ordinance requirements and regulations. Adequate public
facilities are available to serve the proposal, the proposed lots }
exceed the 7,500 square foot m-'nimum lot size and other dimensional
reiuirem6nts of this title. All proposed improvements meet City and
applicable :agency standards.
The applicant is advised to contact the Tigard Water District concerning
the extension of the waterline from 71st Avenue.
C. DECISION
The Planning Director's desicnee for the City of. Tigard approves MLP 90-
0009 subject to the following conditions:
COIiDIITONS 1 THROUGH 3 SHALL BE MET PRIOR TO RECORDING THE MINOR LAND
PARTITION WITH WASHINGTON COUNTY, CONDITIONS 4 AND 5 SHALL; BE MiT PRIOR
TO OBTAINING A BUILDING PERMIT, AND CONDITION 6 SHALL BE MET PRIOR TO
OCCUPANCY.
1. The agreement required by the previous application (S89-06/V89-18)
in which the applicant waived the property owner's right to oppose I
or remonstrate against the future local improvement district formed
to improve SW 71st Avenue, shall be referenced on and shall become
a part of all applicable parcel deeds. STAFF CONTACT: Greg Berry,

2. A partition survey plat and an outbound aescription shall. be
submitted to the Engineering Division before recording. STAFF

3. The applicant shall submit_ a plan ehowinc, the location of the
utilities that serve the existing buildings and provide easements
for any utilities that cross property linea- STAFF CONTACT: Brad

4. An erosion control plan shall be provided as pari, of the buildir.g
permit. The plan shall conform to "Erosion Control Plans-

5. A tree removal permit shall be obtained prior to the removal of any
trees with a diameter of 6 inches or greater at 4 feet in height.

paved area at least 10 feet wide shall be constructed to serve the
