WHEREAS, the City of Tigard Subdivision Ordinance requires installation of streets, sidewalks, streetlights, storm sewers, curbs, sanitary sewers, underground utilities ane other public facilities for the development of subdivisions; and WHEREAS, the City further requir the payment of fees and execution of a Compliance Agreement, which stipulate that : "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements subject to the requirement for correction of deficiencies and maintenance for a period of one year. . . ;" and WHEREAS, the City Council received conditional certification from the Department of Public Works and the maintenance bond, and WHEREAS, the City Council accepted said improvements, subject to correction of specified deficiencies during the maintenance period, via Resolution No. 78-82, and WHEREAS, the Department of Public Works has now certified that said specified deficiencies have been corrected, and all public improvements thereinregard said subdivision are complete, and WHEREAS, the required one year maintenance period has passed NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts all public improvements constructed within Barton Subdivision, said subdivision being recorded in Book 40 on Page 75 in Washington County, Oregon, Plat Records, AND FURTHER, hereby authorizes release of the maintenance bond. The following standards are recommended for collector streets : Right-of-way width : 60 foot minimum Pavement width : 44 foot ( two 13-foot moving lanes and two 9-foot parking lanes . 26 feet of pavement at intersections and crosswalks . Moving lanes : 2 Volume : 1 ,000-6 , 000 vehicles per day Driving speed : 20-35 miles per hour 2. 'the standards des::ribed above are for collector streets in built-up area!; where on-street parking and direct access to property are permitted. In special rases (such as large stale subdivision where access can be controlled , parking space can be provided in off-street parking bays and w,r, lkways can be pravided along rear lot lines) other standerc's may be appropriate . A collector street without on-street parking and with- out curb-cuts to individual properties can be developed with 24-26 feet of driving pavement . The plan designates the following as collector street : North Dakota Street from 121st Avenue to Tiedeman Ave- nue . 4 . The site is zoned R-7, Single Family Residential , which re- quires a 7, 500 square feet minimum lot size . II . STAFF OBSERVATIONS : The site is generally flat with an existing single family resi- dence and two outbuildings. Previous use appears to have been as a pasture. T1e site is surrounded by single family residences on somewhat larger lots . The general character of the area is newer sub- division around one- and two-acre parcels. Adjacent streets are S .W . Tigard Street and S .W. Dakota Street , both of which, ^,re substandard, with S .W. Dakota Street also lacking the 60 foot right-of-way required by the Tigard Commu- nity Plan , 1971 . A five foot dedication along S .W. Dakota and a half street improvement along both S .W. Tigard and S .W. Da- kota Streets would bring the proposal into conformance with the requirements of the Tigard Community Plan , 1971 and subdivi- sion ordinance for collector streets . The applicant proposes to create a new 240 foot cul-de-sac. The site is within the Metzger Water District , which can ade- quately service the subdivision from an eight inch line in S .W . Dakota Street and a six inch line in S .W . Tigard Street . An eight inch sanitary sewer line exists in both S .W. Dakota and S .W . Tigard Streets . This is adequate to service the site . III . CONCLUSIONARY FINDINGS : 1. The proposed preliminary plat c:•onforms to the Tigard Com- munity Plan , 1971 in that : ( 1) It is within the four dwelling units per acre limita- tion ( 2 ) The subdivision will be fully improved to City stand- ards ( 3) As noted in the staff observations. adequate water and sc%%erage facilities exist to service the subdivision . SUBDIVISION S 6-77 Page 4 and, with the attachment of appropriate conditions, adequate street facilities will be available . 2. The proposed density conforms co the density limitations of the underlying R-7 zone in that each lot is 7,500 square feet or larger. 3. The proposed street system does nat adversely impact any previously platted street . IV. FINAL ACTION: Based on the staff report , the proposed preliminary plats is found to be in conformance with the Tigard Community Plan , 1971 and Titles 17 and 13 of the Tigard Municipal Code and is hereby approved subject to the following conditions : 1.
