The size and setback of this structure are consistent with Sectior 18. 144
of the Community Development Code (CDC). This section permits an
accessory structure of up to 500 square feet when a lot is under 2 .5
acres. Setbacks must also be at least 5 feet from the side and mar
property lines , The applicant' s 475 square foot structure conforms to
size and setback standards .
Several concerns arose over the placement of the structure on this
property. One concern had to do with whether this would be considered an
e>.pansion of a non-conforming use. It was determined that placing the �
house on the property was not actuall, expanding the none-conforming use
since the st:ruc.t.urp would not be allowed to be inhabited. Th-, structure
is not permitted to be connected to any utilities and must remain
uninhabitable.
A second concern involves the future plans for the area and means to
eliminate the non-conforming lot. The applicant has stated that future
development of the area revolves around the willingness of an adjacent
property owner to share costs for developing a small subdivision whose
access would be serveu by a cul.--de—sac located on or near the present
driveway . This would involve subdivision approval through the City.
The third concern of placing the house on the property has to do with
making the structure an attractive nuisance for, vandalism. The applicant
must ensure that access into the structure is restricted and that the
foundation on which the structure sits remains firm and stable enough to
support: the house' s placement.
C. DFCISTON
The Planning Director approves M 87-08 subject to the following conditions:

structural. modifications
2 . The existing structure shall remain ur,inhabitable unless City approval
is gained through a subdivision or minor land partition process .
3 . The applicant shall maintain U.-- structure in a safe and sound manner
to ensure public safety.
4. The approval is valid if exercised within one year of the final
decision date noted below.
