The City's records indicate that when that portion of. lot 8e was dedi-
cated to the public (see attached deed dedication) , it `,v veal property
in ashinf;ton County and not within the City lirnits of Ti6ard. recond-
ly, when the City of Tigard annexed to the City certain areas coati'Euuus
to the City (see ,attached ordinance No. 67-2_0) , including Pinebrook
,>>rbdivision, on I�.arch 13, 1967, no provisions were stated in the ordin-
ance that the City would asstune responsibility for maintaining that
portion of lot 82.
Finally, on June 26, 19721 the City of Tii;ard passed Ordinance NO. 72-41
(attached), which accepted ,jurisdiction of certai.ji county ro:3ds, in-
cluding those in Pinebrook Terrace, but excluded that portion of lot 82
in question. Therefore, I believe it is safe to assume,based upon the
above-stated, docuiented Evidence, that the city of Tigard has at no
tti,ie accepted responsibility for that portion of lot 62, Pinebrook
Terrace .Subdivision, dedicated to the Public on Aulp ist 20, 1966.

Notes made during inspection of Pinebrook streets are as fol.1owst
1. Mmossive patching has been done, which indicates that
possibly the sub--hase was not adequate or that poor con-
struction methods were used.

3. Streets should be cleaned.
4. Driveways have not been made so as to easily accnsmsodate
sidewalks in future.

Subject: Pinebrook Subdivision Sanitary District
The Pinebrook Subdivision is located approximately x mile South
c of the City Limits of Tigard. The subdivision which includes
approximately 92 lots is being developed by A. G. A. Builders
(Stan Adkins) and is being serviced for sewage by a pack ge. treat-
ment plant located on a tributary of Fanno Creek. A, , � i

When the subdivision was platted, the closest city sewer litre was
approximately one mile away uphill at S.W. Burnham Avenue and
. s Highway 217. To connect to the city sewer system at that time
' would have necessitated a lift station and pressure line. The
State Sanitary Authority due to these circumstances entered into
a contract with the Pinebrook Sanitary District allowing the
construction of the package plant. While I have not seen the
agreement, it is my understanding that the tributary of Finno
Creek could be used for only 46 units . In the evant additional
units were built, construction of a 4" outfall line to Fanno
Creek would be required.
In .!ay of 1966 the City of Tigard proposed annexation of lands
inclurryed in the Tigard Water District of which Pinebrook subdivision
was apart. 'At that time the
p problem of the Pinebrook Sanitary
'+ District was first known to the City of Tigard. Preliminary discussions
were held concerning the attainment of a permanent- solution to the
3 sewage treatment problem in that subdivision. A change of events
had occurred whereby the city sewage system was now locator] approx-
imately ' mile via gravity from the Pinebrook Subdivision, due to
1 the construction of the pressure line and pumping station at Bonita
y Road and Fanno Creek.

The annexation election failed and the City did not participate
for the time being in further discussions concerning this matter.
In July 1966, the State Sanitary Authority through the Washington
County Building Department issued stop work orders on all construction
in Pinebrook Subdivision subject to the ccn.struction of the 4" outfall
line to Fanno Creek. At that time the City of Tigard agdinentered
into discussions concerning this problem. The developer approached
the City relative to obtaining a permanent solution to, the sewage
problem of the Pinebrook Sanitary Distr.ict.. It should 'be noted

out of a package) and the 4" outfall line would permit a temporary
solution only.

