WIiI REAS, the City executed a Subdivision Compliance Agroomonl' dated February 25th, 1985, with Waverly Construction Company, Inc. to facilitate installation of public improvements (street, sturm and sanitary sewer facilities) to specified standards and specifications; and WHEREAS, said Compliance Agreement stipulated that: "At such time as all public improvements have been completed in accordance with the City' s requirements, Petitioner shall notify the City of readiness for final inspection and upon certification by the Department of Community Oevelopment that all requirements of the City have been met, the Council agrees to accept said improvements, for operation and maintenance responsibility, and release the Petitioner's guarantee bond"; and WHEREAS, Department of Community Development staff verifies that all requirements of the City have been met. ANALYSIS AND CONCLUSION The Community Development Code provides a two- step review of lot line adjustments . A preliminary application is first evaluated and a decision is made. If the preliminary application is approved, a final. application is submitted containing the final lot line adjustment: map and legal descriptions . Following City approval, the map and legal. descriptions are recorded with Washington County. As noted by the Engineering division and the Tigard Water District, conflicts may result in relation to the location of utility services and driveway locations. The final lot line adjustment map and legal descriptions shall be required for each adjustment that occurs under provisions of this prel4mi.nary approval. . The map and descriptions should include information regarding the precise location of existing utilities and driveways. A certification from an engineer should be provided which indicates that the adjustment will not adversely affect existing utilities or that the facilities will be relocated to the sat4sfaction of those utility company(s) involved . Any costs associated with change in utility location will. be borne by the developer. The R-12 zone does not have a minimum lot width requirement, but the 50+-/- foot wide lots are relatively narrow for single family detached residences. The 5-foot side yard requirement shall remain in effect as well as the 5-foot driveway setback requirement contained in T.M.C. Section 15.04 .080(b) . (09671)/din j ) tiw SUBDIVISION COMPLIANCE AGREEMENT THIS AGREEMENT dated the day of 19 85 between the CITY OF TIGARD, a municipality of Oregon, hereinafter termed the "CITY", and Waverly Construction Company hereinafter termed "Petitioner". W I T N E S S F. T H WHEREAS, Petitioner has applied to the City for approval for filing in Washington County, a subdivision plat known as BOND PARK NO. 3, in Section 12, Township 2 South, Range 1 West , Willamette Meridian, Washington County, Oregon; and WHEREAS, the City has approved and adopted the stondard specifications for Public Works construction by APWA Oregon Chapter and the Unified Sewerage specifications for the sanitary sewers prepared by professional engineers for subdivision development; and WHEREAS, the public improvements required to be constructed or placed in Petitioner's development are incomplete, but Petitioner has nonetheless requested the City to permit progressive occupancy and use of property in the subdivision, and the parties desire hereby to protect the public interest generally and prospective purchasers of lots in said subdivision by legally enforceable assurances that the public improvements will be installed as required and completed within the time hereinafter set forth. NOW, THEREFORE, in consideration of the foregoing premises and the covenants and agreements to be kept and performed by the Petitioner and its sureties, IT IS HEREBY AGREED AS FOLLOWS: (1) Petitioner shall proceed with the development, with the intent and purpose to complete all public improvements except sidewalks and street trees of said subdivision not later than two (2) years from the date of this agreement, and Petitioner is hereby bound to comply with all subdivision standards as set forth in said Subdivision Irdinance and the standard specification adopted by the City of tigard, or 13 may be otherwise approved by the Public Works Department and to use only such material and to follow such designs as may be required to conform thereto. Petitioner shall provide certification of installation conformance, via it registered civil engineer, to the City prior to City inspection of petitioners Improvement work for City tentative and final acceptance consideration. (2) To assure compliance with the City's requirements and the provisions hereof, Petitioner tenders herewith to the City a surety bond in form approved by the City, with liability in the amount of $ 176,790.00 a copy whereof hereto attached by this reference made a part hereof. (3) In the event that Petitioner shall fail , neglect or refuse to proceed with the work in an orderly and progressive manner to assure completion within the time 1tmfts, upon ten (10) days notice by the City to Petitioner and Petitioner's sureties, and such default and failure to proceed continuing thereafter, the City may at its option proceed to have the work competed and - 1 - charge the costs hereof against Petitioner and Petitioner's sureties and in the event same be not paid, to bring an action on the said bond to recover Lhe amount thereof. In the event such action be brought, Petitioner and Petitioner's sureties