Dear Ed:
The purpose of this letter is to explain a recent decision made regarding the
Newport Bay restaurant project and to explain the sequence of events leading
to this decision.
June 24, 1995, Brad Roast and I conducted a framing inspection of the Newport
Bay project. Due to the contractor requesting a change of materials, the
question came up whether or not this building was to be type V-one-hour con-
struction. Upon returning to our respective offices, both Brad and I examined
our sets of submitted plans to discover, in fact, the architect had called out
on the plans the occupancy classification to be A-2.1 and construction type V-
one-hour. prior to this discovery, orad had referred to the issued building
permit which identified the building as construction type V-N and occupancy
classification of B-2 . in addition, the contractor had proceeded with con-
struction with the understanding that the City considered the building to be
type V-N.
June 27, 1985, a meeting was held at the project site to discuss the building
classification and construction type. Those attending were:
- Al Fleenor (Restaurant owner)
- Ralph Bonadure (Architect)
- Mark Colord (Contractor)
- Brad Roast ( Tigard Building Inspector)
- Marie Williams (Deputy Fire Marshal )
Per the adopted 1982 Structural Specialty Code and Fire and Life Safety Code,
the buildi.-,y occupancy classification was to be A-2.1 , thus requiring a minimum
construction type of V-one-hour.
Our discussion led us to the conclusion that some alternate to the orle-hour
construction would have to be agreed upon. Considerable construction progress
had already been made on this project.

which imposes the least amount of financial burden upon the owner and which we

The building owner will provide the following:
a) Combination of smoke and heat detectors throughout the building,
b) Manual fire alarm pull stations at exits,
c) U.L. approved central station supervision on both detectors
and pull stations and,
d) Installations to comply with NEPA Standards for alarm systems.
Rationale:
a) Smoke detection and alarms provide early warning for occupants
to exit building.
b) Supervised systems provide early notification to fire department
for protection of property.
c) Established occupant load was less than 10 percent over 300.
d) Exiting from this building is more than adequate.

A meeting was conducted at the site on June 27, 1185. Attending was Al
Fleenor (Restaurant Owoer), Ralph Bonadure (Architect), Mark Colord (General
Contractor), Marie Williams (1.R.F.D.).
It a purpose was to clear up confusion as to the occupancy classification and
type of construction required.
Because of an occupant load of over 300 was determined, the building was to be
an A 2.1 Occupancy, requiring a minimum type V—one hour construction
(Architects plans indicated same).
The building permit was issued indicating a B-2 occupancy, V—N construct-ion.
It was with that understanding construction proceeded.
Upon discovery of the error there was considerable progress (time, material
and labor) on construction.
A discussion took place to resolve the problem with minimal impact on the
building owner and keep with the intent of the code.
It was decided in lieu of 1 hour construction a products of combustion
detection system (fully supervised, with pull stations) would be a rational
alternate.
Reasoning:
1. Early warning to occupants allows for quicker exit from building.
2. Early notification to fire department provides protection of
building structure.

In regards to our phone conversation on 5/30/85, concerning the Oyster
Bar Cooking Equipment at the Newport Bay Restaurant. As discussed with you,
the cook line wall must be covered with 5/8" Type X fire rated sheetrock and
a 3" air space maintained from the wall to the cooking equipment and hood.
The hood and cooking equipment shall also be protected by an Ansul R-102 fire
protection system.

Dear Ralph Bonadurer:
This is a Fire and Life Safety Plan Review and is based on the 1982
editions of the State of Oregon Structural Specialty Code and Fire and Life
Safety Code (UDC) , the State of Oregon Mechanical Specialty Code and
Mechanical Fire and Life Safety Code (UMC) , Uniform Fire Code WFC) and
other local ordinances and regulations.
Panic hardware is required and shall be mounted at a height of riot less
than 30 inches nor more than 44 inches above the floor. The unlatching
force shall not exceed 15 pounds when applied in the direction of exit
travel . UDC 3304(4)
Service the hood fire exti�,guishing system. This appliance must be
serviced every six (6) months or immediately after discharge, whicheve►
occurs first. Servicingg must be done by properly trained and qualified
persons. UFC 10.315 (e). Existing system must be serviced prior to any
use.
Provide one 40BC U.L. approved fire extinguisher. UFC 10.301 (a) to be
..ocated specifically in kitchen.
Not less than one (1 ) approved fire extinguisher with rating of not less
then 2-A:10-D:C shall be provided for each 3,000 square feel, of floor area
or fraction thereof. The travel distance to an extinguisher from my
portion of the huildirig shall not exceed 75 feet. UFC Standard 10-1
Approval of submitted plans is not an approval of omissions or oversights
by this office or of non-compliance with any applicable regulations of
local government.
Submitted plans are approved for construction subject to the above noted
items.