The Mayor and Council and city staff have met with thejState
Sanitary Authority and the developers in an effort to arrive at a
more permanent solution. The Mayor and Council on August 8, 1966,
i
stated that sewage service could be provided to the ar4a ,on contract
or through annexation. A contract price for the treatment of the
sewage would be quite high due to the fact that the Sanitary District
could not be dissolved and that this would necessitate the payment
of a sewage connection charge. Thn City Council. suggested annexation
prior to sewage service so that the Pinebrook Sanitary ;Distriet
N
assets could be dissolved.
A tenative agreement was reached between the developer, the State
Sanitary Authority and Washington County whereby the annexation
,,j would be proposed to the subdivision residents. The developer
�. after annexation, would enter into a contract with the -City of
Tigard to pay the total cost for the construction of the inter-
ceptor line from the Pinebrook Subdivision to thepumping station
at Bonita and Fanno Creek. It wasp roposed that a portion of this
r cost w-uld be returned to the developer upon future connections .
In early August at a meeting of the developer, Washington County,
and the State Sanitary Authority, tenative agreement was reached
' for a 90 day grace period in order to allow an attempt at annexation
? and thus a permanent solution to the sewage problem in that area.
3} As the Council will recall, the developer offered a bond to insure
at least construction of the 4" outfall line. Tho Stara Sanitary
Authority asked the County District Attorney to draw up the necessary
�i contract concerning this extension of time. On August 19, 1.966,
'4 the developers of the subdivision signed the county drafted document.
.� This document was forwarded to the State Sanitary Authority. It
should be noted that during this interval of time all building
.�? activity in the Pinebrook Subdivision had ceased awaiting the ,
c-rl completion of the contract. On 'Tuesday, August 23, 1966, the
developers of the subdivision were informed that the agreement
drafted by Washington County was inadequate and too open-endnd and
the Sanitary Authority refused to sign it.
In the meantime the Deputy County District Attorney ha4, 1eft for
vacation. On Wednesday, August 23, 1966, the developer stated

the problem to the City Administrator. on Thursclay, Auqust 25,
1966, the City Administrator talked with the State Sanitary Authority
concerning this problem. The State Sanitary Authority at that time
stated that the city had entered into the problem and had clouded
the issue, throwing up a smoke screen thus Preventing the State
Sanitary Authority from following through with their original
intention of forcing the construction of a 1" pr.nssure main to
Fanno Creek.
It appoars evident that the State Sanitary Authority is suffering
from the old bureaucratic problem called "red tape" . In its effort
to prevent pollution it has allowed itself to become mesmerized in
seeking temporary :solutions to the sanitar1► problem. Instead of
} forcing or cooperating on the construction of a proposed permanent
solution to the Pinebrook problem it has crosen through statements
to say the only interest of. the City of Tigard is to effectuate
annexation and that the annexation of the Pinebrook Subdivision
would be of benefit to the City of Tigard.
I feel that the City of. Tigard's interest in this matter hFs been
of one of attempting to solve the sewage treatment problems in our
area. The solution offered by the State Sanitary Authority is
; temporary. The residents of the Pinebrook Subdivision will in the
very near future, if the 4" outfall line is constructed, have to
find a more permanent solution on their own. It appears to me
that the City of Tigard has shown civic responsibilities towards
the alleviation of a potential health problem. The Stats Sanitary
Authority in its efforts to assure compliance with its contract
is forcing a temporary solution to a :-ajor sanitation problem. A
parallel case in Point could be shown where the State Sanitary
Authority was negligent in allowing the expansion of the Tigard
Sanitary Sewage plant and the construction mile upstream on
Fanno Creek of the Metzger Sanitary Treatment plant,
{ I feel that the City of Tigard has done all that is possible in
this matter. Quite a bit of time has been consumed by both the
City Administrator and the City Attorney in attempting to work out
a contract for the construction of the permanent gravity sewacri
line.

