MLP 89-04
MINOR LAND PARTITION
HOGGAN
APPLICATION: A request by Richard E. and Gayle Hoggan for a Minor Land
Partition approval to divide a 66,211 square foot parcel into two parcels of
9,000 and 57,211 square feet each. Location: 8200 SW Ross Street (WCTM 2S1 1.2CB
tax lot 500)
DECISION: Notice is hereby given that the Planning Director's designee for the
C.-.ty of Tigard has APPROVED this request subject to certain conditions. The
findings and conclusions on which the decision was based are noted below.
A. FINDING OF FACT
I. Background
No other applications have been reviewed by the Planning Division
pertaining to the subject property.
2. Vicinity Information
Properties immediately to the north and east are zoned and
developed as R-4.5 (Single Family Residential, 4.5 units/acre) .
Propertien immediately to the south are zoned R-7PD (Single Family
Residential, 7 units/acre, Planned Development) . Properties
immediately to the west are also zoned R-7 (Single Family
Residential, 7 units/ acre) .
3. Site Information and Proposal.
The subject parcel is in the configuration of a horseshoe pointing
north. There is a single family residence on another parcel on the
south side of SW Ross Street. Tie applicant proposes to divide the
parcel into two pieces: one is +.o be 57,211 square feet and the new
parcel will measure 9000 sq.iare feet (90 x 100ft) and will be
located along SW Blst Avenue at the southeastern corner of the
parent parcel.
4. Agency and NPO Comments
The Tigard Water District, Portland General Electric, and General
Telephone have all reviewed the proposal and have no objections to
it.
The City Engineering Division has reviewed the proposal and has the
following observations and findings:

a) The proposed partition shown on the submitted sketch is adjacent
to Ashford Oaks II subdivision which is currently under
construction. The future development plan for the entire site has
been submitted by the applicant.
b) The subject parcel borders Ross Street to the north and 81st
Avenue to the east. Ross Street is an older, paved minor collector
street, while 81st Avenue is a local street and will become a newly
paved street as a result of the Ashford Oaks II subdivision
improvements. The existing right•-of-way for Ross Street and 81st
Avenue is 40 feet wide. Roos Street will require a 60 foot right-
of-way and 81st Avenue a 50 foot right-of-way for ultimate
improvements.
c) Half street improvements, typically required for site
development, are not required for r.eeidentiai minor land partitions.
Since neither Ross Street nor 81st Avenue ate fully improved, a
waiver of remonstrance for a future local imp,.7ovement district is
typically required when half street improvements are not required.
d) The proposed partition of a lot from the southeast corner of the
parcel does not appear to restrict the logical future development of
this parcel or adjacent parcels to the west. If a future street is
constructed an indicated on the submitted plan, the next
intersection t-, the south would be approximately 200 feet away and,
to the nortlL, 160 feet away.
e) The proposed partition has sanitary sewer and storm drainage
available to the south in 81st Avenue. The site slopes to the south.
Therefore, the remain?_ng parcel to the west may need access to
storm drainage across the back of the proposed partition. A private
storm drain and 10 foot easement is typically utilized in these
instances.
No other continents were received.
H. ANALYSIS AM CONCLUSION
Section 18.152.030 contains the approval criteria for the Director or
his designee to approve a minor land partition request. They are:
1) The proposal conforms with the City's Comprehensive Plan;
2) The proposed partition complies with all statutory and
ordinance requirements and regulations;
3) Adequate public facilities are available to serve the proposal.;
4) All proposed lots conform to the size and dimensional
requirements of this Code; and
5) All proposed improvements meet City and applicable agency
standards.

The proposal complies with the City's Comprehensive clan which
designated the subject parcel as Medium Density Residential. The
proposed partition will comply with all statutory and ordinance
requirements and City dimensional regulations for parcels created in
the R-7 zone. The new lot will meet the minimum lot size of 5,000 sq.
ft. in the R-7 zoning district and will satisfy the average minimum lot
width requirement of 50 feet. No proposed improvements are planned at
,,,his time.
C. DECISION
The Planning Director's designee approves MLP 89-04 subjec-t to the
following conditions:

RECORDING THE PARTITION WITH WASHINGTON COUNTY.
2. The applicant shall submit a map and new legal descriptions for all
parcels involved in this decision for City staff review and approval.

3. Additional right-of-way shall. be dedicated to the public along the
Roos Street frontage to increase the right-of-way to 30 feet from the
centerline. The description shall be tied to the existing right-of-way

by the Engineering division. Dedication forms and instructions are

4. Additional right-of-way shall be dedicated to the public along the
81st Avenue frontage to increase the right-of-way to 2E feet from the
