WHEREAS. the City executed a Sanitary Sewer Compliance Agreement dated November 21 , 1978, with AMART DEVELOP',1ENT COMPANY, TNC. to install a public sanitary sewer line, and appurten.:nces thereto, to specified standards; and WHEREAS, the Public Works D -partment has now issued certification that al.l. Lerms and conditions specified by said agreement have been satisfactorily completed, and WHER"AS, the required performance bond has remained in full fore,- and efL^ct throughout the normally required maintenance periof �f one year, and NOW, THEREFORE, RE LL RESOLVED that the City Council of the City of Tigard, Oregon, terut-v accepts the public- sanitary sewer improvements, generally located between F.W. 121st and 130th Avenues northerly of S.11. Katherine Street , known as the Lateral "A" - Scholls Trunk Sonitary Sewer. Extension. AND FURTHER, the City Council. herein authorizes release of the previously submitted performance bond therefor. I believe that the City still has in force the performance bond for its construction. Obviously, the Owner would like to have this project "accepted" by the City and, therefore, withdraw the bond. Due to the approxi.nate year and one-half since completion, we are requesting ;:hat this time serve as the maintenance period and that the City accept this scewer line.
