W I T N E S S E T H: WHEREAS, Petitioner has applied to the City for approval of construction of a public mainline sanitary sewer, to bt, known as SW 108th Avenue Sanitary Sewer Extension _ being within the boundaries or an area - described on th attached Exhibit "A", and by reference made a part hereof; and WHEREAS, the City of Tigard requires applicants for construction of sanitary sewers, and appurtenances thereto, to submit to construction plan review, construction inspection and testing, and, further•, to provide performance assurances, to grant public easements and to remit payment of relevant fees and charges; and WHEREAS, the City has adopted the Standard Specifications for Public Works Construction Oregon Chapter APWA, for street, storm drain, structure and related work, and Unified Sewerage Agency Sanitary Sewerage rules, regulations and specifications for sanitary sewers via Ordinance No. 04-5a and amendments thereto; and WHEREAS, the public sewer improvement to be constructed by the petitioner is incomplete, and petitioner has nonetheless requested that the City permit granting of easements to the public, and the parties herein named desire to protect the public interest and assure that the improvement will be installed as required and completed within the time hereinafter set forth. NOW, THEREFORE, in consideration of the foregoing premise and the covenants and agreements to be kept and performed by the petitioner and petitioners surety, IT IS HEREBY AGREED AS FOLLOWS: 1 . Petitioner shall proceed to complete all public improvements shown on the improvement planapproved by the City of Tigard and prepared by Westlake Consultants, Inc. (Tigard, OR) dated ; said improvement to be completed no later than one (1) year from the date of this agreement and Petitioner hereby agrees to comply with all rules, regulations and specifications set forth by the City and, to use only such materials and to follow such designs as is required to conform thereto. Petitioner shall provide certification of installation conformance and one as-built mylar, both stamped by a registered civil engineer, to the City prior to City inspection of petitioners improvement work for City tentative acceptance consideration. 7 . to assure compliance with the City' s requirements and the provisions thereof, Petitioner agrees to obtain, provide and tender to the City, a surety bond(s) in form approved by the City, with liability in an amount equal to the contract price of 5,500.00 prior to City issuance of a permit or approved construction plans for construction of said improvements; Petitioner' s contractor shall be licensed, bonded and insured. - 1 - 3 . In the event that the Petitioner shall rail, neglect or refuse to proceed with the work in an orderlyand 1 progressive manner to assure completion within the time specified, upon ten (10) days notice by the City to the Petitioner and the Petitioner's rurety, and such default and failure to proceed continuing thereafter, the City may at its option proceed to have the work completed and charge the costs thereof against the Petitioner and the Petitioner's surety and in the event the same be not paid, Lr-irlg an action on said bond to recover ;;tae amount thereof. In the event that such action be brought, the Petit-on(-r and the Petitioner' s surety shall be required to promise and agree to pay, in addition to the amounts accruing and allowable such sum as the court shall adjudge reasonable as attorney' s fees and cost incurred by the City, both in the Trial Court and Appellate Court, if any, or the City may at its option bring proceedings to enforce against the Petitioner and/or Petitioner's surety, specific performance of the contract and compliance with the standards adopted by the City of Tigard, and in any Event, in a like manner, the City shall be entitled to recover such sums as the court ma,i adjudge reasonable fo;• tha City attorney's fees and cost, both in the Trial Court and and Appellate Court, if any. 4. Petitioner, concurrent with the execution hereof, agrees to pay the following fees and charges: a. A plan check and inspection fee to cover the cost of City review of public mainline construction plans and, in the City' s =.nterest, periodic inspection of mainline construction (except building connections) in the amounL of $ 220.00 b. A connection permit fee to cove the cost of processing building connection permit applications and performing inspection of building connection(s) . Said fee to be determined, levied, and paid prior to connection of building sewers to (this) public mainline sew:rr c . A surcharge to connect directly or indirectly (strike inapplicable word) to an existing public mainline sanitary sewer which was installed without cost to the Petitioner. Said surcharge to be determined, levied, and paid (by the Petitioner) in accord with terms of agreement, between the City and N/A d. A monthly sewer service charge for use of the public unitary sewer system. 