In the matter of the eighteen thousand, four hundred, fifty dollars

allow said bank to release to Mariner Development, Inc. , a portion of the

five dollars ($16,605.00) .
The amount to remain entrusted to Washington Federal Savings Bank as a cash

Dear Mr. Kusyk:
Our recent inspection of the newly constructed improvements has revealed the
following:
(fy The "joint" between the old and new pavement on SW Sattler Street
needs to be sealed and sanded.
(2) Gravel and concrete debris needs to be removed from the new storm
drain facility.
(3) The "bird bath" pond located between the new driveway apron and the
storm inlet, in the driveway off Lakeside Drive, needs to be
eliminated.
(4) The T.V. report for the new sanitary sewer line needs to bc submitted
for final review and approval.
(5) The as-built mylar drawing and the project engineerri certificate of
compliance (copy enclosed) needs to be submitted also.

APPLICATION: A request by Kurt Dalbey (Mariner Development Co., property
owner) for two separate Minor Land Partition approvals to divide two
approximately 16,020 square foot parcels into six parcels of approximately
5,340 square feet each. Also requested are Variances to allow 1) rear yard
setbacks of 10 feet for each of the parcels whereas the R-7 zone requires 15
foot setbacks; and 2) corner yard setbacks of 5 feet for the lots fronting on
Lakeside Drive when the Code requires a 10 foot corner yard setback. Zoning:
R-'/(PD) (Residential, 7 unite/acre, Planned Development) . Location: north
side of Lakeside Drive, west of SW 94th Avenue (WCTM 2S1 11CA, southern two-
thirds of tax lot 1100) .
DECISION: Notice is hereby given that the Community Development Director's
designee for the City of Tigard has APPROVED the above described applications
subject to certain conditions. The findings and conclusions on which the
decision is based are as noted below.
A. FINDING OF FACT
J . Background
Both subject parcels were involved in a previous Minor Land Partition
application (MLP 88-14) reviewed and approved by the City on November 18,
1988. That prior partition created the subject parcels and a third parcel
located to the north which has access onto Sattler Street. No other prior
land use applications regarding these parcels have been reviewed by the
City.
2. Vicinity Information
Properties surrounding the subject parcels are also zoned R-7 (PD) .
Parcels to the east and south are part of the Summerfield planned community
and are primarily developed with attached single family residences. The
parcel immediately to the west is undeveloped. The parcel to the north,
which was involved in the earlier partition application, contains a
detached single family residence on a 17,050 square foot parcel.
Lakeside Drive, adjacent to the subject parcels on the south, is classified
by the City's Transportation Plan Map as a local street. The parcels are
separated from the street itself by a triangular shaped area of public
right-of-way that contains a sidewalk and a significant amount of mature
landscaping.

3. Site Information and Proposal Description
The subject parcels are identically dimensioned, approximately 16,020
square foot parcels. The parcels are currently undeveloped. The parcels
front on Lakeside Drive, although this may not be apparent in the field
because of the beforementioned triangular portion of the right-of-way that
is landscaped and separated from the parcels by a six-foot tall chain link
fence.
The applicant proposed to divide each of the parcels into three
approximately 5,340 square foot parcels. A 24 foot wide private road would
run between the parcels on reciprocal access easements. A 5 foot wide
sidewalk would be located along the western edge of the private road. The
applicant has requested that a variance be granted to the R-7 zone's rear
setback standard of 15 feet to allow portions of the rear of the homes to
be constructed on the lots to be 11 feet from the rear property lines. The
applicant has also requested that the two resultant lots which would front
on Lakeside Drive be allowed to have corner yard setbacks of 5 feet whereas
the R-7 zone specifies a 10 foot corner yard setback. The attached site
plan illustrates the partition layout, private road location„ aad proposed
building locations.
4. Agency and NPO Comments
The Engineering Division has reviewed the proposal and commented that
because requirements for access easements, storm drainage, sanitary sewer
service, and private road and sidewalk construction were specified by ::he
prior partition approval and will apply to the additional. lots created by
the current proposal., the Engineering Division has no objections or further
comments regarding the current application.
The Building Division, Tigard Water District, PGE, Northwest Natural Gas,
and Tigard School District 23J have reviewed the proposal and have offered
no comments or objections.
Washington County Fire District t 1 commented that a fire hydrant must be
located within 500 feet of all portions of the exterior of potential
homesites and that a 20 foot wide unobstructed access shall be maintained
within 150 feet of all exterior portions of the homes. Because of this
3st requirement, the District requeete that the private road be posted to
restrict or limit parking as necessary.
NPO # 6 commented that they did not have any objections with the proposed
partition and variances since the lots and required setbacks would be in
general conformance with the adjacent Summerfield development.
The Summerfield Civic Association has commented that negotiations are
occurring with the developer for inclusion of the lots within Summerfield.
No other comments have been received.

H. ANALYSIS AND CONCLUSION
Both proposed Minor Land Partitions are consistent with the Community
Development Code's partition approval criteria (Code Section 18.162.030) .
All proposed parcels comply with R-7 zoning district minimum lot size and
lot width standards. Adequate access is available to all proposed lots
via the proposed private road. All lots will be adequately served by
sanitary and storm sewers ac well as by other necessary facilities and
services. The proposed partitionq will not preclude future opportur.lties
for partitioning adjacent parcels. The proposed partitionings are
consistent with all appli::able Comprehensive Plan policies and Community
Development Code standards.
'Phe proposed site plan, which does not affect the approvability of the
proposed partitions, would locate portions of the houses within 11 feet of
the rear property :inn whereas the R-7 zone requires a 15 foot rear yard
setback. The site dev;,lopm,nt plan also would locate houses on t.ie lots
fronting on Lakeside Drive within 5 feet of the corner side lot lines
whereas the R-7 zone requires a 10 foot setback. The applicant has
requested Variances to these standards. Code Section 18.134.050 provides
the following approval criteria for Variances to Code standards:
(1) The proposed variance will not be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and standards;
and to other properties in the same zoning district or vicinity.
(2) There are special circumstances that exist which are peculiar to the
lot size or shape, topography or other circumstances over which the
applicant has no control, and which are not applicable to other
properties in the same zoning district.
(3) The use proposed will be the dame as permitted under 'hi , Code and
City standards will be maintained to the greatest extent that is
reae.onably possible, while permitting some economic use of land.
(4) Existing physical, and natural systems, such as, but not limited to
traffic, drainage, dramatic land forms or parks will not be adversely
affectid any more than would occur if the development were located as
specified in the Code; and
(5) The hardship is not self-imposed and the variance requested is the
minimum variance which would alleviate the hardship.
The general purposes of the rear yard setback requirement are to allow for
adequate spacing, air, light, and privacy for residential structures and to
promote a certain degree of uniformity in the appearance of yards in a
neighborhood, In the present situation, the applicant requests that a
valance be granted to allow a specific ham( design to be constructed on
the lotA and also to allow the homes to conform with setback requirementr
applicable to adjacent properties in the Summerfield development.

intrude 4 feet into the standard 15 foot deep rear yard. The remainder of
the rear dimension would conform with the 15 foot standard. Rear setbacks
within the Summerfield development have been established at 10 feet through
the Planned Development/Subdivision review process. The subject parcels,
like the Summerfield development, are designated with the Planned
Development overlay zone. The subject parcels, however, are required to
conform with the underlying R-7 zone's setbacks unless other development-
specific setbacks are established through a Planned Development/Subdivision
review process, as was done in the case of Summerfield, or through a
variance, as is presently requested.
The Planning Division finds that the propooed Variance would not be
detrimental to the above Listed purposes for the rear yard setback
requirement because the slight variance to the required rear yard area
would have a minimal effect on building spacing, air, light, and privacy
for the proposed homes and neighboring properties. No other Code or Plan
Provisions would appear to be detrimentally affected by allowance of the
requested variance. The variance would not alter uses allowed on the
parcels nor will existing physical or natural systems be affected. The
variance would allow the parcels to develop in conformance with adjacent
properties in Summerfield and therefore would promote greater uniformity of
appearance in the neighborhood. In addition, the variance will allow the
developer tc utilize a property right, the ability to establish special
setbacks fo•. a development, that they otherwise would have been able to use
if the division of property had occurred through the Planned Development
process.
Similarly, the Planning Division finds the requested corner yard setback
variance is justified for the same reasons. In addition, an additional
purpose of the corner yard setback to to maintain art adaquate clr,ar vision
area for vehicles ano pedestrians at roadway intersections. In tan present
situation, the wider than normal right-of-way provides area which can be
maintained as an adequate clear vision area thereby making the additional
setback distance required for a corner yard beyond the standard five foot
side yard setback unnecessary. As a condition of approval of the
requested partition, the applicant will need to groom or remove the
vegetation within the right-of-way area to assure that adequate vision
clearance for the intersection is provided. It is important to note that
this condition is in no way related to the corner yard setback varia,ice but
instead results solely from having trees, espe-ially conifers, planted
within a public right-of-way.
C. DECISION

V 89-02 subject to the following conditions:

2. Oite driveway will be permitted to connect with Lakeside Drive to serve
the Iota. Access easements totaling a minimum of 30 feet in width to
a point past lots B and E, and a minimum of 20 feet wide beyond that
point must be recorded along with the partition. A joint use and
maintenance agreement shall be executed on City standard forms for the
driveway. The easements and agreement shall be referenced on and
become part of all applicable parcel deeds. The easement and
agreement shall be approved by the Engineering Division prior to

