INFORMATION SUMMARY
1 . TF,,e "Meadow Creek Commercial (Sewer) Extension" project is located
parallel with, adjacent to, and east of SW North Dakota Street, near
SW Scholls Ferry Road. It consisted of a northerly extension of the
sanitary sewer, system to provide service to the multi--family units
recently constructed thereat and to facilitate future service availability
to the commercial parcel at the intersection of Scholls Ferry Road with
Dakota Street.
2 . Completion of the aforesaid sari i tary s owe r, line extension has
satisfactorily occurred and the work has satisfactorily passed its
required guarantee period,
3 . Staff has prepared and recommends passage of the attached resolution.
ALTERNATIVES CONSIDERED
None, Our Compliance Agreement stipulates City acceptance upon the
developer' s satisfactory completion of all. requirements ,
FISCAL IMPACT
Operation and maintenance responsibility for the sewer line improvement will
pass from the developer to the City of ligard.
SUGGESTED ACTION
PASS THE RESOLUTION TITLED: A Resolution accepting public improvements known
as Meadow Creek Commercial (Sower) Extension.

RESOLUTION NO. 87-
A RESOLUTION ACCEPTING PUBLIC IMPROVEMENTS KNOWN AS MEADOW CREEK COMMERCIAL
(SEWER) EXTENSION.
WHEREAS, the City executed a sanitary sewer Compliance Agreement dated
March 8, 1985, with S & J Builders, Inc. , to facilitate installation of a
sanitary sewer line to specified standards and specifications; and
WHEREAS, said Compliance Agreement stipulated that:
"At such time as all public improvements have been completed in accordance
with the City' s requirements, Petitioner shall notify the City of
readiness for final inspection a.nd upon certification by the Department. of
Community Development that all requirements of the City have been met , the
Council agrees to accept said improvements, for operation and maintenance
responsibility, and release the Petitioner' s guarantee bond"; and
WHEREAS, Department of Community Development staff vorifies that all
requirements of the City have been met; and
NOW, THEREFORE, BE IT RESOLVED by the 'Tigard City Council that:
The Tigard City Council hereby accepts the public improvements known as Meadow
Creek Commercial (Sewer) Extension;
AND, FURTHER, the City Council hereby authorizes release of the Petitioners
guarantee bond.

MINOR LAND PARTITION (MLP 2-85)
APPLICATION: Request by IS 6 J Builders to divide a 21.38 acre parcel into two
parcels of 5.81 and 15.57 acres each on property zoned C-P (Commercial
Professional) and R-25 (Residential, 25 units/acre) .and located west of 121st
Ave. and south of Scholls Ferry Rd. (Wash. Co. Tax Map 1S1 348C, Tax Lots 400
and 401) .
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certain
conditions. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
1. background
The Comprehensive Plan adopted in 1983, designated 'he northern
section of the property for Commercial Professional at,: the larger
southeri portion for Medium-High Density residential use. Site
Development Review approval for a 304 unit apartment complex on
the southern segment of the property was granted in 1984 (SDR
22-84) and construction has begun on this project. A
Comprehensive Plan Amendment/Zone Chan;;e application to modify the
designation of the northern section of the parcel to Commercial
General (CPA 3-85/ZC 3-85) is being reviewed by the City.
2. Vicinity Information
The Greenway Town Center and Scholls Ferry Road Lie to the north,
an cndevelaped phase of Summerlake (zoned R-•7PD) is to the west,
an undeveloped parcel zoned R-7PD is to the south, and Woodspring
Condominium- lie to the west. An unimproved 40-foot wide road
right-of-way is situated between the subject property and the
condominiums. The areas to be east and west are "Ertabitshed
Areas" as identified in the Comprehensive Plan.
3. Site Information and Proposal Description
The southern portion of this "L" shaped property is in the initial
stages of construction and the northern section i.,; undeveloped.
The applicant proposes to divide the property into two parcels In
a manner that coincides with the two zoning designations which
apply.
4. Agency and NYU Comments
The Enginee.ing Division has the following comments:
a. Additional rigiit-of-way should be dedicated along the
Scholls Ferry Road frontage for a total right-of-way width
from centerline of 45 feet.

