This spring, construction was begun on a residence on tax lot 800. Morning Hill No. 1. subdivision, which includes Tract ] and tax lots 700 and 800 was platted in 1978. Tax lots 600 and 1.0900 ar-e riot included within this plat, but have been intended fur future development including the extension of Falcon Rise Drive. 2. Vicinity Information the pr.oper.ty to the south is developed and 1s zoned R 4.5 (Residential, 4 .5 units/acre) . The property to the east is zoned R-4.5 (PD) (Residential, 4.5 units/acre, Planned Development) ar►d has re,,ently received preliminary plat approval for a 140 lot subdivision. That plat would require a connection with the existing Falcon Rise Drive in front of the subject parcels. 3 . Site Information and Proposal Description The area subject to the application is presently configured as shown on the attached assessor' s m,ap (Exhibit 1) . The applicants propose to combine the eastern half of lot 36 (tax lot 800) and the western half of lot 35 (tax lot 700) into one parcel; create a second parcel from the eastern half of lot 35 and the northern portion of tax lot 600; create a third parcel from the combination of the southern portion of tax lot 600 and tax lot 10900; and a fourth parcel from adjusting the eastern boundary of Tract I. The proposed lot configuation is illustrated on Exhibit 2. Parcels 1 and 2 will each be 6,600 square feet in size. Parcel 3 would be 6,510 square feet and Tract I would become approximately 4,828 square feet in size. Because parcel 3 and Tract I would both be smaller 'char► the :',500 square foot lot size required in the R-a.5 zone, a variance is requested to the minimum lot size standard. Because parcels 1 and 2 would be larger• than the 5,000 square foot minimum lot size required for the R--7 zone which applies to those parcels, no variance to that standard is necessary. As justification for the requested variance, the applicants note that of the six lots immediately west of Tract I which ,Are also within the R-4 .5 (PD) zone, only one, lot 33, meets the 7,500 ;square foot minimum lot size standard. These lot sizes were permitted through lot size averaging provisions allowed by the Planned Development section of the Community Development- Code. 'The applicants assert that because of these existing lot sizes, the proposed lot sizes of parcel 3 and Tract I would conform with the neighborhood if not the Code requirement. 4. Agency and NPO Comments The E::ngineer•i.ng Divi.son reviewed the proposal and provided the following corm ones; 1) Falcon Rise Drive is designated as a minor collector• street according to the l^d3 Comprehensive Plan Transportation Map. Immediately west of the site, Falcon Rise Drive was constructed in 1919 to local street standards of 30 foot pavement width within a 50 foot eight.- of--way, with 3 inches of asphaltic concrete on 8 inches of aggregate baseruck. A temporary turn around area shall be provided, if recommended by the fire department, at the end of the street.. The Building Inspection Division and PGFreviewed the application arid offered no objection to tha proposal. The Tigard Water District has no objection but it is noted that the develuper will be responsible for moving the service laterals to the new parcels. Washington County Fire District No. 1 states that Falcon Rise Drive must eithor be extended to another street: or be terminated with an appropriate turn around area. Also fire hydrants must be within 500 feet if all of the proposed lots . GTE.: commented that relocation of GTE cables, and distribution boxes which are located on the existing lot lines will be necessary and that costs must be paid by the appli-ant. No other comments have been received. B. ANALYSIS AND CONCLUSION With the exception of the lot sizr variance request discussed below, the proposed partition and lot- line adjustment are consistent with the applicable standards of the Community Development Coda. Efficient utilization of the pr'uperty will resul.L and Falcon Rise Drive will be capable of becoming a through streat as called for in the City of Tigard Comprehensive Plan. In order to approve a variance request, the appi.ication must meet the following criteria conLained in Section 18 . 134.050 of the Code: 1. The proposed variance will not: bo materially detrimental to the purpose4 of this Code. be in conflict with the policies of the Comprehensive Plan, to any ciher applicable policies and standards; and to other properties in the same zoning district or vicinity; 2.. There are special circumstanc?s that exist, which are peculia, to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3. Tho planned development concept was to be used throughout. One important feature of this concept was to consider -average lot- size rather than require a minimum size standard for each individual. lot. As a result, the lot sizes on Falcon Rise Drive range between approximately 5,200 and 8,500 square feet in size. Since smaller lots are situated on the north side of the street., the R- 7 zone with a 5,000 square foot minimum lot size was applied. The R--4.5 zone, which has a 7,500 square foot minimum lot size, was applied to the arca south of Falcon Rise Drive. Although this zone applies, the majority of the lots on this side of the street are between 5,500 and 6,200 square feet in size. The two proposed lots on the north side of the street would both be approximately 6,600 square feet in size. This exceeds the 5,000 square foot minimum lot. size of the P- 7 zone, The variance is requested for the two loLs on the south side of the street which at 4,828 and 6,510 square feet would be smaller than the 7,500 square foal: mi•unuim lot size standard of Lhe R.