agreement of Krol Court, and r quest our immediate coL.-
pliance with paragraph 9 subsection (a5 which states:

SUBDIVISION COMPLIANCE AGREEMENT
THIS AGREEMENT dated the "-,, day of

WHEREAS, Petitioner has applied to the City for approval for
filing in Washington County, a subdivision plat known as _ Y
Karol Court ---—--
rocete�in Suction 3�, Township T Soukh, Range- West, wrilraarniette
Meridian; and Section 2, Township 2 South, Range 1 West, Willamette
Meridian; and
WHEREAS, The City of Tigard Subdivision Ordinance requires
the subdivider to install streets, sidewalks, ,street lights, storm
sewers, sanitary sewers, underground utilities and other public
facilities for the development and requires the payment of fees; and
WHEREAS, the City has approved and adopted certain standard
specifications prepared by professional engineers for subdivision
development, and
WHEREAS, the public improvements required to be constructed
or placed in petitioner's development are incomplete, but the petitioner
hes nonetheless requested the City to permit progressive occupancy and
use of property in the subdivision and the parties desire hereby to
protect the public interest generally and prospective purchasers of
lots in said subdivision by legally enforceable assurances that the
public improvements will be installed as required and completed with-
in the time hereinafter set forth,
NOW, THEREFORE, in consideration of the foregoing premises and
the covenants and agreements to be kept and performed by the petitioner
and his surety, it is hereby agreed as follows:
1. Petitioner shall proceed with the development with the
intent and purpose to complete all public improvements in said sub-
division not later than .Tune 1, 1970 and petitioner is hereby bound
to comply with all subdivision standards as set forth in said
subdivision ordinance and the standard specifications adopted by the
City of 11gard, or as may be otherwise approved by the Public Works
Department and to use only such material and to follow such designs as
may be required to conform thereto;
2. To assure compliance with the City's requirements and the
provisions hereof, the petitioner tenders herewith to the City a
corporate surety bond in form crproved by the City, with liability in
the amount of $15,500.00, a copy whereof is hereto attached and by
this reference made a part hereof;
3. In the event that petitioner shall fail, neglect or refuse
to proceed with the work in an orderly and progressive manner to
assure completion within the time limited, upon ten days notice by
the City to petitioner and petitioner's sureties, and such default
and failure to proceed continuing thereafter, the City may at its
option proceed to have the work completed and charge the costs
thereof against the petitioner and petitioner's sureties and in the
event the same be not paid, to bring an action on the said bond to
recover the amount thereof. In the event such action be brought
petitioner and petitioner's sureties promise and agree to pay, in

addition to the amounts accruing and allowable, such sum as the court
shall adjudge reasonable as attorney's fees and cost incurred by
the City, both in the Trial Court and Appellate Court, if any, or the
City may, at its option, bring proceedings to enforce against the
petitioner and/or petitioner's sureties specific performance of the
cnntract and compliance with the subdivision standards and ordinances
of the City of Tigard, and in such event, in like manner, the City
shall be entitled to recover such sum as the court shall adjudge
reasonable as and for the City's attorney's fees and costs, both in
the Trial Court and Appellate Court, if any.
4. Petitioner, concurrent with the execution hereof, has
deposited with the City an amount estimated to equal rental and main-
tenance fees with respect to the sl:reet. lighting facilities within
SECTION I of the subdivision, accorling to Portland General Electric
Schedule #91, Option B, together wish s further sum equal to the
estimated cost of providing electrical energy to energize the street
lighting facilities within said subdi,.ision for a period of two (2)
years from the date of initial energizing of said ligi,t.s.
5. The City agrees to make and provide periodic and final
inspections as in the City's judgement are necessary to assure com-
pliance herewith, in consideration whereof the petitioner has paid
prescribed inspection fees.
b. The City agrees to install street identification and
traffic signs within the said subdivision.
7. At such time as all public improvements except sidewalks
an:i street trees within the said subdivisi m have been completed in
accordance with the City's requirements, petitioner shall notify the
City of the readiness for final inspection and upon certification by
the Department of Public Works that all requirements of the City have
heen met, the petitioner will submit to the City a gond and sufficient
maintenance bond in form approved by the City in the sum of $7,750.00
to provide for correction of any defective work or maintenance becoming
apparent or arising within one year after the final acceptance of the
Public improvements of said subdivision by the City.
8. Upon receipt of certification by the Department of Public
Works that all requirements have been met and a One year Maintenance
Bond, the City Council agrees to accept the public improvements, subject
to the requirements for correction of deficiencies and maintenance for
a period of one year as hereinabove set forth.
9. That in addition to or supplementary of the requirements
of the City's Subdivision Ordinance and the provisions hereof, peti-
tioner binds itself to conform to the following requirements,
schedule and limitations:
(a) None of the Lots in said subdivision as above
described may be occupied for residential purposes until
an occupancy permit is issued under authority of the City
and no occupancy permit shall be issued prior to the acceptance
of the subdivision and to the time that the sidewalk paralleling
the street for each developed lot proposed to be occupied, is
installed as a part of the development; provided that all
sidewalks as required by the plans and subdivision code shall
be installed througbout said subdivision not later than three
(3) years from the date of this Subdivision Improvement
Contract.
(b) That improvement of the walkway to the City Park
be made within the above mentioned three (3) years or before

