That construction of the proposed sanitary sewerage improvement shall not commence until posting of a 100% performance bond, payment of public improvement plan check and inspection fees and execution of (and City acceptance of) a construction compliance agreement occurs. Page 1 - SL2-85/V3-85 2. That construction of the proposed sanitary sewerage improvement shall occur between April 30th and Octoler 1st, 1985 , at the discretion of the City Engineer. 3. That: erosion controls be applied throughout the course of construction and, further, that a temporary (before and during construction) and permanent (after construction) erosion control plan be submitted to and approved by the City Engineer, prior to commencing improvement work. 4 . The homesites shall be situated above 140 feet in elevation. Development other than that approved by this action shall require a separate sensitive lands approval. 5. The land within the 100 year flood plain for the Tualatin River shall be dedicated to the public for greenway purposes. The flood plain boundary shall be surveyed and the land below 128+ feet in elevation shall be cedicated. A 20-foot wide area around the dam shall be excluded from this dedication to allow for continued private maintenance of the facility. That a joint use agreement be executed, recorded, for common use of and maintenance of the proposed driveway by each affected party. 2 . That visual clearance be provided and maintained at tY.e inter- section of the driveway with SW 108tY. Avenue, in accord with City code. 3. That vehicular access be provided to within fifty feet of the rearmost structure and, that the driveway be of an ail weather material . The initial 18 foot portion of the driveway adjacent to 108th Avenue, shall be of asphaltic concrete. 4 . A City Street Opening Permit shall be obtained by the applicant prior to commencing work on the driveway connection to SW 108th Avenue ; posting of a 100% performance bond and payment of a 4% permit fee is required. 5. It has, therefore, been considered to be a significant open space, water shed and wetland area; and it includes all of the land designated as floodplain, approximately 35 acres . This low lying area is primarily covered with deciduous trees and underbrush with a few marshy areas. It provides a habitat for a variety of small animals and birds while providing a unique open space resource. In some of the areas, the property owners have maintained the area as lawn, ' This natural area also functions as a drainageway primarily during the months of higher water concentration. Many of the slopes going into the area exceed 15%, and adjacent to the mobile home park the reinforced slopes are a minimum of 25 percent. The actual floodplain area is less area than the entire resource area. The Tigard Comprehensive Plan indicates that the areas surrounding this resource will be developed for Low Density Residential uses (1-5 units per acre), except for the mobile home park which is already developed at a Medium Density Residential use (6-12 units per acre) . These uses may conflict in some ways with the preservation of this resource. If the entire resource is preserved, there may be a loss of buildable lands, fewer dwelling units, and additional development costs . On the other hand, land and amenity values might be enhanced, dwellings buffered from other dwellings, and local open space generated. If the conflicting use is allowed unaltered, there may be a loss of wildlife habitat, lower water quality, and additional costs of modifying the area. The staff recommendation for this Goal NS is that the floodplain and the entire ravine area below the 150 foot elevation mark be preserved in their natural condition, including topography and vegetation. Density transfer from the site will be allowed up to 75% of the density allowed within the rp3ource area. Parcels containing any of the resource site will be required to develop under an approved Sensitive Landq permit and the standards set forth in the Community Development Code K Durham Elementary School The Durham Elementary School was determined to be a significant historic structure. W I T N E S S E T H: 6HEREAS, Petitioner has applied to the City for approval of construction of a sanitary sewer, to be known as __Lhc._Phil.lip5__S,�t.gr}_ Sewer Extension being within the boundaries of an area as described on the attached Exhibit "A" 6 "fi" and by reference made a part hereof; and WHEREAS, the City of Tigard requires applicants for construction of gewers, and appurtenances thereto, to submit to construction inspection, and testing therewithal, to grant public easements, therefor, and requires the payment of fees; and WHEREAS, the City has approved and adopted the standard specifications for Public Works construction by APWA, Oregon Chapter-, and the Unified Sewerage Agency specifications for sanitary sewers prepared by professional engineers for Public Works construction; and WHEREAS, the public improvements required to be constructed are incomplete, but petitioner has nonetheless requested that the City permit granting of the property to the public, and the parties herein named desire to • protect the pubic interest generally to assure the public improvements will be installed as required and completed within the time hereinafter set forth. NOW, THEREI-ORF, in consideration of the foregoing premise and the covenants and agreements to be kept and performed by the Petitioner and its contractor and contractors surety, IT IS HEREBY AGREED AS FOLLOWS: 1 Petitioner shall proceed to complete all public improvements as shown on herewith improvement plan, as approved by the City of- Tigard and prepared by. In the event that such action be brought, the Petitioner and the Petitioner' s surety shall be required to promise and agree to pay, in addition to the amounts accruing and allowable, such sum as the, court shall adjudge reasonable as attorney' s fees and ( ost incurred by the City, both in the Trial Court and Appellate Court, if any, or the City may at, its option bring proceedings to enforce against the Pet.it.iuner and/or Petitioner' s surety, specific performance of the contract and compliance with the standards adopted by the City of Tigard, and in any event, in a like manner, the City shall be entitled to recover such sums as the court may adjudge reasonable for the City's attorney' s fees and cost, both in the Trial Court and and Appellate Court, if any. 4. Petitioner, concurrent with the execution hereof, agrees to pay the following fees as required by Unified Sewerage Agency Resolution and Order No. 70-12: a. A plan check fee to cover the cost of review and approval of construction plans and inspection of sewer construction (except house connections) in the amount of $ 297.50 • b. A permit fee to cover the cost of processing the permit application and performing the inspection of property connection(s) in the amount of $ C. A connection charge to connect directly to an existing sanitary sewer, which was installed with/without (strike inapplicable word) cost to the Petitioner, in the amount of $ N.A. d. A monthly sewer service charge for the use of the public sanitary, sewer system. 5. Petitioner, concurrent with the execution hereof, also agrees to pay a surcharge in the amount of $ N/A as required by that certain contract entered into by the City with N/A for the reimbursement of sewer construction costs pertinent thereto 6 . Section 2: Chapter 18.84 of the Community Development Code shall be amended by adding a Section 18.84.045. Language to be added is underlined below and will be inserted after section 18.84.040 D. 4. "18.84.045 Exceptions for Development in the 108th/113th Ravine Significant Wetlands Areas. A. Under the Sensitive Lands Permit process, the Hearings Officer may allow portions of the Ravine at 108th and 113th designated as a significant wetlands area to develop provided that all of the following criteria are met. 1. All of the land (within the ravine) being considered for development is at less than 25% slope. 2_ There are no unstable soil conditions on the land being considered for development. 3. The provisions of chapter 18.150- TREE REMOVAL shall be met Section 3.
