CITY OF TIGARD, OREGON RESOLUTION NO. 81- 81 RESOC.UTION OF THE TIGARD CITY COUNCIL ACCEPTING THE PUBLIC IISPF.OVEIENTS CONSTRUCTED WITHLh LAUNA LYNDA PARK SUBDIVISION AND AUTHORIZING RELEASE OF THE MIAINTENANCE BO::D T11EREFOR. WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, street lights, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of sub- divisions; and WHEREAS, the City further required the payment of fees and the execution of a Compliance Agreement whirl, stipulates that: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year. . . ;" and WHEREAS, said Certification has n^w b,,e-i received; and WHEREAS, an acceptable Maintenance Bond has been in effect for the aforsaid maintenance period; and WHEREAS, all deficiencies have now been corrected, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public improvements constructed within Launa Lynda Park Subdivision, said subdivision being recorded in Book 41 on Page 16 in Washington County, Oregon, Plat Records. Unified Sewerage specifications for the anitary sewers prepared by professional engineers for subdivision development; and WHEREAS, the public improvements required to be constructed or placed in petitioner's J, v.-lopment are incomplete, but petitioner has nonetheless requested the City to permit progressive occupancy and use of property in the subdivision, and the parties desire hereby to protect the public interest generally and prospective purchasers of lots in said .subdivision by legally enforceable assurances that the public improvements will be l.nstalled as required and completed within the time hereinafter set forth. Pedestrian Access With Templeton Elementary and Twality Junior High schools adjacent on the west and approximately 35 acres of buildable land to the east , great numbers of pedestrian traffic is anticipated. No pedestrian circulation is shown . It appears that access easements and pathways bhould be provided through at least the .northern two cul-de-sacs . 2 .
