Acceptance is now the responsibility of the City of Tigard. If

Attention: Mr. Bob Logan Re: Burlwood Subdivision
Gentl,amen:
On May 5, 1966 the writer and Mr. Hardie from the Pettijohn Engineer-
ing Company inspected the streets ii-, the Burlwood Subdivision. The
curbs and paving had been completed as follows:
(a) On S. W. Sl;mmer Crest Drive from S. W. 121st Avenue to the
southeasterly edge of Lot 1, Block 3.
(b) On S. W. Burlcrest Drive from Summor Crest Drive to the north-
easterly edge of Lot 6, Block 3.
The curbs and paving appeared to have been properly constructed origi-
nally, but the present house builder is using :he streets to stockpile
excavated material and has broken and chipped the curbs with his exca-
vation equipment. Also t%e builder his been breaking out the curbs to
install drain pipes and driveways and has been doing a very poor job of
repairing the curbs.
To guarantee the City of Tigard that the streets were properly con-
structed and are in an acceptable condition, we recommend that the
following items be completed:
(a) The City receive a letter from the County Engineering Department
certifying that the above streets were constructed to County stand-
ards.
(b) That the Contractors furnish the City with a Guarantee and Mainte-
nince Bond for 100010 of the cost of the streets to include care of
backfilling of ditches or at structures should the fill settle to such
extent as to require refilling or resurfacing roadway surfaces to
restore the original or intended condition or grade. This guarantee
should be understood to imply prompt attention to any remedy of

such defects as those mentioned ,above if and as they occur after the
Contractor shall have written notice of their existence. If the defect,
in the opinion of the City, is of such nature as to demand imm-diate
repair, the City shall have the right to make them and the cost thereof
shall be borne by the Contractor. To support the above guarantee the
bond should remain in full force and effect for one year following the
acceptance of the project by the City. The bond should be executed
by a surety company authorized to do business within the State of
Oregon and it ar .d be subject to the approval of the attorney for
the City.
(c) The streets and curbs be cleaned and repaired to a like-new condi-
tion. This work should be brought to a standard acceptable to the
City inspector,
Upon completion of the above items -.lve recommend the City of Tigard
accept the constructed portion of Summer Crest Drive and Burlcrest

Attention: Mr. Merrin Re: Burlwood Sanitary Sewer System
Gentleman:
There is a. serious qucetion in the mind of de City of Tigard as to
infiltration into the sanitary sewers above the manhole at which the Burl-
wood Sewer Syste,n connects into the Leron Heiphts Sewer System. The
' flow in the I3e•::ers at this point, considering that: there is Only one service
connected to the lines aLove it, seeclis quite high. Accordingly acting as
City Engineers for Tigard, we request that you arrange to make flow
teets at the: subject manhole and measure both the flow from the Purlwood
System and the flow from the Leron Heights System. If you do not feel
that it ;9 appropriate x,.r you to measure the flow from the Leron Heights
,system, then please malre suitable arrangements with Afr. J. A. Paterson.
When the flow weasurernents have been made, please report them
to the City. Furthermore until Puch time as the City anrees to accept the
flow from the Burlwood Systern for treatment at its Plant, please arrange
to have the Burlwood System plugged at the manhole that the Burlwood
System discharges into. This letter in no way is intended to be a re:flec-
tiun an the efforts of your organization. However, a probl,.i : eerns to
exist and we feel that through actual nieasureiiaent of the flow,( ,+.e prob-
lem can be isolated and a solution found. Your cooperation in this matter