THE FOLLOWING CONDITIONS SHALL BE MET PRIOR TO THE ISSUANCE OF BUILDING
PERMITS.
3. One driveway will be permitted to connect with Lakeside Drive to serve
all. parcels. Individual access to Lakeside Drive from parcels * and F
is prohibited. The joint driveway shall be a minimum of 24 feet wide
from the public right-of-way past the individual driveways of parcels
B and E and shall be accompanied by a five foot wide sidewalk. Beyond
that point, t- a driveway must be a minimum of 20 feet wi ie and must

4. The driveway must be posted for restricted or limited parkins, in

STREET & SEWER COMPLIANCE AGREEMEM
THIS AGREEMENT dated this _ day of _E oirau=v 19 89 ,
between the CITY OF TIGARD, a municipality of the State of Or gon, hereinafter
termed the "Cit-y", and Mariner Development, Inc.
hereinafter termed "Petitioner",
W I T N E S S E T H:
WHEREAS, Petitioner has applied to the City for approval for dedication
and improvement of a street to be known as `Sattler Street & Lakeside Drive
and for improvement of a sanitary sewer line,as described on the attached
improvement1p an __ , and by reference made a part hereof; and
WHEREAS, the City of Tigard requires Petitioners to install streets,
sidewalks, 4*MAXXXM4W4VNX, storm sewers , sanitary sewers, underground
utilities and other public facilities, as may be necessary, and requires the
payment of fees and posting of applicable assurances; and
WHEREAS, the City has adopted the Standard Specifications for Public Works
Construction Oregon Chapter APWA, for street, storm drain, structure and
related work, and Unified Sewerage Agency Standards and Specifications, for
sanitary sewer construction, prepared by professional engineers, for public
street improvement; and
WHEREAS, the public improvements to be constructed by the Petitioner are
incomplete, and Petitioner has nonetheless requested the City to permit
dedications of the property and granting of easements to the public and the
parties herein named desire to protect the public interest generally by
legally enforceable assurance that public improvements will be installed as
required and completed within the time hereinafter set fort.l
NOW, TN[REFORE, in consideration of the foregoing premise and the
covenants and agreements to be kept and performed by the Petitioner and its
surety, IT IS HEREBY AGREED AS FOLLOWS:
1 . Petitioner- shall proceed with the interit and purpose to complete all
public improvements as shown on the improvement plan, as approved by the City
of Tigard, prepared by Alpha Engineering, Inc. (Portland, OR)
Said improvements to be completed no later than one (1) year from the date of
this agreement, and petitioner hereby agrees to comply with standard
specifications as adopted by the City, or as otherwise be or have been
approved by the Department of Community Development, to comply with all ter-ins
and provisions specified hereinregard this improvement by the Council and
Planning Commission of the City of Tigard, Oregon, and to use only such
material and to follow such designs as mai, 6e required to conform thereto.
Petitioner shall provide certification of installation conformance, and one
as—built mylar, both stamped by a registered civil engineer, to the City prior
to City inspection of petitioners improvomont work for City tentative and
final acceptance consideration.

2 . To assure compliance with the City' s requiremiter, , and the provisions

contractor shall be licensed, bonded and insured.
3 . In the event that: the Petitioner shall fail, neglect or refuse to
proceed with the work in an orderly and progressive manner to assure
completion within the time limited, upon ten (10) days' notice by the City to
the Petitioner and the petitioner's surety, and such default and f-ailore to
proceed continuing thereafter-, the City may at its option proceed to ha.vp the
work completed and charge the costs thereof against the Petitioner and the
Petitioner's surety and in the event the same be not paid, to bring an action
on the said bond to recover the amount thereof. In the event that such action
be brought, the Petitioner and the Petitioner's surety sha11 be required to
promise and agree to pay, in addition to the ?mounts accruing and allowable,
such sum as the court shall adjudge reasonable as attorney's fees and costs
incurred by the City, both in the Trial Court and Appellate Court, if any, or
the City may at its option bring proceedings to enforce against the Petitioner
and/or Petitioner's surety specific performance of the contract and compliance
with the standards adopted by the City of Tigard, and in any event, in a like
manner, the City shall be entitled to recover such sums as the court may
adjudge reasonable for the City's attorney' s fees anA costs, both in the Trial
Court, and Appellate Court, if any .
4 . The Petitioner agrees to provide the City with 48 hour advance notice
of commencement of construction and, also, 12 hour advance notice of requested
field inspections.
5. The City agrees to make and provide periodic and final inspections
which in the City' s interest are desirable to assure compliance herewith, in
consideration whereof the petitioner shall pay the prescribed inspection 'ee
of 4% of the total estimated cost of the construction; said fee being $ 738.00 .
6. The Petitioner agrees to insure that Petitioner' s engineer obtains
accurata as--built (field) construction records of said sewer arid street
installations and, also, agrees to insure that the City is furnished with one
accurate as—built mylar thereof and, further, with accurate legal descriptions
and maps of all necessary dedications and easements . Petitioner shall provide
all necessary dedications and easements, on City forms, to the City.
7 . At such time as the public improvements have been completed in
accordance with the City's requirements, Petitioner shall submit a
"certificate of installation conformance" to the city to notify the City of
readiness for tentative acceptance inspection arid, then, upon notification by
the Department of Community Development that the requirements of the City have
been met, the petitioner will submit to thr, cit.y a good and sufficient
guarantee bond, if not already provided with the performance assurance, form
approved by the City, to provide fur correction 'o( anydefective
tentk or
maintenance becoming apparent or arising within one 1) year
ve
acceptance of the public i.mprovements by the City .