-4.5 -zone. In this cw3v, 1ho warirince is justified, with a minor adjustment in the sizes of the southern lots, because the proposed lot sizes will be consist(:nt with the established pattern on Falcon Rise Drive. After the previous plan for Morning Hill was abandoned, the remnant parcels were not of a size that could be easily redeveloped in s!.rict accordancE, with the new R -4 ,5 zone designation. the proposed lul s will accommodate single family residences which are permitted in i.,oth the R--4.5 and R- 7 zones . The variance will not have an adverse impact upon existing physical or natural systems, such as drainage or traffic patterns. Falcon Rise Drive will be allowed to continue. The 5 foot side yard utility easements related to Lot 35 and 36 must be. vacated. In order to create lots that are as consistent as possible with those on the street, all lots should be a minimum of 5,000 square feet . -1h.is can be easily accomplished by expanding Tract "I" Lo the east. Background Tax lots 1S1 33DC 505 and 600 are part of the Ash Valley Tract: and were never, platted as part of the adjacent subdivisions, namely Ari Green and Morning Hill No. 1 , respectively. SW 130th Avenue, informally known as Ash Avenue (Lax lot 4200), was never dedicated to the public as a public roadway, but was created as a separate tax lct in anticipation of future development. In June 1988, a request for, a minor land partition (MLP 88-.04) t:o divide tax lot 1S1 33DC lot 600 into three parcels and to adjust the lot lines of parcels 700, 800, and former tract "I" was approved by the Director subject to conditions . The lot line adjustment brought lots 700 and 800 into compliance with the Code. With the adoption of the City Park Plan in November 1987, it became apparent that the southernmost portions of SW 130th Avenue would no longer be needed for public right—of—way purposes. In April 1988, the owner of tax dot 1.$ 33 DD 4201 quitclaimed the lot to Don_ Morissette - Builars, _Inc. The northern lots 7400 n�750b ch have been con sidired by staff as potential rights--of—ways, are owned by Washington County . 2 . Vicinity Information Please refer to the attached zoning map. 3 . Site Information and Proposal Description All of the lots except lot 2S1 4AB, lot 6600 are vacant and are covered by tall grass, weeds and construction debris . 'fax lot 1S1 MC, lot 600 has not only tall grass and weeds, but also one to a few trees which will necessitate tree removal permits upon development of this lot. Agency and NPO Comments The City Building Division, Tigard Water District, and Portland General Electric have all reviewed the proposal and have no objections to it. The Washington County Fire District has reviewed the proposal and has no objections. The City Engineerina Division notes that the ownership of the subject ;parcel, tax lot 42- has been resolved and that it now belongs to Dori \ Mor•issette Builders, Inc. Tax lots 7400 and 7500 ar•rz owned in fee title by Washington County . B. ANALYSIS AND CONCLUSION Section 18. 162.060 of the Tigard Community Development Code contains the approval criteria whereby the Director or his designee can approve, approve with conditions or, deny an application for a lot line adjustment. They are: 1 . An additional lot: is not created by the lot line adjustment and the existing parcel reduced in size by the adjustments is riot reduced below the minimum lot size established by ' he approved zoning for• that district. 2. By reducing the lot size, the 1_c or structure(s) on the lot will not be violation of the site development or zoning district regulations for that district. 3. If the applicant disagrees with the decision of the Director, an appeal shall be filed in accordance with Section 18.32,310(a) of this Code within 10 days . Application submission requirements for a lot line adjustment shall comply with Sections 18 . 162.070 and 18. 162.080 of this Chapter (preliminary and final application submission requirements) . The provisions of Section 18. 162,040 shall also apply to lot line adjustments. The lot; line &fl ustments proposed in this application will create larger and not smaller lots in all but one of the affected l,,ts. The zoning designations will remain the same. Tax lot 1S1 33DC, lot 4201, once reserved and known as SW 130th Avenue, will be reduced in size and will not meet average minimum lot width requirements. The lot will riot be buildable as a result. However, the City no longer intends that these lots be uRed for• public right-of-way and believes that they will eventually be "absorbed" via a lot line adjustment by properties immediately to the east.
