APPLICATION: Request b•; Jay Miller Builders, Inc . (Waverly Construction Co. )
for Sensitive Lands approval to allow residential construction on ten lots
with slopes in excess of 25 percent. Also requested is a variance to the
Community Development Code's 30 foot maximum height restriction for the R-4.5
zone. The variance would allow homes on these 10 lots to be up to 40 fee:
high in the rear. The 30 foot height standard would be adhered to for the
fronts of these houses. Zoning: R-4.5 (PD) (Pesi.dential 4 .5 units/acre,
Planned D(,jelopment) . Location: Lots 4-13 Dovor Landing Subc'i.vision on SW
Tualatin iri.ve overlooking the Tualatin River (WCTM 2S1 15AD, Lots 2300-32.00) .
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described applications subject to certain
conditi,)ns. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINnING OF FACT
1 . Background
Dover Landing was initially submitted as a. request for a 71 unit
Subdivision (S4--86), Planned Development (PD 1-86), Sensitive Lands
Permit (SL. 3-86) and a Variance (V 6--86) in March 1986. The Planning
staff recommended approval of the requests but the proposal was denied
by the Planning Commission. No appeal was made of this decision.
Lator in 1985, an application was submitted for Dover Landing with a
r•cquest for an 82 unit Subdivision (S7-86), Planned Development (PD
2 -86), and Sensitive Lands Permit (SL 4-86) . Staff agai.r recommended
approval but the Planning Commission denied the proposal. On appeal,
the City Council approved the application subject to several
conditions of approval . Condition of approval No. 12 specifically
stated that a Sensitive Lands Permit would be required for development
on any slope greater- than 25 percent.
In early 1987, the applicants applied for a variance (V 87--01) to
reduce the front yard setback from 2.0 feet t0 15 feet for these same
properties, lots 4 thr-ough 13, and to reduce the corner lot setbacks
for, all corner lots in the subdivision. The proposal was denied by
the Planning Director. The decision was not appealed.
2. Vicinity Information
The subject properties are bounded by the Tualatin River greenwoy an
the south; R--7 (PD) (Residential, 7 units/acre, Planned Devei-)pment)
zoned undeveloped land on t'ie east and one developed parcel zoned
R-4.5 immediately east of lot 4; other R-4.5 recently developed
parcels within Dover Landing to the north across SW Tualatin Drive;
and R-2 (Residential, 2 units/acre), R-4.5, and Washington County R-5
(kE,�irlenti.a] , 7,000 square U-3ot minimum lot size) zoned lands to the
wes'c. rhe majority of thF�Pe parcels are currently developed with
sir(,lp family residences .

3 . Site Information .and Proposal Description
Lots 4-13 have been platted and cleared. The lots drop off steeply
to a wooded greenway along the Tualatin River. All lots have at
least: 30 feet: of vertical drop from the curb to the southern lot
line. SW River Drive in front of the parcels has bean completed.
Sidewalks have riot yet been installed.
The applicants request Sensitive Lands approval to allow construction
of homes on slopes of greater than 25 percent on these lots. Because
of the significant slope on all parcels, the applicants also request
a variance from the standard R--4 .5 zone height limitation of 30 Feet
to allow the houses to be. up to 40 feet high in the rear. The 30
foot height standard would be satisfied for all homes if viewed from
the front.
4. Agency and NPO Comments
The Building Division commented that an adjacent property owner
reported concerns with slope stability and the possible damage to
adjacent structures that may result from the driving of piles to
support houses on thn steep slopes. Stability of the slope is
discussed in the following section. The Building Division dues not
believe that pile driving should result in off-site damage. iowever
if off-site damage should result, liability for possible damage to
adjacent properties will be the responsibility of the centractors and
their insurers.
No other comments were received .
H, ANALYSIS AND CONCLUSION
Sensitive lands Permit
Section 18.84.040(b) of the Community Development Cede authorizes i,he
Director to approve a Sensitive Lands application for development on
slopes of 25 percent or greater upon a finding that the following criteria
are satisfied:
(1) The extent arid nature of the proposed land form alteration or
development will not create site disturbances to an extent greater
than that required for the uses;
(2) The proposed landform alteration or development will riot result- in
erosion, stream sedimentation, ground instabiV ty, or other adverse
on-situ and off-site effects or hazards to life or property;
(3) The structures are appropriately sited and designed to ensure
structural stability and proper drainage of foundation and crawl
space arras for• development with any of the following soil
conditions; wet/high water table; high shrink-swell capability;
compressible/organic; and shallow depth--to-bedrock; and