b. The conditions of approval for SDR 22-84 shall remain in
effect.
c. Half-street Improvements along the Schol.Is Ferry Road
frontage will he required as a condition of development .
The Building Inspection Office has no objection to the request.
No other colnments have been received.
B. ANALYSIS AND CONCLUSION
The proposed partition is consistent with Section 18.162.030 and other
relevant portions of the Community Development Code for the following
reasons:
1. The division is logical relative to the two Plan and zone
designations which apply to the property and it will be ieparated
along the boundary between commercial and residential use.
2. The parcels exceed the minimum lot dimension requirements of the
C-P and R-25 zones.
3. Adequate facilities are available to the site.
C. DECISION
The Planning Director approves MLP 2-85 subject to the following
conditions :
1. AL,L CONDITIONS SHALL BE MET PRIOR TO RECORDING THE PARTITION. THE
SURVEY MAP AND NECESSARY DOCUMENTS SHALL BE SUBMITTED TO THE CITY
FOR APPROVAL. AFTER REVIEW AND APPROVAL BY THE PLANNING DIRECTOR.
THE CITY SHALL RECORD THE PARTLTION WITH WASHINGTON COUNTY.
2. Additional rig'it-of-•way shall be dedicated to the public along the
SW Scholls Fer•ry Road frontage to increase the right-of-way to 45
feet from centerline. The description tor said dediratlon shall
be tied to the existing right-of-way centerline as established by
Washington County. The dedication document shall be on City forms
and approved b the Engineering p( y g veering S«coon.

3. The co- !itfons of approval for SDR 22-84 shall remain in affect.
4. Street Centerline Monumentation
a. ThN centerlines of all street and roadway right-of-ways
shall be monumented before the City shall accept a street
Improvement (SW North Dakota only).

b. All centerline monuments shall be placed in a monument box
conforming to City standards, and the top of all monument
boxes shall be set at design finish grade of said street or
roadway.
C. The following, centerline monuments shall be set :
( 1) All centerline-centerline intersections.
Intersections created with "collector" or other
existing streets, shall be set when the centerline
alignment of said "collector" or other street has been
established by or for the City;
(2) Center of all cul-de-sacs;
(3) Curve points. Point of intersection (P.I. ) when their
position falls inside the limits of the pavement
otherwise beginning and ending points (B.C. and E.C. ) .
(4) All sanitary and storm locations shall be placed in
positions that do not interfere with centerline
monumentation.
5. The "basis o: bearings" for the Plat or Survey shall be C.S.
1120,202 or 19,947, which is a part of the Tigard Field Survey
Network.
6. This approval is valid if exercised within one year of the final
decision date noted below.
D. PROCEDURE
1. Notice_: Notice was published in the newspaper, posted at City
Hall and mailed to:

with Section 18.32.290(A) and Section 18.32.370 of the Community
Development Code which provides ttin t a written appeal must he
filed with the CITY RECORDER within 10 days after notice is given
and sent.

a. LSCA GRANT
City Librarian gave a summary of what was required for the LSCA
Grant. There was concern regarding the square footage that is now
being occupied which is 11 ,400. The grant requires 16,200 square
feet .
Lengthy discussion followed regarding the grant . Council
consensus was to wait until we get into the Civic Center and at
that time with the increased square footage go for the grant.

SANITARY SEWER COMPLIANCE AGREEMENT

between the CITY 01 TIGARD, a municipality of the State of Oregon, hereinafter
termed the "City", and S & J Builders Ltd. , a partnership,
hereinafter termed "Petitioner".
W I T N E S S E T H:
WHEREAS, Petitioner has applied to the City for approval of construction
of a public mainline sanitary sewer, to be known as mo.ido w cr—,k commor-ial
Extension being within the boundaries of an
area described on th'e attached Exhibit "A", and by reference made a
part het-of; and
WHEREAS, the City of Tigard requires applicants for construction of
sanitary sewers, and appurtenances thereto, to submit to construction plan
review, construction inspection and testing, and, further, to provide
performance assurances, to grant public easements and to remit payment of
relevant fees and charges; and
WHEREAS, the City has approved and adopted the Standard Specifications for
Public Works Construction by APWA, Oregon Chapter, and Sanitary Sewerage
rules, regulations and specifications for sanitary sewers via Ordinance No.
84-58 and amendments thereto; and
• WHEREAS, the public sewer improvement required to be constructed by the
petitioner is incomplete, but petitioner has nonetheless requested that the
City permit granting of easements to the public, and the parties herein named
desire to protect the public interest and assure that the improvement will be
Installed as required and completed within the time hereinafter set forth.
NOW, THEREFORE, in consideration of the foregoing premise and the
covenants and agreements to be kept and performed by the petitioner and
petitioners surety, IT IS HEREBY AGREED AS FOLLOWS:
1 . Petitioner shall proceed to complete all public improvements shown on the
improvement plan, approved by the City of Tigard and prepared