Ia. Petitioner agrees to provide for correction of any defective work
and/or maintenance becoming apparent or arising during the ~. iarantee period as
hereinabove set forth.
9. At such time as all public improvements have been completed in
accordance with the City's requirements, Petitioner shall notify the City of
readiness for final acceptance inspection and upon certification by the
Department of Community Development that all requirements of the City have
been met, the Council agrees to accept said improvements for operation and
maintenance responsibility, and release the Petitioner's guarantee bond.
IN WITNESS WHEREOF, the parties have executed this agreement pursuant to
authority in each of them.

MINOR LAND PARTITION MLP 88-14
ROBERT & LILLIAN HEALEY (Kurt Dalbey, applicant)
APPLICATION: A request by Kurt Dalbey (Robert and Lillian Healey, property
owners) for Minor Land Partition approval to divide a 1.09 acre parcel into
three parcels of approximately 17,050 square feet, 15,988 square feet and
15,988 square feet. Zoning: R-7 (PD) (Residential 7-units/acre, Planned
Development overlay). Location 9490 SW Sattler Road (WCTM 2S1 11CA, tax lot
100).
DECISION: Notice is hereby Riven that the Planning Director's Designee for
the City of Tigard has APPROVED the above described application subject to
certain conditions. The findings and conclusions on which the decision is
based are as noted below.
A. FINDING OF FACT
1. Background
No previous land use applications regarding this particular property
have been reviewed by the City of Tigard.
2. Vicinity Information
Properties to the east , south, and west of the subject parcel are also
zoned R-7 (PD). Parcels to the east and south are part of the
Summerfield planned community and are developed with attached single
family residences. The parcel immediately to the west is vacant.
Properties to the north of the subject parcel across Sattler Street
are zoned R-3.5 (Residential, 3.5 units/acre) and R-4.5 (Residential,
4.5 units/acre) and are developed with detached single family
residences.
Sattler Street is functionally classified by the City's Transportation
Plan Map as a minor collector street. Lakeside Drive is classified by
the Transportation Plan Map as a local street.
3. Site Information and Proposal Description
There is an existing single story, single-family residence and a
detached garage on the northern portion of the lot along Sattler
Street (see Exhibit A). The parcel is approximately 1.09 acres. The
applicant proposes to divide the parcel into 3 lots: a 17,050 square
foot parcel which would include the existinp, house; and two 15,988
square foot parcels with access onto Lakeside Drive. The parcels
fronting on Lakeside urive would share a single private driveway to be
located on an easement between the lots.
The eastern boundary of the site contains a six-foot tall wooden fence
and a variety of everg •een and deciduous trees. Several of the yards
on the other side of the fence also have trees adjacent to the fenca..

The western edge of the parcel is not bounded by trees or fencing.
The southern edge of the property is marked by a six-foot tall chain
link fence. Between the fence ari Lakeside Drive is a triangular area
of public right-of-way which includes a .ffvo-400t wide sidewalk and
Landscaping; including a mixture of shrubs, evergreen trees, and
deciduous trees. Some of the trees are greater than 25 feet tall.
The landscaped area contains underground sprinklers. It is important
to note that this triangular landscaped area is public right-of-way
and not privately owned common area of rhe Summerfield community.
4. Agency and NPO Comments
The Engineering Division reviewed the proposal and offers the
following comments:
1. The subject parcel is shown on the plan sheet to be divided into 3
lots, one with access from Sattler Street and two with stree,
frontage on Lakeside Drive.
2. Sattler Street is a minor cnl?ector street and is not fully
Improved with curb, sidewalk, etc. . Generally, driveway access to
collector streets is limited whenever possible. Because access to
this parcel from Sattler Street currently exists, the existing
access can be maintained. No additional dwelling units resulting
from division of this parcel should be allowed access onto Sattler
Street. Half-street improvements along Sattler Street will be
required to be installed by the applicant.
3. Lakeside Drive is a fully improved local street providing access
to 98th Avenue and Alderbrook Drive. No additional public
Improvements along this frontage will be required except for the
driveway option for the private street.
4. The proposed joint access for the southern parcels must be
provided with an easement(s) on one or both properties that is a
minimum of 25 feet of total width. The joint driveway must be
paved to a minimum width of 20 feet. If further division of the
properties is contemplated , the easement(s) should be a minimum
total width of 30 feet. A joint use and maintenance agr�aement for
the common driveway must be executed by the applicant as part of
the recording of the partition.
5. Sanitary sewer is avail3bl- in Lakeside Drive to serve the site.
The Building Code requ4res that each residence be connected to the
main line_ with a 4-1 .ich diameter lateral line. Each lateral Is
required to be accompanied by a private easement to the public
system if it crosses adjacent properties. The newly created
parcels can either be served by individual laterals to the
existing public line in Lakeside Drive or the public sewer can be
extended northward along the parcels' joint access within n 15
foot wide public easement.
6. Storm drainage facilities are available at the public streets.

