REQUEST: To divide a .43 acre parcel into two (2) parcels. One
11,438 square feet and the other V,600 square feet.

PREVIOUS ACTION:
A request by the applicant for a minor land partition to create three (3) lots
on this site was approved by the Planning Director on October 23, 1978
(MLP 12-78) .
A request by the applicant for a zone change from Washington County RU-4 to
City of Tigard R-7 was approved by the Tigard City Council with conditions
on February 26, 1979 (ZC 33-78) .
I. FINDINGS OF FACT:
1.. The site and surrounding area is designated on the NPO #2 Plan as "Urban
Low Density" Residential and zoned R-7 "Single Family Residential"
which has the following applicable requirements:
7,500 square foot minimum lot size (Section 18.20.030 Tigr d Municipal
Code) .
five (5' ) foot side yard setback for one (1) story building (Section
18.20.060 Tigard Municipal Code) .
2. The site is bounded by single family homes on the west and g-ove5 of oak
trees to the east, north and southeast. To the south and southwest are
single family Homes on large lots. There is an existing residence on the
southern portion of the lot.
The site slopes downhill to the north.
71ci 2) single family houses are under construction on the two (2) lots
north of the smote (Lots 501, 502) created in the previous minor land
partition.

3. The appli:ant has posted a performance bond with the City of Tigati
(February 1.,, 1980) for the construction of half street improvements to
N. Dakota Street and a new local street along the west side of this site
and for sanitary sewer construction to serve two (2) new residences
north of the site by private four (4") inch pressure sewer lines.
4. Metzger Water District service is available to the site from a four (4")
inch line in N. Dakota Street. Sanitary sewer service is available from
an eight (8") inch line in SW N. Dakota Street.
5. The adjoining 1.07 acre parcel to the west, Lot 700, was recently annexed
to the City of Tigard (Stoneking Annexation, Boundary Commission #1544,
2/7/80) . The intent of the owners of the .82 acre rear portion of Lot 700
is to construct four (4) single family homes to be served by a north/south
local street between the subject site and Lot 700 (ZC 5-80) .
6. North Dakota Street is in substandard condition, gravel surface, no curbs
or sidewalks.
North Dakota Street is designated as a collector street with a right-of-way
width of sixty (60') feet and a pavement width of forty-four (44') feet in
the NPO #2. The current right-of-way is fifty (50') feet.
Half street improvements have been made on the north side of N. Dakota
for 208 feet east of SW 95th at local street standards. The street is
unimproved from there, 130 feet to the subject site. A sixteen (16)
lot subdivision has been approved on the south side of N. Dakota Street
with half street improvements required to N. Dakota Street (S 3-79,
Dale's Glen) . The proposed development on Lot 700 to the west of the
subject site will be required to make half street improvements to the
portion of frontage between the siibject site and the existing improved
portion of N. Dakota Street (ZC 5-80, O'Neel) .
7. Applicant proposes to serve the new lots by a private sewer connection
to the Metzger Sewer line in N. Dakota Street.
Two (2) four (4") inch private pressure sewer lines have been proposed
to serve the two (2) new residences being constructed to the north of
the site. The lines for these sewers will run in the north/south half
street extension being built by the applicant.
8. The northern two thirds of the combined partitions (Lots 501, 502, 500)
lie in a poorly drained area where ground water is seasonally within
lei feet of the surface.
9. Sections of the pavement on the existing paved portion of N. Dakota
Street (E. of 95th) have been damaged by construction vehicles going to the
applicant's construction site (Lots 501, 502) .

II. CONCLUSIONARY FINDINGS:
1. This Minor Land Partition, when combined with the one approved on the same
site on October 23, 1978, in effect, creates a four-lot subdivision on
the applicant's properties. Although one year has lapsed between the
two (2) land partitions on the applicant's property, as required by City
Code (Section 17.07.01.0) , the effects of the applicants partitioning
will create a subdivision on this site without the requirements of City
Subdivision Standards. It is not in the best interests of the City or
future residents of such partitions to allow piecemeal ,partitions to
create "subdivisions" which do not meet City Subdivision Star.-lards.
Ve' 2. The lack of public sewer lines on the north/south :stub street could
create major sewer line repair liabilities for future residents of the
three (3) rear lots of the two (2) partitions whose private pressure
lines will run in the street. The Public Works Department requires that
such lines be located three (3' ) feet apart for repair purposes. When
development occurs on the adjoining lot to the west (Lot 700) , construction
of a public sewer line will be required. Although the four (4") inch
pressure lines have been approved by the Public Works Department, the
applicant should investigate the feasibility of joint construction of
a public gravity sewer line to SW 95th with the developer of the adjoining
property, Dennis O'Neel.
3. The proposed parcels conform to the NPO ff2 Plan designation and the
current R-7 Zoning.
4. Adequate water and ::ewer service are available to the site.
5. The half street i.,,r.rovements to both N. Dakota and the north/south stub
street (local standards) will be adequate to serve the develoment, if
the half street improvements to the adjoining properties (west and south)
are made in a timely fashion.
6_ Since the street: development and three (3) additional dwellings on these
will. create added storm runoff, the property to the north of the applicant's
(1S1 35AC, Lot 1.700) could be severely impacted by additional runoff.
A storm drainage system is needed for the four (4) lots created in these
p,.rtitions and sh be constructed before the issuance of Building Permits
on the subject site or Occupancy Permits for the two (2) lots to the
north. A drainage easement to the north will be necessary

7. An adequate fifty (50') foot right-of-way exists on N. Dakota Street.
Since the improvements on the N. Dakota Street frontage of the site to
"local" street standards will not require any additional right-of-way,
the lot depth dimension of the partition lots as shown in the partition
sketch is incorrect and should be revised.
III. STAFF RECOMMENDATION:
Staff recommends �Eproval subject to the following conditions:
1. Applicant explora the feasibility of joint construction of a public gravity
sewer line to SW 95th with the developer of the adjoining property,
Dennis 01 Neel.
2. Public Works Director is to approve any/all sewer line _ruction
prior to the issuance of any Permits by the City.

be submitted and approved by the Public Works Director prior to commencement
of work.
7. Public water service and sanitary service shall be installed to this
site prior to the issuance of a Building Permit.
8. No Buii�:4ng Permit shall be issued until the expiration of the twenty (20)

9. Improvements may he bonded prior to issuance of Buil ling Permits.