the completion of the last home in the subdi•;i:ion, which-
ever occurs first. The improvements to be zs submiu
to the City in plan by W. L. McMonagle Asso:iates, revised
8/1/69.
10. The parties hereto hereby adopt the form of performance
I,nnd, copy whereof is hereto attached and by reference made a part
hereof, and petitioner agrees to cause to have the said bond exe-
cuted and filed with the City concurrently with the execution of this
agreement at or prior to tale time this agreement is executed on be-
half of the City.
11. The specific requirements of Paragraph 9 hereof shall for
all purposes be included as a part of the obligation secured by the
aforesaid performance bond and the City shall be entitled to recourse
thereto in the event of default on the part of pvti�-ioner with respect
to any requirement thereof.
IN WITNESS W11HREOF, petitioner acting by and through its duly
authorized undersigned officers pursuant to resolution of its Board
of Directors has caused this agreement to be executed, and the City
acting pursuant to resolution of its Council adopted at a meeting

protect the public interesL generally and prospective purchasers of
lots in said subdivision by legally enforceable assurances that the
public improvemen►.s will be installed as required and completed with-
in the time hereinafter set forth,
NOW, THEREFORE, in consideration of ►.he foregoing premises and
the covenants and agreements to he kept and performed by the petitioner
and his surety, it is hereby nprend as follow»s
1. Petitioner shall proosed with the development with t'ie
intent and purpose to complete all public improvements in said sub-
division not later than .Tune 1, 1970 anti petitioner is hereby bound
to comply with all rnbdivision standards as set forth in said
subdivision ordinanck and the standard specifications adopted by the
City of Tigard, or as may be otherwise approved by the Public Works
Department and to use only such material aal to follow such 1PRi(7-1n as
may be required to conform thereto;
2. To assure compliance with the City's requirements and the
provisions hereof, the petitioner tenders herewith to the City a
corporate surety bond it form approved by the City, with liability in
the amount of $15,500.00, a copy whereof is hereto attached and !)y
this reference made a part hereof;
3. In the event that petitioner shall fail, neglect or refuse
to proceed with Lhe work in an orderly and progressive manner to
assure completion within the time limited, upon ton days notice by
t)ie City to petitioner and petitioner's sureties, and sur_;, default
and failura to proceed continuing thereafter, the City may at its
option proceed to )lave tits work completed and charge the costs
thereof against the petitioner and petitioner's sureties and in the
event the same be rot paid, to bring an action on the said bond to
recover the amount thereof. In the event such action he brought
petitioner and petitioner's suretien promise and 'nree to pay, in
addition to the amounts accruing and allowable, such sum as the court
shall adjudge reasonable as attorney's fees and cost incurred by
the City, both in the Trial Court and Appellate Court, if any, or the
City may, at its option, bring proceedings to enforce against the
petitioner and/or petitioner's suretice specific performance of the
contract and compliance with the subdivision standards and ordinancon
of tho City of Tigard, and in such event, in like manner., the City
shall be entitled to recover such sum as the: court shall adjudge
reasonable an and for the City's attorney's fees and .rests, both in
the Trial Court and Appellate Court, if nny.
4. Petitioner, concurrent with the execution hereof, has
deposited with the: City an amount estimated to equal renal and main-
tenance
aintenance fees with respect to the street lighting facilities within
SECTION I of the subdivision, according to Portland General Ilectr.ic
Schedule 491, Option D, together with a further Aum equal to the
estimated cost of providing electrical energy to energize tho street
lighting facilities within maid subdivision for a period of two (2)
years from the (late of i_iitial energizing of said lights.
5. The City agrees to mike and provide periodic and final
inspections as in the City's judgeunent are necessary to essure com-
pliance herewith, in consideration whereof the petitioner has pai,1
prescribed inspection feces.