The Building Division reviewed the proposal and commented that
existing utility locations must be determined prior to recording the
partition. If the utilities cross property lines, they should be
provided with easements. In addition, the Building Division noted
that the applicant should be aware of the 13,000 "in lieu of
assessment" fee for sanitary sewer for each lot if the existing lot
has not paid this fee prior to recording the partition. The applicant
should contact the Building Division to discuss this fee as well as
systems development fees.
Northwest Natural_ Gas commented that a two-inch steel gas main exists
along Sattler Street. This line should be located prior to any
construction near Sattler Street.
The Tigard Water District, PGE, and Washington County Fire District #1
reviewed the proposal and offered no comments or objections.
NPO #6 reviewed the proposal and did not raise any objections or
comments regarding the proposal. The NPO, however, did ask what the
access will be for the southern lots. The access for the southern
lots is proposed to be on Lakeside Drive as is illustrated in
Exhibit 1.
Lakeside Propertv Owner's Association #5 commented that property
owners in the area, and Summerfield residents in general, strongly
object to the subject property having access on Lakeside Drive. The
Association noted concerns regarding additional vehicular and
pedestrian traffic, potential for increased litter and vandalism, and
possible decreased property values if the proposed partition is
approved resulting in an additional building site, or possibly several
sites, with access on Lakeside Drive with the newly created lots not
subject to the restrictive covenants of the Summerfield development.
The Association also noted that the landscaping, fence, and
underground sprinklers on the portion of right-of-way between the
subject parcel and the sidewalk along Lakeside Drive were ir.dtalled by
the Homeowners Association and that these would likely be eliminated
or altered with development on the southernmost proposed lot. The
Association requests that access for al.l parcels created from tax lot
100 be required to be from Sattler Street. Thirteen additional
letters of comment and numerous phone calls from property owners along
SW Lakeside Drive and SW 94th Avenue generally supported the
Homeowners Association's comments. In addition, several commenters
requested that any Accessway to the southern lots from Sattler Street
be required to be located on the west side of tax lot 100 in order to
reduce the effects of vehicle noise and lights on existing residences
to the east.
A. ANALYSIS AND CONCLUSION
The proposed partition, as shown on Exhibit A, complies with the minor
land partition approval criteria specified by Sections 18.162.030 and .0.50
of the Community Development Code. Those criteria are:

18.162.030 Partition Approval Criteria
A request to partition land shall meet all of the following criteria:
(1) The proposal conforms with the City's Comprehensive Plan:
(2) The proposed partition complies with all statutory and ordinance
requirements and regulations;
(3) Adequate public facilities are available to serve the proposal;
(4) All proposed lots conform to the size and dimensional. requirements
of this Code; and
(5) All proposed improvements njeet City and applicable agency
standards.
18. 152.050 Speclnl Provisions for Lots Created Throw Partition Process
(a) Lot Width. The minimum width of the building envelope area shall
meet the lot requirement of the applicable zoning district.
(b) Lot Area. The lot area shall be as required by the applicable
zoning district. In the case of a flag lot, the accessway may not
be included in the lot area calculation.
(c) Lot Frontage. Each lot created through the partition process
shall front a public right-of-way by at least 15 feet.
(d) Setbacks. Setbacks shall be as required by the applicable zoning
district.
(e) Front Yard Determination for Flag Lot. When the partitioned lot
Is a flag lot, the developer may determine the location of the
front yard, provided that no side yard is less than 10 feet.
Structures stall generally be located so as to maximize separation
from existing structures.
(f) Screening on Flag Lots. A screen shall be provided along the
property line of a lot of record where the paved drive in and
accessway is located within 1.0 feet of an abutting lot in
accordance with Sections 18.000.080 and 18.100.090. Screening may
also be required to maintain privacy for abutting lots and to
provide usable outdoor recreation arras for proposed development.
(g) Fire Protection. The Fire District may require the installation
of a fire hydrant where the length of so accessway would have a
detrimental effect on fire-fighting capcbilities.
(h) Reciprocal Easements. Where a common drive is to be irovided to
serve more than one lot , a reciprocal easement which Fill insure
access and maintenance rights shall be recorded with the approved
partition map.

