VS, tAt �'. kf"� *I M1�� A'.a Krd• � !' r r ;! a� a �jc m CITY OF TIGARD, OREGON RESOLUTION NO. 85- g(y SOLUTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IMPROVEMENT'S NSTRUCTED WITHIN KEVINGTON (McCOY ESTATES) SUBDIVISION WHEREAS, the City of Tigard Subdivision Ordinance requires bdividers to install streets, sidewalks, street lights, storm sewers, nitary sewers, underground utilities and other public facilities for the velopment of subdivisions; and WHEREAS, the City further required the payment of fees and the ecution of a Compliance agreement which stipulates that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject Lo the requirements for correction of deficiencies and maintenance for a period of one year. . ."; and WHEREAS, said Certification has now been received; and WHEREAS, the required performance bond has remained in full force effect throughout the normally required maintenance period of one year, and WHEREAS, no deficiencies remain to be corrected therein, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of ard , Oregon hereby accepts the public improvements constructed within ington (McCoy Estates) Subdivision, said subdivision being recorded in Book on Page 10 and 11 in Washington County, Oregon, Plat Records. Kimberly Drive WASHINGTON 6QUNTY,OREGON Tigard, OR 97223 \, RE: Letter from Consumer Sounding Board dated 4/24/84. Dear Mr. Thatcher: Standard operating procedure in Tigard is to provide the contractor or person applying for the permit a copy of the actual "as built" plan similar to the enclosed plan. Standard operating procedure in the U.S.A. service area is to dig three feet either side of the location given. If the service is not found the agency issuing the permit should be contacted to verify if in tact that your contractor has dug where the lateral location was indicated. A field inspection on site on May 9, 1984, shows that the location of the lateral was within 5 to 6 feet of where the "as built" had indir!ated it should be. Further, a prudent contractor would notice that the service line is connected to a 3' deep by 4' diameter manhole. A cursory look in the manhole would have shown that the lateral entered at an angle. There is a note on the plan that no marker was placed. Our public works department supervisor reports that you returned complaining that the sewer was too low to serve your property. This was after the lot had been lowered several feet at the sewer location. No information was provided that the alignment was incorrect. It would appear from our field inspection that you had to reconnect to the lateral 15 feet out from the manhole to gain enough grade to serve the house that was built on a lot that was lowered from the time the sewer was installed. Clear and sufficient information was easily available to any prudent contractor to determine the location of this sewer lateral . 1 can see no negligence on the part of the city in this matter. All this information was available prior to construction of the house. Please contact our Engineering Division if you require any further specifics. Applicable policies from the NPO 96 Plan are as follows: Policy. 2: The maximum overall density of development will be four (4) dwelling units or twelve (12) persons per gross acre. This amounts to a standard of 7500 square feet of land per dwelling unit allowing for streets and other openspace. Some areas will have a lower density owing to topography, existing development patterns, or the desire of individuals to own a larger lot. Policy 3: Resid(.ntial subdivisions will be developed with paved streets, curbs and gutters, street lights, and walkways, according to city standards. All utilities will be placed underground. Policy 4: Development will coincide with the provision of public streets, water and sewerage facilities. These facilities shall be (a) capable of adequately serving all intervening properties as well as the proposed development, and (b) designed to meet city standards. Policy 5: Planned unit development will be encouraged e,i tracts large enough to accommodate ten (.10) or more dwellings. Planned unit development will permit a degree of flexibility in design that will enable a higher quality of development in accordance with zoning standards. 3. Section 1.7.16.100, Tigard Municipal Code, states that: "No preliminary plat for a proposed subdivision and no map or major partition shall be approved unless: 1. Streets and roads are laid out so as to conform to the plats of subdivisions or maps of major partitions already approved for adjoining property as to width, general direction and in all other respects, unless the City determines it to be in the public interest to modify the street or road pattern. 2. Streets and roads held for private use are clearly indicated on the tentative plan and all reservations or restrictions relating to such private roads and streets are set forth there on; 3. The preliminary plat complies with the comprehensive plan, the applicable zoning regulations, and the regulations within this title; 4. There will exist adequate quantity and quality of water and an adequate sewage disposal system to support the proposed use of the land described in the proposed plat." 4. The site is a vacant, relatively flat field gently sloping to the south. A single family home is located on the southern portion of the lot, and a filbert orchard is located in the northern and of the parcel. Surrounding land uses are the Summerfield golf course to the north, the Cliurch of God and Church of Christ to the east and FINAL ACTION STAFF PEnORT . Sewer service is available to the site from an eight (8) inch line off of Durham Road for lots 5, 6, 7, and 8 and from an eight- (8) inch line at Kimberly Drive to serve lots 1, 2, 3, and 4. 6. water service is available to the site via. a twelve (12) inch line in Sw 98th Avenue. 7. A storm drainage plan was not indicated on the preliminary plat. 8. The existing right-of-way on SW 98th is fifty (50) feet, with twenty- five (25) feet at pavement :.n good condition and adequate shoulders. 9. No :_ire hydrant is indicated or: the preliminary plat. A letter from the Fire Marshall regarding this project must be received by the City prior to the issuance of Building Permits. CONCLUSIONARY FINDINGS: 1. The proposed preliminary plat conforms to NPO #6 Plan in that the lots all exceed 7,500 square feet. 2. The connection of Kimberly Drive to the Kerwood subdivision has been dedicated and proposed on the preliminary plat. 3. Both sewer and water service are available to the proposed site. 4. A street dedication of five (5) feet to provide for a sixty (60) foot right-of-way has been proposed on the preliminary plat. 5. A storm water drainage system will be required. STAFF RECOMMENDATIONS: Staff recommends approval of the preliminary plat of McCoy Estates subject to the following conditions: 1. No Occupancy Permits shall be issued until all conditions placed upon this development by the City of Tigard have been satisfied and inspections verifying this have been carried out by the appropriate department. 2. No changes will be made to approved plans of specifications unless formal application is made to the appropriate City department, and changes are approved by that department. Application for changes will be made in writing and shall include applicable drawings. 3. Grading and constructions plans for all work in public rights-of-way and all other public improvements shall be prepared by a registered professional engineer.- in accordance with City standards, and shall be submitted to the Public works Department for review. All existing and proposed utilities shall be placed underground. Street lighting installations shall be approved by the Public Works Department. 5. A metes and bounds legal description and map shall accompany a dedication of public_ rights-of-way, and shall be prepared by a registered engineer or land surveyor. 6. All streets and parking areas shall be concrete or asphalt. All sidewalks shall be concrete. 7. No Building Permits shall be issued until the expiration of the twenty (20) day appeal period from the date of approval. C sc- 8. Half street improvements to "Collector Street Standards" will be made 7, on the SW 98th Street frontage.