7. At such time as all public improvements except sidewalks
aid street trees vithin the said subdivision have been completed in

been met, the petitioner will submit to the City a good and sufficient
maintenancm bona in form approved by the City in the sum of $7,750.00

apparent or ari►ing within one year after the final acceptance of the
public imL,,rovemunLZ of said subdivision by the City.
8. Upon receipt of cettifieation by the Department of Public

Ilona, the City Council agrees to accept the public improvements, subject

(a) None of the Lots in said subdivision as above
described may be occupied for residential purposes until
ati occupancy permit is issued under authority of the City
and no occupancy permit shall be issued prior to the acceptance
of the subdivision and to the time that the sidewalk paralleling
trip street for each developed lot proposed to be occupied, is
installed as a part of the developments provided that all
sid,•walks as required by the plans +end subdivision code shall
be installed throughout said subdivision not later than three
(3) years fr(re the date of this Subdivision Improvement
Contract.
(h) That improvement of the walkway to the City Park
be made within the above mentioned throe (3) year!e or laefo.-o

10. Tne parties hereto hereby adopt the form of perfor,..ance

hereof, and petitioner agrees to cause to have the said bond nxe-
outod and filed with the City concurren_ly with the execution of thin
agreement at or prior to the time this agreement is executed on be-
half of the City.
11. Tie specific requirements of Paragraph 9 hereof yhnll for
all purposes ba included as n part of the Obligation secured by the
aforesaid performance bond and the City shall be entitled to recourse
thereto in the event of default on the part of petitioner with resper,t

In reply to your letter of ,January 26, we would assume that the developer on
the above subdivision, Crown Development Corporation, posted their bond with
you before your building permit was issued, and, if that is in fact the case,
you, of course, would not want to disturb it until the maintenance period for
that particular project had expired.
If Crown Development Corporation's request for transfer to the City of 1.4gard
is based on the maintenance period having expired, no transfer as such is nec-
essary. When the maintenance time Is up, the City would thereafter be liable
for maintenance.
As far as changing our bond to guarantee the maintenance period, remember
that we _)onded Kearney Bros. Inc. who was merely a contractor working for Crown
Development Corporation. If C,,-own did not post the bond with the issuance of
the building permit, you would have to look to their surety for this bond.

Before the City of Tigard can issue occupancy permits in
the. Karol Court Subdivision, it will be necessary for you
to complete the Suodivision Compliance Agreement, herewith
enclosed. Please note that this agreement should be accore--
panied with a maintenance bond in the amount of $7,750 for
a period of one year from the date of acceptance and a de-
posit cf $108.00 with the City to cover street lighting for
a period of two years. The performance bond required by
the City has &lready been received.
Our records show that the remaining improvements for the su'a-
division are the public walkway and street lights. If you
would please indicate in paragraph 1, the .+anticipated date of
completion, it would be appreciated.
The electrical layout has anticipated street lights between
Lots 9 & 10 and Lots 1 1 2. The style you install is of your

City agrees tc make provision in its budget. In consideration of
said deposit, the City agrees to include in its general Fund budget

subdivision have teen completed in accordance with City's requirements,

accept the public improvements, rubject to the reautrerents for cor-
