This ss the back pressure due to ground water submergence ov(.t the end of the prote. All gauge pressures in the test should be increased by this amount. 4. After the two minute period, disconnect air supply,. 8. When pressure decreases to 3.5 psig, start stopwatch. (5) The City and the Agency agree to require payment by any nwner or t. Premises whose lands abut upon or are to be served by the Fewer trunk line herein described, within the boundaries of the area delineated on the attached plat marked Exhibit "C" and by reference made a part hereof, who shall apply to the City for connection of said premises to said line, in addition to all other connection charges, a sum equal to $483.09059 per acre of said (owners or user of premises) lands, and said amount shall be paid by such applicant prior to being issued a permit for each such connection, and the sum thus collected as and when received by the City shall be paid over to the Owner, or pursuant to Oev,er's direction in partial reimbursement Of (toner's costs in construction of said sewer line. Owner shall furnish to the City upon completion of construction, a sworn Itemized statement of the costa incurred in connection with con strurtion of said sewer line and the City shall be tntltled to examine the records of the Owner with 1 respect to said costs and to verify the amount thereof. Owner shall not be entitled to reinbutsement for any extension of said sewer line or any connection of property to such extension, and the owner's reimbursement 1 -2- (I BOOK I 3 22187 shall be limitefe direct torneetions with the srweroe constructed by Owner hereunder. Reimbursement hereunder stall be limited to a period of'ten (10) years and'shall not exceed sixty-seven per cent (677.) of the total cost incurred by the Omer in constructing said line. At the expiration of 10 years or at such t!-me as 512.181_.35_. reimbuesement has been accomplished in accordance herewith, the Owner's rights to reimbursement hereunder shall be of no further force and effect. . (6) It is an express condition of this agreement that at the City's option, Owner's i lands or any other lands served by said trunk line for which sewer service is made available hereunder, may be annexed to the City as and when said lauds are or become contiguous to the City's boundaries as now established or hereafter extended by annexation, and execution of this agreement by the Omer shall constitute consent to the annexation of the above described lands, and such consent shall run with the land and bind the Owner, its successors and assigns. (7) To the extent authorised by law, any sewer connection of service charge hereinabove required to be paid with respect'to premises served under the terms of this agreement, which charge is not paid when due, shall thereupon become a lien upon such premises until paid. Said lien right shell be in addition to, and not in lieu of, any other remedy provided by law. An executed copy of this agreement, containing a description of the lands to be served hereby, shell be recoraed in the Mortgage Records of Vaskingtea County, Oregon, with the intent and ptrpose that not-ice of the City's lien rights for sewer connection and service charges will be given to all purchasers and users of portions of said lands. If and when the premises are annexed to the City, this provision for lien shall terminate. W. Durham rd. and S. W. Hnll Blvd. and running thence Westerly 33¢2' to S. W. 78th Avenue to those certain lands of the Owner as described on the attached sheet headed "DESCRIPTION", denoted Exhibit "A", and by this reference made a part here( and WHEREAS, the Owner has applied to the City to approve construction of said line and to permit connection thereof to the City's lin- at inter<ection of S. W. Durham rd. and S. W. Hall Blvd. and the Owner has further applied to the Agency for sewage disposal services, and Lhe City and the Agency subject to the r+greement.s and provisions hereof are willing to grAnt to the (honer the privileges and uses as hereinafter set forth, NOW, THEREFORE, in consideration of the foregoing premises, the agreements herein contained, the payments to be made by Owner to the City and the Agency pursuant to the terms hereof., and the mutual benefits to he derived by the parties, the Owner, t' e City and the Agency agree as fnllowat (1) The Owner may, upon dpproval by the City and the Agency of plans and specifications prepared by the Owner, proceed with the construction of said sewer trunk line from S. W. Durham Rd. and S. W. Hall Blvd. West 3342' to the _ Intersection of S. (2) The Owner shall pay or cause to be paid to the City as agent for the• Agency, all connection charges as pr_ �cribed by rate orders of the Agency. In addition, the Owner shall bear the cost of connecting Owners premises to the sewer trunk line as extended, and no connection shall be made until application therefor has been filed and approved, the