(a) Robert Muse and Carl Anderson representing Coldwell Bankers, discussed with Council the property that is available in downtown Tigard. (b) , Consensus of Council was to discuss this matter in an executive session in the next few weeks. 4. REQUEST HERB MORISSETTE BUILDERS (a) Mr. Glen. McBride, Herb Morissette Builders, requested Council allow their company to wait until July 21, 1981, to complete the 1" overlay on Muttley's Addition Subdivision. (b) Director of Public Works requested Council allow the overlay to be completed by July of 1981, only because of adverse weather conditions for this type of work, L(c) but requested that all other deficiencies in the subdivision be completed immediately. Consensus of Council was to require completion of all deficiencies in Muttley's Addition Subdivision immediately except for the 1" overlay which must be com- pleted by June 30, 1981. RESOLUTION REGARDING CAPITA IMPROVK FNT PROGRAM FOR EXTRA CAPACITY STREETS (a) City Administrator �tetly ed the city's share of the Pacific Highway TSM project is approxi $119,000 to $150,0oo. Money to finance the project is to comyf from the Major Street System Development Charge Fund. However before an\, money can be spent an ordinance must be adopted by the City Coi:ocil , indicating a capital improvement program for the streets and '.ow the city will spend the money. (b) The last street ;,riority list for improvements was made in the 1971 Traffic Safety Stu3y and needs to be updated by the 1979-80 Traffic Safety Study. Bids for the TSM project are scheduled for thelatter part of September with the city making a deposit for their share from SDC funds in October. Since the 1.979-80 traffic study is not complete, City Administrator requested City Attorney to review the ordinance and report, and staled it did meet the city's needs for an interim improve- ment program. ! The preliminary estimate specified the following: a. Streets (& Lights) $54, 109. 55 b. Storm Drainage 14, 278.10 c. Sanitary Sewer 28029. 30 d. Water System 13,997.50 Therefore, the bonded total is $1109714.45 (performance bond) . 2. The attached letter requests release of $7,942.79 for street work; but since the paving is incomplete and building permits are currently being issued and since the weather is declining, the chance of losing the existing subgrade and subbase is very high (due to "pumping" ). Therefore, until the rcadways are paved, I cannot recommend release of monies which are intended to assure that such be completed satisfactorily. 3. The attached letter requests release of $82.63 for in- spection labor; but since the bond did not include such amount, we cannot "release" it. 4. The sanitary sewer has been installed and airtested and is nearly acceptable; since the bonded smount is $28029. 30 and since only minor work remains, I :gee no reason not to release the requested sum (26, 242.00) . 5. 'rhe water system has been installed ani is acceptable by the water district• therefore, release of up to the bonded amount (513,997. 505 is okay (their request is for $20,739.83) . 6. W I T N E S S E T H WHEREAS, Petitioner has applied to the City for approval for filing in Washington Lnty, a subdivision plat known as Kittley's Addition located S.W. 'kr S.E. L SPC. 34, . , . Williamette: Meridian, Washington County, Oregon; arid WHEREAS, the City of Tigard Subdivision Ordinance requires the subdivider to .nstall streets, sidewalks, street lights, storm sewers, sanitary sewers, underground utilities and other public facilities for the development and requires the payment of fees; and WHEREAS, the City has approved and adopted the standard specifications for Public Works construction by APWA Oregon Chapter and the Unified Sewerage specifications for the sanitary sewers prepared by professional * ngineers for subdivision development; and WHEREAS, the public improvements required to be constructed or placed in petitioner's development are incomplete, but petitioner has nonetheless requested the City to permit progressive o. .upancy and use of property in the .subdivi,3lon, and the pe-ties desire hereby to protect the public interest generally and prospective purchasers of lots in said subdivision by legally enforceable assurances that the public improvements will be instal 'ed as required and completed within the time hereinafter set forth. NOW, THEREFORE, in consideration of the foregoing premises and the covenants and agreements to be kept and performed by the Petitioner and its sureties, IT IS HEREBY AGREED AS FOLLOWS: (1) PtAl tionc.r shall procc►.d with the development, with the intent and purpose to complete all public improvements except sidewalks and street trees of said subdivision not later than two (2) years from the date of this agreement, and Petitioner is hereby ',ound to comply with all subdivision standards as set forth in said Subdiv' sion Ordinance and the standard specifications adopted by the City of Tigard, or as may be otherwise approved ,by the Public Works Department and to use only such material and to fol ow such design£ as may be required to conform thereto. (2) To assure compliance with the City's requirements and the provisions hereof, Petitiontr tenders herewith to the City a surety bond in form approved by the City, wit}+ liability in the amount of $_ 110,714.45 _ a copy whereof is hereto attached and by this reference made a part hereof. In the event such action be brought, Petitioner nd Petitioner's sureties promise and agree to pay, in addition to the amounts accruing -ind allowable, such sum as the court shall aijudge reasonable as attorney's fees and costs incurred `v the City, both in the Trial Cou- t and Appellate Court, if any, or ' the City ,ray, at its option, bring proceedings to iforce against the Petitioner and/or Petitioner's sureties :p-, cific performance of the contract and compliance with the subdivision standards and ordinances of the City of Tigard, and in such event, in liKe manner, the City shall be entitled to recover such sum as the court shall adjudge reasonable as and for the City's attorney's fees and costs, both in the Trial Court and Appellate Court, if any, (4) Petitioner, concurrent with the execution hereof, has deposited with the City 3n amount ctimated to equal re- tal and maintenance fees with respect to the street lighting facilities within SECT,ON 1 of the subdivision, according to Portland General El,:ctric Schedul- #91, Option B, together with a further sum equal to the estimated cost of providing electrical energy to energize the street lighting facilities for a period of two (2) years from the date of initial energizing of said lights. Said amount ^eing $ 401.76 (5) The City agrees to make and provide periodic and final inspections and in the City's judgment are necessary to assure compliance herewith, in consideration wnereof the Petitioner has paid prescribed inspection fees. The City agrees to install street identification and traffic signs within the said s_l,division, in consideration of payment in the amount of $ 127.80 (7) At such time as all public improvements except sidewalks and street trees within the subdivision have been completed in accordance w th the City's requirements. Petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have "Een met, the Petitioner will .submit to the City a good and sufficient maintenance bony', if not alrr;ady provided with the performance bond, form approved by the City in the sum of $_ 55,357.22 to provide for correction of any defective work or main- tenance hecomins apparent or arising within one (1) year after final acceptance of the public improv�-m nts by the City. (8) Upon receipt of certification by the Department of Public Works that all requirem-nts lave been met and a One Year Maintenance Bond, the City Council agrees to accept the pvblic improvements, subject to the requirements for correction of dpficiencies and maintenance for a period of one year as hereinabove set forth. Add air slowly to the portion of the pipe in,tnilatiou under test until the :utternal air pressure is raised to 4.0 psig. 5. ".heck exposed pipe and plugs for abnormal lc,akcage by G;oating with a so•.Lp ;volution. If any failures ars observed, bleed off air and make necessary t:epairs. 6. After an internal pressure of 4.O psig is obtained, allow at least two minute fcr air temperature to stal,ilize, adding only the ncount of air rcjuir.ad to maintain pressure. 7. After the two minute period, disconnect air supply. 8. When pressure decreases to 5.5 psig, start stopwat:h.
