Dear Joe:
The aformentioned three (3) sewer lines are of a physical condition satisfactory
to the City. Therefore, after receipt of copies of recorded sewer easem.nts
(from you) covering the routing of said sewers across private properties, we
will act to accept same via our usual Council acknowledgment procedure. I
would suggest that you have your original design engineer assist you in de-
termining which easements are necessary, by preparation and submittal of an
'easement location/sewer routing' drawing and the said copies. *
` Further, with regard to the pressure line from thJ pump station to Kerwood
Subdivision, our three--party contract agreement calls for acceptance by U.S.A. ,
not by the City, upon satisfactory completion. Therefore, I suggest that
contract them, therein- regard (written) acceptance ackncwledgement.
* An as-built mytar of the "C"/"C-3. L ' sewer line needs to be provided to
the City by said engineer also.

Request for approval of the phase I apartment complex
within the "Summerfield" development.. Subject site
is located approximately 1000 feet. Past of the existing
"gatehouse" and between S.W. Durh�im Road and S.W.
Summerfield Drive.

A. Brooks presented the staff findings relevant
I to this case which included a printed summary

this item.
Staff Recommendation

A . Brooks gave his recommendation for approval which
included a list of sir conditions.

Testimony
A. Ray Bartel , the project architect , stated his
agreement with the staff recommendation with the
exception that the curbs be painted yellow for
the extent of the main traffic lane. In addition
he thanked the staff for the opportunity to meet
with them prior to the Planning Commission meeting
to discuss the proposed project and work toward a
solution to the previous problems cited by the
Planning Commission.

B. Fred Anderson questioned the wording of the staff
recommendation stating that no parking will be
allowed in the main traff.i =: lane. He said this
wording may lead to some difficulty in .interpretatio
at a later date and suggested that the wording be
changed to main roadway.

C. Whittaker recommended that rather than refering
to the traffic lane as the main roadway that
wording bj added to thL condition that no parking
I be allowed as designated on exhibit "A; and the
site plan be thusly marked.
D. Whittaker asked if any provision could be made to
enforce the no parking requirement.
E. Brooks said that there is no way for the city to
enforce a no parking requirement on this traffic
lane.
F. Fred Anderson said that an easement could be
required for the traffic lane and the City could
pass an ordinance precluding parking on the private
streets in the development.
G. Whittaker asked fir. Anderson if the Planning
Commission could act with a condition of their
approval that such an easement be granted.
Commission DiSCLISsion and Action
A. Parkhurst moved to approve the submitted ccncept
plan according to the staff recommended conditions
amended by the staff as follows :
1. The main traffic lane as described in exhibit
"A" shall be a paved surface 2.8 feet wide,
except at the entrances to S.W. Summerfield
Drive where said main traffic lane 'shall he
24 feet wide for a lista,ice not to exceed 60
feet from the right-of-fray of S.W. Summerfield
Drive. Access to the main Traffic lanes from
S. W. Summerfield Drive shall be over driveway I
aprons constructed to City staidards„
2. No more than 60 apartment units roay be constructed
upon and utilize a main iiaffic ;.ane as described
by exhibit "A", unless an emergnricy access has
been ranstrur: .ed to allow the moveme,it of
emergency vehicles onto the main traffic lanes
at or near the termini of the main traffic
lanes as shown on the approved concept plan.

3. No vehicular backing movements shall be
allowed directly into the main traffic

4. No parking shall occur within any portion of
the main traffic Lane as described by exhibit

stated his concern about the mechanics of
setting up the proposed easement and stated his
objection to the City Attorney ' s statement
that he was opposed to the original motion as '
a point of law.
J. Ray Bartel stated that no parking was .indicated
on the original exhibit showing the main traffic
lane and that no parking is the desire of the
developer. Bartel stated the concept itself,
wh,.ch .includes parking bays will ineffect prevent
on--street parking.
K. Joe Greulich of the Tualatin Rural Fire Protection
District, suggested that the traffic lanes be
named and the units be numbered according to the
metropolitan numbering system to facilitate the
Fire District locating a premise duri.nq an
emergency.
L. The Planning Commission voted on Hartman ' s motion
for amendment and it passed by majority vote
with Barkhurst voting no.
M. The Commission then voted an Barkhurst ' s motion
and it F _ssed by a majority vote of the memebers

N. Following the Planning Commission ' s action, Joe
Greulich asked to be recognized and asked the
Planning Commission if they weren ' t taking a
step backward by allowing a 28 foot access drive
to serve 5000 square foot 2 story buildings.
0. Whittaker replied that the area in question is
part of a planned development where age restriction
have been imposed. This .is therefore a unique
circumstance and the Planning Commission is not
hereby establishing a precedence for all. multi-
family development within the City of Tigard.

development. He then stated that if the Planning
Commission were going to require all. of the
standards normally required in an apartment complex,
as suggested by the fire marshal , that their is
no reason for the city having a P-D zone.
B. Brooks replied that the standards under consider-
ation here are those affecting the public safety
and that it is his belief that these standards
should oot be varied.
C. Joe Greulich, Fire Marshal , stated the need for
wider streets for fire fighting purposes. He said
this is both to allow vehicles to reach a fire
it Gong-sted areas and also to provide a break
be-Lween fires and a place for fire f.tghters to
take a stand against a fire,
D. Whittaker said that the point of the issue, as
he sees it, is public safety and there does not
appear to be any disagreement on the land use
aspbct of the submitted site development plan.

public health safety and welfe- e.
F. Sakata moved to deny the Summerfield Phase I
apartments as submitted. Frazier seconded and

concept was reviewed and Approved by the Planning Commission
on October 2, 1973.

to present the changes proposed in the appro%ed site plan.
These changes were made necessary by the inability of the
Tualatin Development Company to purchagn a key parcel

requirements of the P.-D zonn he met and that an emergency
access route be provided from Durham Road.