5. While the City agrees to make periodic inspection as in the City' s judgment is necesscry to assure compliancF, the Petitioner agrees to provide certification that the improvement. has boon installed in accord with City standards and the approved improvon,ent: pli;n; said certification to be signed by a registered civil engineer. 6. The Petitioner agrees to 9 providk the City with 48 hour advance notice of commencement of construction and, also, 12 hour advance notice of requested field irspections. 7. The Petitioner agrees to insure that Petitinonr' s enginvi,r obtains accurate as-built (field) construction records of said sewer installation ` and, also, agrees to insure that the City is furnished with one accurate J as-built mylar thereof arid, further, with accurate 1a!gal descriptions of all necessary easements . 2 - MmN-%AILmm-x-ML-=� B. At such time as all public improvements have been completed .in accordance with the City' s requirements, Petitioner shall submit a "certificate of installation conformance" to the City to notify the City of readiness for acceptance inspection and, then, upon notification by the Department of Community Development that the requirements of the City have been met, the Petitioner will submit to the City a good and sufficient guarantee bond, if not already provided with the performance bond, form approved by the City, to provide for correction of any defective work or maintenance becoming apparent or arising within one (1) year after, tentative acceptance of the public improvements by the City. 9. Upon receipt of certification from the Department of Development Services that all requirements have been mot, and a one year Maintenance Bond, the City agrees to accept the public improvements subject to of Petitioner' s correction of deficiencies, and maintenance, for a period of one year. 10. Petitiorer agrees to provide for correction of any defective work and/or maintenance becoming apparent or arising during the guarantee pe. iod. 11 . At such time as all public improvements have been completed in accordance with the City' s requirements, Petitioner shall notify the City of readiness for final inspection and upon certification by the Department of Community Development that all requirements of the City have been met, the City agrees to accept said improvements, for operation and maintenance responsibilit.v, and release the Petitioner' s guarantee bond. 12. NOW, THEREFORE, in consideration of the foregoing premise and the covenants and agreements to be kept and performed by the petitioner and petitioners surety, IT IS HEREBY AGREED AS FOLLOWS: I . While the City agrees to make periodic inspections as in the City' t judgment is necessary to assure compliance, the Petitioner agrees to provide certification that the improvement has been installed in accord with City standards and the approved improvement plan; said certification to be signed by a registered civil engineer. 6. The Petitioner agrees to provide the City with 40 hour advance notice of commencement of construction and, also, 12 hour advance notice of requested field inspections. 7. The Petitioner agrees to insure that Petitioner's engineer obtains accurate as—built (field) construction records of said sewer installation knd, also, agrees to insure that the City is furnished with one accurate as--built mylar thereof and, further-, with accurate legal descriptions of all necessary easements. - 2 — 8. At such time as all public improvements have been completed in accordance with the City' s requirements, Petitioner shall submit a "certificate of installation conformance" to the City to notify the City of readiness for 1 acceptance inspection and, then, upon notification by the Department of Community Development that the requirements of the City have been met, the Petitioner will submit to the City a gooc: and sufficient guarantee bond, if not already provided with the performance bond, form approved by the City, to provide for correction of any defective work or maintenance becoming apparent or arising within one (1) year after tentative acceptance of the public improvements by the City. 9. Location: Sduth of SW 108th, north of North Dakota Street, west of 106th (WCTM 1S1 34DA, tax lot 1901 ) . DECISION: Notice is hereby given that the designee of the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the decision is based are as noted below. A. FINDING OF FACT I . Background The Director previously approved a partition application which divided 1 .92 acres into three parcels including tax lot 1901 (MLP 7-86). Condition of approval N13 of that decision required that a redevelopment plan for future partitioning of tax lot 1901 be submitte3, A redevelopment plan wa3 approved by the Planning Division on December 19, 1986. The present application is similar in concept to the approved redevelopment plan. 2. Vicinity Information Properties surrounding tax lot 1901 are all zoned R- 4.5 (Residential, 4.5 units/acre) . Surrounding properties are developed with single family residences ranging in size from 7,500 square feet, for parcels to the north along SW 108th Avenue and west along SW 109th Avenue, to approximately 1 acre for 2 parcels immediately east of the subject parcel. SW 108th Avenue, which is a fully developed 34 foot wide paved local street-, terminates at the northern border of tax lot 1900. A one foot wide access control strip is located adjacent to the end of SW 108th Avenue. The purpose of the stria is to require Planning Division review of any access to tax lot 1901 so as to guarantee that the access does not preclude future development on the lot and parcels to the east. 3. Site Information and Proposal Description Tax lot 1901 is vacant except for a barn. 