(1) Accessway. Any accessway shall comply with the standards set
forth in Chapter 18.108 (ACCESS AND EGRESS).
The proposed partitioning would promote infilling of vacant residentially
designated property within an otherwise developed area and thus would
promote development at or near the density called for by the Comprehensive
Plan for this area. The proposal complies with applicable requirements of
the Plan and Community Development Coda. All proposed parcels meet the
R-7 zone's minimum lot size standard (5,000 square feet) , average minimum
lot width (50 feet for detached dwelling units) , and the parcel containing,
the existing house would satisfy the minimum setback requirements (20-foot
front yard, 5-foot side yard, and 15-foot rear yard) for the R-7 zone.
Adequate public facility capacities for water supplies and sanitary sewer
service exist. Sewer and water lines are available to serve the site from
Lakeside Drive. Reviewing agencies have reviewed the partition plan and
have not commented that the proposal would conflict with their development
standards. Requir-d public facilities will be developed in accordance
with City design standards.
The proposal also complies with the other special provisions for lots
created through the partition procesr. All three lots to be created
through the partition process will have greater than 1.5 feet of frontage
on public rights-of-way. None of the lots to be created will be flag
lots. Fire hydrants are .located within an appropilate distance of all
proposed lots. A reciprocal easement which will ensure access and
maintenance rights for both parcels sharing the common access on Lakeside
Drive will be required to be recorded along with the partition map. In
addition, all parcels will be required to be provided with sanitary sewer
service. The proposed partition thus conforms with all applicable
standards for approval of a Minor Land Partition.
The applicant has indicated a desire to further divide the new parceis in
the future to provide for additional building sites. Each of the proposed
parcels fronting on Lakeside Drive will have the potential to be
re-partitioned into three parcels each. The Planning Division has
discussed various development options with the applicant regarding both
the present partition application and the potential for future
partitioning. (P?case refer to Exhibit B for the following discussion).
The first option would have divided the prase— parcel into one parcel
containing the existing house, a middle "flag lot" parcel with an access
drive to Sattler Drive along the eastern edge of the existing parcel, and
a third parcel fronting on Lakeside Drive. The middle parcel would have
potential for re-division with both resulting parcels utilizing the access
drive onto Sattler Street. The parcel fronting on Lakeside Drive would
have the potential to be re-divided into three parcels all with access
onto Lakeside Drive. This option for partitioning is not favored because:
1) traffic on the accessway to the middle lot could have adverse noise and
headlight impacts on the abutting parcels to the east; 2) allowing an
additional driveway onto Sattler Street would be contrary to the City's

Policy of limiting accesses onto collector streets; and 3) the potential
for three lots fronting on Lakeside Drive could result in three separate
driveways cutting through the landscapes' area between the sidewalk and
property boundaries resulting in removal of much of the landscaping.
The next option considered would have all. lots receiving access from a
roadway from the west with no parcels having access on Lakeside Drive or
from an accessway along the eastern edge of the parcel. This option would
minimize traffic, noise, and other impacts upon existing neighbors or the
site who are locatd on either Lakeside Drive or SW 94th Avenue. This
option, however, is not practical because there does not appear to be
interest at this time on the part of the property owners to the west in
developing their properties. This option also could require that the
current applicant share in the cost of extension of public roads to this
parcel despite the parcel already having adequate public road frontage.
The third jption considered is the plan under review which is illustrated
In Exhibit A. This option would allow all parcels created (potentially
six parcels) to have a common access onto Lakeside Drive with the
exception of the parcel to contain the existing house. This option would
reduce disturbance of the landscaped area along Lakeside Drive through
providing a single shared private road. This option also eliminates the
potential for noise and vehicle lights impacting neighbors to the east.
The plan also conforms with the City's policy of limiting_ accesses onto
collector streets.
The applicant and the Summerfield Civic Association have reached an
agreement whereby ti►e parcels other than the parcel including thin,
existing house would be incorporated into the Summerfield development and
thus would be subject to the same conditions, covenants, and restrictions
of the neighboring parcels within Summerfield. This should serve to
eliminate or minimize the concerns raised by these neighbors. Because
this option would apparently have the least significant impacts upon the
neighborhood and would allow the applicant to partition the parcel without
depending ►►pon the willingness of the property owners to the west to also
develop their properties at this time, the City finds the third option to
be preferred.
In order to assure a proper division of the property in the future that
will meet City standards and the desires of the Summerfield neighborhood,
a redevelopment plan should be submitted prior to recording this proposed
partition.
C. DECISION
The Planning Director's designee hereby approves MLP 88-14 subject to the
following conditions:
UNLESS OTHFRWISF NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO PECORDING THE
PARTITION WITH WASHINGTON COUNTY.
1 . The partition survey maps and legal descriptions shall be submitted to the
Planning D'vision for review and approval prior to recording. STAFF

2. The location of existing private utilities (sanitary sewer, storm drains,
etc.) must be determined, and if they cross a property line, easements
must be granted prior to recording. The existing septic system shall be
removers and/or filled. STAFF CONTACT: Brad Roast, Building Division