promise and agree to pay, in addition to the amounts accruing and allowable, such sum as the court shall adjudge reasonable as attorney's fees and costs incurred by the City, both in the Trial Court and Appellate Court, if any, or the City may, at its option, bring proceedings to enforce against the Petitioner and/or Petitioner's sureties specific performance of the contract and compliance with the subdivision standards and ordinances of the City of Tigard, and in such event, in like manner, the City shall be entitled to recover such sum as the court shall adjudge reasonvbie as and for the City's attorney's fees and costs, both in the Trial Court and Appellate Court, if any. (4) Petitioner, concurrent the with execution hereof, has deposited with the City an amount estimated to equal rental and maintenance fees with respect to the street lighting facilities within the subdivision, according to Portland General Electric Schedule 1191, Option "B", together with a further sum equal to the estimated cost of providing electrical energy to energize the street lighting facilities for a period of two (2) years from the date of Initial energizing of said lights. Said amount being $ 725.76 (5) The City agrees to make and provide periodic and final inspections which in the City's interest are desirable to assure compliance herewith, in consideration whereof the Petitioner has paid prescribed inspections fees.* (6) The City agrees to install street Identification and traffic signs within the said subdivision, in consideration of payment in the amount of $ 120.00 (7) At such time as all public_ improvements except sidewalks and street trees within the subdivtslon have been completed in accordance with the City's requirements, Petitioner shall submit a "certificate of installation conformance" to the City to notify the City of the readiness for acceptance consideration inspection and upon notification by the Department of Public Works that the requirements of the City have been met, the Petitioner will submit to the City a good and sufficient maintenance bond if not already provided with the performance bond, form approved by the City, In the sum of $ 35,358.00 to provide for correction of any defective work or maintenance becoming apparent or arising within one (1) year after tentative acceptance of the public improvements by the City. Upon receipt of certification by the Department of Public Works, that all I requirements have been met , and a One Year Maintenance Bond, the City Council agrees to tentatively tccept the public improvement subject to the requirements for correcticn of deficiencies and maintenance for a period of one year as hereinabove set forth. (8) That in addition to or supplementary of the requlrvinvilts of the City's Subdivision Ord;nan -e and the provisions lit,, .of , Petit Toner hinds itself to conform to the following requirements, scheduling and IImItatIoils ; *Project Pee $ 4267.21 Sewer Pee $ IH61 .41 2 (a) None of the lots of Petitioner's subdivision as described may be occupied for residential purposes until an occupancy permit is issued under authority of the City and no occupancy permit ahall be issued prior to the acceptance of the subdivision and to the time that the sidewalk paralleling the street for each developed lot proposed to a occupied, is installed as a part of the development; provided that all sidewalks as required by the plans and subdivision code shall be installed throughout said subdivision not later than 3 years from the date of this subdivision Improvement Contract. (b) All landscaping trees on that portion of each lot between the public sidewalks and the curb (parking area) is required, shall be planted in place prior to final inspection and issuance of occupancy permit for each such lot in the subdivision. Provided that final inspection and applicant for occupancy permit occurs within any calendar month from October to April of any year, such plantings may be deferred until the next following growing season. In any event, all landscaping and trees in all areas shall be planted and in place within the entire subdivision within three (3) years from the date of this subdivision improvement contract. (c) After tentative City acceptance of the public improvements, the Petitioner agrees to place a one (1) inch asphaltic concrete Class "C" overlay on all roads within the development; placement scheduling to be approve by the City. (d) Compliance with all terms and provisions specified theretofor said subdivision development by the Council and the Planning Commission of the City of Tigard, Oregon, in regard to variances allowed from the suhdivision ordinance, conditions specified by the zone use classification and, also, on the approved plat(s) and plan(s). (e) Petitioner agrees to provide for correction of any defective work and/or maintenance becoming apparent or arising during the guarantee period as hereinabove set forth. (9) At such time as all public improvement-, have been completed in accordance with the City's requirements, Petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have been met , the Council agrees to accept said improvements fot operation and maintenance responsibility, thereinregard , and release the Petitioner's guarantee bond . (10) The parties hereto hereby adopt the form of performance bond, copy whereof Is horeto attached and by reference made a part hereof, and Petitioner agrees to cause to have said bond executed and filed with the