It appears from our records that you received a valid home occupation permit and business tax, therefore, the use that you have is allowed. My concern, however, is that your original application did not spell out hours of operation or location of the use on the premise. According to the complaint which we received, the shop is situated on the premises in a location which may be disruptive to your neighbors. The present home occupation section of the Community Development Codes provides in part that: 18.142.050 (H) The Home Occupation shall not produce any voise or M obnoxious odors, vibrations, glare, fumes, or electrical interference detectable to normal . :nsory perceptions outside the structure. 18.142.070 (A) The Director may approve a Home Occupation Application subject to a specific time period at the termination of which there shall be a renewal application to determine if all of the conditions and provisions of this chapter have been satisfied. 18.142.070 They Director may revoke a home occupation approval if the conditions are not satisfied as provided by Section 18.32.250 (F) . These provisions are consistent with those which were in place when your original approval was granted. Section 18.08.250 of the Tigard Municipal Code, adopted in 1970, also states that the activity must be conducted in a way that does not infringe upon the right of neighborhood residents to enjoy the peaceful occupancy of their homes. In conclusion, in order that your home occupation may continue, you must take steps to comply with the municipal codes, i.e. operate the sharpening operation only in a manner which does not disturb your neighbors. Please advise me of the steps that you plan to take to avoid noise which will affect your neighbors rights.
