LOT LINE ADJUSTMENT M 5-85
APPLICATION: Request by Joe & Glenda Jacobs for a lot line adjustment to
adjust 2 parcels of 6.1,469 and 19,166 square feet into 2 parcels of 52, 1.60
square feet and 31,475 square feet. The property is located at 10905 SW
Tigard Street. (WCTM 151. 34DD, lots 700 and 800) .
DECISION_: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described application subject to certain
conditions. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
1 . Background
The City recently granted partitioning approval (MLP 8--85) for the
larger parcel (Tax Lot 800) . 'The applicants dropped this proposal
because of conditions of approval related to the extension of
108th AvenUO.
2 . Vicinity Information
All of the surrounding properties are small acreage homesites
which are zoned R-4 .5. The exception to the development pattern
is the Doreen Court subdivision which lies directly north of the
subject property . Phis development includes nine lots in the
7,500 to 9, 100 square foot range on both side of 108th Avenue
which begins at North Dakota Street and ends at the northern
boundary of the subject property .
3 . Site Information and Proposal Description
The larger parcel is a flag lot with 50 feet of frontage on Tigard
Street. The larger parcel contains one house near the north end
of the property and a house is centrally located within the
smaller lot.
The applicant proposes to shift the northern boundary of the small
i-arcel 98 .6 feet to the north. This action will result in a
12,309 square foot reduction in the size of the larger parcel .
4 . Agency and NPO „omments
The Engineering Division indicates that Tigard Street is a minor
collector which requires a 60 foot wide right--of-way . The
additional right-of-way dedication should be required.

The Building Inspection Division and the Tualatin
Rural Firo Pr,tectlon District have no objection to
the proposal .
The NPO will be notified of this decis-Lon and will have the right
to appeal as provided by the Community Development Cede.
B. ANALYSIS AND CONCLUSION
The proposed lot line adjustment is consistent with City standards for
lot size and b-ailding setbacks . Also, the proposed change will allow
for the ftiture extension of 108th Avenue.
C. DECISION
The Planning Director approves M 5--85 subject to the following
conditions :
1 . The lot line adjustment survey and l,gal descriptions shall be
submitted t:., the Planning Director for review and approval. THE
CITY SHALL RECORD THESE DOCUMENTS AFTER THEY ARE APPROVED AND A
COPY SHALL BE FORWARDED TO THE APPLICANT.
2. Additional right-of-way shall be dedicated to the public along the
SW Tigard Street frontage of both parcels to increase the
right--of-way to thirty feet from centerline. The description for
said dedication shall be tied to the existing right-of-way
centerline as established by County Survey # 20,267. Tha
dedication document shall. be on City forms and approved by the
Engineering Section. DEDICATION FOPMS AND INSTRUCTIONS ARE
ENCLOSED.
3 . This approval is valid if oxer-ised within one year of the final
decision date noted below.

1. Background
No other land use proposals have been reviewed by the City on this
property .
2. Vicinity Information

3 . Site Information-and Proposal Description
The subject property has a 50 foot wide access strip which
connects the main body of the parcel (174' x 323' ) with S.W.
Tigard Street. A residence is situated in the north central
portion of the property and a garage is located in the northwest
corner.
The applicant proposes to divide the property into two flag lots
of 0.58 and 0,9 acres. The smaller parcel will contain the
existing buildings and the larger lot is vacant. Both parcels
will have a 25 foot wide access strip to Tigard Street .
4 . Agcncy and NPO Comments
The F.ngineering D`.vision has the following comments :
a. An extension of SW 108th Avenue to the property is not
indicated ,m the City of Tigard Comprehensive Plan; but due
to the lace; of north-south connecting roadways (between SW
North Dakota and 5W Tigard Street) it would be in the best
interest ,f the Community to extend the partial connection
of SW 108th through to Tigard Street,