City concurrently with the execution of this agreement at or prior to Hie time this agreement Is executed on behalf of the City. On January 3, 1984, a modification of the preliminary plat was approved by the Commission. Bond Park III. just received Commission approval for a preliminary plat for 33 lots on February 7, 1984. The applicant is now applying for several variances to the standards set forth in the Community Development Code. Listed below are the City standards and the requested variances. The applicant indicates that a sidewalk on one side of the street will adequately handle pedestrian traffic and that it will result in a more aesthetically pleasing atmosphere. Except for the 4-foot side yard and 18-foot garage setback, all of the setbacks requested are the same as those required in the R-7 zone. B. COMMUNITY DEVELOPMENT CODE The Code provides for the Planning Director to consider variance applications. However, this variance is intended to be considered in conjunction with the proposed subdivisions which are under the purview of the Planning Commission. Section 18. 134.050 of the Code lists the following criteria for granting a variance. 1. The proposed variance will not be mate.-ially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity; 2. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control , and which are not applicable to other properties in the same zoning district ; 3. The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; STAFF REPORT - V1-84 - PAGE; 2 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the Code; and 5. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardsnip. C. AGENCY COMMENTS The Tualatin Rural Fire Protection District and the City Building Division have no objections to the request. The Engineering Division objects to the portion of the request relating ' to sidewalks. The Division has no objection to the setback reductions provided that proper visual clearance at intersections is maintained. D. ANALYSIS AND RECCMMENDAT10N The applicant has not provided sucficient evidence to support the request to eliminate some of the sidewalks over the objection of the Engineering Division. Also, a similar request for Bond Park I was denied. The lots in Bond Park II and III are relatively narrow (typically 50 feet) and 10-foot side yards will make placement of single family residences difficult.. Four-foot side yards were allowed in Bond Park 1, however, problems can arise since most utility easements are 5 feet in width. Because of the City's action on the first phase of Bond Park and the narrowness of the lots in Bond Park II and III, 5-foot side yards and 10-foot street side yards,appear to be a roTriate. After initiating this project, the zone on the property was changed from A-12 to R-12. This also increased the rear yard requirement from 10 to 20 feet. The applicant is requesting rear yards of 15 feet as allowed in the R-7 zone. Given the circumstances relating to the City initiated zone change, this variance appears to be justified. The lots in the development typically range from 90 to 120 feet in depth. There appears to be adequate space to meet both the 20-foot front yard and 20-foot garage setback without a reduction in the standards. This is especially true if the above mentioned rear yard variance is granted. Also, a reduction of the garage setback to 18-feet was denied in Bond Park 1. h:. Applicant: Ken Waymire of Waverly Construction Co. INTRODUCTION This application is intended to supplement the attached variance appli- cation already submitted. There is some question in the way the Zoning Ordinance is written whether the standard variance procedure in Section 18. 134, or the subdivision variance procedure in Section 18. 160. 120 applies to this project. The attached variance report is for Section 18. 134 of the Zoning Ordinance and the material in this report is in- tended to comply with Section 18. 1 60. 120 of the Zoning Ordinance. We are covering both procedures in this case to be cure this application is properly viewed. VARIANCE JUSTIFICATION Two of the findings required by Section 18. 160. 120 of the Zoning Ordinance are almost identical to Section 18. 134. They include "special circum- stances" and "detriments to public health, etc. " However, 2 of the following findings are different and are addressed in this report. 1 . The variance is necessary for proper design or function of the subdivision. 2. The variance is necessary for the pr ;,ervation and enjoyment of a substantial property right because of ter extra-ordinary hardship which would result from -+. 4 c t compliance with the regulations of this ordinance. COMMENT ON FINDING 1 This development is designed with 5, 000 square foot lots with 50 lot widths and 100 foot lot depths. These lot sizes and dimensionq R re very common in other developments in the City and appears to be the trend for the general area. The current side and rear yard set backs of the R-12 section of the Zoning Ordinance are too restrictive for the proper design and function of these subdivisions. These set backs proposed are identical to the set backs approved by the Planning Commission for Bond Park No. 1 . These proposed set backs are the mini- mum necessary to develop an adequate subdivision with efficient use of land. Strict interpretation of the code would create unsightly narrow houses with large set backs. The negative effects of this strict s Page 2 Bond Park 2 &3 Variance interpret, tion out weighs the positive effects of development designed to be compatible with the lot sizes and the type of modern houses built on 5, 000 square foot lots. COMMENT ON FINDING 2 The property right of developing 5. 