Accordingly, the developers of Summerfield awning the property on both sides of this segment of 109th petitioned the Board of County Cannissioners for the vacation of said .road. A public hearing was properly advertised and held on July 23, 1974. A group of citizens living north of Summerfield, outside of your city and utilizing 109th as access to Durham, appeared at the public hearing and seemed in doubt as to what was being proposed. The Board of Commissioners, therefore, con- tinued the hearing to August 13, 1974 to give staff an oppor'.:uni_ty to fully explain to these peolble the proposals. At the public hearing continuation on August 13th, four of these owners were rep- resented by an attorney and expressed continued concern. At the close of the hearing the Board of Commissioners adopted a staff recommendation concerning this matter. Location ; Directly east of the current terminus of 5. W, Summerfield Drive at S. W. 98th Avenue; adjacent the 3rd tee. StafF Findings 1 . Conditions attached to the "Summerfield" Planned Develop- ment District, relating to the first phase apartment development are as follows: (1 ) Prior to the issuance of any building permit within the development, a site plan of the entire development setting Forth the site development standards shall be submitted to the Planning Commission. This plan shall include but not be limit,ad to landscaping, setbacks, building heights, signs, streets, proposed improvements, sidewalks, curbs.. gutters, parking, ^ervice and storage areas. ( 2) Each phase of the development shall be reviewed and approved by the Planning Commission. At the time of approval of each phase, the densities and uses shall be approved. 2. The staff supports the location and use proposed by the applicant. A need exists for this type of facility and the location is appropriate from the standpoint of access by vehicles and golfers. The structure is located 195 feet from S. W. 98th Avenue, a sufficient distance to prevent problems of traffic safety. 3. the site plan of the area surrounding the proposed structure has several limitations. °automobiles must back directly onto a public way to utilize the proposed parking. The Commission should consider the extension of these facilities east of S. W. 98th Avenue, Staff Recommendations Tabling the applicant' s request for approval until January 18, 1974 so as to enable the applicant to submit a revised site plan that is sensitive to the limitations HQscribed . n findings 3 and the question raised by finding 6. The staff recommends the Planning Commission reaffirm the cept of a 5 _foot._.sidewalk and 8 fcot bicycle path adjacent Summerfield Drive as shown .ih exhibit "D" of the Planned Development District approval by the Tigard City Council. However, following a more thorough study of the maintenance implication, of the proposed development the staff recommended a sixty foot right-of-way. Summerfield Drive DATE October 29, 1973 I have reviewed the Planning Director's memorandum of October 25, 1973, -etting out the background aspects of South Sttamerfield Drive which I understand the developer desires that the City accept not only as a dedicated street but also for maintenance responsibility. It is my understanding that the dedication proposes a 60-foot right-of-way and the drive has been improved to 36-root width -- curb to curb. The drive was depicted without dimensions on the concept map submitted by the applicant but no formal ap- proval was obtained prior to construction, pursuant to Section 92.014 Oregon Revised Statutes, which requires planning commission approval for the creation of a street or way for the purpose of Partitioning an area or tract of lend. "hapter 696, Oregon Laws of 1973 further provides : "No instrument dedicating land to public use shall be accepted for recording in this state unless such Instrument bears the approval of the city or county authorised by law to aeeept such dedication." Under the definitions of Section 17.08.130 (3) , Tigard Municipal Code, a collector street Is defined: ". a street supplementary to arterial street i system used to some extent for through traffic and to some extent for mraess to abutting properties." Brooks said that the City Attorney ' s office is updating the subdivision ordinance to bring it into conformance with the new state subdivision law. He also stated that the problem of interfacing the P. J. zone and the subdivision ordinance will. be esolved with this revisions. 7. Summerfield Bicycle Path A. Brooks read a letter from the Citizen Bike Path Committee and the Tigard School District expressing a need for a bicycle peth along Durham Road. The letter stated that two stut_ents were hit by cars last lear and the need for a facility along Durham Read is urgent. It continued, suggesting that the Tualatin Development Company construct a path along Durham rather than along Summerfield Drive as required by the Planning Commission. B. Whittaker said that both paths were needed and means should be sought of getting a path constructed on Durham in addition to the path along Summerfield Drive, C. Lewis said the Durham Road bicycle path is the County ' s responsibility, sighting a promise made to the high school students to construct this faciltiy. D. Mickelson said that taking the path off Summerfield Drive, a collector street, would result in the construction of a substandard facility. E . Bolen asked the commissioners to base th9.ir decision upon the public need involved and sug��ested a study be made to ascertain where the greatest need exists. He suggested that the greater need may exist on Durham Road and at this time it me be more to the public benefit to put a path on Durham than Summerfield Drive. F. After a thorough discussion the Commissioners agreed that the path along Summerfield Drive should not be j traded for a path along Durham Road. Summerfield Drive, Location: North of S.W. Durham Read, east of Pacific Highway. Staff Findings 1. The applicant (Tualatin Development ro. , Inc. ) has requested a change in the general development plan and program approved by Council Ordinance #73-5. Thi_- requested change involves a change in standards for planting strips and a proposed bicycle path and sidewalk along the edges of S.W. Summerfield Drive. The applicant proposes to : a Eliminate bicycle riding within the right- of-way adjacent S.W. Summerfield Drive. All bicycle traffic must necessarily travel nn S.W. Summerfiald Drive. Narrow sidewalk ai&.h south side of subject street from 8 feet to 5 feet. 2. The staff has interpreted the applicant' s request as a minor change in the general develorment plan and program, such changes to be approved by the Planning Dirictor, as per Section 18.56. 