4. Traffic control must be provided for by contractor.
5. Erosion control must be provided for by contractor.
6. The roadway shall not be closed to through traffic, at any time.
7 . The existing driveway approach is not in conformance with City Standards
and Specifications . Because of its reversed fall, stormwater from the
public roadway may enter onto private property. Also, because of its
revered grade, it will be abnormally depressed below the longitudinal
grade of the proposed to be constructed sidewalk. Therefore, applicant
shall either reconstruct the existing non-conforming approach, at the time
of sidewalk construction, to meet City Standards, or applicant shall
provide an executed/notarized document to the City acknowledging
appli-ants full and sole responsibility/liability (and shall save the City
and its employees harmless) for any and all claims to persons or property
which may arise from applicant electing to not reconstruct the approach to
City Standards and Specifications, at the time of sidewalk construction.
Said document shall also provide for (approach reconstruction) right-of-
entry agreement and agreement to not remonstrate against formation of a
local improvement district, or inclusion of approach reconstruction
therein should such be deemed desirable, in the future.
