public improvements for the purpose of determining readiness thereof for
City final acceptance action.

family permits could be pulled, however future land division
actions will be required.

INFORMATION SUMMARY
John and Katherine Dorr recently received conditional approval to partition
land off SW North Dakota Street - M.L.P. 7-06 (see attached map) . Included
was the condition to construct half—street improvements to collector street
standards . Another person, Hank Doblie, has now become party to the M.L.P.
approval by agreement with John and Katherine Dorr. John and Hank are
,-equesting a $2646.00 Systems development charge credit against building
permit foes (see attached engineers estimate) collected on the property both
now and in the future.

"Engineer ' s Estimate for the Improvement of S. W. North Dakota
to Collector Standards" prepared at the request of Randy
Clarno.
It is my understanding that this estimate will be submitted to
the Tigard City Council so that the City of Tigard will reduce
the permit costs for the parcels in the John Dorr Minor Land
Partition No. MLP-7-86.
The estimate is based on the plans previously submitted. Tree
excavation, rock and asphalt quantities include:
1 . The extra taper required due to the extra width of 5 ' .
2. Extra excavation depth of 5" of additional rock over the
10 ' of improvement width including tapers.
3 . Extra excavation, rock and asphalt for widening from .17 '
to 22 ' including tapers to meet collector standards.

Lot 1901 would be via 108th Avenue.

APPLICATION: Request by John and Katherine Dorr to divide a 1 .92 acre parcel
into three parcels of 1 .31, 0.38 and 0.23 acres and to allow one lot which
exceeds the maximum lot depth r° 2.5 times the lot width (3 .6 times proposed)
on property zoned R-4.5 (Residential, 4.5 units/acres) and located at 10825 SW
North Dakota Street (WCTM 1S1 34DA, TL 1900, 1901, 1902, 1903)
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard has APPROVED the above described applications subject to certain
conditions . . The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
1 . Background Information
No previous land use proposals have been reviewed by the City
regarding this property.
2. Vicinity Information
Properties to the east, north, and west are zoned R-4.5
(Residential, 4.5 units/acre) and land on the south side of North
Dakota Street are zoned R--4.5 and R-3 .5 (Residential, 3 ,5
units/acre) . The nearby development consists of single family
residents on parcels ranging from 7,500 square feet to one acre.
Black Bull subdivision is immediately north and Carnahan Addition
lies to the northwest.
SW North Dakota Street, which is designated as a minor collector
street, runs along the southern property frontage. SW 108th
Avenue terminates at the northern property line.
3 . Site Information and Proposal Description
The property contains a house and accessory building. The
property was divided into four tax lots without: receiving the
necessary City approval . The applicant is now proposing to create
three lots . The 0.23 acre parcel will include the existing house
and the 0.38 acre lot will be vacant. Both of these ;parcels will
have frontage on North Dakota Street. The barn will be within the
remaining northern parcel which is proposed to have access via
108th Avenue.
4. Agency and NPO Comments
The Engineering [Division has the following comments:
a. Half street improvements similar to those provided with
Carnahan' s Addition shall be constructed along the North
Dakota Street frontage.

b. Additional right-of-way must be dedicated to provide a
right-of-way width of 30 feet from centerline on North
Dakota Street.
C. Any access from the north lot to North Dakota Street should
only be temporary in nature removed in conjunction with
further development of this parcel .
d. Temporary conditional access can be provided to the northern
parcel, provided that such access will not inhibit future
development of the property or the parcels to the east.
e. The design and location of all driveways on to North Dakota
Street must meet City standards for visual clearance,
The Building Division indicates that: the drainfield for the septic
system serving the existing house cannot be within another lot.
Also, sewer connections should be required for all parcels.
Washington County Fire District No. 1 states that all residences
must be within 500 feet of a fire hydrant and if more than three
houses are planned, a road with a turn around area will be
necessary .
No other comments have been received.
B. ANALYSIS AND CONCLUSION
The proposed partition is consist with Community Development Code
standards for minimum lot size, lot width, building setbacks and
access. The proposed 0.2.3 acre lot does not meet a City standard that
requires new lots created through lot line adjustment, partition or
subdivision to not have a length that exceeds 2.5 times the parcel width
(Section 18 . 164.060 (a)(2)) . The applicant is requesting a variance to
exceed this requirement with a 55 foot by 200 foot lot.
The following criteria are given in Section 18. 134.050 of the Code for
granting a variance:
1 . The proposed variance will not be materially detrimental to the
purposes of this Code, be in conflict with the policies of the
Comprehensive Plan, to any other applicable policies and
standards; and to other properties in the same zoning district or
vicinity;
2. There are special circumstances that exist which are peculiar to
the lot size or Shap,?, topography, or other circumstances over
which the applicant has no control, and which are not applicable
to other properties;
3 . The use proposed will be the same as permitted under this Code and
City standards will be maintained to the greatest extent that is
reasonably possible, which permitting_ some economic use of the
land'

