WHI.RFAS, the City executed a Subdivision Compliance Agreement dated April 15, 198'), with titan Properties Corporation to facilitate installation of public 'stroot, storm and sanitary sewer and streetlighting facilities to City standw d�: and specifications; and WH[RIAS, said Compliance Agreement stipulated that: "At, such time as all public improvements have been r-ompleted in accordance with the City' • requirements, Petitioner shall notify the City of readiness for final inspection and upon certification by the Department of Community Development that all requirements of the City have been met, the Council agrees to accept said improvements, for, operation and maintenance responsibility, and release the Petitioner's guarantee bond;" and WHER[AG, Department of Community Development staff verifies that all requirements of the City have been met; and NOW, 1HEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1 : T•he Tigard City Council hereby accepts the public improvements known as Colony Creek No. 4 subdivision public ,improvements. The Tigard Planning Commission reviewed the above application at a public hearing on January 8, 1985. The Commission based its decision on the facts, findings and conclusions noted below: A. FACTS 1. General Information CASE: Planned Development PD 6-84, Subdivision S 11--84 REQUEST: Detailed Planned Development and Preliminary Plat approval for a 15 lot residential development COMPREHENSIVE PLAN DESIGNATION: Medium Density Residential ZONING DESIGNATION: R-7(PD) (Residential, 7 units/acre, planned development) APPLICANT: Titan Properties OWNER: Same 2201 Cornell Road Hillsboro, OR 97123 i LOCATION: East of Hall Blvd. and north of Fanno Creek Drive (Wash. Co. Tax Map 2S1 1288, Tax Lot 100) 2. Background Preliminary Plat and Detailed Planned Development approval was granted by the Planning Commission in February, 1984, for Phases II, III, and IV of the Colony Creek development (PD 2-83, S 11-83, ZC 2-84, and V 6--83) . Phases II and III were intended to be platted with Bingle family residential lots and Phase IV was approved for townhouse development. Phase II has been platted and partially developed. 3 . Vicinity Information Phase I and II of Colony Creek Estates He to the west and south. Waverly Meadows, a single family residential development is immediately east and the Fanno Creek flood plain occupies the northern portion of the subject property as w- 11 as the parcel to the north. Site Information The ro ert con d i lication is Phase IV of Colones Creek es. he applicant proposes to modify the original concept for this segment of the project to single family lots rather than townhouses. Fifteen lots ranging from 4,400 to 10,875 square feet are proposed. Lots 2 through 12, 14, and 15 are designed for 0 foot side yards on one side. All of the units will be detached. 5. Agency and NPO Comments The Engineering Division has the following comments: a. The portion of the property within the 1.00 year flood plain should be dedicated to the public as greenway . b. The developer should consider locating the sanitary sewer between Lots 6 and 7 to avoid the flood plain and the need for a sensitive lands review. C. Due to the small lot frontages on the cul-de-sac, joint driveways are recommended. d . Lots 2 and 13 should have driveways located at the north enL1--Qt the parcels to eliminate traffic conflicts near the intersection of F'anno Creek Drive and the cul.-de-sac. Also, a common driveway for Lots 14 and 1.5 is also advisable to minimize the --number of curb cuts. e. All storm and sanitary lines that are to be maintained by the public will require a 15 foot wide public easement. The Building Inspection Office notes that one hour fire walls are required for all structures within 3 feet of a property line. 'The Tualatin Rural Fire Protection District notes that a fire hydrant is needed at the intersection of Fanno Creek Drive and the cul-de-sac. NPO #5 reviewed the proposal aid although a quorum was not present to take formal action, it was viewed favorably by the members present. 8. FINDINGS AND CONCLUSIONS The relevant criteria in this case are Statewide Planning Goals 1, 2, 5, and 10; Tigard Comprehensive Plan policies 2. 1 . 1, 3 .2. 1 3 .5. 3, and 3 .5.4; and Chapters 18.52, 18 .80, and 18 , 160 of the Community Development Code. The Planning Commission concludes that the proposal is consistent with the applicable Statewide Planning Goals and Guidelines based upon the following findings: FINAL ORDER NO, 85-0Z_PC Paige 2 a � a. Statewide Planning Goal #1 is met because the City has adopted a Citizens Involvement program including review of all development applications by the Neighborhood Planning Organization (NPO) . In addition, all public notice requirements were met. b. Statewide Planning Gaal #2 is met because the City applied al: applicable Statewide Planning Goals, City Comprehensive Plan Policies and Development :ode requirements to the application. C. Statewide Planning Goal #5 is met because development will avoid the 100 year flood plain. d. Statewide Planning Goal #10 is satisfied because the proposal will provide for housing as contemplated by the City Comprehensive Plan. The Planning Commission has determined that the proposal as submitted, or with minor modifications, is consistent with the relevant portions of the Comprehensive Plan based upon the findings noted below: { a. Plan Policy 2.1 . 1 is satisfied because the Neighborhood Planning Organization and surrounding propE^ty owners were given notice of the hearing and an opportunity to comment on the applicant's proposal. b. Plan Policy 3.2. 1 is satisfied because the development shall not include any portion of the Fanno Creek flood plain. C. Plan Policy 3 .5.3 is satisfied because the 100 year flood plain shall be dedicated as greenway. This is consistent with the Open Space designation for the Fanno Creek flood plain that is shown on the Comprehensive Plan Map. d. The proposed site plan will require a minor adjustment to conform with Plan Policy 3 ,5.4. The Detailed Plan which was approved by Planning Commission last year included an 8 foot wide, paved path connecting Fanno Creek Drive and the flood plain parcel to be dedicated to the City . This path is to be located between this project and Colony Creek I and II. A condition of this previous approval stated that the path shall be installed and bonded along with the other public improvements . This path shou:d be included with this phase of the development. The Planning Commission has determined that the proposal is consistent with the relevant portions of the Community Development Code based upon the findings outlined below: a. Chapters 18 .80 and 18. 160 of the Code is satisfied because the preliminary plat/detailed plan meets the requirements set forth in the Code. b. The pedestrian/bicycle path shown on the previous plan shall be installed. FINAL ORDER NO. 85-42_PC Page 3 Although not required by the Code, the staff recommends that the 0 foot side yards on Lots 9 through 12 be shifted from the southern lot line to the north. This will allow for improved solar access since the Building Codi does not permit windows for walls on the property line. C. DECISION Based upon the above findinr;s and conclusions, the Planning Commission grants detailed appro-al of PD 6-84 and preliminary plat approval of S 11-84 subject to thz following conditions. 1 . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO RECORDING THE FINAL PLAT. 2 . Seven (7) sets of plan-profile public improvement construction plans e.nd one(1) itemized construction, cost estimate, stamped by a Regi3tered Professional Civil Engineer, detailing all proposed public improvements shall he submitted to the engineering Section for approval. 3 Sanitary sewer- plan-profile details shall he provided as part of the public improvement plans. This shall include necessary off-site sanitary and storm sewer easements. 4 . Constructiun of proposed public improvements shall not commence until after the Engineering Section has issued approved public improvement plans . The Section will require posting of a 100% Performance Bond, the payment rf a permit fee and a sign installation/streetlight fee. Also, the execution of a street opening permit or construction compliance agreement shall occur prior to, or concurrently with the issuance of approved public improvement plans. In accordance with ORS 92.060 subsection (2), O.e centerlines of all street and roadway rig +t-of-ways shall be munumented before the City shall accept a street improvement. All centerline monuments shall be placed in a munument box conforming to City standards, and the top of all monument boxes shall be set at design finish grade of said street or roadway .
