FLEXIBLE SETBACK M 89-12.
(BROWER)
APPLICATION: A request by Ronald R. Brower for flexible setback approval to
allow a 4 foot side yard setback where 5 feet is normally required. The
request is ',sing made to allow construction of an 864 square foot garage which
will be attached to the house. Zone: R-4.5 (Residential, 4.5 units/acre)
Location: 10940 SW North Dakota (WCTl1 ISI 34DB, Tax Lot 3600)
DECISION: Notice is hereby given that the Planning Director's Designee has
APPROVED the above request subject to certain conditions. The findings and
conclusions on which the decision is based arra noted below.
A. FINDING OF FACT
1. Background
No previous applications regarding the subject parcel have been
reviewed by the City.
2. Vicinity Information
Properties to the north, east, south,, and west are zoned R-4.5.
Surrounding lots vary in size from approximately 0.40 to 4.80
acres. Most of these Lots are developed with single-family
residences. To the north is a subdivision, Carnahans Addition, and
abutting the sybject percel to the east is a 25 foot wide accessway
which serves a flag lot south of the subject parcel.
3. Site Information and Proposal
The subject parcel is located on the south side of SW North Dakota
Street slightly west of the SW 109th intersection. It is
approximately 17,126 square feet in size. There is an existing
house and garage located 71 and 97 feet, respectively, from the
front property line. A deciduous tree, approximately 60 feet in
height, straddles tie eastern property line between the subject
parcel and the accesswal that serves the previously mentioned flag
lot.
The applicant proposes to construct an approximately 864 square
foot garage attached to the existing house by a breezeway. He
intends to demolish the existing garage and construct the new
garage in the same area. He seeks approval of a flexible setback
to allow the garage to be built In the side yard, 4 feet from the
eastern property line where it would normally be required that it
be set back 5 feet.

4. Agency and NPO Comments
The Building Division has reviewed the proposal and commented that
the eave of the roof can have only a one-foot overhang.
The Engineering Division has reviewed the proposal and has no
objections.
Portland General Electric, Tigard Water District, and Washington
County Fire District No. 1 have reviewed the proposal and have no
objections.
No other comments have been received.
B. ANALYSIS AND CONCLUSION
Section 18.146.090 -)f the Tigard Community Development- Code contains
approval criteria for a flexible setback. The approval criteria are:
The front, rear, side, or corner yard setback areae may be reduced up
to 20 percent provided the following standards are satisfied:
1. The reduction of the setback area established by the applicable
zoning district shall be necessary to allow for the enlargement or
remodeling of an existing building;
2. The proposed addition shall otherwise satisfy the setback
requirements of the applicable zoning district;
3. The standards of chapter 18.102 (Visual Clearance) shall- be.
satisfied;
4. The resulting lot coverage shall not exceed the maximum lot
coverage of the base zone; and
5. The proposed addition shall not encroach upon any existing
easements;
6. When the proposed addition is within the rear yard, the area
adjacent to the rear property line shall be landscaped with sight
obscuring plantings in accordance with the standards set forth in
18.100.080 (Landscaping and Screening) .
7. Setback, buffering, and screening requirements that apply when
commercial and industrial zones abut a residential zone shall be
satisfied.
The proposal complies with the above criteria because:
1. The proposal involves enlarging an existing hou9e;
2. The proposed garage location satisfies all other setback

requirements for the R-4.5 zone.
3. `rf.sion clearance standards are not applicable;
4. Maximum lot coverage for the R-4.5 zcie is 80 percent. Lot
coverage on the subject parcel will be less than 10 percent.
5. The garage will be setback 4 feet from the flag lot accessway to
the east. 4herefore, no existing easements will be encroached upon
by the proposed addition.
6. The proposed garage addition is not within the rear yard. It 1.0
within the side yard.
7. The subject parcel is not in a commercial or indllStri.al zone.
The deciduouE tree located on the common property line between the
subject parcel and the 25 foot wide flag lot accesoway to the east may
have to be removed to accommodate construction of the garage addition.
This action will. require consent from the owner of the flag lot.
C. DECISION
The Planning Director's Designee approves M 89-12 to allow a minimum
side yard setback of 4 feet for a garage addition to the existing house
at 10940 SW North Dakota si.rbject to the following conditions:
1. A building permit shall be obtained prior to construction of the
garage addition.
2. Thie approval is valid if exercised within 18 months of the final
decision date noted below.
