WHEREAS, the City of Tigard Subdivision Ordinance requires the installation of streets, sidewalks, streetlights, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City required the payment of fees and execution of a Compliance Agreement, which stipulated that: "At such time as all public improvements except sidewalks and street trees within the said SF,CTION II of the subdivision have been completed in accordance with the City's requirements, petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have been met, the ;petitioner will submit to the City a good and sufficient maintenance bond in form approved by the City In the sum of $36,108.00 to provide for correction of any defective work or maintenance becoming apparent or arising within one year after final acceptance of the public improvements of said SECTION II by the City"; and further that "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to .accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year as hereinabove set forth"; and WHEREAS, the petitioner has now requested final Inspection; and WHEREAS, said certification has now been recetved, that all required construction is satisfactorily completed, along with a recommendation to forego the requirement of the aforementioned maintenance boiid, since the (project) performance bond remained in effect throughout the normally riquired one year maintenance period, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public improvements constructed within SECTION II of BROOKWAY Subdivision, said subdivision being recorded in Book 28 on Page 1 In Washington County, Oregon, Plat Records, Page 1 L AND FURTHER, the City Council hereby nullifies the requirement of submission of the aforesaid maintenance bond. Sidewalks fronting 121.65, 12175 and 12195 S .W. 124th have been installed. i �. Damaged sidewalk sections at 12285 S .W. 124th and fl t ' through,- the City Park section have been replaced. II ��. Driveway approach at 12103 S .W. 12.5tb has been repaired. Sunken grade over sewer trench near the manhole at 125tb and Katherine has been overlayed. •. Water infiltration in the sewer manhole at 1250 and Katherine has been stopped. I I All damaged curb sections where home building contractors have roken out for rain drains to the street have been repaired. i 7. Street barricade at East end of Katherine Street has not been erected. Although a street barricade is usually justi- fied in a location where a dead end street is dedicated, improv- ed, and future extension for a through public way is pending, this particular case has two unique problems. (1) Katherine Street is already dedicated all the way through from Brookway to 121st. The School District dedicated this to the City several years ago, but dia not improve it. Can this public way be legally barricaded is the question? In Wash- ington County I have experience where a street barricade was c0astructed blocking the public way, also not improved as in this case but dedicated beyond the obstructing barricade at the end of' U,e paved street. The barricade was ruled illegal and had to �e ..emoved by the developer. This was so even though it was located in what seemed to be an appropriate place at the time. ILA ( � 2 Mr. Max Miller who lives at 12350 S.W. Katherine Street( end of Katherine Street in Brookway on the South side) uses the public way for access to his trailer storage area beyond his house and driveway. If a barricade is erected as per City specifications for same, Mr. Miller will be denied access over the public way in question. In light of the legal question and the inconvenience that Mr. Miller will suffer, I am reluctant to erect the street barricade you request at the East end of Katherine Street in Brookway. �` � � r 8. One as-built sanitary sewer cepia is being checked and prepared by McMonagle & Harris and will be submitteeA by them as soon as possible. I would like to request a waiver of the maintenance bond for the following reasons. The streets and major improvements were completed and have been in use for over three years , since September 1972. Street lights were installed and energized about a year later at which time the first final inspection was re- quested. No .inspection was made and no further action initiated ,,by the City until April 1974. Another final inspection was then scheduled but again not accomplished. This subject inspection was finally set up just prior to Mr. Hiebert' s leaving the City' s �t employment. Because of this procrastination and since the major improvements have been in and used for over three years, it 6�"would be very difficult and I feel unnecessary to get a ma: nten- 5��,r�2 ance bond, the prime purpose of which is to provide for correction of any defective work or maintenance ;.)ecoming apparent or arising within one year after acceptance , which should have been done a long time ago. If the City is not to be in violation of its own Ordinance Title 7, Chapter 7.10, Section 7.10.020, the park area should be mowed before too long. Due to the nature of the marshy terrain, if anything in to be accom},'ished in the park this year- -even to the extent of mooring the grass--it should be done in August or early September. At one time the area was rough graded and the creek in a channel with some latera] drainage ditches running rough]y Korth to the creek to kmep the ground fairly solid. Last year, however, with the co-t!tructlon that was permitted in Bellwood adi-r•ent to the creek and park, the channel .as disrupted and thus the creek flooded the plain throughout the winter. As a consequence, many spots are still pretty •?et at thin time. If you are leiking to the future and eventual construction of the planned improvements, I might muppest that before the rains, that the channel for the creek be re dug :.o insure that the creek stays there this winter through the whole Length of the Park. Quite possibly some cross drainage ditches or tile should be installed to insure preserving some firm terra for the work to be done next summer. I would appreciate a letter of response to what you are going to do about the above situation in the Park this summer. I also would like to know at this time just what, the timetable is for installing the planned improvements for which I have contributed $2,4hO and for which I understand there are matching Federal Fends. No changes or deviations shall be made without the prior written approval of the Department of Environmental Quality. 