4. Existing physical and natural systems, such as but not limited to
traffic, drainage, dramatic land forms, or parks will not be
adversely affected any more than would occur if the development
were located as specified in the Code; and
5. The hardship is not self—imposed and the variance requested is the
minimum variance which would alleviate the hardship.
This standard is primarily intended to avoid future problems in
redeveloping or dividing parcels which are exceedingly long and narrow.
The proposed lot: is 0.23 acre or 11,000 square feet, The R--4.5 tone has
a 7,500 square foot minimum lot size and therefore, it could not be
redivided. With a 55 foot width, the Code would normally allow a
maximum depth of 137.5 feet. In order for the existing house to meet
the required rear yard setback of 15 feet, the lot must be approximately
175 feet deep, The applicant has not shown the need for the additional
25+ foot length of the lot,
Section 18. 162.070 (b)(a) states that when it is apparent that further
division of property can occur, the applicant must demonstrate that the
proposed partition will not inhibit future development. It appears that
the exact depth of the two lots with frontage on North Dakota Street
should be determined after an acceptable redevelopment plan has been
established for the northern parcel.
C. DECISION
The Planning Director approves MLP 7-86/V-86 subject to the following
c,)nd i t inns:
1 . Unless otherwise noted, the conditions below shall be satisfied
prior to recording the partition with Washington County .
2. Standard half—street improvements including concrete sidewalk
driveway apron(s) and curb, road base and pavement and utilities,
including sanitary sewer (building lateral and storm sewer(s), and
streetlight(s), shall be installed along the SW North Dakota
Street frontage. Said improvements shall. be designed and
constructed to Minor Collector street standards and shall conform
to the alignment of existing just improvements west of this site.
3 . Sanitary and storm sewer details shall be provided as part of both
Huilding Permit plansA, Public Improvement plans.
4 . Seven (i) sets of plan—profile public improvement construction
plans and one (1) itemized construction cost estimate, stamped by
a Registered Professional Civil Engineer, detailing all proposed
public 'Improvements shall be submitted to the Engineering Section
for approval .

5. Construction of p!^oposed public improvements shall not commence I
until after the Engineering Section has issued approved public
improvement plans. The section will require posting of a 100%
Performance fond, the payment of a permit fee and a streetlight
fee. Also, the execution of a street opening permit or
construction compliance agreement shall occur prior to, or
concurrently with the issuance of approved publicimprovement
plans. SEE THE ENCLOSED HANDOUT GIVING MORE SPECIFIC _INFORMATION
REGARDING FEE SCHEDULES, BOWING AND AGREEMENTS.
6. Additional right-of-way shall be dedicated to the Public along the
SW North Dakota Street frontage to increase the right-of-way to 30
feet from centerline. The description for said dedication steal)
be tied to the existing right-of-way centerline as established by
Washington County. The dedication document shall be on City forms
and approved by the Engineering Section. DEDICATION FORMS AND
INSTRUCTIONS ARE AVAILriBLE FROM THE ENGINEERING SECTION.
7. The applicant shall provide for connection of proposed/exis+:ing
buildings to the public sanitary sewerage system. A connection
permit is required,
8. Evidence demonstrating that the (Washington County) Dakota Street
sanitary sewerage line assessment has been paid in full, shall be
provided to the City Building Office by the applicant prior to
is3uance of any permits (and prior to recording of the partition.
9, The applicant shall provide for roof rain drainage to the public
stormwater system,
10. Visibility at driveways along SW North Dakota Street shall be
developed in accordance with City Standards ,
11 , Any acce3s to the proposed north lot, from SW North Dakota Street,
shall be temporary in fact- and shall terminate upon any future
division thereof. A copy of any document which creates such
access shall be reviewed and approved by the City, and
acknowledged thereby, prior to recording,
1.2. Access to the proposed north lot from SW 108th Avenue is
controlled by the City by means of an access control strip.
Tempora:-•y conditioned access shall be granted provided if it does
not negatively input the future development of the proposed north
lot and existing lots located to the east of this site.
13 . A redevelopment plan shall be submitted for Planning Director
approval. the Director shall also approve the depth of the two
lots with frontage on North Dakota Street.
14 . The partition survey and legal descriptions shall be submitted to
the Planning Director for review and approval . Only after
approval is granted shall the partition be recorded. In addition,
the applicant shall recombine Tax Lots 1902 and 1903 into one tax
lot .

a lean commitment in the amount of�$,11,878.00, to finance the improvements of
a street improvement located in the City of Tigard, being commonly known as
SW North Dakota Street. 'This loan commitment is specifically for construction
purposes for: Public streets, including driveway aprons, sidewalks, curbs,
and storm sewers. All such improvements are to be completed in conformity
with City approved construction plans and the subdivision compliance agreement:

We have agreed that disbursements of the $1.1,878.00 will be made in accord
with the following schedule upon completion of each, or all, item(s); but riot
including the hold-back described below.

We have entered into a "Street Opening Permit Agreement" whereby we have
agreed to install all improvements in accordance with the requirements of the
City of Tigard and we are hereby authorizing you to hold the above-stated
funds to pay them to us only when the following has been adhered to:
That the City of Tigard has provided certification
acknowledging completion of any or all work pursuant
to the above itemized schedule of improvements .
Pursuant to the above schedule, 20 percent of the commitment funds (i .e. ,
$2_,376.00) will be held back through the normal. one year guarantee period or
until final City Acceptance of the project takes place or until the City is
provided with a separate maintenance band, effective for, said one yep;r period
from the date of tentative acceptance of the work, to assure ^ontinued
freedom from defects, and maintenance, during the guarantee period,
Concurrent with the final release of the-ie funds, establishment proceedings
will be instituted.
It is understood and approved by all parties of concern to this letter of
commitment that the City of Tigard shall have first claim and priority to t- e
sum of $a��878.00, less disbursements approved by the City of Tigard, in the
event of any defect s)/or failure(s) to correct such in the construction of
the required improvements.

It is further understood and agreed that: the aforesaid priority of claim is
paramount to all parties including the lending institution making the loan and
that the lending institution has covenanted and agreed that the sum of
$.11,878.00_ less disbursements approved by the City of Tigard shall. be held
available to satisfy any aforementioned claim by the City notwithstanding
default on loan by borrowing party or termination of .loan by .lending
institution.