said improvement to be completed no later than one (1) year from the date
of this agreement and Petitioner hereby agrees to comply with all rules,
regulations and specifications set forth by the City and, to use only such
materials and to follow such designs as is required to conform thereto.
Petitioner, via a registered civil engineer, shall provide certification
of installation conformance, to the City prior to City inspection of
petitioners improvement work for initial City acceptance.
2. To assure compliance with the City's requirements and the provisions
thereof, Petitioner agrees to obtain, provide and tender to the City, a
sur-sty borrd(s) in form approved by the City, with liability in an amount
equal to the contract price of $ 5, 380.00 prior to City issuance of a
rer•mit or approved construction plans for construction of said
• improvements; Petitioner's contractor shall be licensed, bonded, and
Insured.

i, In the event that the Petitioner shall fail, neglect or refuse to proceed
with the work in an orderly and progressive manner to assure completion
within the time specified, upon ten (10) days notice by the laity to the
Petitioner and the Petitioner's surety, and such default and failure to
proceed continuing thereafter, the City may P' its option proceed to have
the work completed and charge the costs thereof against the Petitioner and
the Petitioner's surety and in the event the same be not paid, bring an
action on said bond to recover the amount thereof. In the event that such
action be ;sought, the Petitioner and the Petitioner's surety shall be
required to promise and agree to pay, in addition to the amounts accruing
arid allowable, such sum as the court shall adjudge reasonable as
att,):ne}•'a fees and cost incurred by the City, both in the Trial G„-jrt and
Appellate Court, if any, or the City may at its option bring proceedings
to enforce against the Petitioner and/or Petitioner's surety, specific
performance of the contract and compliance with the standards adopted by
the City of Tigard, and in any event, in a like manner, the City shall be
entitled to recover such sums as the court may adjudge reasonable for the
City attorney's fees and cost, both in the 'Trial Court and and Appellate
Court, if any.
4. Petitioner, concurrent with the execution hereof, agrees to pay the
following fees and charges:
a. A plan check and inspection fee to cover the cost of City review of
public mainline construction plans and, in the City's interest,
periodic inspection of mainline construction (except building
connections) in the amount of $ 215.20
b. A connection permit fee to cover the cost of processing building
connection permit applications and performing inspection of building
connection(s). Said fee to be determined, levied, and paid prior to
connection of building sewers. to (this) public mainline sewer.

WOVd)x to an existing public mainline sanitary sewer which was
installed without cost 'Lo the Petitioner. Said surcharge to be
determined, levied, and paid (by the Petitioner) in accord with terms

d. A monthly sewer service charge for use of the public sanitary sewer
system.
5. While the City agrees to make periodic inspections as, in the City's
,judgment, is necessary to assure compliance, the Petitioner agrees to
provide certification that the improvement, has been Installed In accord
with City stand .rds and the approved improvement plan; said certification
to be signed by a registered civil engineer.
6. The Petitioner agrees to provide the City with 48 hour advance notice of
.:ommencement of construction and, also, 12 hour advance notice of
requested field Inspections.
• 1. The Petitioner agrees to insure that Petitlooer's engineer obtains
accurate as-built (field) construction records of said sewer Installation
and, also, agrees to insure that the City is furnished with one accurat,..
as-built mylar thereof and, further, with accurate legal descriptions of
all necessary easements.