The conditions and assurances listed below are those which are require] for all
Public Law 84-660 projects.
You are advised that the project, as planned, will meet the requirements of
Section 8 of the Federal Water Pollution Control Act for reimbursement from
appropriations which may be made by Congress at some future date provided:
1. That actual construction work will be performed by the lump sum (fixed
price) or unit price contract method, that adequate methods of obtaining
competitive bidding will be employed prior to awarding the construction contract,
and that the award of the contract will be made to the responsible bidder sub-
mitting the lowest acceptable bid;
2. That the project will not be advertised or placed on the market for
bidding until the final plans and specifications have been approved by the
appropriate State Agency and the Federal Water Pollution Control Administration
and the applicant has been so notified.
3. That the construction contract will require the contractor to furnish
performance and payment bonds, the amount of which shall each be in an amount
not less than fifty percent (50%) of the contract price, and to maintain during
the life of the contract adequate fire, and extended coverage, workmen's
compensation, public liability and property damal;e insurance;
4. That any change or changes in the contract which make any major alter-
ation in the work required by the plans and specifications or which raise the
i cost of the project above the latest estimatr approved by the Federal Water
Pollution Control Administration, will be submitted to the FWPCA for prior
approval;
5. That the construction of the project, including the letting of
contracts in connection therewith, shall conform to the applicable require-
ments of Federal, State,Territorial and local laws and ordinances;
6. Ihat the cunstruction contract will prov-ide that the representatives
of the FWPCA and the State will have access to the work wherever it is in
preparation or progress and that the contractor will provide proper facilities
for such access hnd ir.+pection;
7. That the applicant wil :)rovide and maintain competent and adequate
engineering supervision and inspection at the project to insure that the
construction conforms with the approved plans and specifications;
8. That adequate accounting and fiscal records shall be maintained to
reflect the receipt and expenditure of funds for the purpose of this project
and all funds, however provided, for the payment of the cost of the project,
shall be credited, promptly upon receipt thereof, in a separate construction
account or accounts and these fundi shell be expended only for costs of the
project;

9. That the declarations, assurances, representations and statements
made by the applicant in the application, and all documents, amendments and
communications filed with the FWPCA by the applicant in support- of its
request for a grant, will be fulfilled;
10. That the applicant will submit to the FWPCA such documents and
information as they may require;
11. That construction contracts in excess of $2,000: will prescribe the
minimum rates of pay for laborers and mechanics engaged in the construction
of the project as determined by the Secretary of Labor pursuant to Section
6(f) of the Federal Water Pollution Control Act, (33 U.S.C. 466e) and in
accordance with the Davis-Bacon Act, (40 U.S.C. 276a through a-5) ; shall
contain the stipulations and provisions contained in Section 55. 32 of the
FWPCA Regulation,, (42 CFR, Part 55, SubNart B) ; and that all construction
contracts, regardless of amount, will require the contractor to comply with
the Regulations of the Secretary of Labor made pursuant to the Contract Work
Hours Standards Act, (40 U.S.C. 327 et seq.) ; the Anti-Kickback Act of JUne
13, 1934, (40 U.S.C. 276c), and any amendments or modifications thereto, to
cause appropriate provisions to be inserted in subcontracts to insure
compliance therewith by all subcontractors subject thereto, and to be re-
sponsible for the submission of statements required of subcontractors there-
under, except as the Secretary of Labor may specifically provide for reason-
able limitations, variations, tolerances, and exemptions from the requirements
thereof;
12. That the applicant will demonstrate i'u the satisfaction of the FWPCA
his ability to pay the remaining cost of the project;
13. That the applicant will demonstrate to the satisfaction of the FWPCA
that he has or will have a fee simple or such other estate or interest in the
site of the project, including necessary easement, and rights-of-way as the
FWPCA fit:ds sufficient to assure undisturbed use and possession for the
purposes of construction and operation for the estir.,aLed life of the project;
and in the case of projects serving more than one municipality, that the
participating communities have such intere •LS or rights as the E14PGA finds
sufficient to assure their undisturbed utilization of the project for the
estimated life of the project;
14. That the applicant agrees to construct the project or cause it to be
constru&ed to final completion in accordance with the application. and plans
and specifications approved by the FWPCA;
15. That the construction of the works under consider:,tion will result in
an operable project.
16. That the applicant will submit all Compliance Reports required by the
Office for Equal Opportunity in such form that they will receive its approval;

17. That upon completion, these facilities will be operated and maintained
in accordance with good practice and the applicable state requirements.
18. T}iat no federal contracts other than a contract dealing with a Public
Law 660 grant have been or will be executed which will cause federal monies to
be used for direct payment of any portion of the eligible costs of this project.
This assurance docs not refer to monies provided on a loan or repayment basis
or to supplemental grants which are properly authorized under the Economic
Development Administration or the Farmers Home Administration programs.