The Building Inspection Office has no objection to the proposal
but it is noted that the proposed sewer easement will reduce the
buildable arca within the 0,58 acre lot.
B. ANALYSIS AND CONCLUSION
The proposed division is consistent with the applicable standards in the
Community Development Code for minimum lot size (7,500 square feet.),
minimum lot width (50 feet), building setbacks and access.
However, as mentioned in the comments from the Engineering Division,
this proposal does not provide for the extension of 108th Avenue. When
Doreen Court subdivision was platted, it was clearly the intent that it
wnuld be extended to Tigard Street when development occurred to the
south. The alignment of 108th Avenue suggests a street extension that
would straddle the property li.ne between the subject property and the
property to the east.
C. DECISION
The Planning Director approves MLP 8--85 subject to the following
conditions-.
1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHAD BE MET PRIOR TO
ISSUANCE OF BUILDING PERMITS.
2. Standard half-street improvements including sidewalks, curbs,
driveway aprons, storm drainage, and utilities shall be installed
along the SW Tigard Street frontage. Said improvements along SW
Tigard Street shall be built to City lncal street standards and
conform to alignment: approved by the City' s Engineer
3 Seven (7) sets of plan-pr, file public improvement construction
plans and one (1) itemized construction cost estimate, stamped by
a Registered Professional Civil Engineer, detailing all proposed
public improvements shall be submitted to the Engineering Section
for approval.
4. Public mainline sanitary seo,ier plan-profile details shall be
provided as part of the public improvements plans.
5. Construction of proposed public improwtments shall not commence
until after the Engineering Section has issued approved public
improvement plans . The Section will require posting of a 1.00%
Performance Bond, the payment of a permit fee and a sign
installation/streetlight fee. Also, the execution of a
construction compliance agreement shall occur prior to, or
concurrently with the issuance of approved public improvement
plans . SEE THE ENC' `SED HANDOUT GIVING MORE SPECIFIC INFORMATION
REGARDING FEE SCHEDULES, BONDING, AND AGREEMENTS.

6. A one (1' ) f,,)ot reserve strip granted to the "City of Tigard"
shall be provided at the terminus of the extension of SW 108th
Avenue.
7. Additional right--of-way shall be dedicated to the Public along the
SW Tigard Street frontage to increase the right-of-way to 30 feet
from centerline. The description for said dedication shall be
tied to the existing right-of-way centerline as established by
County Survey # 20,267. The dedication document shall be on City
forms and approved by the Engineering Section. DEDICATION FORMS
AND INSTRUCTIONS ARE ENCLOSED.
8. Joint use and maintenance agreements shall be zxecuted and
recorded on City standard forms for all common drivew•.ys. Said
agreements shall be referenced on and become part of all
applicable parcel Deeds. Said agreement shall he approved by the

9. Street Centerline Monumentation
1 . In accordance with ORS 92.060 subsection (2), the centerline
of all !treet and roadway right--of--ways shall be monumented
before the City shall accept a street improvement.
2.. All centerline monuments shall be placed on the surface of
the fin;l lift of asphalt.
3 . The following centerline monuments shall be set:
a. All centerline-centerline intersections. Intersections
created with "collector" or other existing streets,
shall be set when the centerline alignment of said
"collector" or other street has been established by or
for the City;
b. Center of all cul--de -sacs;
C. Curve points. Point of intersection (P.I. ) when their
position falls inside the limits of the pavemant
otherwise beginning and ending points (B.C. and E.C, ) .
d. All sanitary and storm locations shall be placed in
positions that do not interfere with centerline
monumentation.
10. The "basis of bearings" for the Plat or Survey shall be County
Survey # 20,267, which is a part of the Tigard Field Survay
Network .

11. S.W. 108th Avenue shall be extended southerly, through the
norther ly portion of the applicants tract, ::o provide for future
connection to SW Tigard Street. The applicant may illustrate an
alternative as to how this future connection will be made to SW
Tigard Street. All improvements normally associated with public
street construction shall be provided therein, including curbs,
aprons, sidewalks, streetlights, storm, and sanitary sewers and
underground utilities. The roadway shall be built to City local
street standards and shall conforl.i to an alignment approved by the
City' s Engineering Division.
12. Each lot shall be connected directly to a public sanitary sewerage
system.
13 . The partition survey and legal descriptions shall be submitted to
the Planning Director for review and approval. THE CITY SHALL
RECORD THESE DOCUMENTS AFTER THEY ARE APPROVED AND A COPY SHALL BE
FORWARDED TO THE APPLICANT.
14 . This approval is valid if exercised within one year of t,.e final
decision date noted below.