3. Standard half-street improvements, including concrete sidewalk, driveway
apron, curb, asphaltic concrete pavement, storm drainage, streetlights and
underground utilities, shall be installed along the Sattler Street
frontage. Improvements shall be designed and constructed to minor
collector street standards and shall conform to the alignment of existing
adjacent improvements or to an alignment approved by the City Engineer.
The applicants shall work with City staff to attempt to design the
sidewalks so as to preserve existing trees as much as is practical. STAFF

4. Additional right-of-way shall be dedicated to the public along the Sattler
Street frontage to increase the right-of-way to 30 feet from the
centerline. The description shall be tied to the existing right-of-way
centerline. The dedication document shall be on City forms and approved
by the Engineering Division. Dedication forms and instructions are

5. The applicant shall provide for roof and driveway rain drainage to the
public stornwater drainage system. STAFF CONTACT: Gary Alfson.
6. One driveway will be permitted to connect with Lakeside Drive to serve the
two southern lots. An access easement on one parcel or complementary
easements on both parcels totalling a mirimum of r, feet in width must be
recorded along with the partition. The driveway must be paved and must be
a minimum of 20 feet wide. A joint use and maintenance agreement shall be
executers on City standard forms for the driveway. The easement and
agreement shall be referenced on and become part of all applicable parcel
deeds. The easement and agreement shall be approved by the Engineering

7. The applicant shall. provide for connect'on of the existing house and each
of the new parcels to the public sanitary sewerage system. All public
sanitary sewer lines shall be accompanied by a 15 foot wide public utility
easement unlees otherwise approved by the City Engineer. STAFF CONTACT:

8. Seven (7) sets of plan profile public improvement construction. plans and
one (1) itemized construction cost estimate, stamped by a Registered
Professional Civil Engineer, detailing any public sanitary sewer extension
and the proposed half-street improvements on Sattler Street and driveway
approach on LaKeside Drive, shall be submitted to the Engineering Division

2 . Sat+:ler Street is a minor collector street and is riot fully improved with
curb, sidewalk, etc. Gonerally, driveway access to the collector streets
is limited whenever possible.
3 . Lakeside Drive is a fully improved local strekt providing access to 98th
Avenue and Alderbrook Drive.
4 . Sanitary sewer is available in Lakeside Drive to serve the site. The
building code requires that each residence be connected to the main line
with a 4-inc;n -i.-Ameter lateral line. Each lateral is required to be
accompanied by An easement to the public systrn.
S. Stora drainage facilities are available at the public streets. The
interior lot will be required to discharge its roof drainage within an
easement to the public system or by an on site system to prevent
discharge onto adjacent properties .
Conditions
1 . Standard half-street improvements, including concrete sidewalk, driveway
apron, curb, asphaltic concreto pavement, sanitary sewer, storm drainage,
streetlights and underground u-ilities, shall be installed along the
Sattler Street frontage. Improvements shall be designed and constructed

STREET & SEWER COMPLIANCE AGREEMENT
THIS AGREEMENT dated this day of , 1989 ,
between the CITY OF TIGARD, a municipality of the State of Oregon, hereinafter
termed the "City", and Mr. Kurt Dalbey _
hereinafter termed "Petitioner",
W T T N E S S E T H:
WHEREAS, Petitioner has applied to the City for approve . ' .)r MLP 88-14 and
improvement of a street to be known as Sattler Street and Lakeside Drive
and for improvement of a sanitary sewer line as illustrated on the attached
improvement plan, and by reference made a part hereof; and
WHEREAS, the City of Tigard requires Petitioners to install streets,
sidewalks, street lighting, storm sewers sanitary sewers, underground
utilities and other public facilities, as may be necessary, and requires the
payment of Fees and posting of applicable assurances; and
WHEREAS, the City has adopted the Standard Specifications for Public Works
Construction Oregon Chapter APWA, for street, storm drain, structure and
related work, and Unified Sewerage Agency Standards and Specifications, for
sanitary sewer construction, prepared by professional engineers, for public
street improvement; and
WHEREAS, the public improvements to be constructed by the Petitioner are
incomplete, and Petitioner has nonetheless requested the City to permit
dedications of the property and granting of easements to the public and the
parties herein named desire to protect the public interest generally by
legally enforceable assurance that public improvements will be installed as
required and completed within the time hereinafter set forth,
NOW, THEREFORE, in consideration of the forego ng p emise and the
covenants and agreements to be kept and performed b ge Pe itioner and its
surety, IT IS HEREBY AGREED AS FOLLOWS:
1. Petitioner shall proceed with the in an purpose to complete all
public improvements as shown on the ImpruXemelt al approved by the City
of Tigard, prepared by Alpha Engineering, Int. ( ortladd Oregon)
Said improvements to be comple ed no later than oche year from he date of
t )ls agreement, and petitioner hereby agrees' td comply with standard
specifications as adopted by the City, or as c'Lherwise be or have been
approved by the Department of Community Development, to comply with all terms
and provisions specified hereinregard this .imptovement by the Council and
Planning Commission of the City of Tigard,i Oregon, and to use only such
material and to follow such designt as May b-6 tequired to conform thereto.
Petitioner shall provide certificat#on def installation conformance, and one
as-built mylar, both stamped by a registered ivil engineer, to the City prior
to City inspection of petitioners imp, em nt work for City tentative and
final acceptance consideration.