connection charges paid, and all work and materials involved in the sewer service connection shall have been inspected and approved by the City anal/or the Agency. (3) The rights of the owner hereunder are subject to the sewer charges, terms and provisions of pre-existing contracts as described on the attached sheet headed "SCHEDULE", denoted Exhibit "B" by reference made a part hereof, and, in addition to all other charges herein, the owner shall pay the surcharges set forth on said Exhibit "B". (4) Title to, and ownersh!p of, said trunk line, upon completion of construction thereof pursuant to the terms hereof, shall vest in the City, and the City shall thereafter have full jurisdiction thereover in all respects to the same extent as the City exercises jurisdiction over any other sewer line within its system. (5) The City and the Agency agree to require payment by any owner or user of premises whose lands abut upon or are to be served by the sewer trun6, line herein described, within the boundaries of the area delineated on the attached plat marked Exhibit "C" and by reference made a part hereof, who shall apply to the City for connection of said premises to said line, in addition to all other connection charges, *4 8s,ago" a sum equal to 0001FINOM per acre of said (owners of user of premises) lends, and said amount shall be paid by such applicant prior to being issued a permit for ea-.h such connection, and the sum thus collected as and when received by the City shall be paid over to the Owner, or pursuant to Owner's direction, in partialruimbursement of Owners costs in construction of said sewer line. owner shall furnish to the City upon completion of construction, a sworn itemioed statement of the costs incurrr:d in connection with construction of said sewer line and the City shall be entitled to examine the records of the Owner with respect to said costs and to verify the amount thereof. Owner shall not be entitled to reimbursement for any extension of said l sewer line or any connection of property to such extension, and the Owners reimbursement .2- shall be limited to direct connections with t'.,c sewer line constructed b} Owner hereunder. n imbursemenL hereunder stall be limited to a period of ten (10) years and shall not excec., sixty-seven per cent ( 6T:) of the total cost incurred by the Owner in constructing said line. At the expiration of LO years or at such time as $32,787.35 reinbursement has been accorlillished in accordance herewith, the Owner's rights to reimbursement hereunder shall be of no further force and effect. (6) It is an express condition of this agreement that at the City's option, Owner's lands or any other lands served by said trunk line for which sewer service is made available hereunder., may be annexed to the City as and when. said lands are or become contiguous to the City's boundaries as now established or hereafter extended by annexation, and execution of thi.s agreement by the Owner shall constitute consent to the annexation of the abovu described lands, and such consent shall run with the land and bind the Owner, its successors and assigns. (7) To the extent authorized by law, any sewer connection or service charge hereinabove required to be paid with respect to premises served under the terms of this agreement, which charge is not oaid when due, shall thereupon become a lien upon such premises until paid. said lien r]6',L shall be in addition to, and not in lieu of, any other remedy provided by law. An executed copy of this agreement, containing a description of the lands to be served hereby, shall be recorded in the Mortgage Records of Washington County, Oreton, with the intent and purpose that notice of the City's lien rights for sewer connection and service charges will be given to all purchasers and users of portions of said lands. If and when the premises are annexed to the City, this provision for lien shall terminate. (8) The City shallnot be t!-sponsible or liable for disruption or temporary discontinuance• of sewage disposal services hereunder due to flood, earthquake, or other act of God, or other causes beyond the governmental control of the (711ty. (9) Each of the parties hereto shall be bound only as to those provisions hereof as to which such party may lawfully assent. At such time as all public .improvements, have been com- plet - I in accordance with the City's requirements, Petitioner shall be required to notify the City of the readiness for final inspections upon affirmation by the Department of Public Works that all requirements of the City have been met, the Petitioner will submit to the City a good and sufi ,cient maintenance bond in the form approved by the City in a sum equal to fifty per cent (50%) of the contract price to provide for correction of any defective work or, maintenance becoming apparent or arising within one yeas after final acceptance of the public improvements by the City.
