Dear Mr. Liden,
Thank you for meeting me briefly this week to discus:
the issuance of our occupancy permits for the Windmill
Apartments. We discussed that in order to receive occupancy
permits, all conditions shall be met from SDR 88-21 . SDR 88-
21 states the following conditions:
PRIOR TO THE ISSUANCE OF AN OCCUPANCY PERMIT FOR ANY NEW
BUILDINGS ON THE SITE, THE FOLLOWING CONDITIONS SHALL BE MET
TO THE SATISFACTION OF THE PLANNING DIVISION. STAFF CONTACT:
Deborah Stuart, Planning Division (639-4171 ) .
13. All landscaping materials and other proposed site
improvements shall be installed prior to occupancy of any
structures.
14. A sign permit shall be obtained prior to the
erection of any identification sign. Sign location and size
must be in accordance with the provisions of Section 18. 114
of the Community Development Code.
As of this date both of these items have been completed
or are .in the process of being completed. The sign permit was
taken out in August. The landscaping, however, is not
completed as of this date. There are approximately 55 pine
trees and 16 crab apple trees left to plant.
Enclosed is a written estimate from our landscape
sub-contractor. The amount of. 5,000 dollars is his estimate
to complete t: -2 landscaping. From our discussion, you
indicated that you would accept a set-a-side letter from our
lending institute or a bond for the completion of the
lardscaping.
Please review the enclosed bond in the amount of
$5, 000.00, for its acceptan�.e. Hopefully we have met all of
your conditions for receiving an occupancy permit . All of the
buildings have been finalled from the building department . We
would appreciate your immediate response to this request .

Dear Brad,
The progress on our apartment project has been better
than expected. We anticipate that units will b-� ready to
occupy June 30, 1989. There will be 6 buildings o: 24 units
completed by this date. We would appreciate your cooperation
in granting us a temporary occupar. -y for these buildings.
Final inspections will be asked for and hopefully passed
on or about June 26 , 1989. This will include building,
plumbing and electrical . We also will have the landscaping
nearly completed around these buildings. We anticipate that
all of the planting materials will be in place except for
lawns.
The enclosed site plan indicates the buildings as well
as the extent of paving that will be completed by J1ane 30,
1989. The building numbers involved are buildings 1 , 2 , 3,4, 18
and 19. Addresses are 10601 , 10605, 10609, 10615,10543 ,and

Plans for this project have been reviewed for conformity with applicable
codes, and are approved, subject to clarification or inclusion of the
following items.
1.. Sewer line+ require a cleanout every 100 feet or, as an
alternate, a manhole every 300 feet.
2. Catch basins for the storm drainage system shall baa the
"Lynch" type, or approved equal, with a clean-out at each
catch basin.

instances, not properly eized.The individual buildings may

DECISIvN_: Notice is hereby given that the Planning Director's designee for

A. FINDING OF FACT

A minor land partition request QIL P 5-82) was approved in August, 1982.

The net development area for this parcel is calculated by subtracting
land in the 100-year floodplain (1.78 acres) , and all land proposed
for private streets (i.10 acr,.$). This results in net acreage of 4.87
acres. To calculate the net units per acre, the number of square feet
in the net development area (212,137.2 square Leet) is divided by the
minimum number of square feet required for each lot or resident+al
unit in the R-12 zone (3,050 square feet minimum). The result is a
subtotal of 69.55 housing units.
Residential density transfer provisions of the Code allow transferal
of 25 percent of the units which would have been allowed in the
floodplain. This would add an additional 6.34 units for a total of
75.9 or. 76 units.
The subject property abuts an established neig:,00rhood area ',.o the
orth as denoted on the established area/developing area map. Section
18.40.040(a) states that regardless of the allowed housing densities
In Section 18.54, any property/land area within 100 feet of an
established area shall not he developed at a residential housing
density greater than 125 percent of the allowed density in the
adjacent established area(s).
The adjacent established areas are designated in the Comprehensive
Plan for a maximum of 5 dwelling units per acre. This would dictate a
maximum density of 6.25 dwelling units per acre, or a total of 7 un-ca
in the 100 foot wide by 1,490 foot long area along the northern edge
of the property. The applicant's site plan shows 4 full units (one
fourplex) in this area plus small portions of other fourplexes. Staff
concludes that the residential transition requirement has been met.
f. Tr%e Removal
The City is interested in preserving as many trees as possible.
Chapter 18.1.50 of the Community Development Coke aims to prohibit the
unnecessary removal. of trees and sets forth some guidelines. There is
a large orchard of fruit trees which bisects the property as well as
other deciduous trees, and the applicant does not indicate on the
landscaping plan which, if any, of the trees are intended to be
saved. Staff is less concerned with the orchard trees than :he stand
of evergreen trees along the northern portion of the area. It is
unclear whether any of these trees are on the subject property and how
they will be protected. Staff recommend, ,i revised landscaping plan.
C. RECOMMENDATION
Planning recommends APPROVAL of SDR 88-21 subject to the following
conditions:

Registered Professional Civil Engineer, detailing all proposed public
improvements shall be submitted to the Engineering Division for
approval. Two (2) sets of plan and profile plans shall be submitted
for preliminary review prior to submittal of final plana. STAFF

10. Construction of proposed public imlrovements shall. not commence until
after the Engineering Division has approved public improvement
plans. The section will require a 100% performance assurance or
letter of commitment, an developer-engineer agreement, the payment of
a permit fee and a sign installation/streetlight fee., Also, the
execution of a street opening permit or construction compliance
agreement shall occur prior to, or concurrently with the issuance of
approved public improvement plans. These plans shall include the
pedestrian/bicycle path noted in Condition 12 below. STAFF CONTACT:

11. A detailed tree protection plan shall. be submitted for Planning
Division approval which includes locations and types of trees to be
retained, an arbori.st's recommendations for methods of protecting
these trees during construction of the proposed apartments and also
for maintenance of the long-term health of the trees. The trees to
be saved shall be protected during construction by fencing or similar
means approved by the Planning Division. No site grading, clearing,
or tree removal shall occur prior to satisfaction of this condition.
Also, the adequacy of the visual. screening for abutting properties

either side of the subject site showing the existing grade and

2. Standard half-street improvements, including concrete sidewalk,
driveway apron, curb, asphaltic concrete pavement, banitary sewer,
storm drainage, streetlights and underground utilities, shall be
Installed along the Tigard Street frontage. Improvements shall be
designed and constructed to minor collector street standards and snall
conform to the alignment of existing adjacent ,.wnrovements or to an
alignment approved by the City Engineer. The half street improvements
shall be constructed from the west end of the Ff-e to poinL where the