9. At such time as all public improvements have been L,,mpleted it accordance
with the City's requireme- :s, Petitioner shall submit tare aforesaid
"certificate of installation conformance" to the City to notify the City
of readiness for conditional accc,."ance inspection and, then, upon
notification by the City that all requirements have been met, rF-.
Petitioner will submit to the City a good and sufficient maintenance bond,
in form approved by the City, in a sum equal to twenty percent (20X) of
the contract price to assure correction of any defective work or
maintenance becoming apparent or arising within one year after conditional
acceptance of the public improvements by the City.
10. Upon receipt of certification from the Department of Development Services
that all requirements have been met, and a one year Maintenance Bond, the
City Council agrees to accept the public improvements subject to of
Petitioner's correction of deficiencies, end maintenance, for a period of
one year.
11. That Petitioner, in consideration of ( ity approval of the application to
construct a public sanitary mainline sewer within the boundaries of
easements held by or to be held by ► ie City, does hereby covenant and
agree to save, hold harmless and indemnify the City, its officers, agents
and employees, for and from all claims, demands, damages, and each and
every other obligation that can or could arise from the neglect of
Petitioner, his officers, agents, contrac'Drs and employees, or from
trespass upon property outside of the easement area, including attorney's
fees and costs, if any, necessarily incurred by the City in defending
S against such claims, with the intent and purpose that the City shall be
made whole with respect to any amounts it may be required to pay or be
held liable for in connection with exercise of real or assumed privileges
afforded Petitioner for sewer construction purposes.

Dear Mr. Anderson:
This letter is in response to your letter of March 14, 1984 and our
subsequent meeting wtth Russ Costello of your Eugene Branch. The
Roseburg Urban Sanitary Authority will allow the use of pipe manu-
factured to the ASTM Fr789 specification in applications where we
currently allow the use of PVC pipe meetinv ASTM-D 3034 SDR-35
provided the following two requirements are met:
1) The pipe modulus indicator shall be T-1.
2) The pipe color shall not be a dark earth tone color
(the color can not be red-brown, rust, brown, grey,
etc. ) Approval of the pipe color m.ist be obtained from
our office prior to construction.
We will carefully monitor the first applications of this new pipe in
our system in order to determine whether its continued use is
warranted.

Thank, you for meeting with our engineers and explaining your product
and it' s • informance to the newer ASTM F 789 specification f, poly
(vinyl chloride) (PVC) plastic pipe.
Vie have compared the ASTM D 3034 and AS1•M F 789 specifications and have
concluded that PVC plastic pipe manufactured in accordance to eithor
of these specifications is acceptable for use under the appropriai.E
conditions.
As a result of this review, we have approved PVC plastic pipe manufac-
tured in accordance to ASTM F 789 specifications as an equal to PVC
plastic pipe manufactured in accordance to ASTIM D 3034, SDR 35 spec-
ifications for installation in the City of Portland sanitary sewer
collection system where PVC plastic pipe has been specified or allowed

1. General . Tee fittings shall be provided in the
sewer main for side sewers. All fittings shall be
of sufficient strength to withstand all handling
and load stresses encountered. All fittings shall
be of the same materials as the pipe unless
otherwise approved. Material joining the fittings
shall be of the same materials as the pipe unless
otherwise approved. Material joining the fittings
to the pipe shall be free from cracks and shall
adhere tightly to each joinir.y surface. All
fittings shall be capped or plugged, and gasketed
with the same gaket material as the pipe joint,
fitted with an approved mechanical stopper, or have
an integrally cast knockout lug. The plug shall be
able to withstand all test pressures without
leaking, and when later removed, shall permit
continuation of piping with jointing similar to
joints in the installed lino.
2. Concrete Pipe. Fittings shall be manufactured
integrally and be of class at least equal to that
of the adjacent pipe. Field taps shall be made by
Agency personnel only.
3. Cast Iron and Ductile. Fittings shall be
mechanical or push-on of the class as specified.
Mechanical joint cast iron fittings shall conform
to AWWA CILU a.wA shall be of a class at least equal
to that of the adjacent pipe. Push-on joint
fittings shall be gray iron with body thickness and
radii of curvature conforming to ANSI A21 .10.
4. PVC Pipe. Fittings shall conform to the applicable
portions of the following specifications: ASTM
• D1785, ASTM D2729, AS YM 02466, ASTM 2467, ASTM