1E0, Tigard Municipal Code. Staff made a recommendation to the Planning Commission at their September 25, 1973 study session. Said recommendation was informally approved by the Planning Commission. Said recommendation was as follows: ° That the prop,-)sed sidewalks on both sides of S.LI. S-immerfield Drive be designated bicycle pathways. ° That said bicycle pathways be not less than 8 feet wide on both sides of S.W. Summerfield Drive ° That crop curbs be provided at all intersections of said bikeway with intersecting streets or drives, or other such design accomplished that will not cause a bicycle rider to dismount when traveling from the bikeway across a street or driveway. 3. The applicants have requested to be heard before the Planning Commission concerning their proposal. 4. The 1973 State Legislature passed and the governor has signed S. B. 693, providing an amendment to Chapter 176 Oregon Revised Statutes. Said legislation provides for "not less than two curb cuts or ramps pvr lineal block to be located on or near the crosswalks at intersections. Each curb cut or ramp shall .'e. . . . so constructed as to allow reaGonable access to the crosswalk for physically hanudicappe4 persons. Standards set for curbs arid ramps. . . . . shall apply to all new curb construction and to all replacement curbs constructed at any point in a block which gives reascnable access to a crosswalk. " 5. The pjblic safety is a factor in any decision relating to the subject proposal. Wherever possible, bicycle traffic should be spearated from automobile traff?c. As an ideal, pedestrian traffic should be jeparated from bicycle traffic, however, it is mora appropriate to mix bicycles and pedestrians then to mix bicycle and automobile traffic. From a safety standpoint, a pedestrian holds less chance of serious injury from a bicyclist, than injuries sustainable by a bicyclist from an automobile Staff Recommendation Disapproval of the applicants proposal. The Planning Commission giving authority to the Planning Director to approve a new submission by the applicant, meettrg the following standards: ° That the proposed sidewalks an both sides of S.U. Summerfield Drive be designated bicycle pathways. ° That said bicycle pathways be nut less than 8 feet in Width on both sides of S.W. Summerfield Drive. ° That drop curbs and ramps be provides at all inter- sections of said bikeway with intersecting streets Page 2 - Staff Report - Miscellaneous - 10-2-73 or drives, or other such design accomplished that will not cause a bicycle rider to dismount When traveling from the bikeway across a street or driveway. Said drop curbs and ramps shall be a minimum of 1130 inches wide of a slope not to exceed one inch rise per eight inch run" as per Senate Bill 693. ° The right-of-way width along S.W. Summerfield Drive shall not be less than 61 feet. A minimum 3j foot wide planting strip shall be placed between the curb line of S.W. Summerfield Drive and the proposed bicycle paths. Landscaping as proposed on the applicant'F rroposal received by the City September 17, 1973 :shall be adhered to, said landscaping to continue the full length of S.W. Summerfield Drive. Brooks presented the request , delineating the changes ;—inj requested. Basically , these --�—j� changes amounted to elimination of the bicycle r path adjacent to Su7nierfield Drive and the reduction of sidFwalk widths fic -; e to 5 feet. I s 2. Staff Re,.ummendation A. The staff recommended disappic,zil of the applicant' s request and suggested that the Planning Commission grant authority to the Planning Director to approve a ievised sibmission. This to meet a list of five standards included by staff with the recommendation. In summary these standards designated eight foot combined pedestrian- bicycle paths on hot:h sides of Summerfield Drive with dropped curbs at. all intersections. B. George Marshall , of the Tualatin Development Company , stated his disagreement with the staff recommendation. He said it was his belief that pedestrian and bicycles Should not be mixed. That based upon the 36 foot width of Summerfield Drive aild the fact that there will be few cars parked along this street , there is ample room for bicycles to use tha street. De Mr. Marshall said that people usually ignore such sigi.s and policing is difficult if not impossible. E. Hartman asked if a stripe identifying a bicycle land could be put along one side of Summerfield Drive. F. Brooks said that this type of path does not work well . G. Whittaker asked Mr. Marshall what the original basis was for the 36 foot spine road and bicycle path. H. Mr. Marshall said that the spine road required a greater width being the main traffic_ carrier in the development.. I . Whittaker then pointed out that the bicycle path was a selling point used by Tualatin Development Company when the zone change Was being considered. J. Lewy asked Marshali why Tualatin Development Company was de_erting their original plan. K. Marshall said that his cor^pany no longer Gees a need for a bicycle path. 3. Commission Discussion and Action A . Lewis stated his disagreement with the staff recommendation to put bike paths on beth sides of the street and suggested that Tualatin Bevelopment Company stick with their original plan. B. Mickelson suggested that a five foot sidewalk and 10 foot bike path be considered. C. Ball moved that using the standards recommended �-- by the staff that an eight foot pedestrian path be placed on one nide of Summerfield Drive and an eight foot bicycle path on Oe other. Mr. Marshall asked if the vote should have not been to approve or deny his request and if he so chose could he continue with his original plan. Mickelson asked if dropped curbs at inter- sections would still be required if Tualatin Development Company went with the -originally approved plan.