000 square foot lots with adequate i set. backs to fit the type o,' housing proposed will be utilized by the future owners of the lots in Bond Park No. 1 and the property owners of R-7 land in the area. Strict interpretation of the code would add 20% to the price of the proposed lots without any corresponding public ben efi t. This unnecessary hardship can be. eliminated by this variance request. The property right, in this case, allows development up to 12 units per acre, however, only 7 units per acre is proposed. Strict interpretation of the code would only allow 5. 5 units per acre. This smaller density is not in compliance with the Comprehensive Plan. Further, it unnecessarily restricts proper development of the property so that a reasonable density can not be acheived. Therefore, approval of these variance requests are in compliance with the Comprehensive Plan and in the best interests of the City and surrounding property owners. ff-y'an O' B ri er. Dear Eli I I , On behalf of Ken Waymire, I am requesting consideration of a modification of the sidewalk standards of the City of Tigard. Attached are the sidewalks routes that we desire . The main reason for this renuest are provide more landscaping_ and to create a more aesthetically pleasing environment. Sidewalks on one side softens the harsh look of sidewalks, gutters , curb, , street lights , and mail boxes , utility boxes , etc. To properly accomodate foo+ traffic , sidewalks are not needed on both sides of the street . Many other developments in the City of Tigard have sidewalks on one side only . A recon+ example is Pic ' s Landing. INTRODUCTION This application is a request to reduce the set backs of single family lots in the R- 12 zone , The required set backs of the R- 12 zone and the proposed set bacFs are as follows : required set backs proposed set backs 20 feet - front yard 15 feet 20 feet - distance to garage 20 feet 20 feet - street side yard 10 feet IC feet - interior side yard 4 feet 20 feet - rear yard 15 feet VARIANCE JUSTIFICATION 1 . The proposed variance will not be materially detrimental to the purposes of this Code , be in conflict with the policies of the Comprehensive Plan , to any other applicable policies and standards ; and to other properties in the same zoning district or vicinity . 2 . There are special circumstances that exist which are peculiar to the lot size or shape , topography or other circumstances over which the applicant has no control , and which are not applicable to ether properties in the same zoning district ; 3. The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; 4 . Existing physical and natural systems , such as but not limited to traffic , drainage , dramatic land forms or parks will not be adversely affected any more than would occur if the develop- ment were located as specified in the Code; and 5 . The hardship is not self- imposed and the variance requested is the minimum variance which would alleviate the hardship . Page 2 COMMENi ON FINDING NO. I the intent of the set backs in the R- 12 zone are to properly separate multiple family structures from adjacent properties and lower density zones . These set backs are not necessarily intended for single family detached houses . This fact is demonstrated by the following requirements of the R-4 . 5 and R-7 zones . These standards are significantly less restrictive than the R- 12 zone. Generally the set back standards in Zoning Ordinances become less restrictive in higher density zones . 5 Zone R-7 Zone 20 feet front yard 15 feet 15 feet street side yard 10 feet✓ 5 feet interior side yard 5 feet ',/ 20 feet distance to garage 20 feet ✓ 15 feet rear yard 15 feet The type of development proposed is almost identical to development permitted in the R-7 zone. At a minimum, the R-7 set backs should be permitted. The purpose of the R- 12 zone is to permit development of single family attached and detached houses . The allowance of this variance will not conflict with this purpose. These variances will not conflict with the policies of the Comprehensive Plan . The property is designated residential and all public facilities are available. No new residential development has occured in the area to establish a development trend exceit Bond Park No. I which was approved with almost -rhn same type of set backs proposed with this application . Both Bond Park 2 and 3 were purchased by the applicant prior to adoption of the Zoning Ordinance and the current set back requirements . No impact to surrounding property will be created . No proposed develop- ment will be close or a6jacent to existing house . Further , these proposedset backs will not impact future development of adjacent property. COMMSNT ON FINDING NO. 2 The special circumstances that exist on this property are the size and shape which have created the need for the lot sizes proposed. The lots are generally 50 feet in width and 100 feet in depth . They are specifi - cally designed to accomodate 36 to 42 foot wide houses with 2 car garages . The other properties c.10 not contain the small lots requested and do not have the same circumstances or need for these requested variances . COMMENT ON FINDING NO. 3 The use will be single family detached house , a permitted use in the P- 12 zone.