'The parcel contains a large tree covered berm in the approximate center of the lot. For now, the private street would be extended only as far as necessary to provide access to the smaller parcels. The 10, 132 square foot parcEl would include a 35 foot wide easement along its northern edge to allow for future development of a private road to provide access to the parcels to the east. 4. Agency and NPO Comments The Engineering Division has the following comments; a. The applicant proposes to partition the parcel into 3 lots (one of which may later be redivided into 3 additional lots) . Access would be provided by a 24 foot private street that is an extension of SW 106th Avenue, a 34-toot wide local street. b. Storm and sanitary sewers to serve the proposed lots are available in SW 108th Avenue. Washington County Fire District #1 commented that hydrants must be provided by the developer, if not already in place, so that all portions of possible building footprints are within 500 feet of a hydrant. The Planning Division has established that an existing hydrant at the end of SW 109th Avenue will satisfy the requirement. The 'Tigard Water District has the following comments; The Water, District objects to the proposed development because it is inconsistent with past- plans for traffic patterns in the City. SW 108th Avenue was not original;y planned to be a dead end street• but was proposed to extend to North Dakota ,Street. Nevertheless, any development on the property will require the extension of a 6 inch diameter water main for the full length of the property. Meters will not be installed for lots 1 and 2 only without: an extension of the main. The Building Division, GTE, PGE and Northwest Natural Gas reviewed the proposal and offered no comments or objections . No other comments were received. B. ANALYSIS AND CONCLUSION The proposed partition (Exhibit 1) is consistent with Community Development Code standards for R-4.5 zone minimum lot size and lot width requirements and provides ample area in which houses can be situated within the R-4.5 zone' s setback requirements. Adequate access and plans for providing the proposed lots with necessary public services are provided. NOTY E nF DECISION - MLP 88-06 - HERB MORISSETTE BUILDERS - PAGE 2 Lot 2 provides fog 35 foot wide easement- to pro, a access to lots 1700 and 1000 to the east. The width of the easement provides enough room for a 30 foot wide accessway and screening of the roadway from the abutting lot to the north [Code Section 18. 162.050(f)] . Screening will riot be required to be installed until the easement is developed with a roadway. The conceptual development plan for adjacent properties and the remainder Of tax lot 1901 (Exhibit 2) substant-'ally complies with Plan and Code re4uiroments. Future development- apF, ications for these parcels must i;iclude requests for variances to v;ude Section 18. 108.070(x) which specifie4•that private roads serving 3 to 6 dwelling units be no more than 100 feet ir. length. Both the private extension of SW 108th onto tax lot 1901 a,id the access road to tax lots 1700 and 1800 would exceed the 100 fool; length standard. The Planning and Engineering Divisions do not concur, with the Water District' s comment regarding the connection of SW 108th Avenue with North Dakota Street. Existing houses and the present lotting pattern would make a southward extension of SW 108th Avenue to North Dakota Street difficult to accomplish The staff believes that a future extension of SW 109th Avenue to Black Ciamond Way will accomplish the planned through circulation for the area with lesser impacts than a southern extension of SW 108th to North Dakota Street would. Extension of 109th Avenue will be considered further upon applications for any partition or subdivision approvals for properties north of the existing 109th Avenue. C. DECISION The designee of the Community Development Director approves proposed Minor Land Partition MLP 88-06 subject to the following conditions: THE FOLLOWING CONDITIONS SHALL BE SATISFIED PRIOR TO RECORDING THE PARTITION WITH WASHINGTON COUNTY. 1 . A survey map and legal descriptions for both the parent parcel and proposed parcels shall be submitted to the City for review and final approval prior to recording.