2. The installation of said sewers shall comply fully with the regu- lations of the State Board of Health -I Environmental Quality Commission regarding the relative lof ion or separation of water and sewer lines, which include the requirements for 18 inches of vertical clearance at water and sewer crossings with the water line located above the sewer and 10 feet of horizontal separation for parallel runs unless cast iron pipe with watertight joints is used in each instance. 3. Walnut Street, Tigard, Washington County, Oregon , 3-02-Definitions "Owner"i J.A. Paterson. "Engineer.": James R. Harris, or authorized representatives. 11City113 City of Tigard, Washington County, Oregon 3-03-Control of Work All work under this contract shall be executed in a manner satisfactory to the Engineer and the City. The wor;- shall not be considered complete until accepted by both the Engineer and the City. 3-04-Scope of Work The work to be done under these specifications and plaris which accompany them consists of the construction of sanitary sewers, manholes, and such appurtenant facilities and work as indicated and required. The contractor will be required to furnish all labor, materials and equipment necessary for construction of the systems as indic9ted on the plans and stated herein and to furnish all miscellaneous items required to complete the work. 3-05-Subsurface Conditions Adverse soil conditions may be encountered at some locations. The extent of such adverse conditions is not known, but the design has been prepared with the intent of effecting a sewer that will be as shallow as is practicable and yet accomplish the objectives of the project. The con- tractor should recognize that these considerations can allow little if any adjustment of depth to avoid difficult excavation. � s t SP-2 3-05-Plans Plans for this project are shown on a drawing consisting of one (1) sheet which is bound separately and which bears the title BROOKWA Y SANITARY SEWER PIAN & PROFILE 3-07-Guarantee Whether or not there appears here or elsewhere herein specific reference to guarantees of all items of material, equipment, and workmanship, they nevertheless shall be so guaranteed against mechanical, structural, or other defects for which the contractor is responsible, that may develop or become evident within a period of one year from and after acceptance of the work by the owner. Such guarantees shall include care of backfilling of ditches or at structures should the fill settle to such extent as to require refilling or resurfacing roadway surfaces to restore the original or intended condition or grade. This guarantee shall be understood to imply prompt attention to any remedy of such defects as those mentioned above if and as they occur after the contractor shall have written notice of their existence. If the defect is of such nature as to demand immediate repair, the owner shall have the right to make them and the cost there shall be borne by the contractor. To support the above guarantees the contractor's performance bond shall remain in full force and effect for one year following the acceptance of the project by the owner. The bond shall be executed by a surety company authorized to do business within the State of Oregon and it shall be subject bo the approval of the attorney for the owner. In addition to the above requirements, the contractor shall make his own determination as to the amount of the maintenance bond which will be required by any corporation or agency granting a permit for work to be done under these plans and specifications. Such bonds shall be in addition to that required by the owner as indicated above. Payment will be made for footage actually laid ae measured along the ground from center to center of manholes or to limits of Contract. Teas and pipe fittings will be paid for under other bid items but are also included in the lineal feet of sewer pipe paid for under this item. These items shall include payment for excavation of all materials of whatever nature encountered, except solid rock. Boulders over 1/2 cubic yard will be paid for as solid rock. It is not expected that solid rock will be encounterod, and if it is encountered, it will be paid for as an extra. These items shall include the cost of sheeting, bracing and dewatering, if necessary, and excavation for manholes and drainage structures. The cost of hauling away any excess material shall be included in this item. The cost of clenrinp for installation of pipeline is also included. These items include the cost of removing and replacing fences, mail boxes, poles and posts of all types,trenching through trees and shrubs, and rockeries; g g paved streets lawn area and driveways; furnishing and placing of gravel and crushed rock on road shoulders to restore surface to original condition; tunneling under walkways less than 5 feet, in width and restoration of all other surfaces not included in unit bid prices. These items include the cost of restoration of driveways and roadway asphalt surfaces in accordance with County requirements. 4-0.1.2- Manholes Price includes furnishing all materials and constructing standard manholes as shown on the Standard Details. r MRcP-2 4.01.3- Cleanouta Price includes furniahi,A all materials and constructing standard cleanouts as shown on the Standard Details . 4.01.4-Pipe Fittings Payment for providing and installing pini fittings for survices is in addition to the prices per lineal footof pipe. The exact number and type will be determined in the field. The costa of furnishing and installing plugs as necessary to seal the line at locations for side sewers and house sewers are included in these items. 4-01.5-Sedding Material Includes furnishing and placing bedding gravel and/or foundation gravel in accordance with Standard Details. Bedding gravel re4uired by unauthorized excavation below the required trench depth or excavation of trench width greater than thirty inches (30") will not be paid for. 4-01.6-Select Backfill The unit price per cubic yard includes all costs to furnish and place select backfill in accordance with these specifications.
