He pointed out that according to the top of curb grade, the back of the existing sidewalk poured by the builder of the house on Lot 32 is 1 inch higher than standard. Reconstruction of a portion of the sidewalk may be a solution to the drainage problem of the pathway. The sidewalk and the pathway are part of your subdiNision improvements. There is a concern regarding the drainage of lots and soil conditions. bots 10 & 11 have been graded flat(sloping slightly to the rear) . I doubt that their elevations will allow for rain drains to be graded toward the street, or allow storm water to flow off them. Dots 17-29 have been graded away from the street and sloping from lot 17 toward lot 29. 1 doubt these lots will allow rain drains to reach the street, or allow storm water to drain off the bottom lots(28 & 29) . bots 32 & 33 appear very boggy, wet and with poor drainage. Subdivision Compliance Agreement. (b) All landscaping trees on that portion of each lot between the public sidewalks and the curb (parking area), if required, shall be planted in place prior to final inspection and issuance of occupancy permit for each such lot in the subdivision. Provided that final inspection and application for occupancy permit occurs within any calendar month from October to April of any year, such plantings may be deferred until the next following growing season. In any event, all required landscaping and trees in all areas shall be planted and in place within the entire subdivision within three (3) years from the date of this subdivision improvement contract.