(4) Where natural vegetation has been removed due to land form alteration
or development, the areas net covered by structures or impervious
surface4 will be replanted to prevent erosion in accordance with
Section 18. 100 !LANDSCAPING AND SCREENING) .
In the present situation, the Planning Director finds that the criteria
are satisfied or can be satisfied through the building plan rz,,iew
process. The Director's conclusion is based upon information provided in
soil investigation studies submitted by the applicant (studies prepared by
John McDonald Engineering dated September 6, 1987, and Carlson Testing Lab
dated January 28, 1987) . These studies indicate that the original snail
beneath recent fill material i.s firm to hard arid indicu+es good slope
stability; that: slopes are reasonable; and that if careful construction
techniques are employed, the subsurface_ soil should be adequate to support
the developmc: t proposed. The applicants propose that the houses to be
developed would be constructed on pilings or footings engineered to each
particular site. Conditions --+f approval tc be applied through the
building plan review process will assure that - :r disturbances will be
minimized; measures will be taken to minim'.ze t' `ential for erosion,
sedimentation, ground instability, arid other p.,.. le adverse effects;
soil characteristics will be addressed in engineering the foundation to
the site; and non—impervious areas will. be revegetated.
Variance
Section 18. 134.050 of the Community Develo.,.+,c,it Code lists the following
approval criteria for a variance:
1 . The propused var-ince will not be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and standards;
.and to other properties in the same district or, vicinity;
2. There are special circumstances that exist which ar•e peculiar to the
lot size or share, topography or other circumstances over which the
applicant: has no control, and which are riot applicable to other
properties in the same zoning district;
3 . The use proposed will be the same as permitted under this Code and
City standards will be maintained to the greatest extent that is
reasonably po!•sible, while permitting some economic use of the land;
4. Existing physical and natural systems, such as but riot limited to
traffic, drainage, dramatic lard forma, or parks will riot be
adversely affected any more than would occur if the development were
located as specified in the Coda; and
5. The hardship is not self--imposed and t:he variance requested is the
minimum variance which would alleviate the hardship.

The present request is for a variance ► rom the R•-4.5 zone' s 30 foot height
restriction so that; homes on lots 4 through 13 could be 40 feet, high in
the rear. The homes would all be 30 feet high or less in the fr.nt.
'The primary purpose of the height restriction in the R.-4.5 zone is to
maintain the character of a neighborhood through limiting the range of
building heights within the zone, A sot-ndary purpose of the restriction
i- to prevent the construction of tall buildings that would shade adjacent
dwellings . These purposes would not be detrimentally affected if the
requested variance is granted because the homes to be constructc-d would
not appear any taller than existing dwellings elsewhere in the development
when viewed from the street and the additional height will not affect
shading of adjacent properties. No other policies or purposes of the Code
or Comprehensive Plan would appear to be adversely affected by granting
the variance.
The need for the requested variance arises from the peculiarly steep
topography of these lots when compared to most other lots similarl;
zoned. The use proposed for the lots, single family residences, i.�
pe-mitted by the zone and is in no way altered by the requested variance.
Other Code requirement, such as building setbacks will be adhered to for
thegc lots . No impacts upon existing physical and natural systems arising
from granting the variance are foreseen by any of the reviewing agencies
or the preparers of the soil investigation studies . Although the need 'or
the variance could be. viewe6 as s,,l.f-imposed in that the property owner
w,as responsible? for creation of these strep lots, the subdivision plat was
approved by Lie City Council with the implication that the ]ott would be
buildable upor approval of th^ Sensitive Land_ Permit and m:thoW. the need
fcr• a variance. It late - uecame apparent that a variance to the height
standarc would be necrassary for any residence to be constructed on these
lots, Tlerefore, the Planning Division does not view the hard-lip created
by the height restriction to be self-imposed . Further, a variance
requested, an additional. 10 feet of building height, is the minimum
variance required to allow residential construction on the lots. _ All of
the appro► al criteria for a vari,a-►ce are therefore satisfied.
C. DECISION
The Planning Director approves Sensitive Lands application St. 88-01 and
Variance V 88--03 subject to the following conditions:
1 . Prior to the issuance of b,iilding permits for these lots, the
applicants shall demonstrate to the Building Division that the
proposed structure will be sited and designed to ensure structural
stability. Foundation plans for each building shall be stamped by a
Professional Engineer,
2. Proper drainage, erosion control and slope stabilizing techniques
shall be employed during constructi01 in accordance with Building
Division requirements ,