2. To assure compliance with the City's requirements and the provisions
hereof, Petitioner tenders herewith to the City an assurance in form approved
by the City, with liability in the amount of $30,893.00 a copy whereof is
hereto attached and by this reference made a part hereof. Petitioner's
contractor shall be licensed, bonded and insured.
3. In the event that the Petitioner shall fail, neglect or refuse to
proceed with the work in an orderly and progressive manner to assure
completion within the time limited, upon ten (10) days' notice by the City to
the Petitioner and the Petitioner's surety, and such default and failure to
proceed continuing thereafter, the City may at its option proceed to have the
work completed and charge the costs thereof against the Petitioner and the
Petitioner's surety and in the event the same be not paid, to bring an action
on the said bond to recover the amount thereof. In the event that such action
be brought, the Petitioner and the Petitioner's surety shall be required to
promise and agree to pay, in addition to the amounts accruing and allowable,
such sum as the court shall adjudge reasonable as attorney's fees and costs
Incurred by the City, both the Trial Court and Appellate Court, if any, or
the City may at its option Ll ing proceedings to enforce against the Petitioner
and/or Petitioner's surety specific performance of the contract and compliance
with the standards adopted by the City of Tigard, and in any event, in a like
manner, the City shall be entitled to recover such sums as the court may
adjudge reasonable for the City's attorney's fees and costs, both in the Trial
Court and Appellate Court, if any.
4. The Petitioner agrees to provide the City with 48 hour advance notice
of commencement of construction and, also, 12 hour advance notice of requested
field inspections.
5. The City agrees to make and provide periodifinal inspections
which in the City's interest are desirable to assure compl ance herewith, in
consideration whereof the Petitioner shall pay the pescr ed inspection fee
of 4% of the total estimated cost of the con tr ct n; said fee being
$1,235.72.
6. The Petitioner agrees to insure t t Pe it oner's engineer obtains
accurate as-built (field) constructio r or f said sewer and street
installations and, also, agrees to ins e t t he City is furnished with one
accurate as-built mylar thereof and, fu they w th accurate legal descriptions
and maps of all necessary dedications d e sem nts. Petitioner shall provide
all necessary dedications and easements on it formic to the City.
7. At such time as the public imp emer�s have been completed in
accordance with the City's requir ments, Petitioner shall submit a
"certificate of installation con rman e" to tfie City to notify the City of
readiness for tentative acceptance ins ectio and, then, upon notification by
the Department of Community Develop n tha the requirements of the City have
been met, the Petitioner will subml the City a good and sufficient
guarantee bond, if not already provided with the performance assurance, form
approved by the City, to provide f correction of any defective work or
maintenance becoming apparent or aril ng within one (1) year after tentative
acceptance of the public improvements by the City.
B. Petitioner agrees to provide for correction of any defective work
and/or maintenance becoming apparent or arising during the guarantee period as
hereinabove set forth.
9. At such time as all public improvements have been completed in
accordance with the City's requirements, Petitioner shall notify the City of
readiness for final acceptance inspection and upon certification by the
Department of Community Development that a' l requirements of the City have
been met, the Council agrees to accept said improvements for operation and
maintenance responsibility, and release the p'etitioner's guarantee bond.
IN WITNESS WHEREOF, the parties have executed this agreement pursuant to
authority in each of them.

project located in the City of Tigord, said project being commonly known as
the Dalbey Sewer and Street Improvement (MLP 83-14) . This loan commitment is

aprons, sidewalks, and curbs 2) sanitary and storm sewers 3) domestic water 4)
underground telephone and power 5) appurtances thereto. All such improvements

the compliance agreement thereinregard.

to perform the following work pertinent to the above project-.
1 . Perform the surveying or verify the existing surveying information as
necessary for the design.
2. If necessary, provide for the expertise of other engineers such as soils
or structural engineers and, also, oversee materials and systems testing.
3 . Prepare constriction drawings in accordance with the City standards and
obtain the City, and if applicable, DEQ, County, or State approval of such
drawings.
4. Supply construction staking.
5. Provide adequate inspection to assure compliance with City Specifications,
and keep accurate field notes in order to prepare "as-built" drawings .
6. Upon completion of construction provide ons, scat of as-built drawings on
mylar to the City .
I . Upon completion of construction provide written certification that all
improvements are complote in accord with the approved plans and
specifications.
A. Obtain City approval prior to any substantial deviation from the approved
plans.
