WHY-PEAS , the City of Tigard Subdivision Ordinance requires subdi.vidars to install streets, sidewalks, street lights , storm sewers , sanitary sewers, underground utilities and other public faci] ities for the development of subdivisions ; and WHEREAS, the City further required the payment of fees and tht, execution of a Compliance Agreement whien stipulated that : "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year . . . . " . and WHEREAS , said Certification has now been received; and WHEREAS , the required performance bond has remained in full furca and effect throughout the normally required maintenance period of one year , and WHEREAS , no deficiencies remain to be corrected therein , NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregen hereby accepts the public improvements constructed within Way Lee Subdivision , said subdivision being recorded in Book 35 oii Page 42 in Washington County, Oregon , Plat Records . Installation of unfinished sidewalk section on 69th Street. If we put the sidewalks on the lower portion of 69th at this time, they would only have to be torn up when that area Is completed. This letter will confirm that during construction on the lower end (which is the next phase) we will go ahead and put in the necessary walks. 2. Installation of three street lights as per your plan prepared by PGE. The wiring is in for the lights and they are bu-Ing ordered. We are working with PGE on this and will have them in just as soon as possible. At the time the final set of plans are submitted it wojld be helpful if you would snake a schedule showing the total amount of units and/or list the total amount of each fixture for comparison ea this will assit in reaching a more accurate cost fee. I have not as yet received any information from Unified Sewerage Agency regarding the "Selvajor" unit you proposed in place of the garbage disposal. I will forward the fee schedule as soon as it is available to this department. An estimated cost of your sewer permit for both restaurants appears to be based on fixture unite totaling to 4 dwelling unite at 5525.00 per dwelling u,iit equaling (2100.00 plus $35.00 inspection fee far a Lotal of $2135.00 each. Approval of a "Ifajor Land Partitioning" was granted by �- the Planning Commission at its October 15, 1974, meeting subject _to the following conditions : a. Access to the White property be protected by means of a reserve strip to be held by the City along; this portion of the proposed dedicated street. In addition, a reserve strip will be provided at the terminus of the proposed right-of--way. b. Parking areas must be designed to facilitate turn- around movements, especially for emergency vehicles. c. T11e property line be eliminated between "lot 1, block 1" and "lot 2, block 111. d. Paving of the proposed street be extended to the end of the nearest driveway and a bond be filed with the City in sufficient amount to ensure construction of the remainder of the street. e. Participation be required in the cost of placing a traffic light at the intersection of SW 69th Avenue and Pacific Highway. 2. The preliminary plat thus approved included a 36' paved street in a 60' right-of-way with no parking to be allowed on the street. Commercial traffic re(iaires at least 10 ft. travel lanes with 12 ft. preferred plus a minimum 2 ft. "shy distance" to the curb when no parking is allowed. A curve adds about 2 ft. (depending on the radius) to the street width required. In order to allow passage of emergency vehicles and or bicycles in the street margin, a safety margin should be added to the 2 ' "shy distance" cC 2 to 3 feet. If a street were to accomodate commercial traffic without parking and provide for emergency vehicles and a curve, then a minimum of 16 feet and an optimum of 18 feet would be in- dicated from the curb to centerline or a 32-34 ft. street. By this rationale, if no parking .is to be allowed, this portion of 69th could appropriately be built to a '34 ft. curb-curb width with a 44 ft. curb to curb width (to accomodate a left turn channel) for 100 ft. from the intersection with Pacific Hwy. 5. Right--of-way width is generally predicated on the width of the street to be provided. In cases where a street may require widening or reconstruction in the future, the appropriate policy is to require a R/W width adequate for ruture needs. In this case, staff does not feel that it is likely that there would be widening. The 50 ft. right- of-way width would then bo appropriate for all of the proposed street except the first 100 ft. from its inter- sEction with Pacific Highway. Staff notes that only 40' of that 100 ft. falls within the subject site. 6. The preser ; and proposed land use of the site, the land areas and division, and the use and proposed future uses of land adjacent or near the site has reira ined unchanged since the Planning Commission heard the major land par- titioning in October, 1974. 7. The provision for a 60 foot right-of-way and the Subdivision requirement for construction of an 8 foot sidewalk on both sides of the street would be unusual and would he an unnecessary waste of land usage for these irregular- shaped .lots. Since there will be no on-street parking, pedestrian traffic will be minimal. Therefore, a reduction of the right-of-way from 60 feet to 50 feet and a reduction in width of sidewalks from 8 feet to 4 feet ar6 requested on the basis that the development of the parcel is made difficult by F;iLe, and physical con- figuration. Thus, this reduction will allow for greater usage of the land avail- able not only frr '`ie proposed restaurant complex, but for additional landscaping. The additional landscaping would further enhance the City's desire to improve the visual at-ality along Pacific Highway. These constitute special circumstances pec-ilia co the .land and development of this project. Because a 36 foot wide roadway will be built to conform to the existing contours, it would be a further hurdun to use the extra land for a 50 foot right-of-way and 8 foot sidewalks which would be a result of strict compliance with the requlaticris of this chapter, and would not appear consistent with the approved roadway. This variance is necessary for the preservation and protection of the City of Tigard's efforts in creating an urban environment. The granting of this variance will not be detrimental in any way to th'3 citizens of Tigard, their health, safety or welfare end will be consiStent therewith and shall not be injurious to the rights of adjacent property owners. In addition, the Page 2 Tigard Planning Commission March 27, 1975 variance will not constitute a departure from or be in violation of the Compre- hensive Plan of the City of Tigard. Rather than being detrimental, this variance will he assisting the City in creating a more pleasing highway environment. The proposal for a variance regarding this parcel conforms to and is consistent with all regulatory requirements of the Subdivision Code.
