WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, street lights, storm sewers, sanitary sewers, underground uti;i.t:ies and other public facilities for the development of subdivisions ; and WHEREAT, the City further required the payment of tees and the execution of a Compliance agreement which stipulates that : Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject. to the requirements for correction of deficiencies and maintenance for a period of one year. . ."; and WHEREAS, said Certification has now been received; and WHEREAS, the required performance bond has remained in full force and effect throughout the normally required maintenance period of one year, and WHEREAS, no deficiencies remain to be corrected therein, NOW, THEREFORE, BE IT' RESOLVED by the Tigard City Council that: the City Council of the City of Tigard, Oregon hereby accepts the public: improvements constructed within Winsome Terrace Subdivision, said subdivision being recorded in Book 47 on Page 39 and 40 in Washington County, Oregon, flat Records. NOW, THEREFORE, if the Principal shall fai.thfuily observe and timely comply with all requirements of said Subdivision Compliance Agreement and all ordinances and regulations applicable to said subdivision, and if the Principal shall well and truly perform all matters and things undertaken thereby and hereby to be performed and shall promptly make payment to all persons supplying labor or material for any prosecution of the work, and if the rrincipal shall not permit any lien or claim to be filed or prosecuted against the City on account of any labor or material furnished, and if the Princiral shall promptly pay all contributions or amounts due the State Industrial Accident Fund and the State Unemplcyment Compensation Fund, and shall promptly as due make payment to the person, co- partnership, association or corporation entitled thereto of the monies mentioned in Chapters 279.320 and 279.510 O.R.S. and shall promptly comply with all withholding and payment requirements of Chapters 316.162 to 316.212 O.R.S. with respect to the collection of taxes at source, then upon full completion of all work and the furnishing of evidence satisfactory to the City that all requirements hereof have bcert fulfilled, and if the Principal. shall execute and deliver to the City the Maintenance Bond described in said Subdivision Compliance Agreement, then the Bank shall thereupon releass to the Principal the said cash bond deposit: PROVIDED, however, that the obligations hereof shall not apply to any money loaned or advanced to the Principal or ti any subcontractor or other person in the performance of any such work whether specifically provided for by contract or other- wise. IF, however, the Principal shall fail to literally comply with all requirements of said Subdivision Compliance Agreement and all the requirements hereof, or shall in any particular perform the work in a defective manner, upon 10 days notice by the City to the Principal and such default or failure continuing thereafter, the City is hereby authorized to have said work performed or the requirements of the Subdivision Compliance Agreement brought into conformity with the terms thereof and with the City's ordinances and regulations, and tl,e City shall be, and it is hareby, autho-ized to charge the same against the entrusted cash deposit and the Bank agrees to pay therefrom all amounts certified by the City to be chargeable thereto. Nothing herei,.► contained shall be construed to constitute acceptance by the City of any responsibility for maintenance of the improvements nor shall the City of any responsibility for maintenance of the improvements nor shall the City by reason thereof become obligated to any person or property owner for any loss or dampge arising by reason of the manner in which said improvements were Lorstructed. Further, the City be, and it is hereby authorized in addition to the foregoing, in the event of such default on the part of the Principal to charge against said funds all costs incurred by the City including Attorney's fees in exacting compliance therewith or herewith, and the Bank agrees to disburse said funds for said purposes upon certification thereof by the City. The tentative plan complies with the Comprehensive Plan and applicable zoning regulations of the City then in effect. d. No tentative plan of a subdivision or map of a major partition shall be approved unless there will exist adequate sewage disposal system to support the proposed use of the land described in the proposed plat. 5. The site is relatively' flat and the tax lot is vacant with the exception of a few large deciduous and conifer trees. Surrounding land uses are apartments . to the east, single fai,ily homes to the south and west , and preschool to the norti. . 6 . Water service is available to the site from the Tigard Water District via an eight 'inch line in S .W. Grant Avenue . Sanitary sewer is also available to the site via an eight inch line in S .W. Grant Avenue . 7 . S .W. Crant Avenue is designated as a local street on the NPO #2 Plan w. th 50 feet of right--of-way. Insufficient right-of- way exists and S.W. Grant is in substandard condition . 8 . No indication has been given as to how storm water run-off is to be handled. State Law requires that : Rain, storm, and other surface run-off water drained from roofs, paved areas , courts or courtyards shall not be conveyed and discharged to the storm sewers or to the street guttercJr gutters in a manner which may cause flooding to adjacent property , alleys or walkways. II . Conclusionary Findings : 1 . The proposed preliminary plat conforms to the Tigard Community Plan, 1971 , in that the proposed lotting pattern is for res- idential purposes and conforms to the dimensional requirements of the zoning code. 2 . With the attachment of appropriate conditions , access will be available to all lots, and each lot as proposed will abu,' a public. street. 3 .
