Dear Mr . Perr i_ne
We have investi-ated your excavation along Lots
23 to 27 and Lots 30 to 3�, Block 3 in Burlwood t:^ . 4 and
find thatyou have excavated by hack_hoe right adjacent
to the curb. This is the first time you have excavated in
this way. This letter is to inform you that any damage to
the streets from your Lmproper excavation including the
crossing between Lot 24, Block 3 and Lot 2, Block 6 is
directly the responsibility of Portland General. Electric .
The back-fill awtertal which was used in this
area was improper since it is directly under the inter-
section of ;she city sidewalk. We he .eby request that this
inn t(�r. t.al `.,c teplaced immediately.
if t'aere are any questions as to the responsibility
and the action taken, please -,all .
Since the start of our development which dates back
three years , the electrical facilities have been installed
after all. the cons truetion has taken place, even after man),
requests of the developer and tauilder to have adequate
electrical f,acilitic16 in early in the project so that nur
builder could commence. The streets have been complete0
approximately a minimum of 45 days and service 1.9 still
not supplied to the builder by underground.

50 percent of the construction costs for a period
of one year, the as built plans , and a certification
from the engineer that the supervision was in
accordance with your specifications with a copy of
the air test report. I believe chis completes
your request in your letter of October 17 , 1968 ,
and I request acceptance of the streets in Burlwood
into the city street system.

therewith has promised and obligated itself to maintain said sewers, streets
and storm drains and to correct any defects in said sewers, streets and
storm drains for a period of one year following acceptance by the City;
NOW, THEREFORE, the condition of this obligation is such, that, if the
Principal shall maintain said sewers, streets and storm drains and correct
any d,fects in said sewers, streets and storm drains for a period of one
year following acceptance by the City, then this obligation shall be void:
