Dear Frank:
This letter is to provide additional narrative related to storm
drainage planning at the intersection of Hall Blvd. and Durham
Road and the plans which we have prepared for the Plaid Pantry
financed street improvements.
A number of specific parameters and solutions are involved with
our proposed design:
1. Our choice of size, type and grades of storm drain pipes
is extremely limited by the 10" high pressure gas line
on Durham, the very larye concrete-enclosed telephone
ducts on both Durham and Hall , and the shallow grade and
limited capacity of the e-..isting 30" storm drain on
Durham.
2. Calculations show that the 30" pipe does not have the
capacity to handle the additional drainage contribution
from the under-developed area north of Durham Road after
that area is developed. Future storm drain planning
should propose intercepting the 24" line from Hall Blvd.
and take it easterly on Durham Road.
3. Because of grade conflicts with the gas line and the
concrete-enclosed telephone ducts, special arch-pipe
construction si used to cross Durham Road. The lower
portion of this arch-pipe would be under slight pres-
sure if the 30" pipe flowed full . Therefore, the arch-
pipe will be installed with watertight joints.

are attached. I believe our proposal handles this tough situa-
tion in a proper manner.
We are requesting your earliest approval so that construction
can be complete by our September 2, 1983 deadline, in order to

J,-7r Mr. Thompson:
Your letter of June 29, 1983, regarding the 15 foot strip of land run-
ning along the south property line of our parcel., has been referred to
me for action. Frankly, we were very surprised that this strip was
still an apparent problem, because our records show that Mr. Joe Bailey,
your former Ci,y Attorney, was going to take action in 1980 to resolve
this problem.
At that time an investigation by an attorney retained by the broker
representing the Randall Co. in this land transaction, revealed that
this property is unowned, with no recorded landowner in the Washington
County tax records. It is my understanding that heing the case, Mr.
Mc Clendon, the attorney, met with Judge Musick, a Washington County
Circuit Court Judge, to determine what type of action he should take
on the matter. Judge Musick instructed him to have the City initiate
action to take over this unclaimed property for the benefit of the
public. Later Mr. Mc Clendon met with Mr. Bailey and it was his
understanding that this process had been initiated to resolve the
matter. Your letter was the first indication we have had that this
has not occurred.

By copies of this letter, I am requesting that Mr. Sullivan, your
City Attorney, look into this matter to determine why the solution
we had arranged has not been followed through. I, of course, am
willing to assist him in any manner necessary to resolve this matter.
Mr. Mc Clendon has also been appraised of this problem and will. do
likewise.
Given the facts surrounding this property, I see no reason that this
situation should obstruct the resolution of access design for the
Plaid Pantry or Summerplace Village Of course, we need accurate
information from your department on the location of Durham Road
relative t., Lias parcel and on how its existence will effect the
dedications required from our property on Durham Road.
C,ven this information, I am sure that our Company, Plaid Pantry
and the C ty can move ahead to a prompt resolution of this problem.

REQUEST: For a Site Design Review to construct a two phase commercial
development consisting first of a 2,400 square foot convenience
store, and then a 3,800 square foot commercial addition within two
years.
COMPREHENSIVE PLAN DESIGNATION: Neighborhood Commercial
ZONING: C-4
PREVIOUS ACl1ON: On December 24, 1980 the Planning Director approved a Site
Design Review for 72 multi-family units with a convenience
center on the site.
S11L PLAN/DESIGN REVIEW:
The applicant is proposing to construct the project in two phases. i'hase I
will be a 2,400 square foot Plaid Pantry store. Phase 11 will be 3,800 square
feet of leased retail space. The site is .62 acres , is zoned C-4 and
designated Neighborhood Commercial on the present Comprehensive Plan.
The site plan submitted by the applicant was originally approved in 1980.
However, since that approval, the applicant has modified the plan to include
an additional access point onto Durham Road. For that reason, the Planning
Director has required that the applicant resubmit for a Site Design Review.
In addition, the applicant recorded a Minor Land Partition for the .62 acre
parcel without filing a Minor land Partition application with the City. The
building configuration and parking lot proposed are the same as were approved
in 1980 as part of a large residential project with convenience facilities.
However, the Minor Land Partition, if approved, will put the proposed building
in violation of the setback requirement in Section 18.32.040 of the Tigard
Municipal Code which requires a 25-foot rear yard setback for C-4 projects
abutting a residential zone.

'lhe parking requirement for Phase I is six (6) spaces (2400 - 400 = 6). '!he
site plan indicates seven (7) parking spaces for Phase I. The site plan
proposes two access points: one 30 feet in width off S.W. Durham and a second
40 feet in width off S.W. Hall Blvd. Durham Road is under Washington County 's
jurisdiction. The access onto Durham Road has been approved by Washington
County and meets the city 's code requirement for access under Chapter 18.64 of
the Tigard Municipal Code. Hall Blvd. is a State Highway. Ilhe access onto
Hall has been reviewed and approved by the Oregon Department of Transportation
and meets the TMC Code requirements for access and egress.
'lhe applicant has submitted a landscape plan which conforms to the
requirements set forth in Chapter 18.59 of the 'ligard Municipal Code.
However, no irrigation plans were submitted. Plans for public water and sewer
connections have been submitted.
There was no site drainage plan submitted with the Site Design Review
application.
S.W. Hall Blvd. is not improved to arterial street standards in front (:f the
site. Improvement plans for S.W. Hall have been reviewed and approved by the
Oregon Department of Transportation and the City of ligard's Engineering
Division. S.W. Durham Road has been improved to collector street standards in
front of the site. Improvement plans have been submitted to and reviewed by
the City's Engineering Division for improvements to Durham Road.
STAFF RECOMMENDAIION:
Staff reco►mnend.r, approval of SDR 26-82 with conditions as follows:
1. All public improvements shall be made in accordance with plans approved by
the City's Engineering Division. A bond shall be posted for 100% of the
cost of the improvements prior to issuance of Building Permits.
2. A street opening permit shall be required to tap into the sewer line in
the public right-of-way. A bond for 100% of the cost of connecting the
sewer line shall be posted with the City of Tigard prior to issuance of
Building Permits. In addition, the Engineering Division shall inspect the
sewer line connection prior to the line being covered.
3. A site drainage plan showing finished floor elevations shall be submitted
to and approved by the City of ligard Engineering Division prior to the
issuance of Building Permits.
4. An irrigation plan shall be submitted to and approved by the City of
Tigard Planning Division prior to the issuance of Building Permits.
